Rising Internet Shutdowns In India: A Legal Analysis, Shrutanjaya Bhardwaj, Nakul Nayak, Raja Venkata Krishna Dandamudi, Sarvjeet Singh, Veda Handa
Indian Journal of Law and Technology
The central theme of this paper is to critically study the interplay of internet shutdowns with the right to freedom of speech and expression. A study of this nature is necessitated by India’s abysmal record with inter- net shutdowns. We must hence begin examining Internet shutdowns seriously within the Indian constitutional framework. In the recent judgment of Anuradha Bhasin, the Supreme Court has accepted that Article 19(1)(a) protects the right to disseminate and receive information through the internet. Therefore, the constitutional validity of every internet shutdown would have to be tested (at least) against the three standards ordinarily applied …

Criminal Justice Practitioners Perceptions On Collateral Consequence Policies Affecting Formerly Incarcerated African American Males, Ronnie Devon Williams
Criminal Justice Practitioners Perceptions On Collateral Consequence Policies Affecting Formerly Incarcerated African American Males, Ronnie Devon Williams
Walden Dissertations and Doctoral Studies
Formerly incarcerated African American males have a challenging time transitioning back into the community due to invisible barriers that impede their opportunities for successful reintegration. This generic qualitative study aimed to explore criminal justice practitioners' perceptions regarding collateral consequence policies for formerly incarcerated African American males. The theoretical framework for the study was labeling theory, which explained how others stigmatize individuals due to their social and environmental characteristics. The research question guiding this study was how criminal justice practitioners perceived the impact of collateral consequence policies on the successful reintegration of African American males. Ten criminal justice practitioners including probation …

‘A Storm Is Coming:' The New York Times Coverage Of The Covid-19 Pandemic In American Prisons, Katarzyna Celinska, Amina Cheboubi
Publications and Research
In this research, we analyzed the content of 171 articles published between March and August 2020 in the New York Times (NYT) on COVID-19 in American correctional institutions. We observed that the NYT coverage decreased significantly over 6 months. Our analysis uncovered 8 themes within two broader frames: institutional and systemic inequity. Although the themes are not mutually exclusive, we argue that ‘Responding to COVID-19,’ ‘A storm is Coming,’ ‘Collective Experience,’ and ‘Critiquing Prison Conditions’ are within the institutional framing. ‘Redefining Public Safety,’ ‘Categorizing Prisoners,’ ‘Doing Injustice,’ and ‘Making it as a Celebrity’ are the themes that highlight systemic inequity, …

The concept of smart city/region has become increasingly common due to the rapid acceleration of digital transformation in the use of advanced technologies across all sectors. This has had a significant impact on the urban environment of both urban and rural agglomerations. The concept of the smart city has extended to include larger spatial regions as a result of the sectorial relationships and interactions that arise between these agglomerations, forming what is known as Smart Regions.
The importance of studying and analyzing smart regions has increased due to the great opportunity they represent in achieving high rates of development in …

Bayesian Optimization Based Extreme Gradient Boosting And Gpr Time-Frequency Features For The Recognition Of Moisture Damage In Asphalt Pavement, Hongwei Li, Jun Zhang, Xiaokun Yang, Min Ye, Wentao Jiang, Jing Gong, Yaogang Tian, Liang Zhao, Weitian Wang, Zhi Xu
School of Computing Faculty Scholarship and Creative Works
Moisture damage is one of the major defects in asphalt pavement, and will evolve into potholes in a short time which will affect traffic safety. Ground Penetrating Radar (GPR) is an effective non-destructive testing (NDT) method for detecting moisture damage but its data explanation replies on human experience and subjects to labor intensive. To address this issue, an automatic detection method based on extreme gradient boosting (XGBoost) combined with Bayesian hyper-parameter optimization (BHPO) was proposed to detect moisture damage area from GPR traces. High frequency GPR antenna with 2.3 GHz was used to detect the moisture damage area from simulation, …
Ecological Factors And Minority Young Adults’ Trust In Law Enforcement, Jason Boswell
Ecological Factors And Minority Young Adults’ Trust In Law Enforcement, Jason Boswell
Walden Dissertations and Doctoral Studies
Throughout the past decade, studies have shown that the relationship between police organizations and community members has developed mistrust as more citizens begin to document misconduct by law enforcement officers. Studies have also proven that community members trust the police when they feel the police are fair and just. Distrust of law enforcement undermines the legitimacy of police officers, and without this trust legitimacy, police officers lose their ability and authority to perform their jobs effectively. To help bridge the gap between minority communities and law enforcement agencies, this qualitative phenomenological study was conducted to examine the trust within law …

A Government Branch Of Its Own: Reining In The Power Of The Regents Of The University Of California, Veronica Gray
A Government Branch Of Its Own: Reining In The Power Of The Regents Of The University Of California, Veronica Gray
UC Law Constitutional Quarterly
The University of California system is the crown jewel of American public universities. However, Californians have virtually no say over University of California policies. At the University of California’s inception, the drafters of the 1879 California Constitution envisioned a school system controlled by a Board of Regents who are largely insulated from politics. The autonomy from elected officials and the public allows the Regents to have nearly full control over a public good. The Regents’ autonomy and control over the University of California system has led to conflict between the Regents, the public, and state legislators regarding land use, labor, …

Automated Concrete Bridge Deck Inspection Using Unmanned Aerial Systems Collected Data: A Machine Learning Approach, Rojal Pokhrel
Master's Theses
Many national infrastructures, particularly bridges, are becoming older and older day by day. Their safe operation and maintenance require routine monitoring and inspection. There are lots of bridge inspection specifications and manuals to guide inspectors to give the proper recommendations about the bridge structure and safety. These manuals and specifications require bridge inspectors to manually inspect the bridge and recommend maintenance and repair tasks referring to the specific criteria available in the manuals. In time, the application of technology makes many Unmanned Aerial Systems (UAS) advancements during the phase of data collection. For the image processing and analysis of collected …

This article discusses the influence and significance of the introduction of Islam in the Malaya on Malays before achieving independence. Prior to the advent of Islam, the Malaya was heavily influenced by several belief systems, including Hinduism, Animism, Buddhism, Dynamism, Hyang, and others. Nevertheless, Malaya, like other regions influenced by Islamic Civilization, has embraced the Sunnah teachings of Prophet Muhammad. Since 12 AD, the way of life in Malaya has been firmly rooted in Islamic teachings. Opt Out Or Pipe Down, You Traded Your Data Away: Balancing Computer Crime Prevention, Third-Party Data, And Individual Privacy Rights, Ken Sterling
UC Law Science and Technology Journal
This article explores the complex issue of governments’ access to thirdparty user data without search warrants in the detection, prevention, and prosecution of computer crimes. Topics under analysis include balancing data privacy and public safety, the application of the Fourth Amendment, and seminal court cases such as Riley, Carpenter, and Smith v. Maryland. Cybercrime poses a significant threat to society, businesses, individuals, and governments. While privacy advocates argue for warrant-based access to user data, individuals readily “opt in” and share their data with companies, raising the question of why stricter standards should apply to government use. This article proposes that …

An Experimental Study On Mixed Hydrocarbon Gas On Transport Through Subsurface And Atmospheric Interfaces With Application To Natural Gas Pipline Leak Dection And Quantification, Richard Kolodziej
Civil and Environmental Engineering Theses and Dissertations
Natural gas (NG) production and usage as a fuel source have surged in recent years, becoming a critical component of the global energy system and requiring extensive belowground pipeline infrastructure. Leaks in belowground pipelines release fugitive methane (CH4) emissions, posing significant environmental, safety, and economic risks. Effective leak detection and quantification (LDAQ) methods are essential for identifying and measuring leaks to enable timely repairs and accurately address these threats. However, few studies have characterized the effectiveness of current and advanced LDAQ survey methods for belowground NG pipelines, with existing work often limited to technology-centric evaluations or studies of …

Imperfect Insanity And Diminished Responsibility, E. Lea Johnston
Imperfect Insanity And Diminished Responsibility, E. Lea Johnston
UF Law Faculty Publications
Insanity’s status as an all-or-nothing excuse results in the disproportionate punishment of individuals whose mental disorders significantly impaired, but did not obliterate, their capacities for criminal responsibility. Prohibiting the trier of fact from considering impairment that does not meet the narrow definition of insanity contradicts commonly held intuitions about mental abnormality and gradations of responsibility. It results in systemic over-punishment, juror frustration, and, at times, arbitrary verdicts as triers of fact attempt to better apportion liability to blameworthiness.
This Article proposes a generic partial excuse: Diminished Responsibility from Mental Disability. This excuse could be asserted as an affirmative defense at …
