Nebraska Rural Poll
Most rural Nebraskans are somewhat or very concerned about their household’s cost of living, their household income, and their household’s financial situation. This was particularly true for certain groups, including persons with lower household incomes, younger persons, and persons with construction, installation, or maintenance occupations.
When asked about the impacts of international trade, most rural Nebraskans think it is good for Nebraska’s economy. Residents of the Panhandle are the regional group least likely to think trade is good for the state’s economy.
Many rural Nebraskans think international trade is good for creating jobs in Nebraska, for their own standard of …

Online Crime Reporting: A New Threat To Police Legitimacy?, Kris Henning, Kimberly Kahn, Kathryn Wuschke, Christian Peterson, Stephen Yakots
Criminology and Criminal Justice Faculty Publications and Presentations
Police are more likely to be perceived as legitimate when officers are procedurally just during interactions with the public (i.e. impartial, transparent, fair and respectful). Efforts to reinforce these skills have largely focused on contacts initiated by officers. Less attention has been paid to interactions with crime victims. Moreover, in recent years many police departments have sought to increase efficiency by directing victims to report online, rather than communicating directly with an officer. Very little is known about how victims experience online reporting systems. This study surveyed 1,198 property crime victims who used a large US police department’s online reporting …

Financial Impacts Of 2020 Labor Day Wildfires To Oregon Highways, Kevin Christiansen, Rubayet Bin Mostafiz, Ayat Al Assi, Robert V. Rohli, Carol J. Friedland
Faculty Publications
Wildfire-caused damage to highways has a significant financial cost to the local, regional, and state jurisdictions where they occur. This study examines the financial ramifications of the harm caused to highways by megafires, using a case study of the highways impacted in the U.S. state of Oregon by the five megafires that occurred during the 2020 Labor Day wildfires. This study proposes a method to classify financial road damage from these wildfires based upon curated datasets collected from the Oregon Department of Transportation (ODOT). Hence, this study presents a dataset with labeled classes, which include physical, roadway, and traffic. Physical …

Ai Regulation In A Chatgpt Era: Cross-Border Cooperation And Hope In A Sudden Storm, Heidi L. Frostestad
Ai Regulation In A Chatgpt Era: Cross-Border Cooperation And Hope In A Sudden Storm, Heidi L. Frostestad
College of Law Faculty Publications
This article addresses the complex and burgeoning issue of worldwide and national AI regulation in a legal context, with insights from international business law. The present regulatory efforts throughout the globe are a messy tapestry of initiatives with varying approaches that do not coalesce for cross-border multinational corporate entities (MNE). Most AI technologies are developed by multinational enterprises that need a more uniform international regulatory environment and structure for “responsible AI” enforcement. The human rights models of corporate social responsibility and human rights mechanisms that regulate the protection of fundamental rights and “responsible AI” to prevent harms in the context …
(Synthetic) Stump Speech: Crafting Generative Ai Disclosure Regulations For Political Advertisements, Alex Paget
(Synthetic) Stump Speech: Crafting Generative Ai Disclosure Regulations For Political Advertisements, Alex Paget
Fordham Law Review
Synthetic media, or content generated using artificial intelligence, has begun to infect political advertising. Federal legislation has spent most of its time stalled in committees, but states and online platforms have rapidly implemented regulations. Although synthetic media may pose harms through voter manipulation and democratic distortion, it also can lower campaign costs and more vividly illustrate conceptions of a political choice’s consequences. Some governments and commentators have sought to prohibit the most harmful forms, while others have focused more on transparent approaches to regulation. In the face of yet another contentious election cycle, the question of how to ensure choices …

Comprehensive Analysis Of Adverse Events Following Covid-19 Vaccination: Insights From Diverse Data Sources, Yiming Li
Dissertations and Theses (Open Access)
This dissertation investigates adverse events (AEs) associated with COVID-19 vaccinations through a multi-faceted approach involving structured and unstructured data. The study is organized into three specific aims, each contributing to a comprehensive understanding of vaccine safety. Aim 1 focuses on the temporal and spatial analysis of AEs reported in the Vaccine Adverse Event Reporting System (VAERS). We performed a detailed temporal analysis to detect patterns over time, revealing a significant increase in reported AEs shortly after the vaccine rollout. Spatial analysis highlighted regional variations in AE reporting, with higher frequencies observed in middle and north regions of the United States …
Trouble Bruen For Assault Weapon Bans: A Feature-Based Analysis Of The Second Amendment, Samuel R. Vasilopulos
Trouble Bruen For Assault Weapon Bans: A Feature-Based Analysis Of The Second Amendment, Samuel R. Vasilopulos
Northern Illinois University Law Review
“Assault weapons” and “large-capacity magazines” have been the target of recent legislation, such as the Protect Illinois Communities Act. Weapons bans of this nature have traditionally been upheld by the lower courts; however, the U.S. Supreme Court has refined the test for constitutionality under the Second Amendment in New York State Rifle & Pistol Association, Inc. v. Bruen (2022). Bruen has laid out a two-step test in which the first step asks whether the conduct, namely the possession of a specifically banned arm, is within the scope of the plain text of the Second Amendment. To determine whether an arm …

Popularity Contest: Is An Independent Judiciary Compatible With Popular Constitutionalism?, Lulu S. Faulk
Popularity Contest: Is An Independent Judiciary Compatible With Popular Constitutionalism?, Lulu S. Faulk
Indiana Law Journal
Can the theory of popular constitutionalism—where the people have authority to shape constitutional law—exist alongside judicial independence? On the surface, these two ideas seem like contestants in a popularity contest: Popular constitutionalism embraces the will of the people in defining constitutional law, while judicial independence insists that judges disregard any and all external pressure in an effort to uphold the tenets of the Constitution even when they are unpopular. The contrast of these competing ideas is all the more evident with recent Supreme Court decisions such as Dobbs v. Jackson Women’s Health Organization, demonstrating a deviation from majority opinion in …

How Did The Deer Cross The Road? Reducing Habitat Fragmentation And Wildlife-Vehicle Collision Deaths Through Connective Conservation In The South Mountain Region, Pennsylvania, Jack B. Joiner, Emily R. Kreider, Thomas H. Manning, Madison E. Rowell

While some deleterious effects of road networks and the vehicles that travel them– such as pollution, fossil fuel extraction, and carbon emissions– are widely recognized, their significant role in causing an estimated one million wildlife deaths per day (Shilling et al., 2021) and contributing to habitat loss and degradation, the leading causes of global biodiversity decline (Pinto et al., 2023), has garnered less attention. Connective conservation policies, such as designating wildlife corridors and constructing wildlife crossings on roadways, have been proposed as a means of mitigating these repercussions. This study proposes a connective conservation plan addressing the logistics of a …

The Columns From “The Tomb Of Charlemagne” Between Aachen And The Louvre: A Modern Spoliation Saga, Brigitte Buettner
The Columns From “The Tomb Of Charlemagne” Between Aachen And The Louvre: A Modern Spoliation Saga, Brigitte Buettner
Art: Faculty Publications
In September 1794, the French army, after conquering much of Belgium and the Netherlands, marched into Aachen. This early campaign of military conquest turned into the first laboratory for the systematic plunder of cultural assets enacted by various post-revolutionary and Napoleonic regimes from 1794 to 1815. Works of art “liberated” from the tyranny of aristocratic and religious ownership were earmarked for the newly opened Musée Central des Arts (now the Louvre) to showcase the enlightened cultural supremacy of Paris. From Aachen, the conquerors took more than the usual loot of movable assets: they “extracted” some forty columns from Charlemagne’s famed …

Shocking Sentences, John B. Meixner Jr.
Shocking Sentences, John B. Meixner Jr.
Indiana Law Journal
Harsh recidivist sentencing penalties, like three-strikes laws, have been criticized heavily among both academics and practitioners on a number of different grounds. Most arguments focus on how sentences arising from these penalties are disproportionate—that there is no sensible relationship between the wrong committed and the sentence imposed. Those critiques are valid, but there’s another important problem with recidivist sentencing penalties that has been overlooked: They lead to sentences that are totally unexpected—indeed, shocking—to the defendants who face them. Many recidivist sentencing penalties cause large leaps in sentencing exposure that amount to exponential growth when compared with a defendant’s prior sentences. …
The Future Of Work In The Era Of Ai, Orly Lobel
The Future Of Work In The Era Of Ai, Orly Lobel
Indiana Law Journal
Artificial intelligence (AI) is revolutionizing both work itself and the processes of employment—hiring, recruitment, evaluation, compensation, performance analysis, retention, and job mobility. This Essay, based upon the 2024 Indiana Law Journal annual William R. Stewart Lecture, examines the effects of AI on work and argues for a holistic approach that harnesses the benefits of automation while addressing the inevitable systemic changes that AI is rapidly bringing to the labor market. The Essay examines two industries in which AI is already changing labor market demands: trucking and the performing arts. The Essay argues that while the automation can often increase efficiency …
