San Diego Collaboration For Conservation: Sustaining The Region's Legacy Of Biodiversity Conservation, Tessa Tinkler, Darbi Berry, A-Bel Gong, Bryan Cardenas, Daniela Olguin, Connelly Meschen, Eo Hanabusa

Environment

We are living through significant environmental, social, political, and economic challenges. These challenges have strained our communities and humanbuilt systems, as well as our interconnected habitats, wildlife, and natural systems. Lack of adequate infrastructure to withstand natural disasters and climate change, as well as historical and presentday inequities in resources across neighborhoods, are examples of the multifaceted and interconnected threats contributing to the accelerated loss of our rich biodiversity. This natural abundance is integral to our region’s health, history, and continued prosperity.

Seeing The Whole Together Through Relational Mapping: A Method For Engaging In Complex Systems Change, John Paul Stephens Oct 2024

Seeing The Whole Together Through Relational Mapping: A Method For Engaging In Complex Systems Change, John Paul Stephens

Faculty Scholarship

Complex global challenges cut across organizational and sectoral boundaries, increasing calls for holistic responses. Seeing the whole across diverse stakeholders is challenging for participants in complex systems, yet doing so is essential for engaging effectively in systems change. A promising new method known as relational mapping, based on relational coordination theory, has been used to facilitate complex systems change. Here, we propose that relational mapping can be applied to help participants (1) see the whole in relation to the parts, (2) share their explicit and tacit knowledge, (3) engage in dialogue across distinct perspectives supported by the map as a …

Disparity And The Need For Sentencing Guidelines In Maine: A Proposal For Enhanced Appellate Review, Daniel E. Wathen Oct 2024

Disparity And The Need For Sentencing Guidelines In Maine: A Proposal For Enhanced Appellate Review, Daniel E. Wathen

Maine Law Review

Perhaps in no other field of judicial endeavor is diversity and variety more apparent than when a sentencing judge considers the circumstances presented by a defendant convicted of a criminal offense. In each case, the sentencing judge confronts an individual who has no exact counterpart in any defendant previously appearing before the court for sentencing. The sentence imposed is primarily a matter of judicial discretion and is based upon consideration of the nature of the offense, the circumstances surrounding the commission of the offense, and the circumstances of the defendant. The sentencing judge formulates a specific sentence within broad statutory …

Reasonable Accommodation And Non-Invidious Discrimination Under The Maine Human Rights Act, Stuart W. Tisdale Jr. Oct 2024

Reasonable Accommodation And Non-Invidious Discrimination Under The Maine Human Rights Act, Stuart W. Tisdale Jr.

Maine Law Review

"Invidious," through its Latin root invidia, for envy, hints at the dangers of arbitrary discrimination. Statutes, for instance, that distribute social or economic benefits and allocate burdens in a patently arbitrary manner alienate the burdened class. Such laws tear at the social fabric by instilling resentment and bitterness in the disfavored group. At an extreme they encourage rebellion. The famous Carolene Products footnote, in which Justice Stone suggested that the Court would apply a heightened standard of judicial review to statutes affecting "discrete and insular minorities," draws an implicit connection between invidiousness and fundamental unfairness. Invidiousness thus refers to the …

Federal Nuclear Policy And The 1987 Maine Nuclear Referendum: Viable Initiative Or Legal Cul-De-Sac?, David P. Crocker Oct 2024

Federal Nuclear Policy And The 1987 Maine Nuclear Referendum: Viable Initiative Or Legal Cul-De-Sac?, David P. Crocker

Maine Law Review

On November 3, 1987, Maine voters once again rejected a proposal which would have forced closure of the Maine Yankee nuclear power plant, the state's only nuclear utility. The vote was the most recent in a series of attempts to close the plant, utilizing the vehicle of popular referendum. This latest initiative was in large part a consequence of intense public outcry against the possible location of a permanent nuclear waste repository in the state. It is therefore uniquely and personally linked to current passions concerning the future of nuclear electrical generation in the nation. The previous referenda to close …

The Public In Action: The Potential For Public Inquiries To Realize Deliberative Democracy A Case Study Of The Mass Casualty Commission, Grace Bryson Oct 2024

The Public In Action: The Potential For Public Inquiries To Realize Deliberative Democracy A Case Study Of The Mass Casualty Commission, Grace Bryson

Dalhousie Journal of Legal Studies

Public inquiries have the potential to promote deliberative democracy. However, the current structure and procedures employed in public inquiries do not promote this goal. Rather, the procedures are based in adversarial methods that do not align with the diverse functions of public inquiries. This paper addresses these procedural shortcomings and seeks to encourage more fulsome public participation. Using the Mass Casualty Commission in Nova Scotia as a case study, this paper proposes procedural changes that could enhance the role of the public in future inquiries to lead to transformative and beneficial policy change.

Examination Of Musical Sophistication And Working Memory Correlates In High School Students, Abby South Oct 2024

Examination Of Musical Sophistication And Working Memory Correlates In High School Students, Abby South

LSU Doctoral Dissertations

Abstract

The purpose of this study was to examine the relationship between musical engagement and cognitive ability in high school students. While musicians’ brains have long been of interest to those who study experience-dependent neuroplasticity, a lack of adolescent data grossly limits our understanding of the relationship between music training and observed neuroplastic changes in the brain. Advances in psychometric testing and brain imaging reveal relationships among musical expertise, changes in brain function, structure, and connectivity, and enhanced cognitive ability, but categorical groupings of dichotomously defined musicians and non-musicians prevent nuanced understanding of these complex relationships. In this study, 83 …

Bulletin of Chinese Academy of Sciences (Chinese Version)

In the context of the new round of scientific and technological revolution, how to grasp the historical opportunity of supporting the development of the “overall safety and emergency response framework” with the NGIT, and promoting the transformation of the public safety governance to emphasis on prevention, is a pressing issue to be studied. This study focuses on five typical scenarios in emergency management, drawing on multiple rounds of expert interviews and questionnaire surveys to identify a list of critical technologies, analyze future development trends and constraints, and provide references for advancing relevant technological research and development. The study further emphasizes …

The Need For U.S. Stability Policing, John F. Hussey Oct 2024

The Need For U.S. Stability Policing, John F. Hussey

Joint Force Quarterly

This article argues that the U.S. military needs a dedicated stability policing capability to establish public order, protect civilians, uphold the rule of law, and consolidate gains during the transition from combat operations to postconflict stability. Drawing on U.S. experiences in Vietnam, Iraq, and Afghanistan, the author contends that military forces have often been ill prepared to perform civilian policing or train indigenous police forces, leading to overly militarized approaches that can undermine legitimacy and public trust. The article emphasizes that stability policing requires personnel with civilian law enforcement expertise, particularly during the critical period immediately following major combat operations. …

State V. Cloutier: Implied Invitees, Pretext And Plain View Under The Fourth Amendment, Dennis M. Doiron Oct 2024

State V. Cloutier: Implied Invitees, Pretext And Plain View Under The Fourth Amendment, Dennis M. Doiron

Maine Law Review

Law enforcement officers often have occasion to follow the path to the front door of a residence in order to speak to its occupant. Upon answering the door, the occupant may hear a complaint about his barking dog, a query as to whether he witnessed the burglary next door, or a plea seeking support for the police department's Christmas charity drive. Occasionally, a police officer follows the path to a person's door and unexpectedly observes incriminating evidence or activities. In such cases, the police officer's conduct generates the issue of whether his observation implicates the fourth amendment's prohibition against unreasonable …

A Qualitative Study Of Federal Employee Whistleblowing And Reprisal For Whistleblowing, Bruce S. Mclean Oct 2024

A Qualitative Study Of Federal Employee Whistleblowing And Reprisal For Whistleblowing, Bruce S. Mclean

Doctoral Dissertations and Projects

Federal employee whistleblowing is essential to holding government officials accountable. The U.S. Office of Special Counsel (OSC) was established in 1979 to provide a secure channel for federal government employees to report wrongdoing while protecting them from reprisal. More statutory protections were enacted with the Whistleblower Protection Act (WPA) in 1989; however, deficiencies in the WPA led to the eventual passage of the Whistleblower Protection Enhancement Act in 2012. The problem is that the literature on whistleblowing fails to distinguish the OSC as the Executive Branch whistleblower protection agency nor recognize its annual reports and surveys as the only known …

Exploring Attitudes Within Legal Precedents Related To Police Use Of Force, Jazmine L. Garcia Oct 2024

Exploring Attitudes Within Legal Precedents Related To Police Use Of Force, Jazmine L. Garcia

Doctoral Dissertations and Projects

Policing is a dangerous profession: Data from the National Institute for Occupational Safety revealed that policing is the second highest in occupational homicides (White et al., 2019). Fifty-nine police officers were killed in the line of duty from January 1, 2021, to September 30, 2021, which is a 51% increase compared to results found in 2020 (FBI, 2021). Therefore, officers must-read situational cues, communicate effectively, and make decisions to choose the best actions for a situation whether that be de-escalation or escalation, all within fractions of seconds. These decisions are rarely black and white with each situation being different and …

Typology Of Atmospheric Conditions Leading To Dam Overtopping In The Eastern Us, Hodo I. Orok, Deanna Hence Oct 2024

Typology Of Atmospheric Conditions Leading To Dam Overtopping In The Eastern Us, Hodo I. Orok, Deanna Hence

I-GUIDE Forum

Statistical characterization of reanalysis datasets during over 300 hydrologic dam incidents between 2003 and 2022 will create a detailed typology of weather systems associated with dam overtopping in the eastern United States. Dam overtopping poses significant risks to infrastructure and public safety, necessitating a comprehensive understanding of the multi-scale atmospheric conditions that lead to such events. To better account for the natural flow of water to the affected dams, we will adopt a watershed-focused Principal Component Analysis (PCA) on regional atmospheric data collected from ERA5 alongside USGS streamflow and Stage IV precipitation observations to enhance understanding of high-risk weather conditions. …

A Taking By Any Other Name: Why Exclusionary Zoning Should Be Classified As A Per Se Taking, Matthew J. Ruppel Oct 2024

A Taking By Any Other Name: Why Exclusionary Zoning Should Be Classified As A Per Se Taking, Matthew J. Ruppel

Seattle University Law Review Online

The housing affordability crisis in U.S. cities, particularly on the West Coast, has been well publicized in recent years, and the search for solutions has drawn together allies from across the ideological spectrum. While various cities and states have rolled out many types of reforms, there remains a widespread regulatory failure preventing the adaptation of cities to modern demands. A primary culprit is exclusionary zoning: plot-by-plot designation of which types of structures can be built on a piece of property— particularly which types of structures are absolutely prohibited from being built—and the broad definitional standards to which those structures must …

Health literacy (HL) is a key social determinant of health (SDoH) and is of increasing importance in public health research and intervention for improved health outcomes. Definitions of HL and digital health literacy (DHL) have evolved over time as the field has expanded conceptualization from an individual focus to the broader community and organizational levels. Careful consideration of HL and DHL for a variety of contexts and audiences is critical given increased global adoption of digital technologies and responses to emerging public health challenges. This study aimed to capture researchers' conceptualizations of HL/DHL and their motivations to engage in this …

Empowering Change Through Raizal Perspectives On Prison Education In San Andrés Island, Sigifredo Castell Britton

Walden Dissertations and Doctoral Studies

Raizal ex-offenders on San Andrés Island, Colombia, encounter significant challenges when reintegrating into their community, often compounded by ineffective prison education programs and the unique sociocultural dynamics of the Raizal community. While previous researchers have identified barriers to successful reintegration, a deeper understanding of the lived experiences of Raizal ex-offenders and the perspectives of community leaders is needed. This phenomenological study, guided by culturally responsive pedagogy and social disorganization theory, was conducted to explore these experiences and perspectives. Through semistructured interviews with 10 Raizal ex-offenders and 10 community leaders, data were collected to examine the effectiveness of current prison education …

Factors Affecting The Quality Of Reporting Dispensing Errors Among Pharmacists, Kelley Latrece Lavallais

Walden Dissertations and Doctoral Studies

Medication dispensing errors, which are the inconsistency between the dispensing of medication to the patient against the prescribed medication, continue to be a public health challenge. Many studies have been conducted to examine their causes, including burnout, illegible handwriting, workload, and interruptions. There have also been studies on the types of medication dispensing errors. This study focused on the reporting of errors. The purpose of this quantitative study involving secondary data analysis was to examine the factors affecting the quality of reporting dispensing errors among pharmacists and the seriousness of the adverse events. The social-ecological model served as the theoretical …
