Progressive Facade: How Bail Reforms Expose The Limitations Of The Progressive Prosecutor Movement, Sarah Gottlieb
Progressive Facade: How Bail Reforms Expose The Limitations Of The Progressive Prosecutor Movement, Sarah Gottlieb
Washington and Lee Law Review
Progressive prosecutors have been acclaimed as the new hope for change in the criminal legal system. Advocates and scholars touting progressive prosecution believe that progressive prosecutors will use their power and discretion to address systemic racism and end mass incarceration. Just as this hope has arisen, however, so have concerns that meaningful change cannot be enacted within the criminal system by the very actors whose job it is to incarcerate. This Article highlights these concerns by looking at the bail reforms enacted by four different progressive prosecutors and analyzes the initial promises made, the actions taken to reform and eliminate …
Punishing Gender, Erin Collins
Punishing Gender, Erin Collins
Law Faculty Publications
As jurisdictions across the country grapple with the urgent need to redress the impact of mass incarceration, there has been renewed interest in reforms that reduce the harms punishment inflicts on women. These "gender-responsive" reforms aim to adapt traditional punishment practices that, proponents claim, were designed "for men." The push to change how we punish based on gender, while perhaps well intentioned, is misguided. As abolition feminist principles reveal, these gender-responsive practices not only reify traditional gender norms, but also strengthen the operation of the carceral state. This Article catalogs the ways in that the gender-responsive approach currently influences various …
The Necessity Of Restorative Justice Within Prisons, Sarah J. Pietrowski
The Necessity Of Restorative Justice Within Prisons, Sarah J. Pietrowski
Law Student Publications
In the era of mass incarceration, it is vital to reexamine the prison system to identify not only its weaknesses, but its successes. Successes in correctional systems are often measured by a reduction in recidivism rates, and in states where restorative justice practices have been implemented in prisons, recidivism rates have exhibited a significant decrease, affirming the necessity of restorative justice practices in prisons. Additionally, restorative justice not only helps victims of crime feel that their voices are heard and that the one who harmed them will experience personal growth, but it is preferred by the majority of victims as …

American Star Chamber: Online Misinformation, Government Intervention, And The Intellectual Matrix Of The First Amendment, Emily E. Burton
Catholic University Journal of Law and Technology
Just as monarchs and clerical authorities struggled to respond to seditious and heretical writings enabled by the invention of the printing press, twenty-first century governments are experiencing a similar information revolution as a result of the digital age and a rising tide of what the United States has labeled online misinformation. Like the printing press, the Internet has enabled the spread of information at an exponentially lower cost and an exponentially higher speed as it extends the ability to publish thoughts and opinions to an increasingly diverse array of individuals. Although this was largely celebrated during the first two decades …

The Intellectual Structure And The Future Of Counter-Uncrewed Aerial Systems (Uas) Research: A Bibliometric And A Scoping Review, Chuyang Yang, Chenyu Huang, Yanhui Zhao
International Journal of Aviation, Aeronautics, and Aerospace
With advancements in remote sensing technology and affordable design, uncrewed aerial systems (UAS), commonly known as drones, have become prevalent in civil and military applications, such as agriculture, public safety, and aerial imaging. However, the rise in unlawful UAS activities, such as non-compliance with legal standards and potential terrorist attacks, has raised significant public concern, necessitating effective detection and mitigation solutions. Despite the growing importance of this issue, comprehensive and detailed examinations of existing counter-UAS solutions are lacking. To address this gap, this study conducts a bibliometric analysis and scoping review of the current literature to identify key topics and …

If It Can Make It There, It Can Make It Anywhere: How New York's "Green Amendment" Is Catalyzing Environmental Progress In Light Of Federal Failures, Zoe Zingale
Cardozo Journal of Equal Rights & Social Justice
The note examines the challenges faced by minority and low-income communities in seeking legal redress for environmental injustices, highlighting how federal legal avenues like Title VI of the Civil Rights Act of 1964 have been limited by Supreme Court rulings. It proposes that state-level Green Amendments, such as New York's, offer a promising alternative for these communities to assert their right to a healthy environment and seek relief from disparate environmental impacts.

During his 2018 campaign to become Dallas County District Attorney, John Creuzot promised to decline prosecution of low-level marijuana misdemeanors. After his election, District Attorney Creuzot (DA Creuzot) honored this campaign promise, issuing policies designed to radically reduce misdemeanor marijuana prosecutions. Analyzing qualitative and quantitative data, the authors describe police enforcement changes associated with the Dallas County District Attorney's Office's (DAO) marijuana prosecution policies. The authors also explore how the DAO's Intake Unit successfully implemented and enforced these marijuana prosecution policies.
The authors show that DA Creuzot's policies were associated with a significant decrease in marijuana misdemeanor arrests and an …

Flood events present substantial challenges for coastal communities, severely impacting public safety, transportation infrastructure, and overall livability. Tropical storms, hurricanes, and sea level rise can cause extensive damage to homes and critical systems, requiring costly and prolonged recovery efforts. Coastal transportation networks are particularly vulnerable to flooding, leading to road closures, increased congestion, restricted access to essential services, and long-term economic disruptions. Understanding the effects of flood events on mobility patterns is crucial for urban planning and effective disaster management.
This thesis utilizes motif analysis to examine transportation network disruptions and access patterns in Harrison County, Mississippi, during Hurricane Ida …

Tailoring Biometric Innovation To Privacy Law In The Retail Industry, Bailey White
SMU Science and Technology Law Review
Biometric data technology is trending in retail. Retailers utilize biometric data to improve their bottom line through virtual try-on technology (VTOT), contactless payment methods, fingerprint scanners, and more—albeit at potentially steep prices. Many types of biometric technology used in retail fall under strict U.S. state privacy laws, exposing businesses to serious legal and financial consequences. This Comment provides an analysis of the current state of biometric data privacy law in the U.S., focusing on Illinois’ Biometric Information Privacy Act (BIPA), California’s Consumer Privacy Act (CCPA), Privacy Rights Act (CPRA), and more. This Comment also identifies proposed legislation, relevant case law, …

Can The Excessive Fines Clause Mitigate The Lfo Crisis? An Assessment Of The Caselaw, Michael O'Hear
Can The Excessive Fines Clause Mitigate The Lfo Crisis? An Assessment Of The Caselaw, Michael O'Hear
Minnesota Law Review Vols. 106:2 onward (2021-present)
The nation’s increasing use of fees, fines, forfeiture, and restitution has resulted in chronic debt burdens for millions of poor and working-class Americans. These legal financial obligations (LFOs) likely entrench racial and socioeconomic divides and contribute to the breakdown of trust in the police and courts in disadvantaged communities. One possible source of restraint on LFOs may be the Excessive Fines Clause of the Eighth Amendment. Largely ignored by courts and commentators for two centuries, the Clause has in recent years been the subject of a burgeoning volume of litigation and scholarship. The U.S. Supreme Court has decided a handful …

The Impact Of Measure 110 On Fatal Overdoses, Property And Violent Crime In Oregon, Hannah Mercado
MPA/MPP/MPFM Capstone Projects
In November 2020, the Drug Addiction Treatment and Recovery Act (also known as Measure 110) was passed in Oregon with the purpose to provide access to treatment and recovery services available to anyone who may need to utilize them, while focusing on a health-oriented approach towards substance use disorder (SUD) across the state through the removal of low-level drug possession criminal penalties (Oregon Health Authority, n.d.). Historically, Oregon has consistently had some of the highest rates of substance use in the U.S., making this a pertinent issue which was addressed through the implementation of Measure 110. Citing a critical need …

City Beautification And Homelessness: Differing Priorities Of Cities Considered Beautiful And Ugly, Katia Davis
MPA/MPP/MPFM Capstone Projects
The downtown area of a city is often considered the economic hub where people come together as a society to engage in consumerism, recreation, and build relationships. Cities use the downtown area to showcase the beauty and appeal of the area to attract new residents or retain current residents. One thing that affects many downtown areas is the presence of visible homelessness. Homelessness is often seen as an unsightly issue that affects local businesses, residents, and tourism. Local governments can choose to push the homeless presence out of downtown or create an environment that helps those in need. This paper …

Curing Terry's Colorblindness, Ilan Friedmann-Grunstein
Publications
Scholars, policymakers, and advocates have long bemoaned the Supreme Court's colorblind Fourth Amendment jurisprudence. The Court has alternatively ignored or condoned racially discriminatory searches and seizures, allowing government agents to engage in widespread racial profiling. Proposed reforms have typically focused on doctrinal solutions that would limit police discretion or called for the reversal of Terry v. Ohio.
This Article provides a comprehensive doctrinal, regulatory, and legislative solution to racial discrimination in police investigations. It proposes a novel solution: adopting recent jury selection reforms aimed at preventing racism injury selection to combat racial profiling in searches and seizures. Several states, …
The Picture Of (Mental) Health: A Photovoice, Narrative Inquiry, And Critical Participatory Action Approach To Music Major Mental Wellness, Paige Zalman
Graduate Theses, Dissertations, and Problem Reports (ETD)
Higher education is experiencing a mental health epidemic (Venit, 2022). There is unprecedented student demand for psychological services that colleges are unable to meet (Lipson et al., 2019a), leading to high rates of mental illness-related attrition (Koch et al., 2018). Two groups of students at particularly high risk of mental illness-related attrition are students with historically marginalized identities, whether by race, gender, income, or another factor (Eisenberg et al., 2013), and music majors, a group that has been shown to have greater rates of mental illness than students in other majors (Lipson et al., 2016; Spahn et al., 2004). While …

Enhancing 5g Fixed Wireless Access In Rural Settings Via Machine Learning-Driven Resource Optimization, Maryam Amini
Graduate Theses, Dissertations, and Problem Reports (ETD)
Providing broadband access to rural communities continues to be an important societal problem whose solution would help to break down the digital divide. While 5G wireless networks may be used for rural broadband, a key challenge is the placement of base stations, which is exacerbated by the use of high frequencies in the millimeter-wave band. Such technology requires an unobstructed line of sight, demanding meticulous planning of the number, height, and location of base stations for optimal coverage. Conventional methods, such as ray-tracing to simulate signal propagation across varied terrain, are computational costly and not feasible for vast coverage areas. …
