The Participation Of Non-State Actors In The Bbnj Agreement's Area-Based Management Tools Regime: Successes And Roadblocks, Charlotte Verdon

Fordham International Law Journal

The recently adopted BBNJ Agreement creates a multilateral framework for the establishment of Area-Based Management Tools (ABMTs) in marine areas beyond national jurisdiction. Part of the process for establishing ABMTs under the new Agreement is the consultation of non-State actors (NSAs). ABMTs such as marine protected areas can negatively impact various NSAs, such as Indigenous Peoples that may rely on fishing in ABMTs for subsistence or cultural practices. At the same time, NSAs possess unique knowledge that can be instrumental in the design and management of ABMTs. The Article explores the theoretical and practical justifications for involving NSAs in the …

The Behavioural Response Of Captive M. Nigra And C. Capucinus To A Novel Cooperative Enrichment Device At Newquay Zoo, Julia Sullivan

School of Biological and Marine Sciences Theses

In the wild, primates cooperate to overcome challenges and maximise survival. Introducing cooperative tasks to zoo-housed primates may enhance welfare and promote prosocial behaviour in a captive setting. Comparative research on primate cooperation has predominately taken place in primate research facilities, where they are able to control pairing of individuals and incorporate task specific training. Zoos offer the opportunity to explore cooperation under more naturalistic conditions, but there is limited existing literature. I investigated the cooperative behaviour of socially housed groups of Sulawesi black crested macaques (Macaca nigra) (n=7) and White throated capuchins (Cebus capucinus) (n=4) at Newquay Zoo, using …

Perceptions Of Available Funding Opportunities For West Tennessee’S Young And Beginning Row Crop Farmers, Logan Meeks

Murray State Theses and Dissertations

Research quickly identified many different avenues of funding available to new and beginning traditional row-crop farmers in Tennessee, but questions surrounding local farmers’ knowledge of these opportunities are in question. Many programs specific to the New and Beginning Farmer demographic boasted the potential benefits of using these programs as well as the good work these programs are accomplishing. The current increase in cost of traditional row-crop funding continues to drive the need for more funding resources with New and Beginning Farmers. Providing resources of where farmers can find the best available funds for their operation will expand the level of …

Alternatively Certified Educators’ Impact On The Nation’S Current Teacher Shortage, Allison Heald

Murray State Theses and Dissertations

The teacher shortage experienced across the United States within the K-12 system has garnered the attention of policymakers nationwide. While the alternative certification route made a way for potential new educators to enter the field through abbreviated certification program requirements, the school systems that offered positions to this group of educators had to be willing to take extra steps to ensure their success. Alternatively certified educators within all subject areas specified the need for additional support within the following areas: catered professional development opportunities, reduced extracurricular expectations, mentor/mentee programs, and extended planning time. Based on data collected through previous research, …

Economic And Social Rights, Corruption, And Covid-19: The Indian And South African Experiences, Anashri Pillay

National Law School of India Review

India and South Africa have been at the forefront of debates about economic and social rights for many decades. Whilst the apex courts in these states have led the way in interpreting and handing down remedies stemming from these rights, vast social and economic inequalities persist. This article uses the responses to Covid-19 as a basis to consider how corruption has affected the realisation of economic and social rights in each of these countries. The article goes on to address broader arguments about the value of international human rights in tackling corruption. A human rights perspective is a relatively recent …

Cash Substitution And Deferred Consumption As Data Breach Harms, Lisa Yao Liu, Lior Jacob Strahilevitz Jan 2024

Cash Substitution And Deferred Consumption As Data Breach Harms, Lisa Yao Liu, Lior Jacob Strahilevitz

Coase-Sandor Institute for Law & Economics Research Paper Series

Federal courts have long been divided over whether consumers whose data are breached suffer an “injury in fact” that gives them standing to sue under Article III of the United States Constitution. Judicial opinions find no constitutional standing in a narrow majority of such cases, and plaintiffs are likely to lose absent causal links to subsequent identity theft or the disclosure of embarrassing information. Consumers whose data are breached thus are left without a federal remedy, and firms’ incentives to invest in data security are diminished. Our paper identifies a novel injury that results from data breaches. Upon learning about …

The Additionality Double Standard, James Salzman, David Weisbach Jan 2024

The Additionality Double Standard, James Salzman, David Weisbach

Articles

Carbon offsets are widely criticized for lacking additionality. The public debate, how- ever, has failed to recognize that the problem of additionality goes far beyond offsets. It arises any time the government subsidizes an activity. Programs with longer histories than offsets and far more money at stake offer valuable lessons for managing lack of additionality in offsets. The article sets out the current efforts to prove offset additionality, explains why major gov- ernment programs present comparable additionality challenges, and show why other programs’ problems of additionality are perceived as significantly different than those for offsets. We examine the toolkit used …

Heart failure (HF) is a chronic, debilitating condition associated with significant morbidity, mortality, and socioeconomic burden. Patients with end-stage HF (ESHF) who are not a candidate for advanced therapies will continue to progress despite standard medical therapy. Thus, the focus of care shifts from prolonging life to controlling symptoms and improving quality of life through palliative care (PC). Because the condition and prognosis of HF patients evolve and can rapidly deteriorate, it is imperative to begin the discussion on end-of-life (EOL) issues early during HF management. These include the completion of an advance directive, do-not-resuscitate orders, and policies on device …

Alzheimer’s disease (AD) is the leading cause of dementia globally, having a pathophysiology that is complex and multifactorial. Recent findings highlight the significant role of non-coding RNAs (ncRNAs), specifically microRNAs (miRNAs), long non-coding RNAs (lncRNAs), circular RNAs (circRNAs), and piwi-interacting RNAs (piRNAs) in the molecular mechanisms underlying AD. These ncRNAs are involved in critical biological processes such as cell proliferation, apoptosis, oxidative stress, amyloid-beta aggregation, tau phosphorylation, neuroinflammation, and autophagy, which are pivotal in AD development and progression. This systematic review aims to consolidate current scientific knowledge on the role of ncRNAs in AD, making it the first to encompass …

Identifying Youth Appeals In Alcohol Alternative Social Media Content Through Framing, Melina Oneal Jan 2024

Identifying Youth Appeals In Alcohol Alternative Social Media Content Through Framing, Melina Oneal

West Chester University Master’s Theses

Proposed regulations for alcohol advertising prevent beverage companies from targeting people under the legal drinking age. However, similar regulations for alcohol alternative beverages are less explored, which could allow alcohol alternative products to create awareness for alcoholic beverages among youth. Alcohol alternatives beverages, including no-alcohol and low-alcohol products, are increasing in popularity and can function as compliments to alcoholic products to decrease the total alcohol volume consumed or as substitutes for alcoholic products. Framing theory can be operationalized through the Content Appealing to Youth Index, an index of content elements found in research literature to be appealing to youth, to …
