Fragmented Futures: Publication Choices And The Evolution Of International Legal Scholarship, Melissa (M.J.) Durkee Jan 2024

Fragmented Futures: Publication Choices And The Evolution Of International Legal Scholarship, Melissa (M.J.) Durkee

Scholarship@WashULaw

How we produce and disseminate international legal scholarship affects can affect how international law itself develops. Fragmentation and siloing of international legal scholarship can diminish the coherence of international law as a shared social practice across national borders. It can also diminish the perceived salience of international law within the United States, contributing to U.S. propensities toward exceptionalism and isolationism. Non-traditional publication formats have equalizing and connecting functions, but there is still room for growth when it comes to aggregating scholarship across regional, linguistic, and disciplinary divides. Finding ways to do that will help international lawyers better accomplish the field’s …

The Major Questions Doctrine: Unfounded, Unbounded, And Confounded, Ronald M. Levin Jan 2024

The Major Questions Doctrine: Unfounded, Unbounded, And Confounded, Ronald M. Levin

Scholarship@WashULaw

As explicated by the Supreme Court in West Virginia v. EPA in 2022, and reaffirmed in Biden v. Nebraska in 2023, the “major questions doctrine” provides that an administrative agency’s rule in a “major” case must rest on “clear congressional authorization.” Many commentators have deplored the major questions doctrine on the basis of its policy consequences. This Article offers a critique of the doctrine from a different angle. It primarily contends that the reasons the Court has given for enforcing the doctrine do not withstand scrutiny, even on their own terms.

In West Virginia and Nebraska, the Court relied heavily …

Do High School Students Understand Their Miranda Rights? A Preliminary Investigation, Emma K. Hinds Jan 2024

Do High School Students Understand Their Miranda Rights? A Preliminary Investigation, Emma K. Hinds

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Background: Numerous studies have established that the linguistic complexity of the Miranda warning often results in poor comprehension, particularly for adolescents. Several studies have shown that persons with language disorders are overrepresented in U.S. prisons. Additionally, a few studies have shown a strong positive correlation between language scores and scores on Miranda assessments. These findings suggest that individuals with language disorders are at risk for poor comprehension of their Miranda rights, placing them at greater risk of waiving those rights, which can lead to incarceration.

Aims: The goal of this preliminary investigation is to examine how well adolescents with typical …

The Original Meaning Of The Sixteenth Amendment, John R. Brooks, David Gamage Jan 2024

The Original Meaning Of The Sixteenth Amendment, John R. Brooks, David Gamage

Faculty Scholarship

The Sixteenth Amendment to the United States Constitution enshrines Congress’s “power to lay and collect taxes on incomes, from whatever source derived.” Challenges to the exercise of that power have typically turned on whether the thing being taxed is “income” or not. In the most recent example, the 2023 Supreme Court case of Moore v. United States, taxpayers have argued that the Sixteenth Amendment only authorizes taxation of realized income—this is, that gain from appreciated property can only be taxed as “income” when there has been a sale or conversion of that property.

In this Article we argue—based on the …

1. Navigating The New Frontier Of Generative Ai In Peer Review And Academic Writing, Chris Mayer

Teaching and Generative AI: Pedagogical Possibilities and Productive Tensions

This chapter provides an overview of the current landscape and implications of Generative Al (GenAl) in higher education, particularly focusing on its role in academic writing and peer review. The emergence of GenAl tools such as ChatGPT is a transformative development in education, with widespread adoption at unprecedented speed. Large Language Models such as ChatGPT offer great potential for enhancing education and academic writing but also raise serious ethical concerns and tensions including access and usability, the perpetuation of Standard Academic English, and issues of linguistic justice. There is also the need for new approaches and pedagogies for how to …

Productive Shared Identity: Angola And Lgbtqia+ Norm Diffusion, Robert Tanner Bivens Jan 2024

Productive Shared Identity: Angola And Lgbtqia+ Norm Diffusion, Robert Tanner Bivens

Graduate Research Theses & Dissertations

In 2019, Angola changed its penal code. One notable change was the state's elimination of its previous colonial law that outlawed "vices against nature." With this elimination, nonheteronormative relationships had become legal in the state. Considering Angola’s status as a semi-authoritarian state that did not seem to be close to making progress on LGBTQIA+ reform, it was puzzling to see such a significant reform that occurred so quickly. Research has shown the strength of bottom-up pressure from civil society to alter a state’s stance on a norm. Other research has discussed how material incentives can shape a state’s decision-making to …

The Rhetoric Of Abortion In Amicus Briefs, Jamie Abrams, Amanda Potts Jan 2024

The Rhetoric Of Abortion In Amicus Briefs, Jamie Abrams, Amanda Potts

Scholarly Articles in Law Reviews & Journals

The amicus briefs filed in landmark abortion cases before the U.S. Supreme Court serve as a barometer revealing how various constituencies talk about abortion, women, fetuses, physicians, rights, and harms over time. This article conducts an interdisciplinary legal-linguistic study of the amicus briefs that were filed in the milestone abortion cases of Roe v. Wade, Doe v. Bolton, Planned Parenthood v. Casey, and Dobbs v. Jackson Women’s Health. As the first large-scale study of all amicus briefs submitted in these key cases, this article identifies the roles of amicus briefs, analyzes their rhetorical strategies, and describes how their authors engage …

Exiting The American Dream, Jayesh Rathod Jan 2024

Exiting The American Dream, Jayesh Rathod

Scholarly Articles in Law Reviews & Journals

Exit planning among U.S. citizens is on the rise. A confluence of worrisome domestic conditions— including societal violence, the curtailment of individual rights, and creeping authoritarianism— has prompted U.S. citizens to contemplate and plan for a possible departure from the country. Among the more popular exit pathways, particularly for minorities in the United States who have experienced or fear identity-based mistreatment, are programs that allow descendants of citizens or other members of the diaspora to acquire status in their ancestral homelands. Decades or even centuries after their ancestors’ arrival, present-day U.S. citizens are considering a return journey, thereby disrupting long-standing …

Protecting Free Speech In Social Media: A Pathway To Self-Determination In International Law, Sydney Marie Harley Jan 2024

Protecting Free Speech In Social Media: A Pathway To Self-Determination In International Law, Sydney Marie Harley

Emory International Law Review Recent Developments

With the growth of Internet and social media usage, state regulatory action to surveil and censor citizens is running rampant. As the principle of self-determination stands, minority populations are typically bearing the brunt of these attacks, receiving little protection under domestic and international law. Self-determination within international law must be restructured into a definitive pathway that includes protecting the freedom of speech to encourage discourse and tolerance between the State and its minority populations. This article proposes a solution that could fill the gap in international law formed by insufficient domestic rule in States that neglect to protect these populations …

Psychological Science Faculty Works

Over the last decades, theoretical perspectives in the interdisciplinary field of the affective sciences have proliferated rather than converged due to differing assumptions about what human affective phenomena are and how they work. These metaphysical and mechanistic assumptions, shaped by academic context and values, have dictated affective constructs and operationalizations. However, an assumption about the purpose of affective phenomena can guide us to a common set of metaphysical and mechanistic assumptions. In this capstone paper, we home in on a nested teleological principle for human affective phenomena in order to synthesize metaphysical and mechanistic assumptions. Under this framework, human affective …

Considering Extended High-Frequency Audiometry As A Screening Tool For Auditory Processing Disorder, Maylee Martin Jan 2024

Considering Extended High-Frequency Audiometry As A Screening Tool For Auditory Processing Disorder, Maylee Martin

Williams Honors College, Honors Research Projects

The purpose of this research project is to describe Auditory Processing Disorder (APD) and its background and etiology, signs and symptoms, and treatment options. APD is an auditory disorder that affects the central nervous system. Individuals with auditory processing disorders are able to detect sounds at normal hearing levels and pass a standard hearing test, but struggle with higher order auditory skills such as auditory discrimination, binaural processing, including understanding in the presence of background noise, and temporal processing (ASHA, 2005). A full auditory processing test battery is time consuming, and many audiologists are not skilled in administering typical APD …

Ecclesiological Meaning In Jesus’ Sabbath Healings, Sven Östring Jan 2024

Ecclesiological Meaning In Jesus’ Sabbath Healings, Sven Östring

Journal of Adventist Mission Studies

The earthly life and ministry of Jesus Christ was the full incarnation of his divine identity and mission. However, certain events and situations became windows that allowed his relationship with his Father and his divine mission to be revealed with clarity to those around him. In particular, Jesus saw in the Sabbath a unique and regular opportunity to reveal both his identity and his mission. Likewise, his opponents understood, with almost surprising accuracy and clarity, what he was communicating about himself from his religiously non-conforming actions on Sabbath. However, this was not just a minor ethical scuffle between a well-studied …

Implementing Timothy Keller’S Center Church Principles: Transforming Your Church Into A Center Of Influence, Danie Potgieter Jan 2024

Implementing Timothy Keller’S Center Church Principles: Transforming Your Church Into A Center Of Influence, Danie Potgieter

Journal of Adventist Mission Studies

In contemporary religious discourse, the concept of a church transcending its traditional role as a mere congregation to become a dynamic center of influence within its community has gained significant traction. This paradigm shift, often fueled by a desire to engage with societal issues and impact lives beyond the church walls, finds resonance in Timothy Keller’s Center Church: Doing Balanced, Gospel-Centered Ministry in Your City. Grounded in theological depth and practical wisdom, Keller presents a compelling framework for transforming churches into vibrant hubs of influence capable of effecting meaningful change in the world around them.

Biblical And Theological Principles For Ministry To The Deaf And Other Isolated Groups, Joseph Jacobson Jan 2024

Biblical And Theological Principles For Ministry To The Deaf And Other Isolated Groups, Joseph Jacobson

Journal of Adventist Mission Studies

Deaf people are one of the largest unreached groups in the world (Lowenstein 2019, para. 2). To reach this group with the gospel, it is vital to build a solid biblical foundation for ministry to deaf individuals. The knowledge of God and the importance of faith, hope, and trust in God are often limited among deaf communities despite technological advancements (Broesterhuizen 2005:307). It is essential to show the different groups of deaf communities scattered around the world that Jesus loves them and that “the Bible is at heart a text that is positive for all marginalized people, whether poor, or …

Is There A Future For The Missiological Study Of Worldview? Part 2, Paulo C. Oliveira Jan 2024

Is There A Future For The Missiological Study Of Worldview? Part 2, Paulo C. Oliveira

Journal of Adventist Mission Studies

In Part 1 of this article, I revisited the foundational intellectual roots of the missiological worldview construct, described the concept, and presented an argument advocating for additional critical engagement in mission circles. In Part 2, the focus will be on probing the anthropological shift moving away from worldview studies, exploring some implications of this shift for missiology, and, finally, addressing—more directly—the question of the future of missiological worldview studies.

Zero-Shot Cross-Lingual Pos Tagging For Filipino, Jimson Paulo Layacan, Isaiah Edri W. Flores, Katrina Bernice M. Tan, Ma. Regina Justina Estuar, Jann Railey E. Montalan, Marlene M. De Leon

Department of Information Systems & Computer Science Faculty Publications

Supervised learning approaches in NLP, exemplified by POS tagging, rely heavily on the presence of large amounts of annotated data. However, acquiring such data often requires significant amount of resources and incurs high costs. In this work, we explore zero-shot cross-lingual transfer learning to address data scarcity issues in Filipino POS tagging, particularly focusing on optimizing source language selection. Our zero-shot approach demonstrates superior performance compared to previous studies, with top-performing fine-tuned PLMs achieving F1 scores as high as 79.10%. The analysis reveals moderate correlations between cross-lingual transfer performance and specific linguistic distances–featural, inventory, and syntactic–suggesting that source languages with …

Narratological Considerations In Translating Maria Magsano’S Duksay Kapalaran, Benigno C. Montemayor Jr. Jan 2024

Narratological Considerations In Translating Maria Magsano’S Duksay Kapalaran, Benigno C. Montemayor Jr.

Perspectives in the Arts and Humanities Asia

Translation requires a thorough understanding of the source text, so that it can be aptly conveyed into the target text regardless of the source and target languages. In view of translating Maria Magsano’s Pangasinan novel Duksay Kapalaran into English using foreignizing strategies, which privilege the culture, society, and history embedded in the source text over the cultural values attending the target language, the author first performs a careful reading of the novel. What is brought to the fore are the novel’s nuances and relevant attributes, specifically orality and didacticism, which Ma. Crisanta Nelmida asserts are the dominant features of the …

A New Frontier In Online Dispute Resolution: Combining Ai And Mindfulness, Noopur Amin Jan 2024

A New Frontier In Online Dispute Resolution: Combining Ai And Mindfulness, Noopur Amin

Journal of Law, Technology, & the Internet

The use of artificial intelligence (AI) in dispute resolution has gained attention due to its potential to streamline the resolution process and reduce costs. The purpose of this paper is to explore the integration of AI with alternative dispute resolution (ADR) processes and propose an online dispute resolution (ODR) model that combines elements of mindfulness and different forms of AI. The paper begins by providing an overview of the history of ODR and introducing Lodder and Zeleznikow's three-step ODR model. It then explores the role of AI in dispute resolution and provides a brief history of AI generally. The comparison …

Effects Of Mindfulness Training On Prosocial Responses In Intergroup Relations: A Pilot Randomized Controlled Trial, Denise Yiran Zheng Jan 2024

Effects Of Mindfulness Training On Prosocial Responses In Intergroup Relations: A Pilot Randomized Controlled Trial, Denise Yiran Zheng

Theses and Dissertations

Based on social identity theory and intergroup emotions theory, individuals feel for and act toward others based on their group-based social identities. Recent research shows that mindfulness can enhance prosocial responses toward others across group divides. The current research examined the effects of mindfulness training on prosocial behavior in intergroup relations where such behavior is difficult (e.g., with marginalized or devalued social groups). The study also examined potential mechanisms, namely state empathic concern and appraisal, that may explain how mindfulness increases prosocial behavior toward outgroups. This study compared the effects of a 2-week mindfulness training to a matched coping training …

The Incoherence Of Orientalists, Sarah Zaid Alafifi Jan 2024

The Incoherence Of Orientalists, Sarah Zaid Alafifi

Theses and Dissertations

Orientalism, the Western practice of fetishizing cultures, extends beyond mere misrepresentation of the “other;” it epitomizes the underlying structures of colonialism and imperialism, infiltrating everyday life and eroding the moral fabric of Islamic society.

This thesis analyzes colonial control through the exercise of political power and the production of knowledge, investigating key events related to Napoleon’s Egyptian campaign and the narratives of resistance that emerged in opposition to it.

Through the lens of this 18th-century expedition, the study examines how Western knowledge systematically contributed to the dismantling of Islamic systems of knowledge. Select phrases from Colonial-era printed proclamations are extracted …

Obstacles To And Facilitators Of Services In Child Welfare In The Context Of The Family First Prevention Services Act, Juliet Wu Jan 2024

Obstacles To And Facilitators Of Services In Child Welfare In The Context Of The Family First Prevention Services Act, Juliet Wu

Theses and Dissertations

The child welfare system has generally focused on child wellbeing and protection in the context of abuse or neglect allegation, supporting caregivers with child rearing, and finding a stable, permanent home for children. Because children and caregivers involved with the child welfare system typically have complex needs, public departments of social services often collaborate with other entities to provide services to families. However, connecting families to services has often been difficult, with many barriers along the way that prevent families from receiving the services they need. The enactment of the Family First Prevention Services Act (FFPSA) in 2018 aimed to …

The Cultural Adaptation Of An Eating Disorders Assessment Tool For South Asian American Women, Neha J. Goel Jan 2024

The Cultural Adaptation Of An Eating Disorders Assessment Tool For South Asian American Women, Neha J. Goel

Theses and Dissertations

South Asians (SAs) are less likely to be screened, referred, and treated for eating disorders (EDs), although they experience these serious health conditions at rates similar to those of their White counterparts. Available ED assessment tools do not adequately capture cultural nuances in the presentation of eating psychopathology in SAs. Thus, the current study culturally adapted the Eating Disorder Examination-Questionnaire (EDE-Q) to enhance its validity, applicability, and cultural relevance for SA women living in the US. During the cultural adaptation phase, the principal investigator consulted with participant experts (N=24) and research experts (n=4) to create the …
