Environment And Belief: Investigating The Dakota Archeological Record, Anna Kay Wiitanen-Eggen
Environment And Belief: Investigating The Dakota Archeological Record, Anna Kay Wiitanen-Eggen
All Graduate Theses, Dissertations, and Other Capstone Projects
The oral traditions and histories of a people’s belief systems are one means by which the relationships between a people and their environment are embodied. Environmental aspects of a people’s belief system are reflected in their use of their habited space(s) because beliefs help structure actions. Ergo, an examination of a people’s oral traditions and histories has the potential to provide valuable insight to the archeological record of the places potentially occupied by their ancestors or close relatives. Investigation of this aspect of archeology is a relatively new pursuit and is almost completely unexplored in Minnesota. The relationship between the …

Critical Discourse Analysis Of The Dialogical Demands Of Florida's 10th Grade B.E.S.T. English Language Arts Standards, Amanda Nb Kaplowitz
Graduate Thesis and Dissertation 2023-2024
This study investigates the extent to which the Florida B.E.S.T (Benchmark for Excellent Student Thinking) English Language Arts (ELA) standards demand that students participate in dialogic interactions within the 10th grade ELA classroom. Dialogic demands, characterized by active discourse and collaborative sense-making, are the opportunities students interact with one another or with a text. The dialogic elements of classroom pedagogy are an increasingly recognized critical component of effective literacy instruction in contrast with the monologic classroom where teachers are the primary source of information. A Critical Discourse Analysis through the lens of Fairclough is used as this research aims to …

A Critical Discursive Analysis Of The Effects Of Confidence Chats On The Positioning Of Students With Disabilities During Mathematics Discourse, Kelly R. Penny
Graduate Thesis and Dissertation 2023-2024
This qualitative study investigated how confidence chats affect how students with disabilities (SWD) position themselves during mathematics discourse and the impact the confidence chats had on a student’s mathematical identity. A critical discourse analysis was conducted over a three-month period using transcripts from classroom observations, student-teacher confidence chats, and teacher interview debriefs. Findings revealed that following the confidence chats, SWD participated in discourse, and students were able to adjust their positioning in relation to others. Over the course of the study, student collaboration increased and their reliance on teacher support decreased. In addition, the findings indicated that confidence chats provided …

Translated English Food Articles For A Bilingual Magazine In The Urban Context Of Chiang Mai, Wiriya Inphen
Journal of Urban Culture Research
The study aims to explore the ways in which translated food articles in a bilingual magazine are translated from Thai into English. The research question is: What are the ways in which translators translate food articles from Thai into English and to what extent, in the urban context of Chiang Mai? The source material of the research consists of food articles from the 2019 Spoon & Fork Magazine. Through the concept of rewriting in the systems, the study compares source-text and target-text paragraphs to discover the ways in which translators treat source-text social and cultural elements that are specific to …

Reformatting The Performing Arts : Wayang Climen As A Tradition-Based Entertainment Solution For Urban Audiences In Yogyakarta, Hanggar Budi Prasetya, Hariyanto Hariyanto, Bayu Aji Nugraha, Yuniar Galuh Larasati, Marti Fauziah Ariastuti
Journal of Urban Culture Research
The reformulation of Wayang performances into Wayang Climen has provided a fresh avenue for urban audiences to access tradition-based entertainment, which plays a crucial role in the transmission of cultural knowledge and values. After limited performance opportunities due to COVID-19 restrictions, puppeteers are now vying to put on elaborate performances. However, such performances are often expensive, space-intensive, and lengthy, making them inaccessible for urban communities with restricted resources. This study explores how puppeteers have reimagined performances by streamlining their duration, reducing venue requirements, and narrowing thematic focus to retain the essence of traditional Wayang while making it accessible to urban …
Who Is "Women's Health" For? Lgbtq+ Inclusion In Sexual And Reproductive Health Care, Evan Thomas England
Who Is "Women's Health" For? Lgbtq+ Inclusion In Sexual And Reproductive Health Care, Evan Thomas England
Doctoral Dissertations
Throughout modern Western history, access to fully affirming and supportive sexual and reproductive health care (SRH) has been denied to most women and sexual and gender minorities. Also, as demonstrated by the ubiquity of the term “women’s health,” SRH often reflects a cisgender heterosexual (cishet) women-centered approach, alienating transgender, non-binary, gender nonconforming, and sexual minority individuals who are not cishet women but are in equal need of the same life-saving screenings, treatments, and counseling services. Due to the operationalization and reproduction of gendered ideologies and unequal social hierarchies within SRH, inadequate access to quality sexual health education for youth, and …

Fair Notice And Criminalizing Abortions, Brian G. Slocum, Nadia Banteka
Fair Notice And Criminalizing Abortions, Brian G. Slocum, Nadia Banteka
Journal of Criminal Law and Criminology
The principle of legality requires that individuals receive “fair notice” of conduct that is criminal. Courts enforce this fair notice requirement through various interpretive principles and practices, including the void-for- vagueness doctrine. The void-for-vagueness doctrine remains undertheorized, however, despite its centrality to the interpretation of criminal statutes. We offer a new theory of the void-for-vagueness doctrine that accounts for recent Supreme Court decisions. Specifically, we propose a scalar theory that fair notice is a matter of degree, dependent on various factors. We explore the implications of this theory for anti-abortion statutes post-Dobbs and explain why many of these statutes do …
The Rule Of Lenity As A Disruptor, Maciej Hulicki, Melanie M. Reid
The Rule Of Lenity As A Disruptor, Maciej Hulicki, Melanie M. Reid
Journal of Criminal Law and Criminology
This article discusses the application of the rule of lenity in the American legal system. Although this constitutes a substantial element of criminal law in the United States and has been duly established in jurisprudence and legal science, it has still not been adequately applied in judicial practice. The authors of the article reflect on this situation, analyzing the historical background and the origins of this principle, as well as its current implementation in the U.S. criminal law. The work also includes a comparative analysis, where the authors juxtapose the rule of lenity with similar principles known in civil law …
Trauma-Informed Digital Health Interventions: A Scoping Review, Amelea Lowery
Trauma-Informed Digital Health Interventions: A Scoping Review, Amelea Lowery
Public Health Theses
Background: Trauma exposure is a pervasive issue around the world and the impacts of trauma can be long lasting and detrimental to individual and population health outcomes. Trauma responses can influence and determine an individual or community’s approach in seeking supportive resources. Given the critical role of supportive resources and the prevalent use of technology and internet use, it is essential to understand how digital health interventions contribute to addressing trauma explicitly. This scoping review aims to explore the landscape of trauma-informed digital health interventions for adults, assess their outcomes, and identify their measurable impacts across various settings. Methods: A scoping …
Community Health Workers To Strengthen Hiv Care Continuum And Prep Delivery In The Us/Hics: A Scoping Review, Vanessa Abigail Nunez
Community Health Workers To Strengthen Hiv Care Continuum And Prep Delivery In The Us/Hics: A Scoping Review, Vanessa Abigail Nunez
Public Health Theses
Introduction: With the ongoing global HIV/AIDS burden, community-based service delivery models are increasingly recognized, with community health workers (CHWs) at the forefront. In high-income countries (HICs) like the United States, CHWs have long served marginalized communities, gaining recent legislative attention. Despite this, there's still a need for comprehensive evidence on CHW integration in healthcare delivery.
Methodology: We conducted a scoping review to gather available evidence on community health workers (CHWs) and their impact on HIV outcomes in HICs, and to identify evidence gaps in the use of community-based HIV/PrEP services in HICs. Using the American Public Health Association’s definition of …
A (Sovereign) License To Kill? The Boundaries Of Jurisdictional Immunities For State-Sponsored Crimes, Thibault Moulin
A (Sovereign) License To Kill? The Boundaries Of Jurisdictional Immunities For State-Sponsored Crimes, Thibault Moulin
Emory International Law Review
Thanks to their immunities, states are normally not subject to civil proceedings before foreign courts. While some may argue there are exceptions to this principle, in particular regarding acta de jure gestionis, the International Court of Justice refused to recognize the existence of further limitations to this principle in the Jurisdictional Immunities of the State case. However, even after the judgment, several questions remain unresolved. This article clarifies the boundaries of civil immunities in the field, and especially vis-à-vis state-sponsored crimes. This article finds that state-sponsored crimes may qualify as sovereign acts and that contradiction with jus cogens is …

Self-Determination And Territorial Agreements In The Middle East: From The Ottomans To Colonial Rule, Ilias Bantekas, Moza Al-Thani
Emory International Law Review
A Pan-Arab uprising against the Ottomans must have seemed unlikely in the late nineteenth century. Yet, grounded around a common language, history and culture, Arab nationalists demanded their unification in a single nation state. To achieve this aim, they allied with the British and the Entente but soon discovered that territorial and self-determination commitments made to them were not always forthcoming and were interjected with secret agreements and unilateral acts to which they were not privy. While Gulf sheikhdoms entered into consensual protectorate treaties with the British, the former Ottoman territories of the Middle East and the Levante were still …
Imaginary Margins: Disability Poetics & Reinventing The Page, Audrey T. Heffers
Imaginary Margins: Disability Poetics & Reinventing The Page, Audrey T. Heffers
Graduate Publications – English
Disability poetics resist marginalisation by centralising disabled words and experiences, both literally and figuratively. In a world that prioritises ability, disabled bodyminds are marked as deviant from norms and conventions. Disabled poets have the opportunity to resist the normalised ‘body’ of the poem on the page. Conventions, rules, and norms can shape poetry – not just rhyme and metre, but line breaks, line arrangements, and limiting poems to the written linguistic mode. Disability poetics can include techniques such as poems written sideways, prose poems, and multimodally-composed texts, as explored in Tonguebreaker by Leah Lakshmi Piepzna-Samarasinha, Wound from the Mouth of …

Multifaceted Challenges And Opportunities: Concurrent Mixed Methods Research To Investigate Chinese Exchange Students' Experiences In The Us Transnational Online Learning Ecology, Xinyue Ren, Yi Zhou
STEMPS Faculty Publications
Transnational online education has become an emerging trend in promoting academic collaboration and exchange in higher education during and after the pandemic. Guided by the learning ecology framework, we conducted concurrent mixed methods research by distributing an online survey to Chinese students (N=51) to collect quantitative and qualitative data. This helped us deeply understand their experiences and perceptions of a cross-cultural online learning environment in the United States. We applied multiple regression and thematic analysis to analyze the data. The merging of both types of data analysis indicated the confirmation of the importance of discipline-based English learning environments, the transformation …
The Private Law Of Self-Help, João Marinotti
The Private Law Of Self-Help, João Marinotti
Articles by Maurer Faculty
Individuals regularly take steps to protect themselves, their property, and their broader legal interests. They carry pepper spray, have guard dogs, and install fences. Such measures are colloquially deemed methods of self-help. Yet, despite its ubiquity, self-help as a legal concept has been chronically understudied. Consequently, American private law is missing a doctrinally coherent and prescriptively useful framework for self-help. As a matter of legal theory, this conceptual void is problematic in and of itself; the doctrinal incoherence stemming from this analytical gap decreases the law’s stability and undermines its predictability.
But the concern is not merely theoretical. The magnitude …

Empowering Parents As Partners In Learning: Practices For Developing A Robust Home Learning Environment, Jennifer L. Bencivengo
Empowering Parents As Partners In Learning: Practices For Developing A Robust Home Learning Environment, Jennifer L. Bencivengo
Doctor of Education (Ed.D.)
Parents are often considered a child’s first teacher. However, not all parents are equipped with adequate strategies or have access to equitable resources to provide a rich home learning environment for their children. Bodies of research consistently identify discrepancies in kindergarten readiness from a social, emotional, and academic learning vantage point when discussing foundational literacy skills, the overreliance on technology, and developmentally appropriate executive functioning skills (Bassok & Reardon, 2013a; Jung, 2016; Reardon & Portilla, 2016a; Wolf & McCoy, 2019a). In an attempt to address the inequities in school readiness has more recently been examined with focus on community based …

Undergraduate Theses, Professional Papers, and Capstone Artifacts
This project is a critical analysis of news reports that discuss the potential origins of the 'COVID-19' pandemic for the purposes of identifying themes and trends in the actual reporting. Around 500 news reports published in the U.S. were analyzed and over 100 of them were selected for the critical review. Articles were found using 'Access News Archive' and Google search engine. Original methods for analyzing and reviewing articles were developed and used. A case study is included aside from the review which focuses specifically on trends in fact-check reporting during the pandemic.
