Multi-Sided Information Asymmetry In A Single Contract: Why Revocable Living Trusts Go To Court, James P. Wells

Revocable living trust documents (trusts) are among the most important documents created in contemporary estate planning. One of the trust’s objectives is to provide clear guidance to the trustees on how to carry out the grantor's intent. When a trust is contested in court, the objective of the trust has clearly failed. Consequently, understanding why trusts go to court and developing approaches that reduce or eliminate the number of trusts in our courts is an endeavor worthy of research and the primary objective of this research effort.

At the onset of the full-scale Russian war of aggression against Ukraine, U.S. law clinic professors worked alongside the leadership of the Association of Legal Clinics of Ukraine. The mutual objective was to support Ukrainian law professors and facilitate the continued legal education of their students, particularly the acquisition of skills typically taught in law clinics. Ultimately, the online partnership that developed focused on skills training and included seven Ukrainian law schools, faculty from over six U.S. law schools and one private law firm, and USAID Justice for All Activity in Ukraine. On November 30, 2022, OpenAI released a chatbot called ChatGPT.1 To demonstrate the chatbot’s sophistication and its potential implications, both for legal services and society more generally, most of this paper was generated in about an hour through prompts within ChatGPT. Only this abstract, the preface, the outline headers, the footnotes, the epilogue, and the prompts were written by a person. ChatGPT generated the rest of the text with no human editing. To be clear, the responses generated by ChatGPT were imperfect and at times problematic, and the use of an AI tool for law-related services raises a host of …

The 2022 FIFA World Cup hosted in Qatar was mired in controversy.

From the corrupt bidding process to the sub-standard working and living

conditions, Qatar was heavily criticized for its management of the World Cup.

This paper explores two of the main critiques levied against the host nation:

its exploitation of migrant labor and the harsh and restrictive policies against

women and the LGBT community. Concerning migrant labor, the kafala

Debates over economic protectionism or the technology flavor-of-the-month obscure a simple, urgent truth: people are going online to find help that they cannot get from legal and health professionals. They are being let down, by products with festering trust and quality issues, by regulators slow to apply consumer protection standards to harmful offerings, and by professionals loath to acknowledge changes to how help is delivered. This paper examines the initiatives and policies implemented in the United Arab Emirates (UAE) to protect Children of Determination (COD) from abuse and neglect. Despite global efforts to address child abuse, children with disabilities, referred to here as children of determination, remain particularly vulnerable. This paper explores the social framework, legal protections, prevention strategies, challenges, and necessary measures to ensure that such children are safe and empowered to protect themselves from abuse. The paper also explores approaches to enhancing the efficacy of the caregivers engaged with these children so that they can predict, prevent, and deal with incidents of abuse. …

Institute for Asian American Studies Publications

In cities and towns across the United States, Asian Americans experienced the early 2020s health crisis as a dual pandemic of COVID-19 and anti-Asian racism. In Lowell, a large proportion of Cambodian American residents live in multi-generational households and are employed in working-class occupations with a high risk of exposure to the coronavirus. For this and other reasons, the pandemic had especially serious health and financial consequences for many members of the Cambodian American community. These pandemic challenges in Lowell mounted when a nationwide surge of anti-Asian racism swept through the city and surrounding areas.

Lawyering In The Age Of Artificial Intelligence, Jonathan H. Choi, Amy B. Monahan, Daniel Schwarcz

Minnesota Law Review Vols. 106:2 onward (2021-present)

We conducted the first randomized controlled trial to study the effect of AI assistance on human legal analysis. We randomly assigned law school students to complete realistic legal tasks either with or without the assistance of GPT-4, tracking how long the students took on each task and blind-grading the results.

We found that access to GPT-4 only slightly and inconsistently improved the quality of participants’ legal analysis but induced large and consistent increases in speed. AI assistance improved the quality of output unevenly—where it was useful at all, the lowest-skilled participants saw the largest improvements. On the other hand, AI …

Latinx populations in the USA have grown steadily in recent decades, with significant increases taking place in “new destination communities” of the U.S. South. The focus of our paper is to highlight opportunities for working with these populations, including traditional sociolinguistic ethnographies and community-engaged research. We highlight an initiative named “The SEC Spanish Consortium” which is an interinstitutional collaboration centered on scholarship and service involving Latinx populations in new destination communities of the U.S. South. The present study addresses a crucial challenge in the evaluation of complex systems: the need to incorporate a holistic view that contemplates not only defined elements but also those that are intrinsically ambiguous or uncertain. Rights And Redress For Transgender Survivors Of Prison Rape: The Failures Of The Prison Rape Elimination Act, Natalie Hatton

This Note will argue that PREA [Prison Rape Elimination Act] provides meager protection and insufficient relief to transgender individuals who have been victims of sexual violence while incarcerated and that the existing mechanisms for relief are insufficient. Because PREA contains no private cause of action to allow survivors of rape to sue for violations of PREA, transgender rape survivors’ pain remains unredressed. To address this problem, this Note puts forth a combination of solutions to remove barriers to redress for transgender survivors of prison rape, including amending PREA to include a private cause of action and repealing provisions of the …

This paper describes the multi-pronged approach that a business school took to address the capacity needs of nonprofit organizations that provide health-related services to underserved community members. Supported by a generous grant from a foundation, the business school led several professional development and community capacity-building initiatives, including workshops and projects. Workshops were designed to enhance the skills and expertise of area nonprofit professionals who provide need-based services and programs to underserved populations.
