The Workings Of Legal Exceptionalism: Arbitration As A Portal To Stateless Law-In-Action Regimes, Thomas Schultz
Buffalo Law Review
This Essay seeks to explores the fertility of thinking about arbitration as a portal to stateless legal regimes. Using the distinction between law in books and law in action, as well as the concepts of social and political disembeddedness and quiet politics, it argues that under the current paradigm of arbitration, it operates as a porous portal, getting corporate and natural citizens to escape into stateless law-in-action legal regimes (though in practice not into a law-in-books stateless legal regime). Courts in various jurisdictions have relied on either the right to privacy or the right to equality to offer protections to the LGBTQ+ community. The use of different rights to achieve similar ends may seem like an empty distinction. But the differences in the nature and function of each right evince the differences in the construction of rights across jurisdictions. In the traditional liberal method of conceptualizing rights, privacy is typically a negative right, restricting the state from interfering in intimate relationships between individuals. Courts operating within a transformative framework of rights interpretation, however, rely on the positive right to …

For more than a decade, state courts have been expanding access to justice by adopting online dispute resolution (ODR) platforms and other outward-facing communication technologies. At a deep level, these reforms aim at improving society by bolstering the rule of law. At a surface level, these innovations recognize that the justice system works better when courts and law are easier and less costly to understand and use. In important respects, these efforts have been a success. Plausibly Illiberal: Sua Sponte Dismissals Of Pro Se Complaints Under The Prison Litigation Reform Act, Pierce Edlich

Over a quarter of civil litigants file suit in federal court without an attorney. Most unrepresented litigants are in prison, and many of their cases raise complex, delicate constitutional questions. The number of unrepresented litigants in federal courts rose steadily until the 1990s, when Congress passed the Prison Litigation Reform Act (PLRA) of 1995 to limit the burden of frivolous inmate litigation on federal courts. Since 1996, the PLRA has defined courts’ procedural obligations for inmate and in forma pauperis (IFP) suits, often filed pro se. The PLRA requires that courts screen and dismiss sua sponte cases that are frivolous, …

Each year, eligible schools across the nation receive Title I grant funds through the Elementary and Secondary Act. These funds, justified in pursuit of social justice and educational equity, serve to provide supplemental education services to neglected and delinquent students. While the majority of the awarded schools operate within the traditional school setting, a very small number of schools in the United States operate within the correctional setting. These schools receive Title I Part D Subpart 1 funds. Consequently, most of the guidance pertains to best practices within traditional public schools, which provides no provision on the appropriate use of …

This article explores the challenges and complexities surrounding the application of the Miranda warning in the United States and specifically addresses its impact on non– English–speaking immigrants. While many Americans are familiar with these rights, recent immigrants may not fully understand them, particularly if they come from countries that do not offer equivalent legal protections. This article performs a comparative analysis of the right to silence and counsel in Cuba, Haiti, and Colombia—three countries with the largest immigrant populations in Miami, FL. Domestic violence (DV) or intimate partner violence is a widespread public health problem in the United States that knows no boundaries. Previous researchers have found that in the United States, African American women experience more severe effects from DV than women in other ethnic groups. The purpose of this generic qualitative study was to identify the coping strategies used by African American women who have survived DV living in rural areas where there are limited professional resources. Premises from the superwoman schema and adult resilience theory guided this research. Semistructured audio-recorded interviews, conducted via Zoom and face-to-face, were used to …

Latinx populations in the USA have grown steadily in recent decades, with significant increases taking place in “new destination communities” of the U.S. South. The focus of our paper is to highlight opportunities for working with these populations, including traditional sociolinguistic ethnographies and community-engaged research. We highlight an initiative named “The SEC Spanish Consortium” which is an interinstitutional collaboration centered on scholarship and service involving Latinx populations in new destination communities of the U.S. South. We show that ongoing and future scholarly work in the U.S. South can act as a mechanism for documenting these emerging Latinx communities while simultaneously …

Over the past year, the pervasive role of large language models (LLMs) and artificial intelligence (AI) in text generation has precipitated concerns about ethical usage, authorship, and transparent attribution. This has been true in legal practice, academia, and the corporate world, as well as in countless other arenas. In this non-payment case, the tenant moved for summary judgment based on an overcharge claim, asserting that a two-attorney stipulation in a prior case violated the Rent Stabilization Code by setting the rent above what was allowable. The landlord argued that the stipulation, made post-HSTPA, was valid under 9 NYCRR 2520.13, which permits tenants to waive certain rights. The court rejected this argument, ruling that such stipulations, which violated the Rent Stabilization Code, were void as against public policy. Consequently, the landlord was found liable for the overcharge, although the exact overcharge amount was left unresolved pending further proceedings.
