Using A "Moves To Innocence" Approach To Dissect And Debunk The Claim That Critical Race Theory Is Antisemitic, Diane Kemker Jan 2024

Using A "Moves To Innocence" Approach To Dissect And Debunk The Claim That Critical Race Theory Is Antisemitic, Diane Kemker

Lewis & Clark Law Review

In the United States, law and policy have most frequently reflected dominant white Christian majority interests. Critical Race Theory (CRT) offers powerful tools for understanding our history and situation, including that of American Jews, and how the social positions and interests of American Blacks and Jews, real and perceived, have intersected, sometimes aligning, sometimes diverging, and sometimes conflicting. And yet, among other charges leveled against it, Critical Race Theory is frequently accused of being antisemitic.

Intentionally or not, this charge delegitimizes and discredits CRT, and therefore advances the aims of all who oppose it for any reason, including white supremacists …

Politicizing Antisemitism Amidst Today’S Educational Culture Wars, Lili Levi Jan 2024

Politicizing Antisemitism Amidst Today’S Educational Culture Wars, Lili Levi

Lewis & Clark Law Review

The traditional narrative of American Jewry emphasizes American exceptionalism with respect to antisemitism. But there have been clear signs of a resurgence of public antisemitism in the United States even before the massive rise in antisemitic expression and incidents associated with the Israel-Hamas war of fall 2023.

One of the notable aspects of the rise and normalization of antisemitic expression is the deployment of antisemitism as a political tool. For example, in addition to Democrats and Republicans accusing each other of complicity in antisemitism, both federal policy since the Trump era and state antiantisemitism legislation have targeted campus antisemitism in …

Cultural Loss In The Context Of Indian Residential School Litigation: Exploring The Role Of Tort Law As A Tool For Transformative Reparations, James Plunkett Jan 2024

Cultural Loss In The Context Of Indian Residential School Litigation: Exploring The Role Of Tort Law As A Tool For Transformative Reparations, James Plunkett

Lewis & Clark Law Review

The issue of restitution for sexual and physical abuse of survivors of Indian residential schools has gained litigative traction, leaving the issue of reparations for cultural loss in the shadows. This Comment explores the idea of a new tort of cultural loss to more holistically address the systematized harm experienced by Aboriginal children forced into residential schools in Canada. Based on the qualitative experiences of survivors of residential schools, this Comment suggests a taxonomy of cultural loss that may further inform efforts to use tort law as a vehicle for reparative justice. Ultimately, this tort theory demands further inquiry and …

How Licenses Learn, Madiha Zahrah Choski, James Grimmelmann

Lewis & Clark Law Review

Open-source licenses are infrastructure that collaborative communities inhabit. These licenses don’t just define the legal terms under which members (and outsiders) can use and build on the contributions of others. They also reflect a community’s consensus on the reciprocal obligations that define it as a community. A license is a statement of values, in legally executable form, adapted for daily use. As such, a license must be designed, much as the software and hardware that open-source developers create. Sometimes an existing license is fit to purpose and can be adopted without extensive discussion. However, often the technical and social needs …

Repairing The Family Law Attorney, Daniel F. Bousquet Jan 2024

Repairing The Family Law Attorney, Daniel F. Bousquet

Lewis & Clark Law Review

Professor Clare Huntington’s scholarship advances a theoretical “Reparative Model” of family law that seeks to deemphasize adversarial decision-making and decrease litigation. Building off that scholarship, this Article considers the family law attorney’s role and argues that the current Model Rules of Professional Conduct already support—and should be understood to require—a “reparative” advisory role for the family law attorney. Put simply, the harsh realities of the adversarial court system demand that family law attorneys presumptively provide information on litigation’s harmful impacts on families and children and encourage the possibility of pursuing goals via means less detrimental than litigation. To encourage a …

Analgesic Potential Of The Mimosa Pudica L. Leaf Decoction Using The Primary Dysmenorrhea Mouse Model, Paula Bianca D. De Guzman, Maria Dalisay G. Maligalig Jan 2024

Analgesic Potential Of The Mimosa Pudica L. Leaf Decoction Using The Primary Dysmenorrhea Mouse Model, Paula Bianca D. De Guzman, Maria Dalisay G. Maligalig

Journal Article

Primary dysmenorrhea, a common menstrual pain, is often treated with nonsteroidal anti- inflammatory drugs (NSAIDs), which may cause side effects. In contrast, herbal medicine, such as Mimosa pudica L., has been used in the Philippines due to its accessibility and reportedly fewer side effects. This study investigated the analgesic potential of an aqueous M. pudica leaf decoction in a primary dysmenorrhea mouse model. Phytochemical analysis of the extract was also conducted and results revealed the presence of alkaloids, flavonoids, saponins, tannins, sterols, triterpenoids, and glycosides. Twenty sexually mature female ICR mice (Mus musculus) were orally pretreated with estradiol valerate for …

Journal Article

This study examines the variation and abundance of calcium oxalate (CaOx) crystals in Amorphophallus longispathaceus Engl. & Gehrm., a species of economic interest known for its acridity due to CaOx crystals. These crystals play key roles in defense and calcium regulation. The study quantifies the abundance, morphology, and length-to-width ratio of raphide bundles across different tissues. Samples from five individuals were analyzed microscopically, revealing diverse CaOx crystal forms, including raphides, styloids, druses, and atypical structures in the lamina, petiole, and corm. Raphide bundles were most abundant in the corm, followed by the lamina and petiole, with significant differences in distribution …

Engelson V. Dignity Health, 139 Nev. Adv. Op. 58 (Dec. 28, 2023), Javiera Sothers

Nevada Supreme Court Summaries

The Nevada Court of Appeals determined that the accrual date of a professional negligence action’s statute of limitations is ordinarily determined as a matter of fact. However, if there is irrefutable evidence of such a date, a court can determine it as a matter of law. The Court also held that a wrongful death claim is sufficiently alleged if it alleges that (1) the defendant’s wrongful act or neglect caused the wrongful death and (2) the person bringing the claim is the heir or the personal representative of the decedent. Next, the Court determined that NRS 41A.071 does not require …

Highroller Transportation, Llc V. Nevada Transportation Authority, 139 Nev. Adv. Op. 51 (Nov. 30, 2023), Ciara Clark

Nevada Supreme Court Summaries

There is now clarification on the application of the waiver rule in the context of administrative law, specifically in cases before the Nevada Transportation Authority (hereinafter “NTA”). The Court held that arguments not raised during administrative proceedings are generally considered waived and cannot be introduced in later judicial reviews. This decision emphasizes the importance of presenting all relevant arguments and issues at the earliest stage of administrative proceedings.

Conflicts Of Law And The Abortion War Between The States, Paul S. Berman, Roey Goldstein, Sophie Leff Jan 2024

Conflicts Of Law And The Abortion War Between The States, Paul S. Berman, Roey Goldstein, Sophie Leff

GW Law Faculty Publications & Other Works

On the subject of abortion, the so-called “United” States of America are becoming more disunited than ever. The U.S. Supreme Court’s precipitous decision in Dobbs v. Jackson Women’s Health Organization overturned the nationwide framework for abortion rights that had uneasily governed the country for fifty years. In the immediate aftermath of that decision, it is becoming increasingly clear that states governed by Republicans and those governed by Democrats are moving quickly and decisively in opposite directions. Since the U.S. Supreme Court agreed to hear the Dobbs case, at least twenty-four states have enacted statutes or state constitutional provisions restricting abortion …

The Centennial Of Meyer And Pierce: Parents’ Rights, Gender-Affirming Care, And Issues In Education, Ira C. Lupu

GW Law Faculty Publications & Other Works

This paper was prepared for a Symposium marking the centennial of the Supreme Court’s decisions in Meyer v. Nebraska (1923) and Pierce v. Society of Sisters (1925). At their inception, Meyer and Pierce reflected constitutional principles of economic freedom and parental control of their children’s education. Part I traces the path of ideas put in motion by Meyer and Pierce. These include the decline of their economic freedom component and the broader grounding of their doctrines of parental authority. Eventually, the chameleon-like legacy of Meyer and Pierce stretched to include First Amendment concerns of religious exercise and knowledge acquisition, as …

The Sentinel Stirs: Government Procurement Law After Loper Bright Enterprises, Christopher R. Yukins, Kristen Ittig, Nicole Williamson

GW Law Faculty Publications & Other Works

Administrative law – and by extension, government procurement law – is in a period of transition in the United States. The judiciary, sometimes alarmed by the perceived excesses of the administrative state, is reexamining the deference traditionally afforded agency interpretations of law. As part of that transition, the Supreme Court in Loper Bright Enterprises v. Raimondo (June 2024) overruled the test it first established in Chevron v. Natural Resources Defense Council (1984), which held that if a statute was ambiguous, the courts would defer to an agency’s reading of that statute so long as the agency’s interpretation was reasonable. This …

Causing Or Risking Climate Catastrophe, Donald Braman, Aaron Regunberg, David Arkush Jan 2024

Causing Or Risking Climate Catastrophe, Donald Braman, Aaron Regunberg, David Arkush

GW Law Faculty Publications & Other Works

This Essay explores the potential criminal liability of major fossil fuel companies (FFCs) under state laws prohibiting reckless conduct that causes or risks catastrophe. Using Pennsylvania's criminal code § 3302 as a case study, we argue that FFCs' decades-long pattern of deceptive conduct regarding climate change—continuing to aggressively market and sell fossil fuels while actively concealing and denying the catastrophic risks their own scientists had identified—constitutes criminal behavior under these statutes. We demonstrate how FFCs' actions satisfy the key elements of these crimes: they created risks of catastrophe through their emissions and disinformation campaigns, acted recklessly in doing so given …

Developing A Professional Identity: Lessons For Women, Bipoc, And First Generation Law Students From The Canaries In The Coalmines, Christine Venter

Journal Articles

From the Article

This Article explores the concept of professional identity formation in the law, particularly as it pertains to women and lawyers of color. The topic of professional identity formation is an understudied area in legal education, despite the ABA’s new Standard 303(b)(3), which requires law schools to provide substantial opportunities for the development of professional identity. In the legal field, professional identity is often conflated with professionalism, which leads to confusion about how law schools should best prepare their students for their professional lives, and fails to fully equip students to join the profession.

How American Sports Leagues Can Respond To The Rise Of Sovereign Wealth Funds, Chris Chen Jan 2024

How American Sports Leagues Can Respond To The Rise Of Sovereign Wealth Funds, Chris Chen

Emory Business Law Review

This Comment explores the transformative impact of well-funded Middle Eastern sports leagues on the global landscape of professional sports. Fueled by substantial financial support from sovereign wealth funds, these leagues have raised concerns about the possibility that domestic American players may choose to leave their current league in favor of one of the opportunities for more lucrative salaries overseas. The rise of LIV Golf catalyzes these discussions. This Comment also delves into how American sports leagues may respond by potentially allowing players to have equity stakes, engage in sponsorships with gambling websites, and participate other revenue-sharing arrangements. The potential corporate …

Food For Thought: Fabricating The Cannibal In Colonization, Hannah Dubrovich Jan 2024

Food For Thought: Fabricating The Cannibal In Colonization, Hannah Dubrovich

Theses and Dissertations

Anthropophagy means people-eating, as does cannibal, but the terms are not synonymous. After Europeans landed in the Americas, Christopher Columbus coined the word cannibal. Despite the two terms having similar base definitions, there are additional connotations associated with cannibal. The way in which cannibalism has been thought about by Western cultures is not about the act of people-eating, but the constructed character of the cannibal as a “savage” Other created through colonization. In addition to the term's associated meaning being cemented during this time, colonizers used the term as a tool to Other Native peoples and aid in colonization. It …

Consumption of ergot alkaloids during the second half of gestation has been shown to decrease umbilical artery vasoactivity resulting in decreased birth weights. Negative vascular effects of ergot alkaloids are mediated predominantly through serotonergic and adrenergic receptors in other tissues. Vasoactivity of serotonin (5-HT) receptors 5-HT2A and 5-HT1B/1D in umbilical artery and vein from ewes receiving endophyte-infected seed (E + 1.77 mg ergovaline/hd/d) or a control total mixed ration (CON; 0 mg ergovaline/hd/d) tall fescue seed at d-110 and d-133 of gestation was evaluated. Gravid reproduction tracts were collected from ewes. Two-mm sections of umbilical artery and vein …
