American Indian Census Rolls: An Underutilized Source Of Historical Demographic Information On Tribal Populations, David Swanson, Jeff Tayman
American Indian Census Rolls: An Underutilized Source Of Historical Demographic Information On Tribal Populations, David Swanson, Jeff Tayman
Publications, Reports and Presentations
Historical information on tribal populations in the United States is incomplete. American Indians and Alaska Natives were not enumerated with the general population until the 1940 decennial census. However, Indian Census Rolls were produced for the period 1885 – 1940 under the auspices of the Bureau of Indian Affairs in the U.S. The information given in the Indian Census Rolls varies but usually includes the roll number, age, gender, tribal identity, and relationship to the head of the family. In this paper, we present background information on Indian Census Rolls and demonstrate how the digitized microfiche census roll schedules can …

Homozygous familial hypercholesterolemia (HoFH) is an ultra-rare inherited condition that affects approximately one in 300,000 people. The disorder is characterized by extremely high, life-threatening levels of low-density lipoprotein (LDL) cholesterol from birth, leading to significant premature cardiovascular morbidity and mortality, if left untreated.
Homozygous familial hypercholesterolemia is severely underdiagnosed and undertreated in the United States (US), despite guidelines recommendations for universal pediatric lipid screening in children aged 9–11. Early diagnosis and adequate treatment are critical in averting premature cardiovascular disease in individuals affected by HoFH. Yet, an unacceptably high number of people living with HoFH remain undiagnosed, misdiagnosed, and/or receive …

Purpose: Structured HCT models addressing planning, transfer, and integration into adult care for adolescents and young adults with childhood-acquired chronic conditions are becoming more prevalent. However, consensus on outcome measures to assess health care transition (HCT) interventions particularly for intellectual and developmental disabilities (IDD) population is lacking. This scoping review identified potential HCT outcome measures for young adults (aged 18-26) with IDD using the Quadruple Aim Framework.
Methods: On August 6, 2021 and April 27, 2023, Medline Ovid, Embase, Web of Science, PsycINFO, and Cochrane databases were searched using the terms "young adult," "intellectual disability," "developmental disability, "cognitive dysfunction," "autism," …

Background: Idiopathic pulmonary fibrosis (IPF) is the result of multiple cycles of epithelial cell injury and fibroblast activation; currently, there is no clear etiology. Increasing evidence suggests that protein metabolism and amino acids play a crucial role in IPF, but the role of D-amino acids is not yet clear. The aim of this study was to identify novel mediators in order to test the hypothesis that D-amino acid oxidase (DAO) plays a significant role in the pathogenesis of IPF.
Methods: We analyzed DAO gene expression in patients with IPF and mice with bleomycin (BLM)-induced lung fibrosis. We performed in vitro …

Background: As the number of thrombectomy passes increases during endovascular therapy (EVT) for acute stroke, neurointerventionalists must weigh the risks of potential complications against the risk of failing to recanalize the affected vessel. Thus, we investigated the effectiveness and safety of EVT for patients with acute stroke in which ≥5 EVT passes were performed.
Methods: This retrospective cohort study from January 2013 to December 2022 included 31 thrombectomy-capable centers. Patients in whom ≥5 EVT passes were made were included in the analysis. The patients with successful recanalization defined as modified Thrombolysis in Cerebral Infarction ≥2b at 5, 6, 7, or …
The Impact Of Media On Price Paid For Thoroughbred Horses At Auction, Steven Anderson
The Impact Of Media On Price Paid For Thoroughbred Horses At Auction, Steven Anderson
Animal Sciences
It has been said a picture is worth a thousand words, but the economic value of that picture for livestock sales transactions has not been quantified. The objective of this study aimed to evaluate the effect of the presence of media (photos and/or video) on sale prices of Thoroughbreds. Online auction sale data from two U.S. Thoroughbred auction sites were used to compare 18,221 horses that sold and 4,215 horses that failed to meet the minimum desired bid. Sellers that provided media of their horses at auction received approximately $25,000 more for weanlings, $74,000 more for yearlings, and $89,500 more …

Type 2 diabetes (T2D) is a common forerunner of neurodegeneration and accompanying dementia, including Alzheimer's Disease (AD), yet the mechanisms underlying this comorbidity remain unresolved. Individuals of Mexican descent living in South Texas have increased prevalence of comorbid T2D and early onset AD, despite low incidence of the APOE-ε4 risk variant among the population and an absence of a similar predisposition among relatives residing in Mexico - suggesting a role for environmental factors in coincident T2D and AD susceptibility. We therefore sought to test if differences in gut community structure could be observed in this population prior to any AD …

Housing Choice, Transportation Equity, And Access To Opportunities In Refugee And Immigrant Communities, Diane Mitschke, Anne Nordberg, Stephen Mattingly, Katherine Kitchens
TREC Final Reports
Mobility directly impacts access to opportunities for all protected classes; however, transportation planning and public transit agencies and housing authorities rarely coordinate affordable housing and the transportation system planning decisions. This lack of coordination often leads to mismatches between access to opportunities and affordable housing. Safe access to employment, quality schools, and healthcare represent a few of the many factors that may influence housing choice. For most households with budget constraints, all of these factors may not be achievable. While existing research documents the mismatch between affordable housing and access to opportunities, the role that mobility plays in residential selection …

Fight, Flight, Freeze: How Access To Support Shapes Tenant Responses To Eviction In Multnomah County, Natalie J. Cholula, Lisa K. Bates, Alex Farrington, Marisa Zapata, Colleen Carroll, Jacen Greene, Hadley Bates
Urban Studies and Planning Faculty Publications and Presentations
Facing eviction is a traumatic event that forces tenants into a fight, flight or freeze response. Our focus groups with Multnomah County tenants reveal that their responses to eviction are directly shaped by their access to support. Many tenants are unable to access formal support and therefore respond to eviction by freezing up or fleeing their home. Conversely, tenants who can access formal support—including rental assistance or legal assistance—exhibit a fight response, leveraging external support to challenge or avoid their eviction.

Drawing on focus groups with 101 Oregon tenants who have experienced an eviction since the onset of the COVID-19 pandemic, this report examines the role that discrimination plays in Oregon evictions. As this is not a legal investigation, we do not focus solely on legally-actionable or provable claims. Rather, we include a wide range of tenants’ descriptions of their experiences with unfair, malicious, or prejudicial treatment. We find that many tenants are specifically targeted for eviction or experience prejudicial treatment during the eviction process because of their identity or background. This includes being treated unfairly based on tenants’ race, language, …
Shame And History, Bennett B. Gilbert
Shame And History, Bennett B. Gilbert
University Studies Faculty Publications and Presentations
If history—our past, the sum of our thoughts, passions, and deeds—is so pervasive, influential, and meaningful, why then do we lose sight of it? Why do we not gain good values from it? And if it is part of our existential core, why then do we so often fail to ravel it into our deliberations?
I propose that very often and to a great degree it is shame that separates us from history. Shame: garrulous, compulsive, intense, omnivorous. A shamed person pushes away the experiences that shame her, thus cutting off the past.

Executive Summary
Context for the Study
In July, 2023, Oregon legislators voted to fund research exploring the impacts of the criminalization of sex work in Oregon. Unfortunately, the Governor vetoed the budget item, stating that the private sector should fund this type of public health research and noting the need for additional public discussion about the issue. To date, there have been no attempts to study the impacts of prostitution laws on the people most impacted by them in Oregon. The research presented in this report seeks to address this gap.
This qualitative pilot study was designed to better understand …

Developmental Change In English-Learning Children’S Interpretations Of Salient Pitch Contours In Word Learning, Carolyn M. Quam, Daniel Swingley
Developmental Change In English-Learning Children’S Interpretations Of Salient Pitch Contours In Word Learning, Carolyn M. Quam, Daniel Swingley
Speech and Hearing Sciences Faculty Publications and Presentations
To efficiently recognize words, children learning an intonational language like English should avoid interpreting pitch-contour variation as signaling lexical contrast, despite the relevance of pitch at other levels of structure. Thus far, the developmental time-course with which English-learning children rule out pitch as a contrastive feature has been incompletely characterized. Prior studies have tested diverse lexical contrasts and have not tested beyond 30 months. To specify the developmental trajectory over a broader age range, we extended a prior study (Quam & Swingley, 2010), in which 30-month-olds and adults disregarded pitch changes, but attended to vowel changes, in newly learned words. …

The Legal Metaverse And Comparative Taxonomy: A Reappraisal, Ugo Mattei

The present Article revisits my “Three Patterns of Law: Taxonomy and Change in the World’s Legal Systems”—published in this very Journal a quarter century ago—which acknowledged the ideological nature of the law versus politics distinction and posited taxonomy as a means for understanding law. The original article classified law into professional law, political law, and traditional law, and heralded the tentative and dynamic natures of such classification. The two purposes of the present Article are to (i) reflect on legal transformations that have since occurred as reactions to global geopolitical, technological, and economic changes, and (ii) interrogate whether epistemological assumptions …

The rule of law in Haiti is precarious. The ESCDROJ law school clinic in the town of Jérémie champions indigent individuals whose human rights are under siege during their prolonged and unconstitutional pre-trial connement in prison. To our knowledge, it is the only operating in-house law school clinic in Ha1iti. Despite myriad obstacles, during its initial pre-pandemic period of op- eration in 2018-2019, the inaugural clinic team represented clients in 43 cases brought to trial and succeeded in garnering the release of 25 of those individuals. That is a trial release success rate of over 58%. Subsequently, however, the ad- …

The Road Not Taken: A Critical Juncture In Racial Preferences For Naturalized Citizenship, Ming Hsu Chen

In the “Free White Person” Clause of the Naturalization Act of 1790 as Super-Statute, Gabriel Jack Chin and Paul Finkelman argue that racist results in naturalization have arisen despite, or maybe because of, the race neutral interpretation. This happened in a manner that could have been predicted by the federal government’s attitudes toward non-White persons in the Naturalization Act of 1790 and the nearly unbroken chain of legal developments. This leads them to think of the law as a “super-statute.” While I agree that this is the path actually taken in history, I view the mid-1960s civil rights era as …

Legal responses to litigation funding could take many forms—consumer protection, regulation of interest rates and fees, perhaps even prohibition (as under the old doctrines of champerty and maintenance). In the U.S., procedural responses, often emphasizing disclosure of funding, have featured prominently. From the perspective of one directly involved in the U.S. rulemaking effort, this Article explores the challenges of designing such a rule. Among other things, it notes that litigation funding actually could support important law-implementation features of American litigation. But a host of uncertainties mean that for the present, the future of mandated disclosure of funding remains unclear, as …

“Legally Magic” Words: An Empirical Study Of The Accessibility Of Fifth Amendment Rights, Kate Weisburd, Roseanna Sommers

Fifth Amendment case law (including Miranda v. Arizona) requires that individuals assert their right to counsel or silence using “explicit,” “clear,” and “unambiguous” statements—or, as some dissenting judges have lamented, using “legally magic” words. Through a survey of 1,718 members of the U.S. public, we investigate what ordinary people believe it takes to assert the right to counsel and the right to silence. We then compare their perceptions against prevailing legal standards governing invocation.
With respect to the right to counsel, the survey results indicate that members of the public have a uniformly lower threshold for invocation than do courts. …

This article describes the rounds process used in clinic and externship seminars and considers how adjustments to the structure can address different needs or goals. The authors draw on teaching methods found in similar professional education programs to identify options for faculty facilitating rounds. Ultimately, the authors use externship rounds to highlight lawyering skills, including developing curiosity, withholding judgment, and generating options. The authors posit that rounds facilitate deeper self-reflection and foster a sense of community by encouraging law students to work collaboratively to consider lessons learned in fieldwork. The rounds structure overview can be assigned to students before class …

In a literary analysis of selected fiction by Philip K Dick through an ecocritical framework, the focus of this study reveals the consequences of ecological destruction on futuristic societies reflecting the Anthropocene. Drawing correlations between various texts by the author, the separation of nature from humanity demonstrates how dystopian landscapes influence the identity of the characters in these settings and how dystopia serves as a prism which distorts or reflects what it means to be human. With this, ontology and artificial intelligence are analyzed as a notable facet of his literature which addresses the progress of innovation in society and …

There have been speculations on how it is that cinema works, from editing to emotional processing of the story, but only recently have we begun to explore the inner workings of cinematic impact on the brain. In this paper we will review research on cinematic impact and define cinematic editing, discuss the birth of “neurocinematics”, highlight what we have observed with regards to neuroimaging and empathy when viewing films, and speculate on how our responses to cinema may be driven by the Mirror …
