Administrative Law's Unavailing Duties, Daniel Z. Epstein Dec 2024

Administrative Law's Unavailing Duties, Daniel Z. Epstein

Texas A&M Law Review

Through a novel empirical approach, this Article shows that legal doctrine does not determine whether federal courts provide remedies when agencies fail to enforce a statutory duty. Plaintiffs are most likely to succeed against the government when litigating statutory procedures located within agency-specific statutes and which raise major policy questions in immigration, healthcare, Native American rights, public housing, the environment, or labor. Others are more likely to lose against the government: plaintiffs litigating statutory violations involving procedures not specific to an agency, but which apply to officers and agencies throughout the bureaucracy. These cases involve duties governing ethics, transparency, recordkeeping, …

A Constitutional Right To Exclude Evidence, Colin Miller Dec 2024

A Constitutional Right To Exclude Evidence, Colin Miller

Texas A&M Law Review

The Supreme Court has held that criminal defendants have a constitutional right to introduce evidence and a constitutional right to receive evidence, but it has never recognized a constitutional right to exclude evidence. Specifically, the Supreme Court has issued numerous rulings finding that the Due Process Clause demands that (1) defendants have the right to present a defense that trumps the rules of evidence; (2) the prosecution must disclose material exculpatory evidence to the defense; (3) the State has certain duties to preserve evidence so that it can be disclosed to the defense; and (4) any discovery obligations on defendants …

Careers After Prison: Preventing Recidivism By Reforming Restrictive Licensing Regimes, Ian C. Stephens Dec 2024

Careers After Prison: Preventing Recidivism By Reforming Restrictive Licensing Regimes, Ian C. Stephens

Texas A&M Law Review

A prisoner leaving confinement in the United States is unlikely to seamlessly reintegrate into society. People leaving incarceration face a cornucopia of economic and social barriers that prevent them from easily finding secure economic footing. The well-established link between unemployment and recidivism materializes when economic circumstances drive the poor and desperate back toward crime and back into prison. This vicious circle not only rips apart families and communities but also imposes a ruinously expensive financial burden on states. Despite this cost, many states continue to bar formerly incarcerated people from their most viable opportunities to become peaceful and productive members …

Doe V. Geller And Personal Jurisdiction Over Internet Activities, Elizabeth Kruse Dec 2024

Doe V. Geller And Personal Jurisdiction Over Internet Activities, Elizabeth Kruse

Texas A&M Law Review

Personal jurisdiction is fundamental in American jurisprudence since it gives a court the power to bind parties with its ruling. Despite this subject’s mundane veneer, the concept is so complicated that it has inspired thousands of academic articles. A brief search on Westlaw under Law Reviews & Journals for the term “personal jurisdiction” yields nearly 10,000 results, while Lexis+ yields 14,662 for the same term. Even so, as the nature of human interaction has changed from in person, to in writing, to over the phone, and, most recently, to over the internet, the doctrine of personal jurisdiction has accommodated. Recent …

Administrators’ Perceptions Of Minoritized Students’ Underrepresentation In K-8 Gate, Vernice Verona Sharpe Dec 2024

Administrators’ Perceptions Of Minoritized Students’ Underrepresentation In K-8 Gate, Vernice Verona Sharpe

Walden Dissertations and Doctoral Studies

The purpose of this qualitative study was to understand SWSD administrators’ perceptions of the practices and identification criteria that exacerbated this underrepresentation, guided by a culturally responsive school leadership framework. For this basic qualitative design, eight SWSD administrators with direct knowledge of the GATE programs participated in semistructured interviews. Data analysis involved initial and axial coding, resulting in three key themes: limited cultural awareness among administrators, the importance of incorporating community perspectives, and the need to reevaluate traditional GATE identification practices. Based on these themes, it is recommended to enhance cultural competency training, to engage community members in decision-making, and …

Localization Of Synthetic Manipulations In Western Blot Images, Anmol Manjunath, Viola Negroni, Sara Mandelli, Daniel Moreira, Paolo Bestagini

Computer Science: Faculty Publications and Other Works

Recent breakthroughs in deep learning and generative systems have significantly fostered the creation of synthetic media, as well as the local alteration of real content via the insertion of highly realistic synthetic manipulations. Local image manipulation, in particular, poses serious challenges to the integrity of digital content and societal trust. This problem is not only confined to multimedia data, but also extends to biological images included in scientific publications, like images depicting Western blots. In this work, we address the task of localizing synthetic manipulations in Western blot images. To discriminate between pristine and synthetic pixels of an analyzed image, …

Evaluating The Potential Of Herbal Extracts As Treatment In Immune Thrombocytopenia: A Review Of Evidence And Limitations, Russel Wiggins, Jihoo Woo, John Nicholas Cauba, Shizue Mito

School of Medicine Publications

Immune thrombocytopenia, formerly idiopathic thrombocytopenia purpura (ITP), is an autoimmune disease characterized by the depletion of platelets below 100,000/µL when other causes of thrombocytopenia have been ruled out. It is associated with several infectious pathologies, disease states, and as a known side effect and complication of several drugs and chemotherapies. Standard treatment calls for glucocorticoid-mediated immunosuppression, intravenous immunoglobin transfusion, platelet stimulation, platelet transfusion, and splenectomy in instances of chronic and severe disease. While standard treatments are often effective, some cases prove resistant, and more commonly, some patients are unable to tolerate standard treatment protocols or opt out of surgical intervention. …

Equations To Predict Carbon Monoxide Emissions From Amazon Rainforest Fires, Sarah M. Gallup, Bonne Ford, Stijn Naus, John L. Gallup, Jeffrey R. Pierce

Economics Faculty Publications and Presentations

Earth systems models (ESMs), which can simulate the complex feedbacks between climate and fires, struggle to predict fires well for tropical rainforests. This study provides equations that predict historic carbon monoxide emissions from Amazon rainforest fires for 2003–2018, which could be implemented within ESMs’ current structures. We also include equations to convert the predicted emissions to burned area. Regressions of varying mathematical forms are fitted to one or both of two fire CO emission inventories. Equation accuracy is scored on r2, bias of the mean prediction, and ratio of explained variances. We find that one equation is best …

Theoretical Trends Of Islamic Banking: A Critical Reading, Abduljabbar Al-Sabhany Dec 2024

Theoretical Trends Of Islamic Banking: A Critical Reading, Abduljabbar Al-Sabhany

Journal of King Abdulaziz University: Islamic Economics

Moving away from usurious lending, in which the borrower bears the risk of the loan, to almudaraba and participation, in which the two parties to the contract share its profits and losses, was the title of the emerging Islamic banking, where its project and its contracting system were prepared through individual initiatives. However, as soon as Islamic banks were established, professional considerations began to dominate the leadership of banking practice, specifically in the field of risk management. It led to a decisive transformation that would bring Islamic banks back into the Indebtedness system but through financing sales. Just as this …

Escaping The Pedagogical Cabin In The Woods, Tony Kemerly, Davis Ritenour Dec 2024

Escaping The Pedagogical Cabin In The Woods, Tony Kemerly, Davis Ritenour

Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy

The American educational system, because of its seemingly innocuous yet ubiquitous nature, has become, to borrow a term from Roland Barthes, naturalized. By being naturalized, it has become a system that has somehow slipped beneath the radar of the American populace and operates on an autopilot of sorts that allows it to employ practices that don’t necessarily have the best interests of its constituents at heart. Murray Rothbard (1979) argued that compulsory schooling is not guided by altruism, but rather a desire to coerce the population into a mold that is desired by those possessing power in society. This need …

Seeing The Strange: Science Fiction, Critical Pedagogy, And Future Teachers, Jeremy Delamarter Dec 2024

Seeing The Strange: Science Fiction, Critical Pedagogy, And Future Teachers, Jeremy Delamarter

Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy

Critical pedagogy, which is the branch of critical theory devoted to uncovering hidden power differentials in educational settings, is too often taught in abstract terms, and future educators fail to understand its relevance to praxis in their future classrooms. As a genre, science fiction is particularly adept at helping students consider the power structures and dynamics occasioned by scientific advances. Even more specifically, science-fiction is a powerful tool for teaching future educators the fundamentals of critical pedagogy. This article provides a philosophical exploration of why science fiction is such a useful tool for teaching critical pedagogy and uses the specific …

Comparison Of Efficacy Between Thai-Made Replacement Parts (Smart Litho Plus) And Standard Electromagnetic Shock Wave Systems For Renal Stone Treatment, Supoj Ratchanon, Patranuch Noppakulsati

Chulalongkorn Medical Journal

Abstract

Background: Urinary stones are one of the most common urological problems in Thailand. Extracorporeal shock wave lithotripsy (ESWL) is one of the most frequently used treatments due to its noninvasive nature and widespread availability. However, the effectiveness of lithotripters with power sources produced in Thailand (Smart Litho Plus) compared with that of standard machines is poorly established. Therefore, we aim to compare the efficacy of Thai-made replacement parts with that of standard electromagnetic shock wave systems for the treatment of renal stones.

Methods: We conducted a multicenter retrospective cohort study involving 121 patients with renal stones across three sites …

Magnetized Neutral 2sc Color Superconductivity And Possible Origin Of The Inner Magnetic Field Of Magnetars, Shuai Yuan, Efrain J. Ferrer, Alejandro Pinero

Physics & Astronomy Faculty Publications

In this paper, the neutral 2SC phase of color superconductivity is investigated in the presence of a magnetic field and for diquark coupling constants and baryonic densities that are expected to characterize neutron stars. Specifically, the behavior of the charged gluons Meissner masses is investigated in the parameter region of interest, taking into account, in addition, the contribution of a rotated magnetic field. It is found that up to moderately high diquark coupling constants the mentioned Meissner masses become tachyonic independently of the applied magnetic-field amplitude, hence signalizing the chromomagnetic instability of this phase. To remove the instability, the restructuring …

Faculty Research, Scholarly, and Creative Activity

Script training is a speech-language intervention designed to promote fluent connected speech via repeated rehearsal of functional content. This type of treatment has proven beneficial for individuals with aphasia and apraxia of speech caused by stroke and, more recently, for individuals with primary progressive aphasia (PPA). In the largest study to-date evaluating the efficacy of script training in individuals with nonfluent/agrammatic primary progressive aphasia (nfvPPA; Henry et al., 2018), robust treatment effects were observed, with maintenance of gains up to one year post-treatment. However, outcomes were constrained to measures of script accuracy, intelligibility, and grammaticality, providing a limited view of …

A (Great) Many Of Many Constructions, Jim Wood, Squid Tamar-Mattis Dec 2024

A (Great) Many Of Many Constructions, Jim Wood, Squid Tamar-Mattis

Yale Working Papers in Grammatical Diversity

In this paper, we discuss a series of constructions across various English dialects involving the word many, drawing examples from the Dictionary of American Regional English (DARE) and web searches. The constructions include both standard and colloquial forms, including formally singular and plural constructions, as well as those employing a lot of and a great many. We connect these constructions to existing linguistic analyses, particularly those proposed by Kayne (2002, 2006, 2007a,b, 2017).
