Identifying Higher Education Employee Experiences Using A Diffusion Of Innovations Checklist Planning For Knowledge Management Implementation: A Phenomenological Study, Eric Christopher Viets

Doctoral Dissertations and Projects

The purpose of this transcendental phenomenology study was to understand the experiences of higher education employees planning to implement knowledge management through utilizing a diffusion of innovations checklist. Knowledge management is generally defined as the process of creating, sharing, using, and managing the knowledge and information of an organization. The theory guiding this study was the diffusion of innovations by Everett M. Rogers, as it provided a clear and comprehensive model of the stages of change and knowledge management implementation. The research questions sought to understand the experiences of ten higher education employees utilizing the diffusion of innovations checklist within …

After The Training Ends: A Qualitative Study Of Therapists’ Experiences With Trauma Training And Self-Efficacy, Megan L. Briggs

Doctoral Dissertations and Projects

Counselors meet many clients with experiences of trauma throughout their careers, and many counselors do not feel confident in their skills to process trauma. The training programs that teach trauma-focused skills have been researched regarding dissemination practices, but there has been very little exploration of the experiences of the individuals who do not utilize newly acquired skills. The primary research question asks what are the experiences of outpatient therapists in applying the skills they learned in trauma processing training programs when practicing in the outpatient setting? The purpose of this phenomenological qualitative study will be to describe the experiences of …

Contact Refusal In Children And Adolescents Post-Parental Separation, Ashten N. Gallagher Dec 2024

Contact Refusal In Children And Adolescents Post-Parental Separation, Ashten N. Gallagher

Doctoral Dissertations and Projects

The purpose of this phenomenological study was to explore and understand the underlying themes in contact refusal between a parent and a child through a developmentally sensitive lens. This study examines how trauma, relational dynamics, and developmental stages influence a child’s refusal to engage with a parent post-separation or divorce. The theories guiding this research include Erikson’s psychosocial development stages (Erikson, 1950, 1968), which highlight how children’s developmental needs and challenges impact their relational attachments. Additionally, the diagnostic framework for complex posttraumatic stress disorder (CPTSD) as outlined by the World Health Organization’s International Classification of Diseases 11 (Cloitre et al., …

A Transcendental Phenomenology Study On Teacher Experiences And Perspectives On The Efficacy Of Trauma-Informed Practices In Public Schools With Students With Behavior Intervention Plans, Elaina Marie Lawrence Dec 2024

A Transcendental Phenomenology Study On Teacher Experiences And Perspectives On The Efficacy Of Trauma-Informed Practices In Public Schools With Students With Behavior Intervention Plans, Elaina Marie Lawrence

Doctoral Dissertations and Projects

The purpose of this phenomenological study was to understand public school teachers’ lived experiences and perceptions of the efficacy of trauma-informed practices for students with Behavior Intervention Plans (BIPS) within the Desert Coral Independent School District (DCISD). Due to the complexities that trauma has on personal, social, and cognitive development, Vygotsky’s theory on the zone of proximal development (ZPD) frames this study to combine the relationship between the stages of child development, trauma, and self-determination. ZPD provides a relational model of emergent interactive agency for students with BIPs. It highlights reactions to observation, modeling, and emulating behaviors, attitudes, and emotional …

The Blessing And The Promise: Paul's Covenantal Framework As The Foundation For Galatians 3:14, Eric L. Williams Dec 2024

The Blessing And The Promise: Paul's Covenantal Framework As The Foundation For Galatians 3:14, Eric L. Williams

Doctoral Dissertations and Projects

This dissertation examines the relationship between the blessing of Abraham and the promise of the Spirit in Galatians 3:14. When Paul wrote these words to the Galatians, he did not intend to communicate two distinct, bifurcated concepts. Rather, he uses the two ἵνα clauses to bring depth of understanding to a singular idea. Paul spoke of the blessing of Abraham and the promise of the Spirit in a homogeneous manner, describing one main concept from two distinct angles, much like one would describe two sides of the same coin. It is argued that Paul was able to make such connections …

Ensuring Careful Interpretation And Application Of The Bible Through The Lens Of The Covenants, James Kenneth Rainwater Dec 2024

Ensuring Careful Interpretation And Application Of The Bible Through The Lens Of The Covenants, James Kenneth Rainwater

Doctoral Dissertations and Projects

For centuries, believers in Jesus Christ have turned to the Bible to discover His will for their life. For the most part, this discovery has resulted in joy and significance and has benefited the journeys of millions. However, there have been many examples where the misunderstanding and misinterpretation of the Bible has brought about devastating consequences. Wolves have crept in and used the Bible for their own nefarious purposes. This paper offers a bridge for believers to navigate many of the difficult passages of the Bible and their behavioral application. Specifically, this is achieved through a closer look at how …

Physiological Response To Resisted Plyometric Training On Swimmers Sprint Swim Abilities, David Newman Dec 2024

Physiological Response To Resisted Plyometric Training On Swimmers Sprint Swim Abilities, David Newman

Doctoral Dissertations and Projects

This study used a casual comparative/quasi-experimental research design to determine whether resisted plyometric training has a more significant effect than non-resisted plyometric training on competitive teenage swimmers’ power and speed. Twelve swimmers were randomly assigned to a resisted group (n = 6, age: 14.5 ± 0.96 years; G (RES)) and an unresisted group (n = 6, age 14.17 ± 1.77 years; G UNRES). In both RES and UNRES groups the plyometric training consisted of lateral box step-ups and squat jumps before swim training twice per week. Pre and post-tests consisted of a power test (vertical jump via Vertical Jump Challenger) …

Hellenic Cohesion: A Historic Approach To Transnationalism, Particularism, And Cosmopolitanism In The Greek Immigrant Communities Of Wyoming, Patrick Michael Pace Dec 2024

Hellenic Cohesion: A Historic Approach To Transnationalism, Particularism, And Cosmopolitanism In The Greek Immigrant Communities Of Wyoming, Patrick Michael Pace

Doctoral Dissertations and Projects

Greek immigration to the United States began slowly in the late nineteenth century but found its stride by the second decade of the twentieth century. Behind the incrementally increasing numbers of Greeks emigrating from Greece was an economic collapse related to a mismanaged agricultural industry, leading mostly young men to pursue economic reward abroad in support of families and villages back home. Most early Greek migrants anticipated an eventual return home; however, many moved beyond simple sojourning into permanent settlement for a variety of reasons, including the establishment of proprietorships, the building of families, and nativist driven anti-immigrant legislation. For …

Assessing A Reading Score's Ability To Predict Pta Program Student Success, Tiffany H. Bain

Doctoral Dissertations and Projects

Admission into a physical therapist assistant (PTA) program continues to be highly competitive, with consistently more applicants than available seats. Student success is essential for maintaining CAPTE accreditation. There is limited research on admission criteria and predictors of success in physical therapist assistant education. This study aimed to determine if the Accuplacer or ACT reading test scores can predict student success (program completion and first-time NPTE-PTA) in a physical therapist assistant program using Astin’s input-environment-output (IEO) model as the theoretical foundation. This non-experimental logistic regression study used retrospective secondary data from an associate degree-level physical therapist assistant program 2016 through …

Wildlife Factors And Zoonotic Spillover In Sub-Saharan Africa, Bernard Mgba Dec 2024

Wildlife Factors And Zoonotic Spillover In Sub-Saharan Africa, Bernard Mgba

Doctoral Dissertations and Projects

Zoonotic spillover, the transmission of infectious pathogens from animals to humans, is a critical public health concern in Sub-Saharan Africa. This study examines the role of wildlife factors in zoonotic spillover within this region, highlighting the complex interplay between human-wildlife interactions, environmental changes, and emerging zoonotic diseases. The research underscores that Sub-Saharan Africa is particularly vulnerable due to its rich biodiversity, cultural practices involving wildlife, and socioeconomic challenges. Factors such as habitat encroachment, wildlife consumption, and inadequate health infrastructure contribute to the heightened risk of zoonotic spillover. The study employs an online survey followed with a contextual analysis, and socioeconomic …

The Role Of Customers In Strategic Information Technology (It) Initiatives, Siddharth Aggarwal Dec 2024

The Role Of Customers In Strategic Information Technology (It) Initiatives, Siddharth Aggarwal

Doctoral Dissertations and Projects

This study focused on a small organization in the United States of America. The organization has IT departments that cater to the IT needs of its internal and external customers through IT products and services. Such organizations run full life cycles of product management and product development and often face off with situations to prioritize the use of their limited resources. Ideally, organizations focus on strategic IT initiatives that might be in the company's and its customers' best interest. However, instances occur when IT-driven initiatives lose that focus and might end up diverting resources toward the latest shiny technology and …

Review Of Epidemiology, Prevention And Management Of Blood-Borne Viruses Experienced By Aboriginal And Torres Strait Islander Peoples, Katiska Davis, Eliza Lock, Laura Thum, Gemma Crawford, Roanna Lobo, Odette Aung Thein, Shane Kavanagh, Jonathan Hallett

Journal of the Australian Indigenous HealthInfoNet

This review examines the epidemiology, prevention, and management of blood-borne viruses (BBVs) experienced by Aboriginal and Torres Strait Islander peoples in Australia with a focus on hepatitis B, hepatitis C, and HIV. The review highlights the disproportionate burden of BBVs among Aboriginal and Torres Strait Islander peoples in Australia, influenced by historical, social, and cultural factors stemming from colonisation. Key findings include higher prevalence rates of hepatitis B and C compared to non-Indigenous Australians, with some progress in reducing new infections through vaccination and treatment programs. However, significant gaps remain in screening, linkage to care, and treatment uptake. The review …

State V. Boilard: Are Jury Instructions On Statutory Defenses Essential To A Fair Trial?, Kristin A. Gustafson Dec 2024

State V. Boilard: Are Jury Instructions On Statutory Defenses Essential To A Fair Trial?, Kristin A. Gustafson

Maine Law Review

In State v. Boilard, the Maine Supreme Judicial Court, sitting as the Law Court, recently addressed the question of when the failure to instruct the jury regarding a defense available under the Maine Criminal Code constitutes error. The court held that the trial court's failure to give an instruction on the defense of justification did not rise to the level of obvious error. The court reasoned that because the instruction conflicted with the defendant's theory of defense, and because counsel for the defendant did not claim error at trial or on appeal, any argument that the defendant had been prejudiced …

The Primacy Method Of State Constitutional Decisionmaking: Interpreting The Maine Constitution, Glen S. Goodnough Dec 2024

The Primacy Method Of State Constitutional Decisionmaking: Interpreting The Maine Constitution, Glen S. Goodnough

Maine Law Review

The past fifteen years have witnessed the steady growth of both the theory and practice of state constitutional law. Initial inquiry focused on whether state supreme courts should provide their residents more expansive substantive and procedural rights under their state constitutions than required by United States Supreme Court interpretations of the federal Constitution. Given the plethora of state constitutional decisions expanding rights beyond the federally required minimum, or "floor," it is apparent that a large number of state supreme courts have settled the question of whether they will in fact interpret their state constitutions in such a manner. Nevertheless, lingering …

Federal Agency Nonacquiescence: Defining And Enforcing Constitutional Limitations On Bad Faith Agency Adjudication, Christopher C. Taintor Dec 2024

Federal Agency Nonacquiescence: Defining And Enforcing Constitutional Limitations On Bad Faith Agency Adjudication, Christopher C. Taintor

Maine Law Review

A leading authority in the field of administrative law has posited that "[t]he availability of judicial review is the necessary condition, psychologically if not logically, of a system of administrative power which purports to be legitimate, or legally valid." There is no question that judicial review is an imperfect check on agency action: it is susceptible to criticism for, on the one hand, the excessive limitations on its exercise, and on the other for the arguably inferior level of understanding from which courts must approach matters uniquely within the competence of particular administrators. Nonetheless, the courts remain "the acknowledged architects …

Emerging Protection Against Retaliatory Discharge: A Public Policy Exception To The Employment At-Will Doctrine In Maine, Andre D. Bouffard Dec 2024

Emerging Protection Against Retaliatory Discharge: A Public Policy Exception To The Employment At-Will Doctrine In Maine, Andre D. Bouffard

Maine Law Review

The job security of approximately sixty percent of Maine's civilian labor force has traditionally been, and continues to be, governed by the employment at-will doctrine. In its traditional form, the doctrine allows employers to discharge employees, whose employment contract is for an indefinite length, for good cause, no cause, or bad cause. Similarly, the employee is free to terminate the employment relationship at any time. Courts and commentators have pointed out that the symmetry and logical appeal of the contractual principle of mutuality of obligation is the central doctrinal underpinning of the rule. Because the employment at-will doctrine was consistent …

Handicapped Workers: Who Should Bear The Burden Of Proving Job Qualifications?, June Zellers Schau Dec 2024

Handicapped Workers: Who Should Bear The Burden Of Proving Job Qualifications?, June Zellers Schau

Maine Law Review

Joining a growing number of jurisdictions in 1973, the Maine Legislature amended the fair employment sections of the Maine Human Rights Act (the MHRA) to extend equal employment opportunity protection to all physically disabled workers. Nearly a decade later the Maine Supreme Judicial Court, sitting as the Law Court, defined unlawful employer treatment of handicapped workers in Maine Human Rights Commission v. Canadian Pacific, Ltd. The Law Court held that an employment decision based on a worker's handicap constitutes an admission of discrimination that shifts the burden of persuasion to the employer to prove either that all workers with similar …

The Gulf Of Maine Case And The Future Of Ocean Boundary Delimitation, Edward Collins Jr., Martin R. Rogoff Dec 2024

The Gulf Of Maine Case And The Future Of Ocean Boundary Delimitation, Edward Collins Jr., Martin R. Rogoff

Maine Law Review

On October 12, 1984, a Chamber of the International Court of Justice handed down its decision in the Case Concerning the Delimitation of the Maritime Boundary in the Gulf of Maine Area (Can. v. U.S.). By a vote of four to one, the Chamber described in geodetic lines the course of the single maritime boundary that divides the continental shelf and exclusive fishery zones of Canada and the United States in that area. The Chamber's decision ended more than a decade of conflict between the two countries concerning jurisdiction over continental shelf and fishery resources in the Georges Bank area. …

The Waiver Problem In Maine Real Property Foreclosure Law: A Commercial Paper Perspective, Dennis M. Patterson Dec 2024

The Waiver Problem In Maine Real Property Foreclosure Law: A Commercial Paper Perspective, Dennis M. Patterson

Maine Law Review

When a mortgagee accepts from a mortgagor payment of part of a mortgage arrearage, does the mortgagee then waive its right to foreclose? Many bank counsel will say that the mortgagee does waive its right to foreclose, and they will point for authority to the broad holding of Savings & Loan Association of Bangor v. Tear. In that decision, the Maine Supreme Judicial Court, sitting as the Law Court, seemed to hold that a mortgagee waives its right to foreclose if it accepts tender of a late payment. This broad interpretation of the Savings & Loan decision has proven to …

Perreault V. Parker: Findings Tainted By Error, Gisele M. Nadeau Dec 2024

Perreault V. Parker: Findings Tainted By Error, Gisele M. Nadeau

Maine Law Review

An appellate court does not disturb a trial court's findings of fact unless they are clearly erroneous, and, therefore, usually confines its review to an assessment of a trial court's legal conclusions based on those findings of fact. The method used by a trial court in making factual findings, however, involves the application of legal principles. If a trial court fails properly to apply these legal principles in arriving at its findings of fact, these findings may be tainted by the error. This is so, for instance, when a trial court's findings of fact have been "manifestly influenced or controlled" …

Wilderness, Trust, And Finality: The Baxter State Park Snowmobile Dispute, Ellen Kandoian, Brooke E. Barnes Dec 2024

Wilderness, Trust, And Finality: The Baxter State Park Snowmobile Dispute, Ellen Kandoian, Brooke E. Barnes

Maine Law Review

The recent controversies surrounding the use of snowmobiles in Baxter State Park exemplify the human essence of the trust relationship and the law's awkwardness in addressing the inherently nonlegalistic principles of trust. Baxter State Park is an area of 201,018 acres in northern Maine, purchased by former Governor Percival Proctor Baxter and then donated to the State of Maine in trust. The park includes Mount Katahdin, the highest mountain in Maine and the head of the Appalachian Trail. As Chief Justice McKusick wrote in a recent decision construing the trust, "in its combination of size, uniqueness, permanence, and vision, his …
