Non-Compete Clauses Mysteriously Appearing Out Of Thin Air: The Catastrophic Flaws Of Inevitable Disclosure Doctrine In The New Ftc Non-Compete Rule And Beyond, Bradford P. Anderson Dec 2024

Non-Compete Clauses Mysteriously Appearing Out Of Thin Air: The Catastrophic Flaws Of Inevitable Disclosure Doctrine In The New Ftc Non-Compete Rule And Beyond, Bradford P. Anderson

Southern Illinois University Law Journal

The Federal Trade Commission (FTC) recently adopted a new regulation that prohibits non-compete clauses for employees (Non-Compete Rule). Simultaneously, the FTC allowed the inevitable disclosure doctrine to continue in existence, even though such doctrine is tantamount to a non-compete clause. Under the inevitable disclosure doctrine, an employer posits that an employee will be unable to abide by her/his confidentiality obligations, and therefore unable to resist use and disclosure of proprietary information at an alternative employer. As a result, prescient, mind-reading judges portend future conduct under the inevitable disclosure doctrine and can issue an order banning or restricting future employment, thereby …

Toward A Better Understanding Of Mail Balloting: The Case Of U.S. Labor Union-Representation Elections, Rafael Gely, Leonard Bierman, Timothy Chandler

Louisiana Law Review

The issue of how people vote in elections is important and timely. This Article examines this issue from the perspective of whether people vote by mail—i.e., mail balloting—or in person on a designated election day—i.e., in-person voting. It explores the pros and cons of mail balloting versus in-person voting from a general political perspective and in the context of elections for labor union representation in the United States. It presents heretofore unreported data on the use of mail balloting in union-representation elections. It then draws lessons from these data concerning how mail balloting—which has increased in use since the COVID-19 …

Enhancing Dignity Amongst Persons With Dementia Through Occupational Engagement, Habeeba Ahmed, Amy Lyons-Brown Ms, Otd, Otr/L

Fall 2024 OTD Capstone Symposium

Dementia is a cognitive impairment that impacts an individual's memory, judgement, safety awareness, and emotions which can interfere with their activities of daily living. As the condition progresses, the person living with dementia (PLWD) may require a care partner to help them complete their daily tasks. Having a care partner and being a care partner can be challenging for both, the PLWD and their care partner, as there begins to be a shift in their independence. The PLWD must rely on their care partner to help them throughout their day, leading to a decrease in independence and occupational engagement. When …

A Right To Be Heard: A Proposal For Independent Victim’S Counsel For Sexual Assault Survivors, Madelyn Hayward Dec 2024

A Right To Be Heard: A Proposal For Independent Victim’S Counsel For Sexual Assault Survivors, Madelyn Hayward

Southern Illinois University Law Journal

In the last two decades, there have been several helpful and progressive reforms dedicated to changing the landscape of sexual violence. Yet, survivors of sexual assault lack a voice in the criminal justice process. The support offered by victim advocates and coordinators allows victims to be seen but not heard by the court. This Note contends that the progressive step the criminal justice system must take is an independent victim’s counsel program similar to the United States military. This Note proposes model legislation establishing an Independent Victim’s Counsel program in federal and state criminal justice systems. It is time for …

Waves Of Change: A Call To Federally Safeguard Against Climate-Driven Floods, Trevor Johnson Dec 2024

Waves Of Change: A Call To Federally Safeguard Against Climate-Driven Floods, Trevor Johnson

Southern Illinois University Law Journal

The average flood event in the United States costs Americans $4.7 billion. Flood events have become more frequent, widespread, and of longer duration due to climate change. The United States attempts to combat the emerging threat of flooding through federal and private insurance programs. Still, as flooding risk rises, property owners are burdened by the responsibility to assess and prepare for these risks independently since standard homeowners’ and renters’ insurance does not cover flood damage under any circumstances in the United States. Rural communities are particularly vulnerable to the impacts of climate change due to economic foundations that are intricately …

Discharge-To-Water Level Conversion Using Monthly Duration Curves (Dwl-Mdc): Enhancing The Utility Of The Geoglows Ecmwf Hydrological Model, Darlly Judith Rojas Lesmes

Theses and Dissertations

Flood early warning systems are crucial for disaster risk reduction strategies, enabling communities to take timely action against threats. However, the effectiveness of these systems depends on accurate and timely hydrological data, particularly river discharge and water level measurements. Unfortunately, many regions, face significant challenges in obtaining hydrological data, especially discharge data due to outdated rating curves, high equipment costs, and logistical constraints. Water level measurements, by contrast, offer reduced uncertainty and are often more accessible, providing an alternative for hydrological modeling in data-scarce regions. To address these limitations, we developed and validated the Discharge-to-Water Level Conversion Using Monthly Duration …

Journal of Geriatric Emergency Medicine

Background: Older adults treated in emergency departments (EDs) are at higher risk for adverse outcomes. Using multiple facilities can worsen this issue through service duplication and poor care transitions. Veterans with dual insurance coverage can access both Veterans Health Administration (VHA) and non-VHA EDs. This study aimed to identify factors associated with non-VHA ED use among veterans.

Methods: We conducted a retrospective observational study of patients aged ≥ 65 who had primary care at the James J Peters VA Medical Center and at least one VHA or non-VHA ED visit between October 2017 and February 2020. Data were collected from …

Decoding cellular state transitions is crucial for understanding complex biological processes in development and disease. While recent advancements in single-cell RNA sequencing (scRNA-seq) offer insights into cellular trajectories, existing tools primarily study expressional rather than regulatory state shifts. We present CellTran, a statistical approach utilizing paired-gene expression correlations to detect transition cells from scRNA-seq data without explicitly resolving gene regulatory networks. Applying our approach to various contexts, including tissue regeneration, embryonic development, preinvasive lesions, and humoral responses post-vaccination, reveals transition cells and their distinct gene expression profiles. Our study sheds light on the underlying molecular mechanisms driving cellular state transitions, …

How Might One Practice? Producing Possibilities Through Co-Research As A Daily Practice Of A Minor Science, Mark Mullkoff Dec 2024

How Might One Practice? Producing Possibilities Through Co-Research As A Daily Practice Of A Minor Science, Mark Mullkoff

The Qualitative Report

Narrative practice is a broad field which includes therapy, community work, and research methods, all of which are less rigidly defined as they are connected through resonant ethics. In this paper I explore a practice I have developed in my early years as a narrative therapist asking the question, “If coming to talk to me were part of a Project— although not necessarily the first part, nor the most important part—what would that Project be called?” Through a reflexive process of aspiring towards narrative research principles of co-research, committing to relational ethics (which is grounded and contextual, rather than codified), …

Coding With Those Who Show Up: Two Methodologies On Technical Committee Work, Mark E. Eaton Dec 2024

Coding With Those Who Show Up: Two Methodologies On Technical Committee Work, Mark E. Eaton

Publications and Research

This paper considers our library’s attempt at applying a “laissez-faire leadership” model to technical committee work. Since its introduction in the 1990s, scholarship on laissez-faire leadership has historically viewed the concept very negatively. However, we argue here that many of these perspectives are straw man arguments that do not adequately consider the possibilities of a laissez-faire model. Following some dissenting voices in the literature, we would like to reclaim the laissez-faire model as a way to facilitate library technical work under certain very specific circumstances. This paper will describe the organizational context where these laissez-faire methods worked for us. Our …

Two Lies And A Truth: Perceived Credibility's Effect On The Truth Effect, Zefanya Boentoro, Carter King, Josiah Rosario Dec 2024

Two Lies And A Truth: Perceived Credibility's Effect On The Truth Effect, Zefanya Boentoro, Carter King, Josiah Rosario

Student Work

The truth effect posits that a person believes information the more they are exposed to it. This study researched the effects of perceived source credibility on the truth effect when perceptual fluency is consistent. One hundred ninety-four participants across four groups reviewed sets of information with differing repetitions and perceived credibilities; they then reported their willingness to believe the presented information. A statistically significant relationship was found between one of the sources for one set of information and the willingness to believe scores, while no relationship existed between the repetitions and willingness to believe scores.
