Forty years ago, in its most roundly-criticized criminal procedure decision in modern history, the Supreme Court, in Barefoot v. Estelle (463 U.S. 880 (1983)), a decision premised on testimony by the responses to a hypothetical of a witness who had never directly evaluated the defendant, ruled that such testimony as to future dangerousness – testimony that had concluded there was a “100% chance” the defendant would commit more crimes if released into society -- was permissible. Over a stinging dissent by Justice Blackmun, the Supreme Court had ruled in Barefoot that it was not constitutional error for psychiatrists to testify …

The Puzzle Of Floating Forum Selection Clauses, John F. Coyle, Robin J. Effron

This essay examines floating forum selection clauses—provisions linking the litigation forum to a post-contractual fact such as a party’s future principal place of business, an assignee’s location, or a unilateral designation. Categorizing floating clauses into three types, the authors analyze divergent judicial approaches to enforceability and the underlying tension between waiver and submission as theories of consent. They argue that floating clauses expose conceptual inconsistencies in personal jurisdiction doctrine, especially regarding foreseeability and due process, and highlight how courts struggle to reconcile contract principles with constitutional limits.

They identify specific brands and distinguish their products and services from the competition. Human brains treat sounds like these as categorization tools and cognitive shortcuts—ideal trademark symbols. But what about the sounds your favorite toys or electronic devices make? Or those made by a fictional character in the latest blockbuster?

This essay contextualizes the themes of breath and atmosphere in Nietzsche’s thinking, reading them in relation to certain contemporary crises and theories. Climate change and airborne pandemic challenge the tendency to position breath and atmosphere as life’s unthought background. Luce Irigaray’s phenomenological-feminist claim that Western philosophy has forgotten breath and James Nestor’s comprehensive investigation of medical, scientific, and disciplinary respiratory research programs provide contrasting frameworks for clarifying Nietzsche’s emphasis on breath as crucial to embodied human life. Face recognition systems (FRSs) that are applied by real-time applications such as border control are vulnerable to attacks such as face morphing, which blends two or more facial images into a single morphed image. The vulnerability of FRSs to many types of attacks, including both direct and indirect attacks, as well as face-morphing attacks, has garnered significant attention from the biometric field. The United States Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization marked a constitutional reckoning, with pervasive and inescapable consequences for many Americans. This article discusses this constitutional reckoning in two senses. First, it was a reckoning with the Court’s own precedent, as it overturned nearly fifty years of precedent on abortion rights. Second, it was a reckoning with the Court’s role in American society, as it raised fundamental questions about the Court’s legitimacy and its ability to protect the rights of minorities.

On the four major rivers in South Korea (Han River, Nakdong River, Geum River, and Yeongsan River), 16 weirs were installed in 2011 to secure water resources. If any group is to endure over time, individual frustrations, while inevitable, must be usually experienced as acceptable, or at least tolerable. Failing that, little would prevent the losers in these conflicts from leaving or revolting, which would be cumulatively debilitating to the group. Titin, the third most abundant filament in muscle, serves many roles. It underlies muscle stiffness and functions as a signaling hub particularly during muscular growth. The PEVK region of titin contributes to muscle stiffness and is suspected to play a role in hypertrophic signaling. Euripides’ Bacchae and its reception embody the subversion of identity that codifies my 21st-century understanding of fashion. This project is interested in this subversion and examines how characters’ identities have been portrayed through the costume choices for Dionysus in ’69, The Bacchantes, and The Backanterna. Specifically, I scrutinize the transition of compliance as a physical representation of how this play is a constant struggle of excess vs. modesty, gender binaries vs. gender fluidity, and worship vs. condemnation.

Turtles are being infected by both ectoparasites (typically leeches) and endoparasites (typically blood parasites). It is unknown what the parasite intensity is of wild Central Floridian turtles is, and what effect this parasite load has on them. In order to determine these factors wild turtles (Sternotherus odoratus, Kinosternon baurii, and Kinosternon subrubrum) were caught from two locations, Mead Botanical Gardens, and Lake Virginia. Hoop traps were used to catch the turtles, which were then sampled and released. Captured turtles went through a series of measurements as well as a blood draw before release. This is a case study examining the effects of PCB remediation on transitional floodplain forest along the Housatonic River in Western Massachusetts.
