The Difference Method Makes: Judicial Restraint And Judicial Creativity In Rana Nahid V Sahidul Chisti, Saptarshi Mandal
The Difference Method Makes: Judicial Restraint And Judicial Creativity In Rana Nahid V Sahidul Chisti, Saptarshi Mandal
National Law School Journal
Restraint and creativity are both necessary judicial attitudes. But when should judges exercise restraint in adjudication and when, creativity? This is the question posed by the Supreme Court’s 2020 split verdict in the case of Rana Nahid v Sahidul Chisti, which required the Court to decide whether Family Courts had jurisdiction over maintenance claims under the Muslim Women (Protection of Rights on Divorce) Act, 1986. By contrasting the two approaches taken by the judges to statutory interpretation in this case, the note argues that while judges should refrain from arbitrary rule making, creativity must be viewed as duty when …
Locating The 'Nanny' In Legal Theory, Akshat Agarwal
Locating The 'Nanny' In Legal Theory, Akshat Agarwal
National Law School Journal
Paid domestic workers pose a challenge to legal theorists since they occupy the unique intersection of the market and the home. While being paid for the ‘care’ they provide, their work is characterised by a high degree of informality and is usually also considered emotive. I use India as a case study to show how attempts to include paid domestic workers within formal labour law protections have been consistently unsuccessful, which demonstrates the unique nature of paid domestic work. At the same time, academic arguments for the inclusion of such workers in family law frameworks raise several practical concerns and …

One The Equal And Opposite Of The Other: More Humanity Than Christianity In "Our Sea Of Islands" And Tales Of The Tikongs, Drois Nadia Vi
Theses and Dissertations
Tongan scholar and author Epeli Hau'ofa's "Our Sea of Islands" is an influential essay in several fields including archipelagic studies, Pacific Islands studies, and transpacific studies. However, his poems and short stories have been overlooked as a parallel attempt to advocate for and influence Tongan people. The main purpose of his writings is to educate both Pacific Islanders and Westerners on the importance of putting a stop to viewing the Pacific as small, isolated, and poor. The short stories in his collection Tales of the Tikongs are both satirical and very humorous, yet these moments of satire are not just …
Portuguese Language Use Among First Generation Brazilian Immigrants In Utah County: Some Considerations About Language And Ethnic Identity, Simone Pizzio
Theses and Dissertations
The current study presents an investigation of the Portuguese language use among first generation Brazilian immigrants in Utah County. The research was carried out with 54 first generation immigrants. Several studies have shown that ethnic identity is related to shared cultural characteristics such as practices, beliefs, and languages (Liebkind, 2010; Pennycook, 2010; Reyes, 2010; Souza, 2016). This study explores the relationship between language and ethnic identity by analyzing the attitudes toward the Portuguese language, the contexts and factors that influence language choice, and the purposes for which the Portuguese language has been used by this selected group of immigrants. The …
"How Could Anyone But A Madman Have Thought This Sleeping Girl Dead?": L.T. Meade's Approach To The "Buried Alive" Literary Tradition In Support Of Death Certification Reform, Shelby Johnson
Theses and Dissertations
A March 1866 issue of The Lancet observes, "If a newspaper were in want of a startling story with which to enliven a dull copy in the 'off season,' it could not do better than select one with the heading "'Buried Alive'"("Premature Interment" 295). Stories of being buried alive gave readers of all backgrounds a thrill. However, the stories frustrated the medical and scientific communities who were quick to dismiss the threat of live burial as a possibility in a modern world. Drawing on the literary history of "buried alive" stories and medical knowledge surrounding death signs and catalepsy, this …

Understanding Obsessive Compulsive Disorder Among Racial And Ethnic Minority Groups: A Content Analysis, Tyson William Lovell
Theses and Dissertations
Historically, racial and ethnic minority (REM) communities have faced reduced access to resources for mental and emotional health issues. While research has placed a greater emphasis on REM experiences, there is still a need to further understand the unique contextual factors surrounding mental health challenges among these marginalized groups. Research on Obsessive Compulsive Disorder (OCD) among REM communities is one area in need of further evaluation. Therefore, this study is a content analysis of literature analyzing the current research focused on the intersection of REM communities and OCD experiences. The purpose of the study is to analyze OCD research among …

Applications Of The Re-Aim Framework In Health Promotion, Emiliane L. Pereira
Theses & Dissertations
This dissertation applied a variety of methods under the RE-AIM (Reach, Effectiveness, Adoption, Implementation, and Maintenance) framework and provided a valuable and relevant contribution to the field of the dissemination and implementation (D&I) science. In the first study, we applied the RE-AIM framework to evaluate interventions and summarize the literature on breastfeeding promotion programs on the Black population (Chapter 1). The study results provide meaningful findings by bridging the gap on the literature of reporting breastfeeding supporting services and resources available to ensure breastfeeding continuation, as well as the need for a better reporting on the individual-level and setting representativeness, …
Understanding The Psychological Significance Of Astrology In Millennial Women's Lives, Rachel June Floyd
Understanding The Psychological Significance Of Astrology In Millennial Women's Lives, Rachel June Floyd
Electronic Theses and Dissertations
In North America, astrology has been experiencing a resurgence in popularity. This is immediately remarkable given that the United States and Canada are industrialized, modern societies where astrology is widely lamented as a pseudoscience. This dissertation presents a phenomenological exploration of the underlying reasons for this cultural trend, particularly among the demographic that uses it most: millennial women. Existing psychological literature on astrology is primarily dominated by correlational studies or historical analyses and lacks the depth and richness of direct experiences of individuals engaging with this phenomenon. This study sought to address this gap within psychological literature specifically, by conducting …

Rhabdomyosarcomas (RMS) are pediatric mesenchymal-derived malignancies encompassing PAX3/7-FOXO1 Fusion Positive (FP)-RMS, and Fusion Negative (FN)-RMS with frequent RAS pathway mutations. RMS express the master myogenic transcription factor MYOD that, whilst essential for survival, cannot support differentiation. Here we discover SKP2, an oncogenic E3-ubiquitin ligase, as a critical pro-tumorigenic driver in FN-RMS. We show that SKP2 is overexpressed in RMS through the binding of MYOD to an intronic enhancer. SKP2 in FN-RMS promotes cell cycle progression and prevents differentiation by directly targeting p27Kip1 and p57Kip2, respectively. SKP2 depletion unlocks a partly MYOD-dependent myogenic transcriptional program and strongly affects stemness and tumorigenic …
Type Vs. Turnout: Correlations Between Types Of Higher Education Institutions And Student Voter Turnout, Janea Mccoy
Type Vs. Turnout: Correlations Between Types Of Higher Education Institutions And Student Voter Turnout, Janea Mccoy
Undergraduate Honors Theses
Voter turnout in the youth demographic has been the subject of increased attention and research in the past several years, with many questions left unanswered. The 18-25 age demographic can play a crucial and impactful role in elections. However, many young adults do not vote. Higher education has often been viewed as a catalyst for civic engagement amongst this age demographic, with correlations between enrollment in higher education and increased rates of voter turnout being evident. Given there is much variation between different kinds of institutions, however, this raises the question: what types of institutions and their respective characteristics correlate …

Social Determinants Of Health: Evidence-Based Practices For Hospitals To Screen And Address Their Patients’ Needs, Lanna N. Anderson
Master's Projects and Capstones
There is an increasing acknowledgment that addressing the specific social, economic, and environmental factors contributing to health inequalities would improve the overall health and wellbeing of individuals. Arguably, hospitals and other healthcare systems are getting more conscious of their responsibilities in dealing with SDOHs, with an increase need to address these SDOHs to improve patients' healthcare outcomes and lessen the prevailing healthcare inequalities. To reach this aim, there is a need for screening and addressing SDOH at different levels, including healthcare system. This paper examined the existing evidence-based practices that screen and address social determinants of health (SDOH) among disadvantaged …

Toxic Fashion: Evaluation Of Chemicals In Clothing And Recommendations For The Amended Tsca, Gregory Zajac
Master's Projects and Capstones
The fashion industry is one of the largest polluting industries in the world and its rising environmental impact is partly due to the dominance of fast fashion business models. Recently researchers and advocates have found that large amounts of chemicals are used by textile manufacturers to produce clothing, some proven to be toxic in other applications. The risk of exposure to these classes of chemicals is a growing concern. With the risk management model, a qualitative examination was conducted on existing policies in the United States that regulate chemicals used by the industry. Despite some policy changes regarding chemical exposure …
