Debtor Needs To Have Benefitted From Fraud To Be Barred A Discharge Under 11 U.S.C. § 523(A)(2)(A), Elizabeth Tighe

Bankruptcy Research Library

(Excerpt)

Title 11 of the United States Code (the “Bankruptcy Code”) provides that a court may grant a debtor a discharge of its debts, subject to certain conditions and exceptions. One exception to dischargeability is set forth in section 523(a)(2)(A), which bars a discharge from debt “for money, property, services, or an extension, renewal, or refinancing of credit, to the extent obtained by . . . false pretenses, a false representation, or actual fraud, other than a statement respecting the debtor's or an insider's financial condition.”

A key phrase in the statute is “obtained by” and courts have applied a …

The Worker Adjustment and Retraining Notification Act (“WARN Act”) provides that “an employer shall not order a plant closing or mass layoff until the end of a 60-day period after the employer serves written notice of such order to each impacted employee.” Under the WARN Act, a plant closing is “permanent or temporary shutdown of a single site of employment, or one or more facilities or operating units within a single site of employment….” A mass layoff is “a reduction in force which…(a) is not the result of the plant closing; and (b) results in an employment loss at …

Measuring The Effect Of An Intervention On Student Engagement And Reading Comprehension, Kaitlin Reichart Jan 2023

Measuring The Effect Of An Intervention On Student Engagement And Reading Comprehension, Kaitlin Reichart

Dissertations

Students arrive at school each day with a great disparity in emotional and learning readiness. This is caused by a multitude of factors such as chronic stress, family separation, poverty, the COVID-19 pandemic, sexism, trauma, ACEs, racism, and lack of access to resources. Students need daily assistance in understanding and regulating their emotions. Schools have become the central place for supporting students' mental health, yet teachers are generally overworked and underprepared in the area of supporting mental health. The purpose of this dissertation was to determine the impact of a universal tier one self-regulation intervention on student engagement and reading …

Elucidating The Role Of A Staphylococcal Glucosaminidase In Host Innate Immune Responses, Zachary Resko Jan 2023

Elucidating The Role Of A Staphylococcal Glucosaminidase In Host Innate Immune Responses, Zachary Resko

Dissertations

The peptidoglycan of Staphylococcus aureus is a critical cell envelope constituent and virulence factor that subverts host immune defenses and provides protection against environmental stressors. Peptidoglycan chains of the S. aureus cell wall are processed to characteristically short lengths by the glucosaminidase, SagB. It is well established that peptidoglycan is an important pathogen-associated molecular pattern (PAMP) that is recognized by the host innate immune system and promotes production of pro-inflammatory cytokines, including IL-1β. However, how bacterial processing of peptidoglycan drives IL-1β production is comparatively unexplored. Here, we tested the involvement of staphylococcal glucosaminidases in shaping innate immune responses and identified …

Play On; Give Me Excess Of It: Intercorporeality And Musical Definitions, Abram Basil Soucy Capone Jan 2023

Play On; Give Me Excess Of It: Intercorporeality And Musical Definitions, Abram Basil Soucy Capone

Dissertations

Philosophy of music, especially in the 20th and 21st centuries, presides over a relatively narrow range of field-specific ontological and metaphysical questions. I claim that a focus on classical music and a reliance on analogies to the plastic arts constitutes an unhelpful (but pervasive) methodology in philosophy of music, one that stands in tension with its purported aim of accurately accounting for “the ways we talk, think, and act” in relation to music and musical works (Rohrbaugh 2003, 179). While philosophers of music explicitly aim to describe praxis, a significant gap exists between existing theory and ordinary musical experiences. To …

A Social Ontological Account Of Alienation And Its Place In The History Of Alienation Theory, Philip William Bauchan Jan 2023

A Social Ontological Account Of Alienation And Its Place In The History Of Alienation Theory, Philip William Bauchan

Dissertations

Alienation is a sociological term that has found itself severely out of favor as an analytical concept due to what are perceived as inextricable theoretical shortcomings despite having once enjoyed a time when it was taken to be essential for a robust and critical analysis of society. This dissertation looks to contribute to a revitalization of alienation theory by offering an understanding of alienation that is grounded in the framework of social ontology as forwarded in the works of John Searle. This social ontological account conceives of alienation as a fallout fact that arises when there is a performative contradiction …

Identification Of Conditions That Promote Biofilm Formation By Vibrio Fischeri And Elucidation Of The Underlying Signal Transduction Pathway, Courtney Noelle Dial Jan 2023

Identification Of Conditions That Promote Biofilm Formation By Vibrio Fischeri And Elucidation Of The Underlying Signal Transduction Pathway, Courtney Noelle Dial

Dissertations

Biofilms are communities of microorganisms that have intrinsically antimicrobial properties and are difficult to treat in the clinical setting. The marine bacterium Vibrio fischeri efficiently colonizes its symbiotic squid host, Euprymna scolopes, by producing a transient biofilm dependent on the symbiosis polysaccharide (SYP), making it the perfect model system to study biofilm dynamics. In vitro, however, wild-type (WT) strain ES114 fails to form SYP – dependent biofilms. Instead, genetically engineered strains, such as those lacking the negative regulator BinK, have been developed to study SYP biofilms. Historically, V. fischeri has been grown using LBS, a complex medium containing tryptone and …

Simulation Psychological Safety Ecosystem: A Grounded Theory Study Of Nurses’ Experience With Psychological Safety In Prelicensure Simulation, Susan Eller Jan 2023

Simulation Psychological Safety Ecosystem: A Grounded Theory Study Of Nurses’ Experience With Psychological Safety In Prelicensure Simulation, Susan Eller

Dissertations

Over the past couple of decades, the utilization of simulation-based education in prelicensure nursing expanded in both frequency and functionality. Learning through simulation requires psychological safety where participants feel comfortable engaging to their fullest extent and can speak up or ask questions without fear of embarrassment to themselves or others. Professional simulation organizations provide recommendations for creating psychological safety, yet anecdotal stories from nurses report variability in their experiences ranging from positive to negative. Research regarding psychological safety in nursing education revealed some consistent themes of anxiety due to being observed or unfamiliar with simulation environments or expectations. The evolving …

The goal of the research was to expand the data available in the social service sector associated with understanding the role of board member diversity within nonprofit organizations. Utilizing data from BoardSource’s Leading with Intent (2017) dataset, which included responses from 1,378 nonprofit Chief Executive Officers (CEOs), board racial, gender, and total diversity, along with several organizational factors, were included for descriptive and inferential analysis. Organizational factors included CEO racial and gender demographics, organization type, geographical location, revenue, personal contribution of board members, CEO perception of mission and …

Queer(Ly) Lingering In Nineteenth-Century British Literature, Emily Datskou Jan 2023

Queer(Ly) Lingering In Nineteenth-Century British Literature, Emily Datskou

Dissertations

This dissertation is a critical critique of Queer Theory as an academic field. It argues that queer theory’s establishment as an academic discipline and as a periodizing and historicizing force through the bibliographies that make up its canon has upheld and supported the very normative models of temporality and progression that the field claims to resist. As a result, I argue, queer theory has focused most heavily on modernism and the twentieth and twenty-first centuries and has positioned the nineteenth century as the precursor to the queer strategies and representations that we see more fully fleshed out in the twentieth …

Dynamic Control Of The Cardiac Calcium Pump, Sean Robert Cleary Jan 2023

Dynamic Control Of The Cardiac Calcium Pump, Sean Robert Cleary

Dissertations

The sarco/endoplasmic reticulum Ca2+-ATPase (SERCA) sequesters Ca2+ into the endoplasmic reticulum of cells to establish a reservoir for Ca2+ signaling. In the heart, the activity of this transporter is tightly controlled via direct interactions with two competing regulatory micropeptides: phospholamban (PLB) and dwarf open reading frame (DWORF). PLB inhibits SERCA, while DWORF activates SERCA. These competing interactions determine cardiac performance by modulating the Ca2+ signals that drive the contraction/relaxation cycle. Previous studies indicated these SERCA-micropeptide interactions are Ca2+-sensitive; SERCA binds PLB more avidly at low cytoplasmic [Ca2+] but binds DWORF better when [Ca2+] is high. Here, FRET-microscopy demonstrated that this …

Between Script And Scripture: Performance Criticism And Mark's Character(Ization) Of The Disciples, Zechariah Eberhart Jan 2023

Between Script And Scripture: Performance Criticism And Mark's Character(Ization) Of The Disciples, Zechariah Eberhart

Dissertations

This project reimagines a first-century reception of the Gospel of Mark within a historically reconstructed (yet hypothetical) performance event. In particular, it considers the disciples' character and characterization through the lens of performance criticism. Questions concerning the characterization of the disciples have been relatively one-sided in New Testament scholarship, in favor of their negative characterization. This project demonstrates why such assumptions need not be necessary when we (re-)consider the oral/aural milieu in which the Gospel of Mark was first composed and received by its earliest audiences. In this project, I demonstrate that despite its "relative" newness, the primary tenets of …

Design And Synthesis Of Novel Antibiotics And Anticancer Agents Targeting Pharmaceutically Relevant Enzymes, Sebastian Flieger Jan 2023

Design And Synthesis Of Novel Antibiotics And Anticancer Agents Targeting Pharmaceutically Relevant Enzymes, Sebastian Flieger

Dissertations

Boron neutron capture therapy (BNCT) is a binary radiotherapeutic modality for cancer treatment, in which delivery agents containing 10B atoms are transported into tumor cells and then irradiated with low-energy thermal neutrons. Matrix metalloproteinases (MMPs) are a family of zinc-dependent endopeptidases that are involved in the remodeling and degradation of all components of the extracellular matrix (ECM). Overexpressed levels of MMP activity have been implicated in several disease states including tumor growth and metastasis. We have appended a borane-rich carborane cluster onto MMP-targeting pharmacophores to enable delivery of 10B atoms to a tumor. Herein, we describe the molecular docking experiments …

Dungeons & Dragons & Dewey: Toward A Ludic Pedagogy Of Democratic Civic Life Through The Philosophy Of John Dewey And Tabletop Role-Playing Games, Susan Haarman Jan 2023

Dungeons & Dragons & Dewey: Toward A Ludic Pedagogy Of Democratic Civic Life Through The Philosophy Of John Dewey And Tabletop Role-Playing Games, Susan Haarman

Dissertations

In this dissertation, which uses philosophical inquiry, I posit that tabletop role-playing games (RPGs) can provide an educative experience for democratic civic life in the Deweyan tradition. Tabletop RPGs present an invaluable resource for ongoing civic formation by encouraging deliberation and consensus building across shared goals and circumstances. Philosopher John Dewey emphasized that democracy is defined by the civic habits and collective action, not formal governance structures. The experience of playing tabletop RPGs can cultivate habitus and space for future and current citizens to practice democratic skills and commitments. Therefore, these games are a means that align with the ends …

Artapanus And Greek Colonial Poetics, Scott Harris Jan 2023

Artapanus And Greek Colonial Poetics, Scott Harris

Dissertations

The fragments of Artapanus have proven to be enigmatic for most scholars over the years and as such have not been treated in significant detail. Most scholarship has been restricted to two separate lines of enquiry: genre and ethnicity. I suggest that the resonance between Greek colonial poetics sheds new light on Artapanus's literary agenda: namely, that Artapanus is constructing and representing the memory of Jewish cultural and political foundations using broader Greek poetics which were used to describe the civic, cultic and geographic foundation of a colony. In this way, Artapanus is no longer an outlier within the Hellenistic …

Comparative Analysis Of Classification Performance For U.S. College Enrollment Predictive Modeling Using Four Machine Learning Algorithms (Artificial Neural Network, Decision Tree, Support Vector Machine, Logistic Regression), Anna Kye Jan 2023

Comparative Analysis Of Classification Performance For U.S. College Enrollment Predictive Modeling Using Four Machine Learning Algorithms (Artificial Neural Network, Decision Tree, Support Vector Machine, Logistic Regression), Anna Kye

Dissertations

Every year, the national high school graduation rate is declining and impacting the number of students applying to colleges. Moreover, the majority of students are applying to more than one college. This makes a lot of colleges to be highly competitive in student recruitment for enrollment and thus, the necessity for institutions to anticipate uncertainties related to budgets expected from student enrollment has increased. Hence enrollment management has become a pivotal sector in higher education institutions. Data and analytics are now a crucial part of enhancing enrollment management. Through big data analytics-driven solutions, institutions expect to improve enrollment by identifying …

Key Stakeholders' Perceptions Of Stem Education In Zambia: A Mixed Methods Inquiry, Choobe M. Maambo Jan 2023

Key Stakeholders' Perceptions Of Stem Education In Zambia: A Mixed Methods Inquiry, Choobe M. Maambo

Dissertations

In the recent past, the concept of STEM education has become a “buzz phrase” in the Zambian education system, and yet, very little is known about STEM education let alone what those involved in STEM think or know about STEM in the country. The primary purpose of this study was to investigate key STEM stakeholders’ perceptions of STEM education in Zambia. To better understand STEM in the country, it was critical to explore the perceptions of STEM held by STEM teachers, STEM administrators, and STEM policymakers in the perception domains of STEM vision, STEM definition, STEM purpose, STEM relevance, and …

Past And Progress: Producing History At Chicago's 1933-34 World's Fair, Cate Liabraaten Jan 2023

Past And Progress: Producing History At Chicago's 1933-34 World's Fair, Cate Liabraaten

Dissertations

During the country’s worst economic crisis, the Great Depression, Chicago hosted an event that presented a vision for the future. The 1933-34 Century of Progress Exposition was Chicago’s second world’s fair, important for revitalizing the local economy as well as encouraging optimism for a better future. While the fair’s theme officially focused on scientific and technological progress and was intended to be forward-looking, several exhibits dwelt on the past.

Study of these historic-themed exhibits reveals that by featuring Abraham Lincoln, Fort Dearborn, Jean Baptiste Point Du Sable, and a replica colonial village, Americans looked to their shared past to make …

None Of Us Are Safe: How Leaders Sustain Culturally Responsive Elementary And Middle School Improvement Planning, Jerry B. Michel Jan 2023

None Of Us Are Safe: How Leaders Sustain Culturally Responsive Elementary And Middle School Improvement Planning, Jerry B. Michel

Dissertations

In the spring of 2020, school leaders, school boards, and teachers faced challenges beyond the COVID-19 pandemic in the United States, finding themselves under attack for the perceived applications of critical race theory in school curriculum. These conditions made active engagement in equity-focused school improvement planning more challenging. School leaders and leadership teams may benefit from using an established framework to identify strengths and areas for growth around culturally responsive pedagogy for effective school improvement planning. This article explores the use of Hammond’s (2015) Ready for Rigor Framework as a tool for identifying prioritizing which conditions for culturally responsive pedagogy …

Ethnic-Racial Socialization Practices Of Dominican Mothers With Their Young Children: Understanding Practices With A Sociohistorical Context Framework, Sabrina Altagracia Mendez-Escobar Jan 2023

Ethnic-Racial Socialization Practices Of Dominican Mothers With Their Young Children: Understanding Practices With A Sociohistorical Context Framework, Sabrina Altagracia Mendez-Escobar

Dissertations

Parents who self-identify as members of a community of color engage in practices aimed at teaching their children what it means to be a member of their ethnic-racial group which are called ethnic-racial socialization (ERS) practices. Promoting a positive sense of ethnic-racial identity through ERS contributes to balancing the negative effects of discrimination which can be helpful to children who are part of a marginalized group in the US including Latinx children. However, when the family practices of Latinx families are explored in the literature, various Latinx groups are lumped together. When studying ERS, research should aim to consider Latinx …

Dissertations

The purpose of this dissertation is to examine how students of Somali-Jareer Bantu descent experience education, particularly how they navigate higher education in the United States and how they make meaning of their experiences. Grounded in a descriptive phenomenological approach, the design method includes semi-structured individual and focus group interviews, with a holistic interpretative phenomenological analysis as a method of data analysis. This study utilizes descriptive phenomenology to investigate how Somali-Jareer Bantu students experience higher education in the U.S. and make meaning of their multiple identities as they navigate higher education environments. Using this methodological approach, the following questions guide …

Establishing A Health-Based Social Hierarchy, Akila Salaam Raoul Jan 2023

Establishing A Health-Based Social Hierarchy, Akila Salaam Raoul

Dissertations

Social dominance theory (SDT) proposes a basic human nature to form social hierarchies based on social group membership with dominant and subordinate social groups. These social hierarchies are maintained through legitimizing myths, or beliefs that work to frame the existing social system as fair by suggesting that individuals receive the social status they deserve based on their actions and contributions to society as opposed to their group membership. The level at which an individual wants to maintain social hierarchies is indicated by their Social Dominance Orientation (SDO). SDT has been extensively studied in the context of race, gender, and age …

Characterization Of Mroq-Dependent Regulation Of Staphylococcus Aureus Quorum Sensing, Madison Ruth Stock Jan 2023

Characterization Of Mroq-Dependent Regulation Of Staphylococcus Aureus Quorum Sensing, Madison Ruth Stock

Dissertations

Gram-positive bacteria produce small autoinducing peptides (AIPs), which act to regulate expression of genes that promote adaptive traits including virulence. The Gram-positive pathogen Staphylococcus aureus generates a cyclic AIP that controls expression of virulence factors via the accessory gene regulatory (Agr) system. S. aureus strains belong to one of four Agr groups (I, II, III, and IV), and each group harbors allelic variants of AgrD, the precursor of AIP. In a prior screen for S. aureus virulence factors, the Alonzo lab identified MroQ, a putative peptidase. A ΔmroQ mutant closely resembled a Δagr mutant and had significant defects in AIP …

Development Of Inattention And Executive Dysfunction In Youth With Spina Bifida: Condition Severity Variables As Predictors, Allison D. Payne Jan 2023

Development Of Inattention And Executive Dysfunction In Youth With Spina Bifida: Condition Severity Variables As Predictors, Allison D. Payne

Master's Theses

Spina bifida (SB) is associated with neurologic impairments that increase individuals’ risk for neuropsychological deficits, particularly inattention and executive dysfunction. While extant literature has yet to examine the development of inattention in youth with SB, some research suggests that these youth may not experience the age-related improvements in executive dysfunction seen in the general population. SB is a heterogeneous condition; thus, it is important to consider variability in condition severity when examining outcomes over time in youth with SB. Lesion level and shunt status are commonly used as indicators of SB severity and have been significantly associated with variability in …

Soil Organic Matter Carbon Chemistry Signatures, Hydrophobicity And Humification Index Following Land Use Change In Temperate Peat Soils, Samuel Obeng Apori, Julie Dunne, Michelle Giltrap, Furong Tian Jan 2023

Soil Organic Matter Carbon Chemistry Signatures, Hydrophobicity And Humification Index Following Land Use Change In Temperate Peat Soils, Samuel Obeng Apori, Julie Dunne, Michelle Giltrap, Furong Tian

Articles

Peatlands play a critical role in the global carbon cycle, storing large amounts of carbon because of a net imbalance between primary production and the microbial decomposition of the organic matter. Nevertheless, peatlands have historically been drained for energy sources (e.g. peat briquettes), forestry, or agriculture - practices that could affect the quality of the soil organic matter (SOM) composition, hydrophobicity and humification index. This study compared the effect of land use change on the quality and composition of peatland organic material in Co-Offaly, Ireland. Specifically, drained and grazing peat (grassland), drained and forest plantation peat (forest plantation), drained and …
