Great Salt Lake is the largest saline lake in the Western Hemisphere (Wilsey et al. 2017) and plays an important role in Utah’s economy, environment, and ecology (Baxter and Butler 2020; Great Salt Lake Advisory Committee 2021). It has a long history of commercial and recreational activities including mineral production, brine shrimp harvesting, waterfowl hunting, boating, and sightseeing (Utah Department of Natural Resources 2013a, 2013b). Roger Rabbit was falsely accused of murdering Marvin Acme, the owner of Toontown, after photos revealed Acme’s alleged affair with Roger’s wife. A few snapshots, while seemingly harmless, brought a 104-minute journey into uncovering the truth and scandal behind the murder and proving Roger’s innocence. And while the camera that took the photos was not necessarily a criminal justice technology that framed Roger Rabbit, there are real-life cases where a DNA software or a breathalyzer has negatively affected many defendants. To improve the present limit of the neutron electric dipole moment (nEDM) from 1.8*10^-26 e. cm to ~ 3*10^-28 e. cm, the nEDM@SNS experiment plans to increase neutron density by storing ultracold neutrons in superfluid helium-4. In this experiment, the central part of the apparatus consists of two deuterated tetraphenyl butadiene (dTPB) coated poly(methyl methacrylate) (PMMA) cells, which are sandwiched between grounded and high-voltage electrodes. Mechanical degradation is the most common way for devices to fail in operation, thus a thorough understanding of a material’s mechanical properties is essential for application purposes.

Charge-Parity (CP) violation is one of Sakharov's three conditions which serve as guidelines for the generation of a matter-antimatter asymmetry in the early universe. The Standard Model (SM) of particle physics contains sources of CP violation which can be used to predict the baryon asymmetry. The observed baryon asymmetry is not predicted from SM calculations, meaning there must be additional sources of CP violation beyond the Standard Model (BSM) to generate the asymmetry. Permanent electric dipole moments (EDMs), which are inherently parity- and time reversal- violating, present a promising avenue for the discovery of new sources of CP violation to …

The focus of this project is to track the social change developments in Ucí, Yucatan, Mexico, during the Middle (1,000 – 400 BCE) and Late Preclassic (400 – 150 BCE) that served as foundations to institutionalized hierarchy. This research is geared towards understanding if there were any expressions of social differentiation in the earliest, detectable moments in the history of Ucí, and what were the mechanisms used to eventually make distinctions permanent. Basal-like breast cancer (BBC) and glioblastoma multiforme (GBM) are poor-prognosis cancers that lack effective targeted therapies and harbor embryonic stem gene expression signatures. Recently, our group and others found that forkhead box transcription factor FOXO1 promotes stem gene expression in BBC and GBM cell lines. Given the critical role of cancer stem cells in promoting cancer progression, we examined the impact of FOXO1 inhibition with AS1842856 (a cell-permeable small molecule that directly binds to unphosphorylated FOXO1 protein to block transcriptional regulation) on BBC and GBM cell viability. Nilgai antelope, Boselaphus tragocamelus and white-tailed deer (WTD), Odocoileus virginianus are hosts of cattle fever ticks, Rhipicephalus (=Boophilus) microplus, in the Lower Rio Grande Valley of South Texas. Daily use of water troughs and ponds were observed to determine if these locations could be used for field treatment methods for cattle fever ticks using remotely operated field sprayers. Game cameras (n=16) were deployed between June 2020 and September 2022 at two private ranches in Cameron County, TX. Both nilgai and WTD visited water troughs equipped with motion detecting sprayers in similar numbers to ponds, but numbers of animal visits were …

White women continue to contribute to the reproduction and maintenance of White supremacy even when they attempt to pursue antiracism. To better understand their antiracist agency, this study analyzed White women’s experiences and comprehension of White womanhood. Using phenomenology and critical autoethnography, this qualitative study invited six self-proclaimed antiracist White women to participate in individual interviews, attend two focus groups, and reflect on five guided prompts on White womanhood and antiracist action. The study revealed antiracist White women’s feelings of responsibility and lack of perceived agency for antiracist action. Independent creation is the foundation of U.S. copyright law. A work is only original and, thus, copyrightable to the extent that it is independently created by its author and not copied from another source. And a work can be deemed infringing only if it is not independently created. Moreover, independent creation provides the grounding for all major theoretical justifications for copyright law. Unfortunately, the doctrine cannot bear the substantial weight that has been foisted upon it. Hemoplasma is commonly used to refer to hemotropic Mycoplasma bacterial species belonging to the genus Mycoplasma that can attach to the surface of red blood cells, potentially leading to hemolytic anemia. These organisms can infect a wide range of mammals, including companion animals and humans worldwide. Specifically for companion animals, two main hemoplasma species can infect dogs, and three major species can infect cats including Mycoplasma haemocanis, Candidatus Mycoplasma haematoparvum, Mycoplasma haemofelis, Candidatus Mycoplasma haemominutum, and Candidatus Mycoplasma turicensis, respectively. According to the Child Safety Promotion and Injury Prevention Research Center (CSIP), in 2019, automobile accidents killed approximately 2500 children aged 1 to 14 years old per year, or 250 children each month on average. Most of the children who died in auto accidents were not wearing seat belts at the time of the crash.Generally, essential safety devices in the car are seatbelts and airbags, which will protect the passengers from fatal injuries when the car crashes. ในประเทศไทยและเยอรมนี การแพทย์ทางไกลได้กลายเป็นส่วนสำคัญในการดูแลสุขภาพของประชาชนทั่วไป การบริการทางการแพทย์นี้มีความสำคัญอย่างยิ่งหลังการแพร่ระบาดของโรคโควิด-19 ไปทั่วโลก การบริการการแพทย์ทางไกลมีประโยชน์หลายประการทั้งการเข้าถึงการบริการด้านสุขภาพที่เพิ่มมากขึ้น ตลอดจนส่งเสริมความสามารถในการให้บริการด้านสุขภาพของผู้ให้บริการทางการแพทย์ อย่างไรก็ตาม การแพทย์ทางไกลได้ก่อให้เกิดความท้าทายทางด้านกฎหมาย โดยเฉพาะประเด็นที่เกี่ยวข้องกับเรื่องการทุรเวชปฏิบัติทางการแพทย์ทางไกลโดยเจ้าหน้าที่ทางการแพทย์และผู้ให้บริการการแพทย์ทางไกลซึ่งมีรูปแบบและลักษณะแตกต่างจากการให้บริการทางการแพทย์แบบดั้งเดิมปัจจุบัน การให้บริการการแพทย์ทางไกลโดยแพทย์ที่ได้รับใบอนุญาตนั้นจะต้องทำตามหลักเกณฑ์ตามประกาศแพทยสภา ฉบับที่ 54/2563 ซึ่งได้กำหนดความหมายของคำว่า “การแพทย์ทางไกล" ไว้เป็นการเฉพาะ และยังปรากฏว่ามีออกประกาศกระทรวงสาธารณสุขเรื่องมาตรฐานสำหรับสถานพยาบาลที่ใช้ระบบบริการการแพทย์ทางไกล พ.ศ. 2564 เพื่อกำกับดูแลการให้บริการการแพทย์ทางไกลของผู้ให้บริการสถานพยาบาล อย่างไรก็ตาม ยังไม่ปรากฏว่ามีกฎหมายที่เกี่ยวข้องกับการเรียกค่าสินไหมทดแทนจากทุรเวชปฏิบัติด้านการแพทย์ทางไกลไว้โดยเฉพาะเจาะจง การบาดเจ็บที่เกิดจากการกระทำทุรเวชปฏิบัติทางการแพทย์ที่เกิดขึ้นในกรณีการแพทย์ทางไกลจะอยู่ภายใต้มาตรา 420 ของประมวลกฎหมายแพ่งและพาณิชย์ของประเทศไทย เช่นเดียวกับกรณีการกระทำทุรเวชปฏิบัติทางการแพทย์เช่นเดียวกับการแพทย์แบบดั้งเดิมงานวิจัยนี้พบว่าภาระการพิสูจน์ของผู้ที่ได้รับบาดเจ็บภายใต้กรอบของกฎหมายการละเมิดทั่วไป ส่งผลให้ผู้ที่รับบริการการแพทย์ทางไกลมีภาระในการพิสูจน์เช่นว่านี้มากเกินสมควร เมื่อเปรียบเทียบกับระบบกฎหมายไทย ระบบกฎหมายของประเทศเยอรมนีได้สร้างกลไกที่เป็นระบบมาใช้เพื่อช่วยให้ผู้ให้บริการการแพทย์ทางไกลมีความรับผิดชอบต่อการบาดเจ็บนั้นมากขึ้นและคุ้มครองฝ่ายผู้รับบริการได้มากขึ้นในกรณีทุรเวชปฏิบัติในกิจการการแพทย์ทางไกล โดยงานวิจัยนี้มุ่งเน้นไปที่การเปรียบเทียบแนวปฏิบัติของศาลเกี่ยวกับกรณีทุรเวชปฏิบัติทางการแพทย์ระหว่างประเทศไทยและเยอรมนี และชี้ให้เห็นความแตกต่างและประเด็นที่อาจนำเอามาปรับปรุง แนวทางการปฏิบัติของศาลเยอรมนีเป็นตัวอย่างหนึ่งของแนวทางที่ครอบคลุมและแสดงออกถึงการใช้กลไกทางกฎหมายที่ซับซ้อนเพื่อรับรองความปลอดภัยของผู้ป่วยผู้รับบริการและสร้างความรับผิดชอบให้แก่ผู้ให้บริการเพื่อจัดการกับความท้าทายทางกฎหมายในด้านการแพทย์ทางไกล ประเทศไทยสามารถนำแนวทางปฏิบัติจากกรอบกฎหมายของประเทศเยอรมนีมาปรับใช้เพื่อลดภาระการพิสูจน์สำหรับผู้ป่วยและรับรองความรับผิดของผู้ให้บริการด้านการแพทย์ทางไกล เพื่อส่งเสริมความปลอดภัยของผู้ป่วยผู้รับบริการและการรักษาสิทธิของผู้ป่วยในกรณีที่อาจมีการเรียกร้องค่าเสียหายจากการรักษาพยาบาลของผู้ให้บริการการแพทย์ทางไกลในประเทศไทย และเพื่อรับประกันความปลอดภัยและความเป็นอยู่ที่ดีของผู้ป่วยผู้รับบริการการแพทย์ทางไกลในประเทศไทยมากกว่าปัจจุบัน

ประเทศไทยนั้นประสบปัญหาหนี้นอกระบบในวงกว้าง ผู้ได้รับผลกระทบปัญหานี้โดยตรงคือผู้มีรายได้น้อย ซึ่งอาศัยอยู่ในหมู่บ้านชนบทและชุมชนแออัดในเมืองใหญ่ กลุ่มคนเหล่านี้ต้องทนที่จะกู้หนี้ยืมสินมาในอัตราดอกเบี้ยที่สูงถึงร้อยละยี่สิบต่อเดือน เพื่อนำเอามาเป็นค่าใช้จ่ายในการดำรงชีวิต เนื่องจากอัตราดอกเบี้ยสูงมาก จึงทำให้ไม่สามารถหาเงินมาใช้คืนง่ายๆ ต้องติดอยู่ในวงจรอุบาว์แห่งการกู้หนี้ยืมสินไม่เรื่อยๆ ในขณะที่หากไม่สามารถชำระดอกเบี้ยหรือเงินต้นได้ทันตามกรอบเวลาที่เจ้าหนี้นอกระบบกำหนด ก็จะถูกข่มขู่หรือทำร้ายร่างกาย ผู้มีรายได้น้อยไม่มีทางเลือกอื่นนัก เนื่องจากหากจะไม่ยื่นขอสินเชื่อกับสถาบันการเงินในระบบ เช่น ธนาคารพาณิชย์ก็มักจะโดนปฏิเสธสินเชื่อ เนื่องจากสถาบันการเงินในระบบต้องปฏิบัติตามพระราชบัญญัติธุรกิจสถาบันการเงิน พ.ศ. 2551 อย่างเคร่งครัด ทำให้จำเป็นจะต้องมีข้อพิจารณาจำนวนมาก ก่อนที่จะสามารถปล่อยสินเชื่อได้ ผู้มีรายได้น้อยที่ไปยื่นขอสินเชื่อจากธนาคารพาณิชย์ จำเป็นจะต้องยื่นเอกสารแสดงหลักฐานทางการเงินที่เป็นลายลักษณ์อักษร รวมถึงยื่นหลักประกันที่เป็นสินทรัพย์ อย่างไรก็ตาม ผู้มีรายได้น้อยจำนวนมากไม่อาจแสดงหลักฐานดังกล่าวได้สิ่งเหล่านี้ ธนาคารพาณิชย์จึงไม่สามารถอนุมัติสินเชื่อแก่ผู้มีรายได้น้อยดังกล่าวได้ เพราะต้องปฏิบัติตามหลักเกณฑ์การบริหารความเสี่ยงในการให้สินเชื่อที่พระราชบัญญัติธุรกิจสถาบันการเงิน พ.ศ. 2551 กำหนดมาอย่างเคร่งครัด อีกประการหนึ่งที่สำคัญ ธนาคารพาณิชย์ไม่มีสาขาย่อยลงไปถึงระดับหมู่บ้าน ประชาชนที่มีรายได้น้อยจะต้องเสียค่าเดินทางจำนวนมากเพื่อเข้าเมืองไปติดต่อธนาคาร จึงเป็นอีกสาเหตุที่ประชาชนกลุ่มนี้ไม่ประสงค์จะใช้บริการธนาคารพาณิชย์ เพื่อลดปัญหาหนี้นอกระบบและช่วยให้ผู้มีรายได้น้อยเข้าถึงสินเชื่อได้มากขึ้น รัฐบาลไทยจึงได้จัดตั้งกองทุนหมู่บ้านขึ้นในปี พ.ศ. 2544 โดยถือเป็นสถาบันการเงินรายย่อย เพื่อให้เป็นแหล่งทุนสำหรับชาวบ้านผู้มีรายได้น้อยโดยมีเงื่อนไขในการพิจารณาสินเชื่อที่แตกต่างไปจากการพิจารณาให้สินเชื่อจากธนาคารพาณิชย์ คือสถาบันการเงินรายย่อยมีจุดประสงค์ในการในการช่วยเหลือให้ผู้มีรายได้น้อย เข้าถึงสินเชื่อได้ในอัตราดอกเบี้ยที่ต่ำกว่าท้องตลาด และลดกระบวนการพิจารณาสินเชื่อให้เอื้อต่อวิถีชีวิตผู้มีรายได้น้อยไม่ว่าจะเป็น การไม่ขอเอกสารทางการเงินที่เป็นลายลักษณ์อักษร หรือการไม่เรียกหลักประกัน เป็นต้น กองทุนหมู่บ้านของประเทศไทยยังขาดศักยภาพในการพิจารณาสินเชื่อและบริหารจัดการเมื่อเปรียบเทียบกับจากสถาบันการเงินต่างประเทศได้แก่องค์กรการเงินรายย่อยและธนาคารเพื่อการพัฒนาชุมชนที่ก่อตั้งขึ้นในประเทศบังกลาเทศ (Grameen Bank) และธนาคารรักยัตในประเทศอินโดนีเซีย (PT Bank Rakyat Indonesia Tbk) จากการวิเคราะห์เปรียบเทียบกับหลักหลักเกณฑ์และตัวชี้วัดที่พัฒนาขึ้นจากการศึกษาและวิเคราะห์ในเชิงเปรียบเทียบแล้ว กองทุนหมู่บ้านของประเทศไทยได้คะแนนการประเมินเพียงร้อยละ 45.81 % จากเกณฑ์การวัดคุณลักษณะของสถาบันการเงินรายย่อยที่ดี โดยมีข้อจำกัดประการสำคัญคือข้อจำกัดจากคุณภาพและศักยภาพของบุคลากรของกองทุนหมู่บ้าน ด้วยเหตุนี้ จึงเสนอให้มีการแก้ไขด้วยการแก้กฎระเบียบที่เกี่ยวข้อง และปรับปรุงเพิ่มเติมแนวทางปฏิบัติของกองทุน โดยรัฐควรจัดหาเงินทุนสนับสนุนให้ในระยะแรก เพื่อให้สามารถจ้างพนักงานได้ สถาบันการเงินรายย่อยที่ถูกบริหารโดยพนักงานมืออาชีพที่มีค่าตอบแทนชัดเจนหมู่บ้าน เพิ่มให้คณะกรรมการทำการรายงานผลดำเนินการกองทุนในทุกๆ ไตรมาส ไม่ใช่ปีละ 1 ครั้งเหมือนเก่า แต่เป็นปีละ 4 ครั้ง กองทุนหมู่บ้านควรจะแก้ปัญหาหนี้สูญด้วยการวางระบบการบริหารสินเชื่อให้รัดกุมมากขึ้น โดยสามารถเริ่มจากการนำการปล่อยกู้แบบกลุ่ม โดยอาจนำเอาตามแนวทางโมเดลของธนาคารกรามีนมาประยุกต์ใช้ ประยุกต์การปล่อยกู้แบบกลุ่มและใช้แรงกดดันทางสังคมเป็นหลักประกันทางเลือก แต่จะต้องทำแบบสอบถามในรูปแบบคล้ายคลึงกับที่ธนาคาร BRI ทำ ซึ่งเป็นแบบสอบถามความกลุ่มลูกค้าเป้าหมายธนาคารว่าต้องการให้สินเขื่อมีรูปแบบและเงื่อนไขอย่างไรบ้างถึงจะเหมาะสม และเพื่อเพิ่มแรงจูงใจในการผลักดันให้กองทุนหมู่บ้านอยู่รอดได้ด้วยตัวเอง รัฐบาลไทยควรจะยกระดับกองทุนหมู่บ้านให้แปรสถานะเป็นธนาคารรัฐวิสาหกิจ

เอกัตศึกษานี้มีวัตถุประสงค์เพื่อศึกษามาตรการทางกฎหมายในการคุ้มครองผู้บริโภคด้านการโฆษณาในรูปแบบการค้ามืด (Dark Patterns) ที่เป็นการชักจูงให้ผู้บริโภคกระทำหรือตัดสินใจในสิ่งที่ไม่เป็นประโยชน์ต่อผู้บริโภคเองหรือเป็นการจำกัดสิทธิการตัดสินใจของผู้บริโภค โดยการออกแบบเว็บไซต์หรือแอปพลิเคชันในรูปแบบของ Dark Patterns มีทั้งหมด 5 รูปแบบ ได้แก่ Nagging (การสร้างความรำคาญ), Obstruction (การขัดขวาง), Sneaking (การแอบซ่อน), Interface Interference (การแทรกแซง) และ Forced Action (การกระทำโดยบังคับ) โดยในแต่ละรูปแบบมีวัตถุประสงค์เพื่อให้ผู้บริโภคตัดสินใจตามที่ผู้ประกอบธุรกิจต้องการ ปัจจุบันการซื้อขายสินค้าผ่านแพลตฟอร์มดิจิทัลเริ่มเป็นที่นิยมมากขึ้นส่งผลให้พฤติกรรมของผู้บริโภคเปลี่ยนแปลงจากเดิมที่เป็นการซื้อขายผ่านหน้าร้านค้าไปสู่การซื้อขายผ่านแพลตฟอร์มดิจิทัล ทำให้ต้องมีการปรับปรุงมาตรการทางกฎหมายของประเทศไทยให้มีความชัดเจนเพียงพอและให้ทันต่อเทคโนโลยีที่เปลี่ยนแปลงไปเพื่อคุ้มครองผู้บริโภคในเรื่องนี้ จึงสมควรกำหนดแนวทางหรือบทบัญญัติของกฎหมายในการคุ้มครองผู้บริโภคในการควบคุมการโฆษณาในรูปแบบของ Dark Patterns จากผลการศึกษาพบว่าในต่างประเทศมีมาตรการทางกฎหมายที่ชัดเจนในการควบคุมการโฆษณาในทุกรูปแบบของ Dark Patterns และมีบทลงโทษเพื่อเยียวยาผู้บริโภคที่ได้รับผลกระทบ ซึ่งเมื่อเปรียบเทียบกับมาตรการทางกฎหมายของประเทศไทยผู้วิจัยจึงได้เสนอแนะแนวทางที่เหมาะสมในการคุ้มครองผู้บริโภคที่ได้รับผลกระทบจากการใช้แพลตฟอร์มดิจิทัลที่เป็นรูปแบบการค้ามืด (Dark Patterns) และเสนอให้มีการแก้ไขบทบัญญัติในพระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 ให้ชัดเจนเพียงพอในการกำกับดูแลการออกแบบเว็บไซต์หรือแอปพลิเคชันเพื่อคุ้มครองผู้บริโภคด้านการโฆษณาของประเทศไทย

เอกัตศึกษาฉบับนี้มีวัตถุประสงค์เพื่อศึกษากฎหมาย หลักเกณฑ์ และเงื่อนไขต่าง ๆ ที่เกี่ยวข้องกับการขออนุญาตจดทะเบียนรถยนต์สามล้อในปัจจุบัน ปัญหา และข้อจำกัดรวมถึงผลกระทบที่ได้รับจากกฎหมายหลักเกณฑ์ และเงื่อนไขต่าง ๆ ที่เกี่ยวข้องกับการขออนุญาตจดทะเบียนรถยนต์สามล้อในปัจจุบัน ตลอดจนศึกษาและวิเคราะห์ และเปรียบเทียบลักษณะโครงสร้าง ลักษณะการใช้งานตามประโยชน์ใช้สอย และสถิติอุบัติเหตุทางการจราจร เพื่อเสนอแนวทางในการพิจารณานำสู่การปรับปรุงกฎหมาย หลักเกณฑ์ และเงื่อนไขต่าง ๆ ที่เกี่ยวข้องกับการขออนุญาตจดทะเบียนรถยนต์สามล้อ จากการวิเคราะห์คุณสมบัติ และลักษณะโครงสร้าง ของรถยนต์สามล้อมีความแข็งแรง และสามารถบรรทุกสินค้า หรือผู้โดยสารได้ในจำนวนที่มากกว่ารถจักรยานยนต์ รวมไปถึงก่อให้ความสะดวก ความสบาย และคล่องตัวกับผู้ใช้งาน และผู้โดยสารตามหลักการขนส่ง รวมถึงก่อให้เกิดความปลอดภัยต่อสินค้า และผู้ใช้งานอีกด้วย รถยนต์สามล้อมีขนาดที่เล็กกะทัดรัดกว่ารถยนต์ และมีเหมาะสมกับสภาพถนนหรือลักษณะซอยในเมืองต่าง ๆ เช่น กรุงเทพมหานครที่มีซอยตันมากถึง 45% โดยใช้พื้นที่ในการจอดรถ และพื้นที่ในช่องทางเดินรถที่น้อยกว่า สามารถเดินรถในซอยแคบและกลับรถในซอยตันได้ แต่สามารถบรรทุกสินค้า หรือผู้โดยสารได้ไม่ต่างกันมาก อีกทั้งมีอุปกรณ์ป้องกันความปลอดภัยบางส่วนที่คล้ายคลึงกัน เช่น เข็มขัดนิรภัย โดยข้อมูลด้านอุบัติเหตุรถยนต์สามล้อส่วนบุคคล รถจักรยานยนต์ และรถยนต์พบว่าลักษณะของโครงสร้าง ของรถยนต์สามล้อและความเร็วตามกฎหมายที่ต่ำกว่ายานพาหนะประเภทอื่น ๆ ส่งผลให้เกิดความปลอดภัยกับผู้ใช้งานมากกว่ารถจักรยานยนต์ทั้งในด้านความรุนแรงต่อการบาดเจ็บ และอัตราการเสียชีวิตของผู้ใช้งานยานพาหนะ พบว่าอัตราผู้เสียชีวิตของรถยนต์สามล้อมีน้อยกว่ารถจักรยานยนต์ และพบว่าในประเทศสิงค์โปร์ มีการใช้เพื่อการขนส่งจะต้องอยู่ภายใต้การควบคุมดูแลของนิติบุคคล ซึ่งถือเป็นมาตรการที่ทำให้เกิดความรัดกุมด้านการนำไปใช้งานให้ถูกประเภท รวมถึงประเทศอินเดียที่มีข้อกำหนดให้นำรถยนต์สามล้อที่ใช้ในธุรกิจเหล่านี้ ไปตรวจสภาพประจำปีเพื่อให้เกิดความปลอดภัยกับผู้ขับขี่ และผู้ใช้ถนนร่วมกัน อีกทั้งในปัจจุบันมีมาตรการส่งเสริมให้เปลี่ยนแปลงเป็นพลังงานไฟฟ้า เพื่อสอดคล้องต่อมาตรการด้านสิ่งแวดล้อม ดังนั้นจึงมีความเหมาะสมที่จะนำแนวทางการควบคุมดูแลของรถยนต์สามล้อส่วนบุคคลในประเทศสิงคโปร์และอินเดียมาประยุกต์ใช้เพื่อเป็นแนวทางในการขออนุญาตจดทะเบียนรถยนต์สามล้อส่วนบุคคลในประเทศไทย อีกทั้งยังเป็นการส่งเสริมธุรกิจของภาคเอกชนต่าง ๆ ในสามารถมีทางเลือกในการใช้งานยานพาหนะอย่างเหมาะสม และลดต้นทุนของธุรกิจ รวมไปถึงการส่งเสริมการใช้เครื่องยนต์พลังงานไฟฟ้าเพื่อลดมลภาวะในประเทศไทยเช่นกัน

ประเทศไทยได้ก้าวเข้าสู่ “สังคมผู้สูงอายุโดยสมบูรณ์" เมื่อปี 2564 โดยมีผู้สูงอายุที่มีอายุ 60 ปีขึ้นไปกว่า 12.3 ล้านคน และมากเป็นอันดับ 2 ของอาเซียน นอกจากนี้ ยังมีคนพิการ 2.1 ล้านคน ปัจจุบันผู้สูงอายุ คนพิการ และผู้มีปัญหาสุขภาพ ประสบปัญหาด้านการเดินทาง กล่าวคือ มียานพาหนะที่สามารถรองรับกลุ่มคนพิเศษเหล่านี้น้อยเกินกว่าความต้องการ อีกทั้ง ยานพาหนะบางประเภทยังมีข้อจำกัดในการรองรับการใช้งานสำหรับผู้ที่ใช้วีลแชร์ขนาดใหญ่ หรือการเข้าถึงเส้นทางที่คับแคบ ดังนั้นรถยนต์โดยสารที่มีที่นั่งไม่เกิน 10 ที่นั่ง สำหรับรับส่งคนพิการและผู้สูงอายุ จึงเป็นอีกทางเลือกหนึ่งที่ควรได้รับการผลักดันและส่งเสริมให้เกิดการผลิตและให้บริการมากขึ้น เนื่องจากเป็นรถยนต์ที่สามารถนำมาใช้ในลักษณะของรถยนต์ส่วนตัวและรถขนส่งสาธารณะได้ มีพื้นที่เพียงพอสำหรับการรองรับการใช้งานของผู้ใช้วีลแชร์แบบธรรมดาและไฟฟ้าทั้งขนาดเล็กและใหญ่ และมีอุปกรณ์ที่ช่วยลดภาระและการพึ่งพาคนรอบข้างของคนพิการและผู้สูงอายุ อย่างไรก็ตาม รถยนต์โดยสารที่มีที่นั่งไม่เกิน 10 ที่นั่งสำหรับรับ-ส่งคนพิการและผู้สูงอายุ ยังมีปัญหาด้านกฏหมายอยู่หลายประการ ประการที่ 1 คือปัญหาเรื่องต้นทุนการผลิตที่ค่อนข้างสูงเนื่องจากรถยนต์ดังกล่าวเข้าข่ายที่ต้องเสียภาษีสรรพสามิต 25% - 40% ตามพระราชบัญญัติภาษีสรรพสามิต พ.ศ.2560 และบัญชีพิกัดอัตราภาษีสรรพสามิต พิกัดที่ 06.02 ในกฎกระทรวงกำหนดพิกัดอัตราภาษีสรรพสามิต (ฉบับที่ 23) พ.ศ. 2565 ทำให้ผู้ให้บริการต้องแบกรับต้นทุนที่สูง จึงมีการผลิตรถยนต์ประเภทดังกล่าวน้อยเกินกว่าความต้องการของตลาด ประการที่ 2 ประเทศไทยยังไม่มีมาตรการสนับสนุนและข้อกำหนดด้านความปลอดภัยที่ชัดเจนในการควบคุมการผลิตและให้บริการอย่างเหมาะสมที่จะควบคุมให้การใช้รถประเภทนี้เพียงพอต่อความต้องการและมีความปลอดภัยสำหรับผู้ใช้งาน งานวิจัยเล่มนี้จึงจัดทำขึ้นเพื่อศึกษากฏหมาย มาตรการการส่งเสริมและควบคุมความปลอดภัยในการผลิตและให้บริการรถยนต์โดยสารที่มีที่นั่งไม่เกิน 10 คนสำหรับรับส่งคนพิการ-ผู้สูงอายุของไทย และประเทศญี่ปุ่น เพื่อวิเคราะห์ เปรียบเทียบ และหาแนวทางแนะนำเพื่อปรับใช้ให้เหมาะสมกับบริบทของประเทศไทย จากการศึกษาพบว่ารัฐบาลไทยควรกำหนดมาตรการการส่งเสริมและควบคุมรถยนต์โดยสารดังกล่าว โดยกำหนดมาตรการทางภาษีที่เหมาะสม ออกกฏเกณฑ์การขออนุญาตผลิตรถยนต์ดังกล่าวให้ชัดเจนเพื่อลดขั้นตอนการดำเนินการและภาระของเจ้าหน้าที่ ให้เงินอุดหนุนและเงินสินเชื่อสำหรับคนพิการ ผู้สูงอายุ และเจ้าของกิจการที่จ้างงานคนพิการและผู้สูงอายุสำหรับซื้อรถยนต์โดยสารดังกล่าว รวมถึงการติดตั้งอุปกรณ์ที่จำเป็น นอกจากนี้ควรมีการกำหนดมาตรฐานความปลอดภัยเพื่อควบคุมการผลิตรถยนต์ดังกล่าวให้มีความปลอดภัยตามมาตรฐานสากล มาตรการเหล่านี้จะเป็นประโยชน์ต่อการยกระดับคุณภาพชีวิตของคนพิการและผู้สูงอายุ รวมทั้งเพิ่มศักยภาพในการแข่งขันด้านการท่องเที่ยวเชิงสุขภาพและเชิงการแพทย์ของประเทศไทย อีกทั้งทำให้การผลิตรถยนต์มีคุณภาพตามมาตรฐานที่กำหนด และผู้ใช้บริการได้รับความปลอดภัยมากขึ้น

ธุรกิจสัตว์บำบัดมีความนิยมมากขึ้นในประเทศไทย มีแนวโน้มอัตราการเจริญเติบโตของธุรกิจเพิ่มสูงขึ้นและถือเป็นธุรกิจใหม่ที่เริ่มได้รับความนิยม เหตุผลสำคัญที่ทำให้ธุรกิจประเภทนี้เจริญเติบโตคือประชากรของไทยบางส่วนประสบปัญหาทางด้านจิตใจ และอารมณ์ อันเนื่องมาจากการเปลี่ยนแปลงทางสังคม มีการนำสัตว์เลี้ยงมาฝึกฝนให้เกิดทักษะในการดูแลผู้ที่มีความ ซึมเศร้า ผู้สูงอายุ หรือเด็ก เพื่อให้จิตใจหรืออารมณ์ดีขึ้น หรือกระตุ้นพัฒนาการของเด็ก แต่อย่างไรก็ตามเนื่องจากธุรกิจสัตว์บำบัดมีความเกี่ยวข้องกับการคุ้มครองสิทธิและสวัสดิภาพสัตว์จึงต้องมีแนวทางหรือมาตรการทางกฎหมายที่มีความชัดเจนในการกำกับควบคุมดูแลธุรกิจสัตว์บำบัด และในทางกลับกันควรมีมาตรการในการส่งเสริมให้ธุรกิจสัตว์บำบัดมีมาตรฐาน เพื่อให้ไม่เป็นการทารุณกรรมสัตว์ทางกายและจิตใจ จากการศึกษากฎหมายของประเทศไทยและกฎหมายที่เกี่ยวข้องกับธุรกิจสัตว์บำบัดพบว่าประเทศไทยยังไม่มีมาตรการทางกฎหมายที่เข้ามากำกับควบคุมดูแลธุรกิจสัตว์บำบัดโดยตรงแต่เป็นการใช้กฎหมายทั่วไปควบคุมดูแลกิจการที่เกี่ยวข้องกับสัตว์ในทุกกรณี เช่น พระราชบัญญัติการทารุณกรรมและการจัดสวัสดิภาพสัตว์ พ.ศ. 2557 เป็นต้น เมื่อพิจารณาแนวทางในการปฏิบัติพบว่าไม่มีแนวทางในการปฏิบัติเกี่ยวกับธุรกิจสัตว์บำบัดที่มีความชัดเจน มีประสิทธิภาพในการควบคุมธุรกิจสัตว์บำบัดนี้ ทำให้เกิดช่องโหว่ให้ผู้ประกอบธุรกิจมีการกระทำอันเป็นการทารุณกรรมสัตว์ทางจิตใจ จะเห็นได้ชัดเจนว่ากฎหมายของประเทศไทยยังไม่สามารถควบคุมธุรกิจสัตว์บำบัดได้ รวมถึงการกำหนดโทษแก่ผู้กระทำความผิดยังไม่มีผลในภาคบังคับทั้งในส่วนของการใช้บังคับกฎหมายและการลงโทษทางกฎหมายยังไม่ชัดเจน เมื่อพิจารณาในส่วนของกฎหมายประเทศสหรัฐอเมริกาพบว่ากฎหมายของสหรัฐอเมริกามีมาตรฐานในการคุ้มครองสวัสดิการและสวัสดิภาพสัตว์ที่เหมาะสำหรับการนำมาใช้เป็นแนวทางในประเทศไทย โดยได้ทำการศึกษากฎหมายของสหรัฐอเมริกาเนื่องจากความเป็นหลักสากลและประเทศไทยได้นำหลักกฎหมายมาปรับใช้ ดังนั้นผู้เขียนจึงมีข้อเสนอแนะว่าให้มีแนวทางในการควบคุมธุรกิจสัตว์บำบัด มีการขอใบอนุญาตประกอบธุรกิจที่มีความเกี่ยวข้องกับสัตว์ จากหน่วยงานหรือองค์กรที่เกี่ยวข้องอย่างใกล้ชิดตั้งแต่กระบวนการขอใบอนุญาตเปิดกิจการ ต้องมีความชัดเจนเกี่ยวกับรูปแบบวิธีการ และต้องมีผู้ที่มีความรู้ความเชี่ยวชาญเฉพาะด้านมาดูแล รัฐควรจัดหน่วยงานโดยเฉพาะเจาะจงในการกำหนดหน้าที่เกี่ยวกับการดูแลสวัสดิภาพสัตว์และควรกำหนดหน้าที่ให้หน่วยงานที่เกี่ยวข้อง โดยเฉพาะหน่วยงานหรือองค์กรในท้องถิ่นต้องมีความรู้เฉพาะด้านที่เปิดธุรกิจสัตว์บำบัด เพื่อเป็นการสอดส่องดูแลกิจการสัตว์บำบัด ตรวจสอบใบอนุญาตให้ตรงตามมาตรฐานที่กฎหมายกำหนด เป็นการควบคุมไม่ให้เกิดการทารุณกรรมสัตว์ ซึ่งอาจเป็นไปในลักษณะการส่งเสริมให้การประกอบธุรกิจเกี่ยวกับสัตว์ให้ตรงตามมาตรฐานอันจะส่งผลดีต่อผู้รับบริการและสัตว์บำบัดอย่างดีที่สุด
