Reckless Associations, Jane R. Bambauer, Saura Masconale, Simone M. Sepe Jan 2023

Reckless Associations, Jane R. Bambauer, Saura Masconale, Simone M. Sepe

UF Law Faculty Publications

This Article provides a theoretical foundation and practical guide for a new form of liability that has proven necessary in the Internet era: the tort of Reckless Association. This tort would hold de facto leaders of informal networks responsible when radicalized members of the network cause physical harm to others. Recent prosecutions of the leaders of the Oath Keepers and other white supremacists who organized the Charlottesville protest, and rumblings of a similar prosecution against Donald Trump, demonstrate that there is a public appetite for this form of legal responsibility. To date, these prosecutions proceed on theories of incitement or …

The Fallibility Of The Brandenburg Test Through The Lens Of The Capitol Insurrection, Lauren M. Hausman Jan 2023

The Fallibility Of The Brandenburg Test Through The Lens Of The Capitol Insurrection, Lauren M. Hausman

Western New England Law Review

This Article explores the insurrection that occurred at our Capitol in relation to the Brandenburg test. The paper seeks to discuss whether free speech has gone too far, whether Brandenburg needs reform, and how we could effectuate such changes. While the Article certainly has political undertones, sincere efforts were made to present the facts in a more neutral fashion. Despite the political nature of the Article, I wholeheartedly believe that discussing the insurrection is critical to not only our nation’s history, but to the law.

The growing demand for electricity in Europe has increased the need for a more flexible and sustainable power system. In recent years, Demand Response (DR) has emerged as a promising solution to meet this need, by providing an opportunity for residential and smaller commercial consumers to actively participate in the electricity market. This research paper investigates the potential for DR among the residential community and small commercial electricity consumers in Europe and identifies the technological barriers and drivers that impact consumer engagement with DR programs in Europe. The different DR opportunities are identified and validated at the six different demo …

Caregiving Automatons: Gender, Care, And Disability In Poland, Michalina Grzelka Jan 2023

Caregiving Automatons: Gender, Care, And Disability In Poland, Michalina Grzelka

Legacy Theses & Dissertations (2009 - 2024)

The last few years in Poland have seen the increasing visibility of disabled people and family caregivers who demand the introduction of public policies more responsive to their needs. Such development suggests a shift from deeply rooted gendered ideas about caregiving and the rise of activism of people with disabilities and family caregivers who call for solutions to the neoliberalization of care work. However, despite growing attention to disability and care within anthropology, few studies have focused explicitly on caregiving relations in the context of disability, especially in the formerly socialist states of Central and Eastern Europe. This dissertation attempts …

Pleang (แผลง) : Portraying Prince Naris’ Cultural Hybridity In Architectural Forms, Chittawadi Chitrabongs, Malin Phlernjai

NAKHARA (Journal of Environmental Design and Planning)

His Royal Highness Prince Narisaranuvativongse (1863 –1947) was a court designer whose works transcended various fields of art, design, music, and architecture in Siam. Since his death, the prince’s legacy has been fading from the public consciousness. This research comprises an architectural design proposal to resurrect recognition of his designs, and to create public connectivity in terms of physical spaces by focusing on Prince Naris’ way of thinking, as expressed in a Thai word, pleang (แผลง), employed by Prince Naris himself. Pleang does not mean conventional, nor does it mean atypical. Pleang is a way of thinking that has limited …

Assessment Of The Knowledge, Attitude, And Practice Of Postoperative Pain Management Among Nurses In Medical And Surgical Wards At Aga Khan University Hospital, Veronicah Wangui

MSc in Advanced Practice Nursing

Postoperative pain remains a significant global problem despite overall pain management advances. Postoperative pain may alter neural pathophysiology, including peripheral and central sensation, and lead to chronic pain syndrome. Postoperative pain management implies professional care to improve patients’ comfort and early ambulation, decrease analgesia side effects, and reduce chronic pain. Nurses taking care of postoperative patients must be equipped with adequate knowledge and skills to be effective. This study aimed to assess the knowledge, attitude, and nurses' practice on postoperative pain management among nurses in medico-surgical wards at Aga Khan University Hospital. It is a quantitative descriptive cross-sectional study. Data …

Reporting Values, Partnership With Parents And The Hidden Curriculum: A Qualitative Study, Veronica Elizabeth Morcom Jan 2023

Reporting Values, Partnership With Parents And The Hidden Curriculum: A Qualitative Study, Veronica Elizabeth Morcom

Australian Journal of Teacher Education

The Australian government funded the West Australian project ‘Reporting Values to Parents’ as part of ‘The Values in Action Schools Project’ (2009). The two aims of the qualitative study were to develop a common values language supported by observable behaviours and an appreciation that values education is fundamental to schooling. Teachers used an action research process to create authentic values activities and involve parents in the assessment process. Parents shifted their perspectives to ratify teachers’ role to teach values explicitly. Students experienced a deeper sense of connection and belonging at school. Educators can adapt the activities in this paper to …

Measuring Australian Preservice Teachers’ Asia Capability And Perceived Readiness To Teach The Asia Cross-Curricular Priority., James F. Toohey, Peter R. Grainger, Michael Carey

Australian Journal of Teacher Education

Preservice teachers are soon-to-be graduates expected to deliver the Cross-Curricular Priority ‘Asia and Australia’s Engagement with Asia’. Teachers of all learning areas are expected to teach about Asia, irrespective of their knowledge or capabilities in Asian contexts. The curriculum review has revised expectations for ‘Asia literacy’ in graduates. The changes de-emphasise cultural knowledge, and instead, promote relationship-building and intercultural understanding. This research identified 31 preservice teachers’ perceptions of their Asia literacy and preparedness to teach the related curriculum initiative. Grainger and Christie’s (2016) linguistic model was used to define and measure Asia literacy. Thematic analysis identified (1) how participants conceptualised …

Theming, Service Performance, And Downstream Effects Of Subjective Leisure Experiences, Brian J. Hill, Patti Freeman, Gary Ellis, Emily Catalan

Faculty Publications

We examined determinants (i.e., theming and service performance) and results (proclivity to recommend, enjoyment, perceived value of time spent) of structured leisure experiences. Structured leisure experiences were measured in terms of intensity of engagement (focus on unfolding narrative), absorption (focus on sensory stimuli), and immersion (focus on performance) during participation. Experience measures (n=310) reported by 168 young adults upon exiting a variety of leisure, recreation, and hospitality venues supported the research hypotheses.

Research outputs 2022 to 2026

Sports, arts and major events are deeply embedded in the Australian way of life. Weekend matches, concerts and festivals bring us together - to cheer, to share pride and excitement, to feel connected to each other and to keep building our national story.

When we barrack for our beloved teams, discover the work of a new local artist or laugh until our cheeks hurt at a comedy show, we are taking part in a ritual that has shaped social and cultural life in Australia for generations.

Climate change – driven by burning coal, oil and gas – is putting all …

Contact lens (CL) practice is an ever-changing field with clinical knowledge, techniques and equipment continuously evolving. These new developments are backed with clinical trials and research to ensure that practitioners feel confident that there is an evidence base to support these advances. Evidence-based practice is now a crucial part of CL practice, and its importance also filters down to CL education. For example, lectures are one of the most popular tools for an educator but, is standing at the front of a lecture theatre full of students a more effective way of teaching than providing the same material for students …

ARRESTING ASSEMBLY: AN ARGUMENT AGAINST EXPANDING
CRIMINALLY PUNISHABLE PROTEST
ALLISON M. FREEDMAN

ABSTRACT

In recent years, public protests have shed light on societal inequities that had previously gone unheard. Yet instead of responding to protesters’ concerns, many state legislators are attempting to silence disenfranchised groups by introducing hundreds of “anti-protest” bills. This is a recent phenomenon and one that is accelerating—the largest wave of “anti-protest” bills was introduced on the heels of the most robust protest movement in recent history, Black Lives Matter during the summer of 2020.

Although it is clear that legislators are attempting to tamp down public …

Nursing Students Doing Gender: Implications For Higher Education And The Nursing Profession, Lesley J. Andrew, Ken Robinson, Julie Dare, Leesa N. Costello Jan 2023

Nursing Students Doing Gender: Implications For Higher Education And The Nursing Profession, Lesley J. Andrew, Ken Robinson, Julie Dare, Leesa N. Costello

Research outputs 2022 to 2026

The average age of women nursing students in Australia is rising. With this comes the likelihood that more now begin university with family responsibilities, and with their lives structured by the roles of mother and partner. Women with more traditionally gendered ideas of these roles, such as nurturing others and self-sacrifice, are known to be attracted to nursing as a profession; once at university, however, these students can be vulnerable to gender role stress from the competing demands of study. A qualitative research design, guided by Gadamer's hermeneutic philosophy, explored the gendered behaviours and experiences of 22 women nursing students, …

Influenced: Performing Gender And Femininity In Mormon And Evangelical Online Spaces, Kathryn Ann Davis Jan 2023

Influenced: Performing Gender And Femininity In Mormon And Evangelical Online Spaces, Kathryn Ann Davis

CGU Theses & Dissertations

The construction of a digital self is fully performative; online identities are simultaneously highly curated, edited, and uniquely personal. These spaces allow users to become producers of identity and religious narrative. In this dissertation I examine the online communities which are a dynamic and developing aspect of religious life in America. I will argue that religious women have created increasingly diverse virtual spaces for themselves, and that these online communities give women a safe space to talk about their faith and create common bonds with other female adherents. I have engaged with these creators directly through oral history interviews and …

Thai Actors And Their Methods Of Characterization, Thanyarat Praditthaen, Prit Supasetsiri, Porawan Patayanon

Manusya, Journal of Humanities

This article discusses findings from interviews with 26 Thai actors on their methods of characterization. It was found that Thai actors have two concepts regarding their style and beliefs towards acting: (1) good acting naturally portrays normal characters in a realistic manner, (2) a major component of acting is ‘becoming the character.’ Participants reported needing a character’s actions to be logical, and therefore need to thoroughly analyze a character so they can completely transform into the character. Methods of characterization were found to be consistent with approaches in the works of Stanislavski. This is in part due from Pantoomkomol (1995)’s …

Needs Salt, Joshua Lang Jan 2023

Needs Salt, Joshua Lang

Dance (MFA) Theses

Researcher Joshua Lang investigates the development of the Eden narrative in western culture. Near the beginning of the book of Genesis, the Eden narrative provides a lens to culturally significant elements of early Hebrew culture. Genesis illustrates early Hebrew culture’s relationship with the natural world, sex, sin, judgment, and death. Similarly, John Milton’s retelling of the narrative in Paradise Lost divulges information about the culture that Milton lived in, as well as a great deal about the author himself. Milton’s blindness, and his opinions on heteronormative marriage, Protestantism, sin, judgment, and death are evident in the text. In Paradise Lost …
