Copyright Infringement And Enforcement In Ghana: A Comparative Study, Doreen Adoma Agyei
Copyright Infringement And Enforcement In Ghana: A Comparative Study, Doreen Adoma Agyei
SJD Dissertations
Copyright infringement is a widespread problem in developed and developing nations and particularly concerning in Ghana. Many talented creators in Ghana have a strong desire to produce original creative works and are enthusiastic about committing themselves to this pursuit. Additionally, many more aspire to pursue these endeavours into professional careers. However, upon releasing their works, they are unfortunately immediately faced with infringements in nearly all copyright industries. These violations have become so common that they have unfairly placed rightsholders’ original works in competition with the infringers. Within this context, many talented creators, mostly self-funded, lack the incentive to pursue their …
Culture Sustainability Through Storytelling : A Study Of Patricia Riley’S “Wisteria” And “Damping Down The Road”, Ankita Das, Priyanka Chhaparia
Culture Sustainability Through Storytelling : A Study Of Patricia Riley’S “Wisteria” And “Damping Down The Road”, Ankita Das, Priyanka Chhaparia
Journal of Urban Culture Research
In the late 1980s, the United Nations introduced a comprehensive vision of sustainable development, encompassing economic growth, social inclusion, and environmental balance. However, the crucial role of culture within development has very often been overlooked. Contemporary insights emphasize that culture is integral to sustainable development. This paper, through an analysis of two short stories by Native American author Patricia Riley, sheds light on the significance of storytelling as a fundamental element of culture. It explores how these narratives emphasize the need to cultivate a culturally aware society and how ‘storytelling’ contributes to cultural preservation and identity. Focusing specifically on the …

Wading In The Covid-19 Pandemic : Fate And Ways Forward For Malaysian Creative Cities, Suet Leng Khoo, Nicole Shu Fun Chang
Journal of Urban Culture Research
Since the 2019 Wuhan outbreak, the COVID-19 pandemic badly hit all sectors of the global economy. The creative and cultural sectors (CCS) are among the hardest hit. The value chain of CCS (i.e. creation, production, distribution, accessibility to contents) was severely immobilized. In cities, mitigation measures implemented to contain Covid-19 significantly downsized the CCS. Jobs, incomes and livelihoods of creative and cultural employees were threatened. These scenarios question the readiness, resilience and sustainability of CCS, particularly in cities. The fate and way forward of creative cities are now a grave concern. This paper aims to investigate the impacts, developments, reactions …
Everyone Is On Their Phones: Eighth Graders' Struggle With Social Media In School, George Weinhardt
Everyone Is On Their Phones: Eighth Graders' Struggle With Social Media In School, George Weinhardt
West Chester University Doctoral Projects
This qualitative study examined social media in the school setting from the point of view of eighth-grade participants. This study implemented a focused ethnography, examining a group of individuals’ perspectives on a focused area of their shared culture. Using critical theory, this study examined qualitative data with the concepts of structures, subjectivity, and power at the confluence of social media and school for eighth-grade students. Qualitative data were collected using five semi-structured focus groups, artifact analysis, fieldnotes, and memos. The findings highlighted that eighth-grade students acknowledge that there is a struggle between social media and school. This struggle alters their …

European Court Of Human Rights' Ruling In Georgia V. Russia (Ii) And Its Application To The Current Crisis In Ukraine, Edward N. Cain
European Court Of Human Rights' Ruling In Georgia V. Russia (Ii) And Its Application To The Current Crisis In Ukraine, Edward N. Cain
Loyola University Chicago International Law Review
Georgia v Russia (II) represents an important decision in the European Court of Human Rights case law. The Court sets out an important interpretation of Article 1 of the European Convention on Human Rights regarding the jurisdiction of signatory parties during times of invasion and war. The Court articulated that during active hostilities, there is no positive or negative obligation on the invading country to uphold or defend the human rights of the civilians of the invaded country. This is because they do not have effective control over the local population due to the dynamic nature of war. This precedent …
The Record High Of Forcibly Displaced Persons, International Law, And The Comparative Case Of Ukraine And Afghanistan: The Response To A War We Started Versus A War We Opposed, Erin Vance
Loyola University Chicago International Law Review
This Comment addresses the rules and customs of international law that govern forcibly displaced persons, and how such laws have created wide gaps that have allowed the issues and challenges surrounding forced migration to not only persist, but also become increasingly worse. Specifically, Article 14 of the Universal Declaration of Human Rights provides, "everyone has the right to seek and to enjoy in other countries asylum from persecution," but places no accompanying obligation upon States to grant asylum and refugee status to these forcibly displace persons. Rather, States are given significant discretion when interpreting and defining responsibilities under Article 14. …

El Sobredimensionamiento Y Otros Recursos Plásticos Como Representación De La Capacidad Extática–Visionaria En El Arte Chamánico Americano, Ana María Llamazares
Segundo congreso internacional de iconografía precolombina. Barcelona, 2023. Actas.

Trademark Tarnishmyths, Jake Linford, Justin Sevier, Allyson Willis
Trademark Tarnishmyths, Jake Linford, Justin Sevier, Allyson Willis
Scholarly Publications
Trademark law protects famous marks from dilution by tarnishment, defined by statute as use likely to "harm the reputation of the famous mark." Tarnishing uses are typically those that connect a mark with disreputable goods or topics, like sex or drugs. Mark owners worry that consumers will not purchase products connected with sexually explicit or drug-related materials, and courts often presume the same. If those associations likely cause consumers to withhold custom or dissipate goodwill consumers have invested in the mark, anti-tarnishment protection might be justified. But if that harm is more mythic than real, the law penalizing tarnishing use …

Entail, Elopement, And Marriage Law In Pride And Prejudice, Lynda A. Hall
Entail, Elopement, And Marriage Law In Pride And Prejudice, Lynda A. Hall
English Faculty Articles and Research
"The famous first lines of Pride and Prejudice, 'It is a truth universally acknowledged, that a single man in possession of a good fortune, must be in want of a wife' (3), alert the reader to a story about marriage. This 'universal' truth is presented ironically, of course, since it is the women without a good fortune who are in want of husbands. Remember that Emma Woodhouse indicates that she does not need to marry since she does not need “‘fortune’” or “‘consequence’” (E 84). But the Bennet sisters have neither, so '[t]he business of [Mrs. Bennet’s] life …

Shifting Once Again, Hannah Dusek
Shifting Once Again, Hannah Dusek
Undergraduate Theses, Professional Papers, and Capstone Artifacts
Change is constant; an action and a reaction. “Shifting Once Again” is an exploration of how changes in an individual affect one's relationship to themself and others. Figuring out who we are - that is change. Such shifts can be terrifying, exciting, and in some cases, underwhelming. I invite you to reflect on these shifts in your own life as you watch this piece, and how they might have even brought you to this very audience tonight. The knowledge that everyone around us is constantly going through changes can be comforting. Finding comfort in those changes, without resistance, is what …

Terror And Tenderness In Criminal Law, M. Eve Hanan
Terror And Tenderness In Criminal Law, M. Eve Hanan
Scholarly Works
The criminal legal system is at a crossroads. Calls for abolition are met with calls for modest adjustments or maintenance of the status quo. What frequently emerges from these polarities is a promise that police, prosecutors, judges, and other government actors will use their vast discretion to reduce the harmful excesses of criminal legal practices. Initiatives like “compassionate release,” “second look sentencing,” and the progressive prosecutor’s pledge to “charge with restraint” are examples of this promise to exercise discretion with care. In word choice and design, these discretionary reforms suggest tempering harsh criminal legal practices with leniency and individualized consideration—a …
I Am A Camera, Subverted: Reflexivity, Sexuality, And Filming Styles In Bob Fosse’S 'Sweet Charity' (1969), 'Cabaret' (1972), And 'All That Jazz' (1979), Steven Downes
School of Law, Humanities and Social Sciences Theses
The musical films of Bob Fosse, 'Sweet Charity' (1969), 'Cabaret' (1972), and 'All That Jazz' (1979) offer a radical alternative to the ‘arcadian’ musical format with edgier and darker themes as a response to the rapidly developing socio-politico climate and the sexual revolution. However, although 'Cabaret' remains well documented, his other musical films 'Sweet Charity' and 'All That Jazz', remain primarily neglected in academia, which I will rectify. Moreover, while many prolific writers and scholars, including Laura Mulvey and Rick Altman, have previously analysed the movie and film musical from a heteronormative male gaze perspective, this is at odds with …
