The rules governing the scope of liability in cases where firearms cause injuries—some well-established, others fairly novel—help to define the responsibilities of users, owners, and sellers of these popular but dangerous products. As the U.S. Supreme Court has recently expanded an individual’s right to keep and bear arms, some have wondered whether the Second Amendment might operate to limit the reach of these various tort doctrines. Litigants have long tried to manufacture a final, appealable decision by voluntarily dismissing their claims after an adverse interlocutory decision. Recently—and especially since the Supreme Court’s decision in Microsoft Corp. v. Baker—courts have thought that these dismissals created a jurisdictional problem. Either the voluntary dismissal did not produce a final decision, or the dismissal extinguished Article III jurisdiction. But the problem with these appeals is not jurisdictional. It’s waiver. A voluntary dismissal after an adverse interlocutory decision waives the right to appellate review. Background: Peripheral intravenous catheter (PIVC) failure and difficult intravenous access (DIVA) are pervasive issues causing patient suffering and increased costs. Despite their prevalence, there is a gap in internal medicine and pediatric resident training to manage these challenges effectively.

Objective: This study aimed to assess the value of ultrasound-guided-PIVC (USGPIVC) education for internal medicine and pediatric residents and the impact of a 1-hour multidisciplinary workshop on their knowledge and confidence.

Methods: A cross-sectional survey study was conducted at an academic medical center in 2022 to assess residents’ perceptions of USG-PIVC education. This was followed by a USG-PIVC simulation-based workshop with …

Terms such as “woke,” “social justice,” “cancel culture,” “identity politics,” “politically correct,” “critical race theory,” and “DEI” have been increasingly misused and politicized by both the left and the right in recent years. This paper will examine the Hebrew Bible and explore what it says about social justice, compassion for the indigent, inclusion, and many other terms causing such an uproar. The authors assert that the ancient prophets, the true social justice warriors, would be horrified by the actions of both the left and right.

The importance of values has been continuously studied, and the consensus is that values matter. However, the issue of just how much they matter remains open to various interpretations, including the importance of value clarity and congruency. This study examined the impact of personal and organizational values clarity on commitment, performance, and motivation. An online survey involving 8,442 managers was collected in the same way as previous studies on value clarity and consistency (Posner & Schmidt, 1993; Posner, 2010), but unlike previous studies, managers outside the United States were included. Critically Analyzing The Meanings Of “Critical” Media Literacy, W. James Potter

Journal of Media Literacy Education

This study provides a critical analysis into how authors of publications about critical media literacy express what they mean by the term. The use of multiple strategies to examine the degree to which these authors exhibit a sharing of meaning led to the conclusion that there are far more differences than commonalities across definitions of critical media literacy. The implications of this conclusion raise important questions about the value of a literature where authors seem to express so many different meanings for the concept that they use to label their common concern.

Reverse Pseudo-Gours: A New Sub-Type Of Folia Observed In The Nerja Cave (Se Spain), Cristina Liñán Baena, Concepción Jiménez De Cisneros, Yolanda Del Rosal, Paolo Forti

A new sub-type of folia named “reverse pseudo-gour” has been observed and described in the Nerja Cave, southern Spain. It consists of fairly vertical, thin barriers (about 5 mm high and 2 mm thick) that develop on the underside of a sub-horizontal surface (shelfstone) and grow in the opposite direction to normal gours (rimstone dams), generating sinuous shapes. Their mineral composition is essentially calcium carbonate, although globular aggregates composed of clay and phosphate minerals have also been identified. When students find value in technology and can apply that technology in their learning and beyond, they become more actively engaged in the classroom. After having first-year seminar students use Web 2.0 technology, specifically a website creation tool as part of an assignment, they participated in a survey to provide feedback over their engagement in creating a Google Sites® website. Quantitative and qualitative data was collected and analyzed to determine students’ perceptions of their engagement when using website creation tools to complete a modified discussion assignment. The New Markets Tax Credit (“NMTC”) is a federal tax incentive used to promote investment in low-income neighborhoods. Many of these neighborhoods are home to historically marginalized communities. However, very few minority-led institutions participate in the NMTC program. This Article provides the first theoretical and empirical exploration of the underrepresentation of minority-led institutions in the NMTC program. Based on original interviews with representatives of Community Development Entities (“CDEs”), investors, borrowers, and consultants who participate in the NMTC program, this Article describes the “NMTC ecosystem,” a complex, relationship-driven network of NMTC program participants who influence decision-making and create opportunities for success …

There is an emphasis on selective pharmacology (where available), plus links to the open access knowledgebase source of drug targets and their ligands (www.guidetopharmacology.org), which provides more detailed views of target and ligand properties. Talking about race can improve children’s ethnic identities, prepare them for encounters with racism, and reduce their racial biases. Yet adults hold intuitive beliefs (e.g., children do not notice race) that limit their conversations about race with children. Children can also initiate conversations about race, but children have been found to avoid talking about race by 10 years. It has been suggested that children avoid talking about race because of colorblind norms, but children’s reasoning about color blindness as a norm is not well understood. In this paper I discuss a novel construction in English, restricted to existentials and possessive have sentences, exemplified by sentences such as There’s all sand in my hair. I argue that the syntax and the semantics of this construction, which I have labeled the completive all construction, can be explained only if all is understood to be modifying a silent element (in the sense of Kayne 2004). This report is an update to a techno-economic feasibility study undertaken in 2018 to examine the efficacy of building and operating a microgrid in Downtown Cleveland, Ohio. Many factors have changed since 2018, including the 2022 passage of the Inflation Reduction Act, pursuant to which significant tax credits will make microgrids and grid edge technology adoption more attractive. Abstract After two jury trials, two trips to the Federal Circuit, and two petitions to the Supreme Court, the Court this past term decided Amgen Inc. v. Sanofi without much controversy. In a unanimous decision, the Court affirmed the invalidation of Amgen’s functional antibody claims for lack of enablement. As a result, inventors down the road, not just life sciences companies, may find it more difficult to obtain broad patents. Although the Court was clear that Amgen may not “monopolize an entire class of things defined by their function,” the opinion fell short of guiding lower courts on how to …
