การเลือกตั้งทั่วไป พ.ศ. 2562 ในประเทศไทยมีการแข่งขันทางการเมืองสูงและมีความพยายามแบ่งแยกฝ่ายทางการเมือง จากการศึกษาเบื้องต้นพบว่าในการหาเสียงเลือกตั้ง นักการเมืองไทยใช้อุปลักษณ์เป็นเครื่องมือสำคัญอย่างหนึ่งในการต่อสู้แข่งขันทางความคิด งานวิจัยนี้จึงมีวัตถุประสงค์เพื่อศึกษามโนอุปลักษณ์ที่สะท้อนจากถ้อยคำอุปลักษณ์ที่นักการเมืองไทยใช้ในวาทกรรมการเมืองในช่วงการหาเสียงเลือกตั้งทั่วไป พ.ศ. 2562 ตามแนวคิด มโนอุปลักษณ์ (Conceptual Metaphor Theory) อุปลักษณ์วิเคราะห์เชิงวิพากษ์ (Critical Metaphor Analysis) ฉากทัศน์อุปลักษณ์ (Metaphor Scenario) และการผสานมโนทัศน์ (Conceptual Blending Theory) งานวิจัยนี้เก็บรวบรวมข้อมูลจำนวน 4 กลุ่ม ได้แก่ การปราศรัย การประชันวิสัยทัศน์ การให้สัมภาษณ์ และบทเพลงประจำพรรคการเมือง ที่เผยแพร่ระหว่างวันที่ 23 มกราคม - 23 มีนาคม พ.ศ.2562 ซึ่งเป็นช่วงเวลาที่กำหนดให้มีการหาเสียงเลือกตั้ง ผลการศึกษาพบถ้อยคําอุปลักษณ์ทั้งหมด 1,623 ถ้อยคํา จําแนกได้เป็น 17 กลุ่มมโนอุปลักษณ์ และ 34 ฉากทัศน์อุปลักษณ์ มโนอุปลักษณ์ที่พบมากที่สุด ได้แก่ มโนอุปลักษณ์ [การเมือง คือ การเดินทาง] ผลการวิเคราะห์ อุปลักษณ์ตามแนวคิดอุปลักษณ์วิเคราะห์เชิงวิพากษ์ พบว่านักการเมืองใช้ อุปลักษณ์นำเสนอแนวความคิดที่นักการเมืองนำเสนอให้ฝ่ายตนเองมีความชอบธรรมและมีความได้เปรียบทางการเมือง จำนวน 5 แนวคิด ได้แก่ 1) นักการเมืองคือผู้นำหรือวีรบุรุษที่มีความสามารถ 2) นักการเมืองคือผู้เป็นที่พึ่ง ผู้มีเมตตา ผู้อุปถัมภ์ค้ำชู 3) นักการเมืองคือผู้มีความรู้น่าเชื่อถือ 4) นักการเมืองคือผู้แก้ไขและบริหารจัดการสังคม 5) นักการเมืองฝ่ายตนคือผู้ที่ปรารถนาดีและพร้อมจะมอบสิ่งดีให้ประชาชน แนวคิดที่ใช้ลดความชอบธรรมของนักการเมืองฝ่ายอื่น จำนวน 4 แนวคิด ได้แก่ 1) นักการเมืองฝ่ายอื่นเป็นคนขี้โกงและเต็มไปด้วยเล่ห์เหลี่ยมหลอกลวง 2) นักการเมืองฝ่ายอื่นเป็นผู้ด้อยความสามารถ 3) นักการเมืองฝ่ายอื่นคือผู้สร้างความเดือดร้อนแก่ชีวิตประชาชน 4) นักการเมืองฝ่ายอื่นเป็นสิ่งที่น่ารังเกียจ และนำเสนอแนวความคิดเกี่ยวกับการเมืองไทย จำนวน 6 แนวคิด แบ่งเป็นการใช้เพื่อสร้าง/ลดทอนความชอบธรรมระหว่างกลุ่มการเมือง จำนวน 3 แนวคิด ได้แก่ 1) การเมืองตามแนวทางประชาธิปไตยนำไปสู่ความขัดแย้ง …

This study aims to fill a knowledge void on disinformation in a non-western context by examining the infodemic phenomenon in Thailand covering an extensive period from 31 December 2019 to 31 July 2021. The research examines how disinformation about COVID-19 spreads on Facebook and Twitter in Thailand, as well as the effectiveness of counter-disinformation approaches, and policy gaps in addressing the infodemic. Data collection relies on these methodologies—content analysis, sentiment analysis, social network analysis, in-depth interviews, and document analysis. Content analysis of sampled data shows that herbal medicine claims, and politicized COVID-19 information, especially about censorship, are prevalent. Contextual factors …

การศึกษานี้มีวัตถุประสงค์เพื่อศึกษาประสิทธิผลของการปรึกษาหารือของสมาชิกวุฒิสภาที่เป็นช่องทางในการแสดงบทบาทของวุฒิสภาในการกำกับตรวจสอบการบริหารราชการแผ่นดินของรัฐบาล หรือภารกิจอื่นใดตามที่รัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2560 ได้บัญญัติไว้ โดยเป็นการวิจัยแบบผสมในเชิงปริมาณและคุณภาพ เนื่องจากมีการเก็บข้อมูลและพรรณนาเชิงสถิติที่เกี่ยวข้องกับกระบวนการปรึกษาหารือของสมาชิกวุฒิสภา และศึกษาเกี่ยวกับบทบาทของวุฒิสภาไทย ซึ่งจากผลการศึกษาพบว่า กระบวนการปรึกษาหารือของสมาชิกวุฒิสภาเป็นช่องทางหนึ่งในการแสดงบทบาทของวุฒิสภาในการเร่งรัด ตรวจสอบ การบริหารราชการแผ่นดินของรัฐบาล ซึ่งเป็นเครื่องมือที่สามารถสะท้อนปัญหาที่เห็นควรต้องได้รับการแก้ไข หรือข้อเสนอแนะ ให้รัฐบาลรวมถึงหน่วยงานภาครัฐทั้งหมดได้ดำเนินการให้สอดคล้องตามประเด็นของข้อปรึกษาหารือนั้น ซึ่งสอดคล้องกับหน้าที่และบทบาทตามรัฐธรรมนูญ 2560 เป็นประโยชน์ต่อประเทศชาติและประชาชน แต่การแสดงบทบาทดังกล่าวนั้นผ่านกลไกข้อปรึกษาหารือของสมาชิกวุฒิสภา พบว่าข้อปรึกษาหารือของสมาชิกวุฒิสภาไม่ได้รับการให้ความสำคัญเป็นอันดับแรกจากหน่วยงานภาครัฐ ซึ่งมีข้อสังเกตว่าสาเหตุที่เป็นเช่นนี้ เนื่องจากหน่วยงานภาครัฐมีภารกิจ หน้าที่และอำนาจโดยตรงเดิมอยู่แล้วในการปฏิบัติตามกลไกราชการแบบปกติ เมื่อศึกษาจากสารนิพนธ์นี้ จึงสรุปได้ว่า ประสิทธิผลของการปรึกษาหารือทำได้ค่อนข้างน้อย หรือการปรึกษาหารือของสมาชิกวุฒิสภานั้น ไม่ได้ส่งผลต่อการแสดงบทบาทของวุฒิสภามากนัก

วิทยานิพนธ์ฉบับนี้มุ่งศึกษาถึงปัญหาของมาตรการทางกฎหมายในการควบคุมกิจการค้าของเก่าตามพระราชบัญญัติควบคุมการขายทอดตลาดและค้าของเก่า พุทธศักราช 2474 โดยได้นำแนวคิดที่เกี่ยวข้อง และมาตรการทางกฎหมายของต่างประเทศมาศึกษาเปรียบเทียบ เพื่อเป็นข้อมูลสำหรับการแก้ไขกฎหมายในเรื่องการควบคุมกิจการค้าของเก่าให้มีประสิทธิภาพสามารถรองรับรูปแบบในการประกอบกิจการทั้งในปัจจุบันและอนาคตได้อย่างมีประสิทธิภาพ จากการศึกษาพบว่า ในการประกอบกิจการค้าของเก่ามีประเด็นที่เป็นปัญหาหลัก ได้แก่ การวางหลักการและกรอบความคิดเบื้องต้นของกฎหมายที่ไม่ชัดเจน กฎหมายไม่สามารถที่จะรองรับรูปแบบใหม่ ๆ ของการประกอบกิจการได้ ปัญหาที่เกิดขึ้นกับใบอนุญาต และความซ้ำซ้อนหรือไม่สอดคล้องกับกฎหมายอื่น ทำให้มาตรการทางกฎหมายที่ใช้ในปัจจุบันจึงไม่สอดคล้องกับสภาพสังคมและเป็นอุปสรรคต่อการประกอบอาชีพ ซึ่งเป็นการสร้างภาระแก่ประชาชน ผู้เขียนจึงเสนอแนวทางในการแก้ไขกฎหมายฉบับนี้เสียใหม่ โดยในส่วนแรกควรเปลี่ยนการใช้คำว่า “ของเก่า” เป็น “สินค้ามือสอง” และต้องกำหนดหลักการและกรอบความคิดเบื้องต้นของกฎหมายมีความชัดเจนมากขึ้น อีกทั้ง ควรมีการกำหนดนิยามของร้านค้าเพื่อเป็นการแก้ปัญหาในเรื่องรูปแบบการประกอบกิจการในปัจจุบัน รวมถึงปรับปรุงมาตรการที่เกี่ยวกับใบอนุญาตและข้อกำหนดอื่นที่ทำให้เกิดความซ้ำซ้อนหรือไม่สอดคล้องกับกฎหมายอื่นที่เกี่ยวข้องกัน เพื่อให้มาตรการในการควบคุมกิจการค้าของเก่ามีความทันสมัยและมีประสิทธิภาพมากยิ่งขึ้น

รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 มาตรา 68 กำหนดให้รัฐพึงจัดระบบการบริหารงานในกระบวนการยุติธรรมทุกด้านให้มีประสิทธิภาพ เป็นธรรมไม่เลือกปฏิบัติ และให้ประชาชนเข้าถึงกระบวนการยุติธรรมได้โดยสะดวก รวดเร็ว และไม่เสียค่าใช้จ่ายสูงเกินสมควร...” และมาตรา 258 (ง) (1) และ (2) กำหนดให้การดำเนินการปฏิรูปประเทศด้านกระบวนการยุติธรรมให้เกิดผลโดยให้กำหนดระยะเวลาดำเนินงานในทุกขั้นตอนของกระบวนการยุติธรรมที่ชัดเจนเพื่อให้ประชาชนได้รับความยุติธรรมโดยไม่ล่าช้าและปรับปรุงระบบการสอบสวนคดีอาญาให้มีการตรวจสอบและถ่วงดุลระหว่างพนักงานสอบสวนและพนักงานอัยการอย่างเหมาะสม แต่ปัจจุบันยังมีกระบวนการยุติธรรมในขั้นตอนการตรวจสอบดุลพินิจคำสั่งไม่อุทธรณ์ ฎีกาของพนักงานอัยการ ตามประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 145 และ มาตรา 145/1 มิได้เป็นไปตามเจตนารมณ์ของรัฐธรรมนูญดังกล่าวทั้งในเรื่องการกำหนดองค์กรผู้มีอำนาจหน้าที่ในการตรวจสอบ และความล่าช้าในการตรวจสอบ ทำให้กระบวนการตรวจสอบไม่เป็นไปตามหลักการตรวจสอบและถ่วงดุลอำนาจและยังกระทบถึงสิทธิและเสรีภาพของจำเลยในคดีโดยเฉพาะคดีที่ศาลพิพากษายกฟ้องแต่มีคำสั่งให้ขังจำเลยไว้ในระหว่างอุทธรณ์ ฎีกา เพื่อรอระบวนการตรวจสอบดุลพินิจคำสั่งไม่อุทธรณ์ ฎีกาของพนักงานอัยการ ส่งผลให้จำเลยถูกคุมขังนานเกินความจำเป็น วิทยานิพนธ์เล่มนี้จึงได้ศึกษาและวิเคราะห์แนวคิดและทฤษฎีที่เกี่ยวข้องกับการใช้ดุลพินิจ การตรวจสอบดุลพินิจ และการอุทธรณ์ ฎีกาคดีอาญาของพนักงานอัยการ ประกอบกับกลไกการตรวจสอบดุลพินิจคำสั่งไม่อุทธรณ์ ฎีกาของพนักงานอัยการตามกฎหมายต่างประเทศ เพื่อกำหนดรูปแบบและแนวทางที่เหมาะสมของกลไกในการตรวจสอบดุลพินิจของพนักงานอัยการในการออกคำสั่งไม่อุทธรณ์ ไม่ฎีกาของระบบกฎหมายไทย

มาตรการกำกับดูแลธุรกิจที่พักอาศัยท้องถิ่น : ศึกษากรณีการปล่อยเช่าห้องชุดในอาคารชุด, นนทวัฒน์ สุวรรณ

วิทยานิพนธ์ฉบับนี้ได้มุ่งศึกษาประเด็นปัญหาทางกฎหมายเกี่ยวกับมาตรการกำกับดูแลธุรกิจที่พักอาศัยท้องถิ่น โดยมีขอบเขตการศึกษาเฉพาะกรณีห้องชุดในอาคารชุดทั้งในประเทศไทยและต่างประเทศ ทั้งนี้ ในรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 ได้ให้การรับรองและคุ้มครองสิทธิในทรัพย์สินและเสรีภาพในการประกอบอาชีพหรือประกอบกิจการของประชาชนเป็นสำคัญ ฉะนั้นการที่รัฐจำกัดสิทธิและเสรีภาพของประชาชนต้องไม่เกินสมควรแก่เหตุและไม่เป็นอุปสรรคต่อการประกอบอาชีพของประชาชนภายใต้สภาพการณ์เศรษฐกิจและสังคมโดยเฉพาะอย่างยิ่งธุรกิจที่พักอาศัยท้องถิ่นกรณีห้องชุดในอาคารชุดซึ่งเกิดจากแนวคิดเศรษฐกิจแบ่งปันห้องพักอาศัย (sharing economy) เพื่อต้องการให้ผู้ประกอบการภาคเอกชนรายใหม่และรายเล็กสามารถประกอบอาชีพเพื่อสร้างรายได้เสริมดำรงชีพและช่วยให้เกิดการหมุนเวียนจำนวนเงินในทางเศรษฐกิจของสังคมแต่ละท้องถิ่นภายใต้ระบบเศรษฐกิจเสรีนิยม ทั้งนี้ การที่รัฐได้กำกับดูแลธุรกิจที่พักอาศัยท้องถิ่นกรณีห้องชุดในอาคารชุดผ่านระบบอนุญาตตามพระราชบัญญัติโรงแรม พ.ศ. 2547 นั้นเป็นการจำกัดสิทธิและเสรีภาพของประชาชนเกินสมควรแก่เหตุและไม่สอดรับกับลักษณะการให้บริการธุรกิจที่พักอาศัยท้องถิ่นกรณีห้องชุดในอาคารชุดแต่อย่างใด โดยทำการศึกษานำหลักกฎหมายมหาชนทางเศรษฐกิจที่เกี่ยวข้อง ได้แก่ หลักกรรมสิทธิ์หรือสิทธิในทรัพย์สิน หลักเสรีภาพในการประกอบอาชีพหรือประกอบกิจการ การจำกัดสิทธิและเสรีภาพของประชาชน รวมถึงบทบาทอำนาจหน้าที่และภารกิจขององค์กรปกครองส่วนท้องถิ่นภายใต้หลักการกระจายอำนาจ และวิเคราะห์ประเด็นปัญหาทางกฎหมายที่เกี่ยวข้อง มีด้วยกันทั้งหมด 4 ประเด็นสำคัญ ดังนี้ (1) ปัญหาการปล่อยเช่าห้องชุดในอาคารชุดแบบรายวันหรือแบบรายสัปดาห์ขัดต่อหลักเกณฑ์และมาตราฐานของสถานที่พักที่ไม่ใช่โรงแรม (2) ปัญหาการปล่อยเช่าห้องชุดในอาคารชุดภายใต้รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 (3) ปัญหาการกำกับดูแลของนิติบุคคลอาคารชุดกรณีการปล่อยเช่าห้องชุดในอาคารชุดแบบรายวันหรือแบบรายสัปดาห์ (4) ประเด็นปัญหาผลกระทบเชิงลบต่อผู้พักอาศัยรายอื่นๆกรณีการปล่อยเช่าห้องชุดในอาคารชุดแบบรายวันหรือแบบรายสัปดาห์ จากการศึกษาพบว่ากฎหมายที่เกี่ยวข้องกับการให้บริการธุรกิจโรงแรมไม่มีความเหมาะสมเท่าที่ควรและไม่สอดรับกับลักษณะการให้บริการของธุรกิจที่พักอาศัยท้องถิ่นกรณีห้องชุดในอาคารชุด จึงส่งผลกระทบโดยตรงต่อการจำกัดสิทธิและเสรีภาพของผู้ประกอบการภาคเอกชนมากเกินสมควรแก่เหตุในการประกอบกิจการธุรกิจที่พักอาศัยท้องถิ่นผ่านใบอนุญาตประกอบกิจการโรงแรม และทำให้เกิดการปล่อยเช่าห้องชุดไม่ถูกต้องตามกฎหมายตามมา รัฐมิสามารถกำกับดูแลธุรกิจที่พักอาศัยท้องถิ่นดังกล่าวได้ จนทำให้ผู้ใช้บริการเช่าห้องชุดในอาคารชุดตกอยู่ในสภาวะความเสี่ยงภัยอันตราย ความไม่มั่นคงและความไม่ปลอดภัยขณะใช้บริการในสถานที่พักอาศัยแห่งนั้น ฉะนั้น ในลำดับแรกเบื้องต้นมีข้อเสนอแนะควรให้มีการแก้ไขเพิ่มเติมคำนิยามประเภทสถานที่พักในกฎกระทรวงกำหนดประเภทและหลักเกณฑ์การประกอบธุรกิจโรงแรม (ฉบับที่ 2) พ.ศ. 2566 (ฉบับปัจจุบัน) โดยระบุในคำนิยามเกี่ยวกับประเภทห้องชุดในอาคารชุดเพื่อให้เกิดความชัดเจน และเพื่อให้เกิดความเหมาะสมของบทบัญญัติของกฎหมายทันสมัยให้สอดรับกับลักษณะการให้บริการธุรกิจที่พักอาศัยท้องถิ่นกรณีห้องชุดในอาคารชุด และไม่เป็นอุปสรรคขัดขวางการประกอบอาชีพหรือประกอบกิจการของประชาชนภายใต้สภาพการณ์เศรษฐกิจและสังคมปัจจุบัน ในลำดับถัดมา มีข้อเสนอแนะให้ควรออกกฎกระทรวงเกี่ยวกับกำหนดเกณฑ์มาตรฐานการปล่อยเช่าห้องชุดในอาคารชุดแบบรายวันหรือแบบรายสัปดาห์ (ฉบับใหม่) โดยอาศัยมาตรา 32 (9) ของพระราชบัญญัติอาคารชุด พ.ศ. 2522 เพื่อให้เป็นไปตามมาตรฐานเดียวกันกับการให้บริการธุรกิจโรงแรม หรือ ตราพระราชบัญญัติเกี่ยวกับธุรกิจที่พักอาศัยท้องถิ่นเป็นการเฉพาะ โดยนำมาตรการทางกฎหมายในรูปแบบบังคับก่อน หรือในรูปแบบ ex-ante regulationและมาตรการกำกับดูแลในรูปแบบบังคับหลัง หรือในรูปแบบ ex-post regulation มาใช้เพื่อกำกับดูแลการปล่อยเช่าห้องชุดในอาคารชุดกรณีห้องชุดในอาคารชุด แต่หากมีการห้ามประกอบกิจการปล่อยเช่าห้องชุดในอาคารชุดดังกล่าวผ่านข้อบังคับของนิติบุคคลอาคารชุด รัฐก็จะไม่เข้าไปแทรกแซงกิจกรรมทางเศรษฐกิจของผู้ประกอบการภาคเอกชนแต่อย่างใด

ในการศึกษาและวิเคราะห์ความสอดคล้องระหว่างแนวคิดว่าด้วยการจัดการทรัพยากรร่วม โดยมีชุมชนเป็นฐานกับพระราชบัญญัติป่าชุมชน พ.ศ. 2562 มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์ หลักการสำคัญของพระราชบัญญัติป่าชุมชน พ.ศ. 2562 และเพื่อศึกษาความสอดคล้องกันระหว่าง หลักการจัดการร่วมที่มีชุมชนเป็นฐาน (Community-Based Co-Management) กับพระราชบัญญัติ ป่าชุมชน พ.ศ.2562 รวมทั้งเพื่อเสนอแนวทางการพัฒนากฎหมายป่าชุมชนเพื่อให้เกิดความ สอดคล้องกับหลักการจัดการร่วมที่มีชุมชนเป็นฐาน ทั้งนี้ การตราพระราชบัญญัติป่าชุมชน พ.ศ. 2562 เป็นการสอดรับบทบัญญัติมาตรา 43 (2) ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 ในเรื่องสิทธิของชุมชนในอันที่จะจัดการ บำรุงรักษา และใช้ประโยชน์จากทรัพยากรธรรมชาติ สิ่งแวดล้อม และความหลากหลายทางชีวภาพ อย่างสมดุลและยั่งยืน จากการศึกษาการจัดการทรัพยากรร่วมกันได้อย่างมีประสิทธิภาพ ในศึกษา กรณีพระราชบัญญัติป่าชุมชน พ.ศ. 2562 พบว่ามีประเด็นทางข้อกฎหมายดังต่อไปนี้ 1) ประเด็นเรื่องสิทธิในจัดการทรัพยากรป่าไม้ในป่าชุมชน 2) ประเด็นเรื่องความหมายของป่าชุมชนตามพระราชบัญญัติป่าชุมชน พ.ศ. 2562 ตามมาตรา 4 พื้นที่ที่จะนำไปจัดตั้งเป็นป่าชุมชนได้นั้น ต้องเป็นป่าที่อยู่นอกเขตป่าอนุรักษ์หรือพื้นที่อื่นของรัฐนอกเขตป่าอนุรักษ์ เป็นการให้อำนาจแก่กรมป่าไม้เข้ามาจัดการและควบคุมกำกับการจัดการป่าชุมชน 3) ประเด็นเรื่องการจัดตั้งป่าชุมชนตามพระราชบัญญัติป่าชุมชน พ.ศ. 2562 ในการขออนุญาตเพื่อจัดตั้งป่าชุมชนตามพระราชบัญญัติป่าชุมชน พ.ศ. 2562 นั้น ชุมชนจะต้องมีการจัดเตรียมเอกสารมากมาย ตามมาตรา 33 รวมไปถึงการตรวจสอบจากสำนักจัดการทรัพยากรป่าไม้แห่งท้องที่อย่างเข้มงวด และได้รับการอนุมัติจากคณะกรรมการป่าชุมชนประจำจังหวัดในการพิจารณาคำขอจัดตั้งป่าชุมชน แผนจัดการป่าชุมชน และรายงานผลการตรวจสอบซึ่ง แสดงให้เห็นถึงการตรวจสอบจากรัฐและยังคงไว้ซึ่งการรวมอำนาจในการจัดการทรัพยากรธรรมชาติไว้ที่รัฐ ซึ่งขัดแย้งต่อการรับรองสิทธิของชุมชนตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 ในมาตรา 43 (2) 4) ประเด็นเรื่องการขาดการมีส่วนร่วมของชุมชนในป่าชุมชน ตามมาตรา 16 ผู้ที่มีอำนาจควบคุมกำกับการจัดการป่าชุมชนไม่ใช่ตัวแทนจากภาคประชาชนที่อยู่ภายในพื้นที่เขตป่าชุมชน แต่เป็นตัวแทนของรัฐจากส่วนกลาง ทำให้ขาดความใกล้ชิดกับสภาพปัญหา สภาพภูมิศาสตร์ และเศรษฐกิจในพื้นที่ รวมถึงวัฒนธรรมความเชื่อ ส่งผลให้ภาคประชาชนไม่ได้ร่วมมือร่วมใจกันในการจัดการควบคุมการใช้และการอนุรักษ์ทรัพยากรธรรมชาติและสิ่งแวดล้อม 5) ประเด็นเรื่องการกระจายอำนาจ (Decentralization) ให้แก่องค์กรปกครองท้องถิ่น ตามพระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วน ท้องถิ่น พ.ศ. 2542 ในมาตรา 16 (24) บัญญัติให้กระจายอำนาจให้ อบต.หรือเทศบาล มีอำนาจ จัดการ การบำรุงรักษา และการใช้ประโยชน์จากป่าไม้ …

Study Of Genetic Determinants To Explain Antimicrobial Resistance In Escherichia Coli And Salmonella Isolated From Food Animals, Meat And Humans In Thailand, Jiratchaya Puangseree

This study comprised 4 parts. Different bacterial strains with different genotypes were used, depending on the experimental design and objectives. Part 1 - Plasmid profile analysis of E. coli and Salmonella enterica isolated from pigs, pork, and humans. This part aimed to characterize the profile of R plasmids in E. coli (n=1,047) and Salmonella (n=816). Sixteen and 11 Inc groups were identified in E. coli (85.3%) and Salmonella (25.7%), of which IncK-F (23.7%) and IncF (46.2%) were predominant. Plasmid replicon was significantly different among sources of isolates and sampling periods but significantly correlated with resistance phenotype (p<0.05). In conclusion, various plasmids are present in E. coli and Salmonella. The findings in this part form a basis for future studies to explore the possible methodology to counteract horizontal transfer of plasmids. Part 2 - Genomic analysis of Salmonella carrying class 1 integrons with dfrA12-aadA2 gene cassette array isolated from food animals, meat and human in Thailand. This part aimed to investigate the genetic characteristics of transferable plasmid carrying class 1 integrons with dfrA12aadA2 cassette array in 15 Salmonella isolates using Oxford Nanopore Sequencing technologies and Illumina platform. Seven MLST types and 6 clades of phylogenetic trees were identified. IncFIB(K), ColpVC, IncFIB, IncHI2, IncHI2A, IncX1, IncY and IncR plasmids were found. All had 28 AMR genes with the prediction to be resistant to various antibiotic groups. All isolates except B82 which was isolated from human, carried class 1 integrons with dfrA12-DUF1010-aadA2 and qacE-sul1 in conserved region. In conclusion, transferable R plasmids play an important role in the wide distribution of class 1 integrons with dfrA12-aadA2 gene array. Part 3 - Molecular basis of the persistence of chloramphenicol (CHP) resistance among E. coli and Salmonella spp. from food animals, meat and human in Thailand. This study aimed to explore the potential mechanisms associated with the persistence of CHP resistance in E. coli (n=106) and Salmonella (n=57). Most E. coli (67.9%) and Salmonella (64.9%) had ≥4-fold CHP MIC decrease in the presence of PAβN. Ampicillin, tetracycline, and streptomycin selective pressure yielded cmlA-carrying Salmonella and E. coli-transconjugants resistant to CHP (MIC 32-512 µg/mL). IncF plasmids were common in cmlA-carrying Salmonella and E. coli transconjugants. The WGS analysis revealed cmlA1-class1 integrons flanked by IS26 and TnAs1 in IncX1 plasmid, IncFIA(HI1)/HI1B plasmids and IncFII/FIB plasmids, and catA flanked by IS1B and TnAs3 in IncFIA(HI1)/HI1B/Q1. In conclusion, the persistence of CHP-resistance was potentially mediated by cross resistance via multidrug efflux systems using proton motif force (pmf) and co-selection of CHP-resistance genes by other antimicrobials. Part 4 - Resistance to widely-used disinfectants and heavy metals and cross resistance to antibiotics in E. coli isolated from pigs, pork and pig carcass. This study aimed to determine the possible cross resistance between disinfectants/heavy metals and antibiotics in E. coli from pigs (n=643), pork (n=111) and pig carcasses (n=110) in Thailand. Exposure to triclosan (TCS), benzalkonium chloride (BKC) and chlorhexidine (CHX) selected for spontaneousresistant mutants exhibited cross resistance to at least one antibiotic. The presence of PAβN restored MICs of CHP and trimethoprim in BKC- and TCS-spontaneous resistant mutants but PAβN, CCCP and reserpine could not restore ciprofloxacin MIC in ciprofloxacin-resistant mutants with no gyrA and parC mutation. In conclusion, the widely used disinfectants and heavy metals serve as non-antibiotic selective pressure for emergence and spread of AMR via cross-resistance involved in pmf-dependent and/or independent mechanisms. Susceptibilities to disinfectants/heavy metals should be routinely monitored. For the overall conclusion, the objectives of this project were successfully achieved. Further studies are suggested for better understanding of AMR and implementing the strategic actions to contain AMR.

The results showed music-based reminiscence interventions were conducted by both music therapists and non-music therapists. At least 60.9% of people in Thailand speak a minority language natively. Despite a history of political nationalism suppressing dialects and minority languages, Thais seem to accept this linguistic diversity. This study explored attitudes of Central Thai speakers towards the main dialects, generally and by comparing two age groups: 18-30 and 45+. This study investigates the performance of a fixed bed reactor packed with a foam catalyst with non-uniform porosity for hydrogen production from glycerol steam reforming. COMSOL Multiphysics software was employed to model the reactor. The first scenario compared the pellet catalyst with industrial foams with different porosities (i.e., 10, 20, and 30 PPI). The second scenario adjusted the porosity of the industrial foam by rearranging porosity in the reactor's axial, then comparing performance, cost-effectiveness, and economic feasibility. This study delves into dental waste management practices in Yangon City, Myanmar, with a primary focus on optimizing waste transportation routes for environmental sustainability. Through a comprehensive survey of 13 dental clinics in each of the 13 townships in the Western Yangon District, the research employs a blend of quantitative and qualitative methods, including survey, GIS analysis and observational studies.
