การศึกษาวิจัยเรื่อง “ศาลเตี้ยออนไลน์ : กรณีศึกษาสถานการณ์ ปฏิสัมพันธ์ และผลกระทบที่เกี่ยวกับคดีอาชญากรรมที่เกิดขึ้นในชีวิตจริงแต่ถูกสืบสวนและตัดสินในโลกออนไลน์” สามารถสรุปผลการศึกษาโดยอาศัยข้อมูลจากการวิจัยเชิงคุณภาพได้ว่า ศาลเตี้ยออนไลน์คือพื้นที่ทางอารมณ์ที่แสดงบทบาทคู่ขนานไปกับกระบวนการยุติธรรมกระแสหลัก ในรูปแบบของพิธีกรรมที่ทุกคนสามารถริเริ่มและมีกลุ่มคนเข้าร่วมในภายหลัง กลายเป็นการกระทำซ้ำ ๆ ที่มีการเตรียมการ การปฏิบัติการ และการลงโทษ โดยเป็นการใช้อำนาจผ่านสื่อออนไลน์ที่ก่อให้เกิดความขัดแย้งและนำมาซึ่งความรุนแรง ประกอบด้วย 4 ตัวแสดงที่มีบทบาทแตกต่างกัน ได้แก่ 1) ผู้แสดงส่วนที่ 1 หมายถึง สื่อออนไลน์ที่มีอิทธิพลต่อสังคม 2) ผู้แสดงส่วนที่ 2 หมายถึง กลุ่มคนที่มาร่วมแสดงความคิดเห็นในโลกออนไลน์ 3) ใช้การมองเห็นและการรับรู้เป็นอาวุธจนเกิดการแพร่กระจายไปอย่างกว้างขวาง และ 4) เหยื่อหรือผู้ได้รับผลกระทบ ประกอบด้วยสถานการณ์ 5 รูปแบบ เรียงลำดับจากความรุนแรงน้อยไปหามาก ตั้งแต่การให้ข้อมูล การตีแผ่ การปักธง การสืบสวน และการไล่ล่า ซึ่งเป็นกระบวนการของสถานการณ์ที่ก่อรูปทรงจากพื้นที่ทางอารมณ์ จนกลายเป็นพลังงานทางอารมณ์ และแสดงออกผ่านปฏิสัมพันธ์แบบมีบทบาทแลกเปลี่ยน ที่อาจนำไปสู่ผลกระทบตามมาหลายด้าน ไม่ว่าจะเป็น ด้านผู้กระทำ ด้านเหยื่อหรือผู้ได้รับผลกระทบ ด้านสิทธิมนุษยชน ด้านกระบวนการยุติธรรม และด้านสังคม อย่างไรก็ดี ศาลเตี้ยออนไลน์สามารถพิจารณาได้ทั้งในเชิงบวกและเชิงลบ ด้านหนึ่งอาจก่อให้เกิดความอยุติธรรม กลายเป็นกระบวนการยุติธรรมไวรัลหรือกระบวนยุติธรรมแบบปากต่อปากในโลกออนไลน์ที่เต็มไปด้วยความเสี่ยงที่จะเกิดการแทรกแซงกระบวนการยุติธรรมและการลงโทษที่ไม่ได้สัดส่วน อีกด้านหนึ่งเปรียบได้ดั่งรูปแบบคู่ขนานของกระบวนการยุติธรรมกระแสหลัก ที่ช่วยถ่วงดุลกระบวนการยุติธรรมผ่านเลนส์เทคโนโลยี จึงจำเป็นจะต้องสนับสนุนด้านบวกและควบคุมด้านลบ เพื่อนำศาลเตี้ยออนไลน์ไปใช้ให้เกิดประโยชน์อย่างแท้จริง

การวิเคราะห์เชิงลึกเพื่อป้องกันการเกิดความขัดแย้งระหว่างคู่ครองในสังคมยุคดิจิทัล, ไวพจน์ กุลาชัย

การศึกษาวิจัยเรื่อง “การวิเคราะห์เชิงลึกเพื่อป้องกันการเกิดความขัดแย้งระหว่างคู่ครองในสังคมยุคดิจิทัล” มีวัตถุประสงค์เพื่อ (1) ศึกษาปัจจัยที่ก่อให้เกิดความขัดแย้งระหว่างคู่ครองในยุคดิจิทัล (2) ศึกษาประเภทของความขัดแย้งระหว่างคู่ครองในยุคดิจิทัล (3) ศึกษาผลกระทบของความขัดแย้งระหว่างคู่ครองในยุคดิจิทัล และ (4) เสนอแนะแนวทางในการป้องกันและแก้ไขปัญหาความขัดแย้งระหว่างคู่ครองในยุคดิจิทัล การศึกษาครั้งนี้เป็นการวิจัยเชิงคุณภาพ (qualitative research) โดยดำเนินการเก็บข้อมูลจากผู้ให้ข้อมูลสำคัญซึ่งเป็นคู่ครองจำนวน 13 คู่ ด้วยการสัมภาษณ์เชิงลึก และทำการวิเคราะห์ข้อมูลด้วยวิธีการวิเคราะห์สรุปอุปนัย (analytic induction) ผลการศึกษา พบว่า การเปลี่ยนแปลงทางด้านเทคโนโลยีทำให้การใช้ชีวิตคู่มีความเปลี่ยนแปลงไปจากสังคมแบบเก่าทำให้การทำงานและชีวิตส่วนตัวเกิดความผูกพันจนไม่สามารถแยกออกจากกันได้ เทคโนโลยีอาจสร้างความห่างเหินต่อชีวิตคู่ ซึ่งส่งผลต่อความขัดแย้งระหว่างคู่ครองและปัญหาอาชญากรรมรูปแบบใหม่ ส่วนปัจจัยที่ส่งผลต่อความขัดแย้งระหว่างคู่ครองประกอบด้วยปัจจัยเรียงตามลำดับความสำคัญ 12 ปัจจัย ได้แก่ ปัจจัยด้านเศรษฐกิจ ปัจจัยด้านการเปลี่ยนแปลงทางเทคโนโลยี ปัจจัยด้านความแตกต่างในมุมมองหรือทัศนคติ ปัจจัยด้านการสื่อสาร ปัจจัยด้านการนอกใจ ปัจจัยที่เกี่ยวข้องกับการเลี้ยงดูบุตร ปัจจัยด้านพฤติกรรมการดื่มแอลกอฮอล์ ปัจจัยด้านครอบครัวและเครือญาติของคู่ครอง ปัจจัยด้านเวลาและการจัดการชีวิตประจำวัน ปัจจัยความแตกต่างด้านอายุ ปัจจัยด้านความมีระเบียบและวินัย และปัจจัยด้านการแต่งกาย โดยสามารถจำแนกประเภทของความขัดแย้งระหว่างคู่ครองได้ 5 ประเภท ได้แก่ ความขัดแย้งด้านพฤติกรรมและทัศนคติ ความขัดแย้งทางด้านการเงิน ความขัดแย้งทางด้านเพศ ความขัดแย้งด้านการเลี้ยงดูบุตร และความขัดแย้งทางด้านการแบ่งงานกันทำ นอกจากนั้น ผลการวิจัยยังพบว่า ความขัดแย้งระหว่างคู่ครองส่งผลกระทบในด้านต่าง ๆ ได้แก่ ผลกระทบทางด้านจิตใจ ผลกระทบต่อความรุนแรงในครอบครัว ผลกระทบทางด้านร่างกาย ผลกระทบต่อลูก ผลกระทบต่อหน้าที่การงาน ผลกระทบด้านสังคม และผลกระทบด้านความพึงพอใจในความสัมพันธ์ ทั้งนี้ แนวทางในการแก้ไขปัญหาความขัดแย้งระหว่างคู่ครองในเชิงสร้างสรรค์ประกอบด้วย การสื่อสารอย่างสร้างสรรค์ การเรียนรู้ ปรับตัวและยอมรับกัน การจัดการทางอารมณ์ การสร้างบรรยากาศที่ดี การสร้างฐานะทางการเงิน การมีส่วนร่วมในงานบ้าน และการมีกิจกรรมร่วมกันซึ่งจะทำให้ครอบครัวสามารถดำรงอยู่ได้อย่างยั่งยืน ดังนั้น การแก้ไขปัญหาความขัดแย้งระหว่างคู่ครองควรมีการนำเทคโนโลยีสมัยใหม่ เช่น แอปพลิเคชั่นที่ช่วยในการสื่อสารและจัดการความขัดแย้งระหว่างค่าครอง มาช่วยในการแก้ไขปัญหาดังกล่าวควบคู่ไปกับการแก้ไขปัญหาเชิงนโยบายที่ดำเนินการโดยภาครัฐ

การมีส่วนร่วมของอาสาสมัครรักษาดินแดนในการป้องกันอาชญากรรมในพื้นที่อำเภอสุไหงโกลก จังหวัดนราธิวาส, กรัณฑ์วาริษฐ์ สมจันทร์

การวิจัยเรื่อง “การมีส่วนร่วมของอาสาสมัครรักษาดินแดนในการป้องกันอาชญากรรมในพื้นที่ อำเภอสุไหงโกลก จังหวัดนราธิวาส” มีวัตถุประสงค์เพื่อศึกษาบทบาทของอาสาสมัครรักษาดินแดนเกี่ยวกับการปฏิบัติหน้าที่ ในอำเภอสุไหงโกลก จังหวัดนราธิวาส ปัญหาและอุปสรรคของอาสาสมัครในการมีส่วนร่วมในการป้องกันอาชญากรรมร่วมกับหน่วยงานความมั่นคงในพื้นที่ อำเภอสุไหงโกลก และเพื่อเสนอแนะแนวทางการเพิ่มประสิทธิภาพของอาสาสมัครรักษาดินแดนในการมีส่วนร่วมกับหน่วยความมั่นคงในพื้นที่ อำเภอสุไหงโกลก ในการป้องกันอาชญากรรม การวิจัยนี้ใช้ระเบียบวิธีวิจัยแบบผสมผสาน ทั้งการวิจัยเชิงปริมาณและเชิงคุณภาพ กลุ่มตัวอย่างที่ใช้ในการวิจัยครั้งนี้ ได้แก่ อาสาสมัครรักษาดินแดน ในอำเภอสุไหงโกลก จังหวัดนราธิวาส จำนวน 202 ราย และผู้ให้ข้อมูลสำคัญในการสัมภาษณ์จำนวน 8 ราย เครื่องมือที่ใช้ในการวิจัยประกอบด้วย แบบสอบถาม และแบบสัมภาษณ์แบบมีโครงสร้าง สถิติที่ใช้ในการวิเคราะห์ข้อมูลเบื้องต้น คือ สถิติเชิงพรรณนา ได้แก่ ค่าความถี่ ค่าร้อยละ ค่าเฉลี่ย และค่าส่วนเบี่ยงเบนมาตรฐาน ผลการวิจัย สามารถแสดงรายละเอียด ดังนี้ 1) บทบาทของอาสาสมัครรักษาดินแดน อ.สุไหงโกลก จ.นราธิวาส ด้านการรักษาความสงบเรียบร้อย พบว่า มีการปฏิบัติอยู่ในระดับมาก ข้อที่มีค่าเฉลี่ยสูงสุด คือ การเฝ้าระวังภัยคุกคามด้านความมั่นคง 2) บทบาทของอาสาสมัครรักษาดินแดน อ.สุไหงโกลก จ.นราธิวาส ด้านการบริการ พบว่า มีการปฏิบัติอยู่ในระดับมาก ข้อที่มีค่าเฉลี่ยสูงสุด คือ บทบาทในงานจิตอาสาพระราชทานและงานอื่น ๆ ที่เป็นการให้บริการสาธารณะ 3) ปัญหาและอุปสรรคของอาสาสมัคร ด้านการจัดการภายในองค์กร พบว่า อยู่ในระดับปานกลาง ข้อที่มีค่าเฉลี่ยสูงสุด คือ การขาดแคลนงบประมาณและวัสดุอุปกรณ์ 4) ปัญหาและอุปสรรคของอาสาสมัคร ด้านสภาพแวดล้อมภายนอกองค์กร พบว่า อยู่ในระดับปานกลาง ข้อที่มีค่าเฉลี่ยสูงสุด คือ การขาดความร่วมมือในการทำงานจากภายนอกองค์กร 5) การวิเคราะห์ข้อมูลเชิงคุณภาพ สามารถสรุปข้อมูลในภาพรวมได้ว่า ในประเด็นบทบาทด้านการรักษาความสงบเรียบร้อย อาสาสมัครมีการปฏิบัติงานเพื่อเฝ้าระวังภัย โดยเน้นเรื่องผู้ก่อความไม่สงบเป็นสำคัญ ส่วนบทบาทในด้านการบริการ จะเน้นไปที่การอำนวยความสะดวกให้กับเจ้าหน้าที่ทหารและตำรวจที่ปฏิบัติหน้าที่ในพื้นที่ สำหรับปัญหาและอุปสรรคที่เกิดขึ้นในการทำงานของอาสาสมัคร จากการสัมภาษณ์ พบว่า มี 5 ประเด็นหลัก ได้แก่ ปัญหาด้านการบังคับใช้กฎหมาย, ปัญหาด้านสวัสดิการของอาสาสมัคร, ปัญหาการขาดแคลนงบประมาณและวัสดุอุปกรณ์, ปัญหาด้านการขาดความร่วมมือในการทำงานภายนอกองค์กร และปัญหาด้านความปลอดภัยในการทำงาน ซึ่งเป็นไปในทิศทางเดียวกันกับข้อค้นพบที่ได้จากการวิจัยเชิงปริมาณ สำหรับแนวทางการเพิ่มประสิทธิภาพการมีส่วนร่วมของอาสาสมัครรักษาดินแดน จะต้องมีความสอดคล้องกับลักษณะปัญหาที่เกิดขึ้นภายในพื้นที่ …

พลวัต เครือข่าย และกรอบโครงความคิดของขบวนการต่อต้านทักษิณในจังหวัดเชียงใหม่, จุฑามาศ สังข์เงิน

วิทยานิพนธ์ฉบับนี้เป็นการศึกษาเชิงคุณภาพ ศึกษาเรื่องขบวนการต่อต้านทักษิณในจังหวัดเชียงใหม่ ระหว่างปีพ.ศ.2548 – พ.ศ.2557 ศึกษาผ่านกรอบแนวคิดการระดมทรัพยากร แนวคิดการสร้างกรอบโครงความคิด และแนวคิดการวิเคราะห์เครือข่ายทางสังคม ในการตอบวัตถุประสงค์ 2 ข้อ คือ 1. เพื่อศึกษาการก่อตัว พัฒนาการ และพลวัตของขบวนการต่อต้านทักษิณในจังหวัดเชียงใหม่ และ 2. เพื่อศึกษากรอบโครงความคิดของขบวนการต่อต้านทักษิณในจังหวัดเชียงใหม่ ผลการศึกษาตามวัตถุประสงค์ 2 ข้อดังนี้ วัตถุประสงค์ข้อที่ 1. ขบวนการต่อต้านทักษิณเชียงใหม่ก่อตัวขึ้นจากความร่วมมือระหว่างเครือข่ายภาคประชาสังคมนักพัฒนาเอกชน คนเดือนตุลา ชนชั้นกลาง นักวิชาการ นักศึกษา และนักการเมืองท้องถิ่นที่เคยเป็นขบวนภาคประชาชนที่สนับสนุนขบวนการประชาธิปไตย ในช่วงการเคลื่อนไหวของกลุ่มพันธมิตร ฯ พวกเขารวมกลุ่มกันภายใต้การนำของกลุ่มนักพัฒนาเอกชนและเคลื่อนไหวร่วมกับเครือข่ายต่าง ๆ จนกระทั่งเกิดความขัดแย้งทางความคิดภายในขบวนการจนเครือข่ายนักพัฒนาเอกชน เครือข่ายนักศึกษา และเครือข่ายนักการเมืองล่าถอยออกจากขบวนการ ทำให้ขบวนการอยู่ภายใต้การนำของเครือข่ายชนชั้นกลางและเสื่อมพลังลงจนยุติการเคลื่อนไหว ขบวนการต่อต้านทักษิณจังหวัดเชียงใหม่กลับมาก่อตัวขึ้นอีกครั้งในช่วงกลุ่มกปปส. ภายใต้การนำของเครือข่ายนักการเมืองท้องถิ่นโดยได้รับการสนับสนุนจากเครือข่ายชนชั้นกลางเชียงใหม่ ทำให้ขบวนการกลับมาเคลื่อนไหวและได้รับการสนับสนุนขบวนการอย่างสูง แต่เกิดความขัดแย้งขึ้นระหว่างเครือข่ายแนวร่วมทั้งสองทำให้เครือข่ายชนชั้นกลางล่าถอยออกจากขบวนการในที่สุด วัตถุประสงค์ข้อที่ 2. ขบวนการต่อต้านทักษิณจังหวัดเชียงใหม่มีกรอบโครงความคิดที่แบ่งได้เป็น 2 รูปแบบ ได้แก่ ความคิดทางการเมืองแบบเสรีนิยมและความคิดทางการเมืองแบบอนุรักษ์นิยม ในการก่อตัวของขบวนการช่วงกลุ่มพันธมิตร ฯ พวกเขามีความคิดทางการเมืองแบบเสรีนิยมทำให้ขบวนการมีความหลากหลายทางความคิดและเปิดกว้างให้เครือข่ายแนวร่วมที่มีจุดยืนทางการเมืองแตกต่างเข้าต่อสู้ร่วมกันได้โดยมีเป้าหมายในการขับไล่รัฐบาลทักษิณจากการเมืองไทย แต่ในเวลาต่อมากลุ่มที่มีความคิดทางการเมืองแบบอนุรักษ์นิยมที่ชูแนวทางกษัตริย์นิยม ศาสนานิยม ชาตินิยม และนิยมทหารได้เข้ามามีบทบาทนำเหนือขบวนการผ่านการขยายกรอบโครงความคิดและการระดมทรัพยากร ทำให้กลุ่มที่มีความคิดทางการเมืองแบบเสรีนิยมถอนตัวจากขบวนการต่อต้านทักษิณเชียงใหม่ ต่อมาในการกลับมาของกลุ่มกปปส. ขบวนการก่อตั้งขึ้นโดยกลุ่มที่มีความคิดทางการเมืองแบบอนุรักษ์นิยมโดยในระยะแรกพวกเขามีเป้าหมายร่วมกันเพื่อขับไล่รัฐบาลยิ่งลักษณ์ ต่อมาพวกเขารับเอาแนวทางของกลุ่มกปปส.ที่ชูแนวทางต่อต้านประชาธิปไตยและใช้แนวทางแบบชาตินิยม ศาสนานิยม และนิยมทหารจนนำไปสู่การสนับสนุนให้ทหารยึดอำนาจรัฐบาลยิ่งลักษณ์

แนวทางการป้องกันอาชญากรรมบนเทคโนโลยีการเงินแบบกระจายศูนย์ (Defi) : กรณีศึกษาปรากฏการณ์ล้มทั้งยืน (Rug Pull), กุลนันทน์ ศรีเจริญ

การศึกษาครั้งนี้ มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหา รูปแบบ ปัจจัยที่ส่งผลต่อการเกิดปรากฏการณ์ล้มทั้งยืน (Rug Pull) ซึ่งเป็นอาชญากรรมบนเทคโนโลยีการเงินแบบกระจายศูนย์ (DeFi) เพื่อสร้างความเข้าใจให้แก่สังคมและนำไปสู่การแสวงหาแนวทางป้องกันที่เหมาะสม ใช้ระเบียบวิธีวิจัยเชิงคุณภาพ ด้วยการบูรณาการการวิจัยเชิงเอกสาร การสังเกตแบบชาติพันธุ์วรรณาดิจิทัลและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญของหน่วยงานรัฐ หน่วยธุรกิจและตัวแทนนักลงทุนสินทรัพย์ดิจิทัล จำนวน 16 ราย ผลการศึกษา พบว่า ปรากฎการณ์ล้มทั้งยืน (Rug Pull) เป็นอาชญากรรมไซเบอร์ที่อาศัยความน่าเชื่อถือและความปลอดภัยของ DeFi เจตนาหลอกลวงให้นักลงทุนนำสินทรัพย์ดิจิทัลมาฝากในแพลตฟอร์ม จากนั้นเกิดสถานการณ์ทำให้นักลงทุนสูญเสียเงินลงทุนบางส่วน หรือทั้งหมด หรืออาจจะไม่ได้รับผลตอบแทนตามที่กล่าวอ้าง ด้วยสภาพปัญหา 4 ด้าน คือ 1) ด้านโลกาภิวัตน์ ผู้ใช้งานสามารถทำธุรกรรมโดยไม่ระบุตัวตนของคู่สัญญาด้วยความรวดเร็วผ่านระบบนิเวศ DeFi การระบุพื้นที่ หรือเขตอำนาจศาลในการลงโทษผู้กระทำผิดจึงเป็นไปด้วยความยากลำบาก 2) ด้านสังคมความเสี่ยง เกิดขึ้นการจากนำเทคโนโลยีสมัยใหม่ที่มีความซับซ้อน โดยมีสัญญาอัจฉริยะเป็นกลไกหลักในการควบคุมเงื่อนไขต่าง ๆ 3) ด้านกฎหมายและหลักเกณฑ์ที่เกี่ยวข้อง ไม่มีตัวกลางในการกำกับดูแล ทำให้ขาดการตรวจสอบและประเมินความเสี่ยงจากภาครัฐ เมื่อมีความเสียหายเกิดขึ้นจากการฉ้อโกง หรือให้บริการที่ไม่เป็นธรรม จึงไม่ได้รับการคุ้มครอง และ 4) ด้านความร่วมมือระหว่างประเทศ ซึ่งขาดกระบวนการส่งต่อ หรือรับข้อมูลสำคัญที่จะนำมาใช้ในการติดตามตรวจสอบ สืบหาตัวผู้กระทำผิด ทั้งนี้ ปรากฏการณ์ล้มทั้งยืนสามารถเกิดขึ้นได้ 3 รูปแบบ คือ 1) การขโมยสภาพคล่อง 2) การจำกัดการซื้อขาย และ การลากและทุบ โดยมีปัจจัยที่ส่งผลต่อการเกิดปรากฎการณ์ล้มทั้งยืน 3 ปัจจัยหลัก คือ 1) เกิดจากผู้ที่มีความสามารถในการก่ออาชญากรรม 2) เกิดจากนักลงทุนสินทรัพย์ดิจิทัล และ 3) เกิดจากขาดผู้พิทักษ์ที่มีความสามารถ ทั้งนี้ แนวทางการป้องกัน ได้แก่ การพัฒนาการกำกับดูแลและการบังคับใช้กฎหมายที่เกี่ยวกับสินทรัพย์ดิจิทัลบน DeFi ที่เป็นสากลและชัดเจน การสร้างเครือข่ายเพื่อเผยแพร่องค์ความรู้และสร้างความตระหนักเกี่ยวกับความเสี่ยงในการลงทุนสินทรัพย์ดิจิทัลบน DeFi การส่งเสริมให้มีการศึกษาวิจัยและพัฒนาเครื่องมือ หรือกลไกการป้องกันฯ ให้มีประสิทธิภาพ การออกมาตรการกำกับดูแลผู้ให้บริการตรวจสอบสัญญาอัจฉริยะ (Smart Contract Security Audit) สำหรับแพลตฟอร์ม DeFi และการสร้างกรอบความร่วมมือระหว่างประเทศกับหน่วยงานบังคับใช้กฎหมายและผู้ให้บริการสินทรัพย์เสมือน (VASP) เพื่อป้องกันไม่ให้ประชาชนตกเป็นเหยื่ออาชญากรรมไซเบอร์รูปแบบใหม่ ซึ่งจะสามารถลดช่องโอกาสของการเกิดปรากฎการณ์ล้มทั้งยืน (Rug …

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาการปฏิบัติงานด้านติดตามคนหายและพิสูจน์ศพนิรนามและวิเคราะห์แนวทางปฏิบัติงานด้านการติดตามกรณีคนหายและพิสูจน์ศพนิรนามในประเทศไทย และพัฒนาแนวทางปฏิบัติงานด้านการติดตามกรณีคนหายและพิสูจน์ศพนิรนามในประเทศไทย โดยใช้การวิจัยเชิงคุณภาพด้านวิธีการสัมภาษณ์ผู้ให้ข้อมูลสำคัญ จำนวน 11 คน ประกอบด้วย กลุ่มบริหารงานยุติธรรม จำนวนทั้งสิ้น 4 คน ได้แก่ ผู้ทรงคุณวุฒิจากสำนักงานตำรวจแห่งชาติ จำนวน 1 คน ผู้ทรงคุณวุฒิกรมสอบสวนคดีพิเศษด้านการสืบสวนสอบสวน จำนวน 1 คน และ ผู้ทรงคุณวุฒิจากสถาบันนิติวิทยาศาสตร์ กองคนหายและพิสูจน์ศพนิรนาม กลุ่มบริหารจัดการวัตถุพยาน จำนวน 2 คน กลุ่มนักวิชาการ จำนวนทั้งสิ้น 2 คน ได้แก่ นักวิจัย/นักวิชาการด้านการสืบสวนสอบสวนการรวบรวมพยานหลักฐาน และกลุ่มภาคประชาสังคม จำนวนทั้งสิ้น 5 คน ได้แก่ ตัวแทนจากภาคประชาชน จำนวน 3 คน ตัวแทนจากสื่อมวลชน จำนวน 1 คน และตัวแทนจากองค์กรพัฒนาภาคเอกชน ได้แก่ มูลนิธิกระจกเงา จำนวน 1 คน จากผลการศึกษาสภาพปัญหากรณีบุคคลสูญหายและพิสูจน์ศพนิรนามในประเทศไทย ประกอบด้วย 8 ด้าน ดังนี้ 1 ด้านกฎหมาย 2) การสอบสวน 3) การสืบสวน 4) การเข้าถึงกระบวนการยุดิธรรมของผู้เสียหาย 5) ด้านความเป็นอาชญากรรม 6) ด้านการเข้าถึงกระบวนการยุติธรรมของผู้เสียหาย 7) ด้านการสืบค้นข้อมูลผู้สูญหายและศพนิรนาม และ 8) ด้านความหลากหลายของรูปแบบและพฤติการณ์ของคนหายและพิสูจน์ศพนิรนาม ทั้งนี้แนวทางการแก้ไขควรมีการจัดตั้งศูนย์รับแจ้งที่มีอำนาจหน้าที่ตามกฎหมายอย่างแท้จริงเพื่อให้เกิดความสะดวกรวดเร็วในการทำงาน ดำเนินการรับแจ้งคนหาย และกำหนดแนวทางการปฏิบัติงานของเจ้าหน้าที่ให้ไปในทิศทางเดียวกัน และเป็นประโยชน์สูงสุดในการอำนวยความยุติธรรมแก่ประชาชน

สารนิพนธ์นี้ใช้การวิจัยข้อมูลเอกสารเพื่อวิเคราะห์กลยุทธ์ที่สำนักงานตำรวจแห่งชาตินำมาใช้ในการต่อต้านการล่วงละเมิดทางเพศต่อเด็กทางออนไลน์ จากความตระหนักรู้ทั่วโลกในการขยายตัวของปัญหาดังกล่าว องค์การระหว่างประเทศและหน่วยงานที่ทำงานด้านสังคมในระดับนานาชาติจึงเข้ามามีบทบาทสำคัญในการให้คำแนะนำและส่งเสริมความร่วมมือระหว่างผู้เกี่ยวข้องทุกฝ่ายในการต่อต้านและปราบปรามการล่วงละเมิดทางเพศต่อเด็กทางออนไลน์ ทำให้ปัญหานี้ถูกยกระดับให้เป็นประเด็นวาระระหว่างประเทศที่ได้รับความสำคัญทั้งในระดับระหว่างประเทศและระดับภูมิภาค ในบริบทดังกล่าวสำนักงานตำรวจแห่งชาติได้ยกระดับการประสานงานทั้งภายในประเทศไทยและระหว่างประเทศ โดยเฉพาะกับประเทศในกลุ่มอาเซียนเพื่อจัดการกับอาชญากรรมข้ามชาติที่เกี่ยวข้องกับการล่วงละเมิดทางเพศต่อเด็ก เป็นการเสริมพลังให้สำนักงานตำรวจแห่งชาติมีแนวทางเชิงกลยุทธ์และสร้างความร่วมมือในการจัดการกับการล่วงละเมิดทางเพศต่อเด็กออนไลน์ ไม่เพียงแต่ภายในประเทศไทยเท่านั้น แต่ยังรวมถึงประเทศอื่นๆ โดยเฉพาะอย่างยิ่ง การแบ่งปันข้อมูล ความร่วมมือในด้านกฎหมาย และการสร้างความสามารถในการปฏิบัติหน้าที่ในด้านการบังคับใช้กฎหมาย การศึกษานี้มีความหมายที่สำคัญต่อสำนักงานตำรวจแห่งชาติในการปรับปรุงกลยุทธ์ในการป้องกันเด็กจากการล่วงละเมิดออนไลน์และในการเสริมความร่วมมือระดับภูมิภาคเพื่อสู้กับอาชญากรรมออนไลน์ได้อย่างมีประสิทธิภาพ

รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 มาตรา 68 กำหนดให้รัฐพึงจัดระบบการบริหารงานในกระบวนการยุติธรรมทุกด้านให้มีประสิทธิภาพ เป็นธรรมไม่เลือกปฏิบัติ และให้ประชาชนเข้าถึงกระบวนการยุติธรรมได้โดยสะดวก รวดเร็ว และไม่เสียค่าใช้จ่ายสูงเกินสมควร...” และมาตรา 258 (ง) (1) และ (2) กำหนดให้การดำเนินการปฏิรูปประเทศด้านกระบวนการยุติธรรมให้เกิดผลโดยให้กำหนดระยะเวลาดำเนินงานในทุกขั้นตอนของกระบวนการยุติธรรมที่ชัดเจนเพื่อให้ประชาชนได้รับความยุติธรรมโดยไม่ล่าช้าและปรับปรุงระบบการสอบสวนคดีอาญาให้มีการตรวจสอบและถ่วงดุลระหว่างพนักงานสอบสวนและพนักงานอัยการอย่างเหมาะสม แต่ปัจจุบันยังมีกระบวนการยุติธรรมในขั้นตอนการตรวจสอบดุลพินิจคำสั่งไม่อุทธรณ์ ฎีกาของพนักงานอัยการ ตามประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 145 และ มาตรา 145/1 มิได้เป็นไปตามเจตนารมณ์ของรัฐธรรมนูญดังกล่าวทั้งในเรื่องการกำหนดองค์กรผู้มีอำนาจหน้าที่ในการตรวจสอบ และความล่าช้าในการตรวจสอบ ทำให้กระบวนการตรวจสอบไม่เป็นไปตามหลักการตรวจสอบและถ่วงดุลอำนาจและยังกระทบถึงสิทธิและเสรีภาพของจำเลยในคดีโดยเฉพาะคดีที่ศาลพิพากษายกฟ้องแต่มีคำสั่งให้ขังจำเลยไว้ในระหว่างอุทธรณ์ ฎีกา เพื่อรอระบวนการตรวจสอบดุลพินิจคำสั่งไม่อุทธรณ์ ฎีกาของพนักงานอัยการ ส่งผลให้จำเลยถูกคุมขังนานเกินความจำเป็น วิทยานิพนธ์เล่มนี้จึงได้ศึกษาและวิเคราะห์แนวคิดและทฤษฎีที่เกี่ยวข้องกับการใช้ดุลพินิจ การตรวจสอบดุลพินิจ และการอุทธรณ์ ฎีกาคดีอาญาของพนักงานอัยการ ประกอบกับกลไกการตรวจสอบดุลพินิจคำสั่งไม่อุทธรณ์ ฎีกาของพนักงานอัยการตามกฎหมายต่างประเทศ เพื่อกำหนดรูปแบบและแนวทางที่เหมาะสมของกลไกในการตรวจสอบดุลพินิจของพนักงานอัยการในการออกคำสั่งไม่อุทธรณ์ ไม่ฎีกาของระบบกฎหมายไทย

Objective: To explore the experiences of close family members when another family member is using methamphetamine and how the family member responds over time.

Background: Methamphetamine use has widespread implications and harms for both people who use the drug and those that live with them. While there is a significant representation in the literature relating to family members of people who use drugs or alcohol, there are limited studies specifically considering family members experiences of methamphetamine use. Families have been shown to have both positive and negative impacts on people using drugs, but less is known on the impact on …

In the United States, approximately 580,000 individuals were homeless on a single night in 2020. Homelessness can be categorized into three subgroups: sheltered homeless, unsheltered homeless, and unstably housed. Few studies have examined the relations between homelessness subtypes, shelter service utilization, levels of stress experienced, and health risk factors. This study aimed to empirically examine whether shelter status the previous night was related to current stress, recent utilization of shelter-based mental health services, and current health risk factors. Data were collected at multiple homeless shelters in 2016 in the Oklahoma City area (N=575). All participants completed assessments of demographic characteristics, …

According to rape crisis centres and women’s shelters in Canada, the US and the UK, women are reporting extreme levels of violence by men who rape them, including strangulation—a particularly dangerous form of violence that is highly predictive of femicide. At the same time, accused men are deploying the “rough sex” defence when the victim—nearly always a woman—has suffered bodily harm or even death as a result of the accused’s actions. This defence is used to suggest that the woman enjoyed strangulation, bondage or other violence as part of “sex play”, inviting judges and jurors to find that she either …

Sandin and Wilkinson were decided during Chief Justice William Rehnquist's tenure, and the Chief Justice played the lead role in reshaping the Court's solitary confinement caselaw over the past thirty years. It was Chief Justice Rehnquist who fashioned the “atypical, significant hardship” test in Sandin v. Conner and it would have to be exhibit 1 demonstrating the Chief Justice's “indifference to prison terrors,” to borrow Professor Judith Resnik's eloquent phrase. Many have proclaimed that the Bipartisan Safer Communities Act is the most sweeping gun control legislation to be passed in decades. However, the bill is not primarily a gun control bill—instead, much of the Act seeks to improve mental health services in hopes of preventing gun violence. Such a move is not rooted in established evidence, which finds little predictive value in knowing an individual’s mental health history. In fact, people with mental health disabilities are more likely to be victims of violent crimes than perpetrators. The Act therefore shifts the debate about gun reform from one about easy access …

After the Supreme Court of the United States returned authority to regulate abortion to the state level in Dobbs v. Jackson Women’s Health Organization, many states began to redraft their statutes, either protecting or eliminating abortion access. In doing this, the Supreme Court intensified demands for gender-inclusive language in reproductive healthcare legislation and court opinions. The ongoing shift in discourse acknowledges the reproductive healthcare needs of transgender and nonbinary (“TGNB”) people, given the already limited access to general healthcare. The Department of Veterans Affairs Police (“VA Police”), a federal law enforcement agency tasked with law enforcement on Department of Veterans Affairs (VA) properties, has a shocking record of misconduct and brutality against veterans. Because the VA is the largest integrated healthcare system in the United States, the VA Police are primarily responsible for policing VA medical facilities. While issues facing the veteran community have largely been analyzed as separate from those facing the American public at large, VA medical facilities replicate broader socioeconomic trends in policing of vulnerable populations. Should pro-immigrant advocates pursue federally funded counsel for all immigrants facing deportation? For most pro-immigrant advocates and scholars, the answer is self-evident: More lawyers for immigrants would mean more justice for immigrants, and thus, the federal government should fund such lawyers. Moreover, the argument goes, federally funded counsel for immigrants would improve due process and fairness, as well as make immigration enforcement more efficient. This Article argues the opposite: Federally funded counsel is the wrong goal. The majority of expulsions of immigrants now happen outside immigration courts— and thus are impervious to immigration lawyering. Even for those who make it …

The educational mindset for online higher degrees, specifically the master’s and doctoral journey, shifted from the refractive thinking perspective as transformational experiences, producing objective decision-making processes, to transactional business exchanges, and in some institutions, an exchange for investors and stakeholders. Nehrlich (2006) coined “transactional exchange” as an exchange of one thing for another involving some form of gain. Within days of the Supreme Court’s decision overturning Roe v. Wade, progressive prosecutors throughout the country announced that if their jurisdictions enacted restrictions on abortion, they would not prosecute the individuals who had these procedures or the doctors who performed them. This is the latest example of situations, like drug crimes, illegal gun possession, and other offenses, where prosecutors have declined to enforce a state law as a matter of public policy. Critics of this broad use of prosecutorial discretion have argued that it violates the constitutional separation of powers.

Law students are impacted by trauma and law professors are in a position to help by adopting a trauma-informed approach as a matter of universal precaution. The 2021 Survey of Law Student Well-Being (“SLSWB”) revealed that over twenty percent of responding law students meet criteria that indicate they should be evaluated for post-traumatic stress disorder (“PTSD”). The study also revealed that almost fifty percent of responding students reported an important motivation for attending law school was experiencing a trauma or injustice. We link these developments to broader developments within the national and international clinical legal education spheres. Designer drugs and novel psychoactive substances (NPSs) are continuously entering the black market and causing serious health problems among users. NPSs present an especially difficult challenge to forensic chemists and toxicologists because they are not well characterized and often involve families of structurally related analogs. In crime laboratories, mass spectrometry is commonly used as a part of an analytical scheme to characterize and identify unknown analytes. The problem addressed in the research was that many individuals were not diagnosed with attention deficit hyperactivity disorder (ADHD) until they were adults. The purpose of the study was to examine the experiences and beliefs of participants regarding the management of ADHD and the impact that experiences may or may not have regarding the quality of life during adulthood. This study utilized a phenomenological qualitative approach to collect data from adults diagnosed with ADHD about their life experiences. This applied dissertation was designed to better understand how to support university administrators serving in a compliance role. Safety on university campuses is of utmost importance and many collaborators work toward this endeavor. Generally, on any given college or university campus, there is one administrator tasked with compliance with the Clery Act. Administrators had varying direct experience and interest in serving in this role, though all understood the importance of compliance and the consequences of noncompliance.
