Threats To School Safety: Examining Levels Of Community Violence And Its Relation To School-Related Threats, Dorie Ross
Threats To School Safety: Examining Levels Of Community Violence And Its Relation To School-Related Threats, Dorie Ross
USF Tampa Graduate Theses and Dissertations
Despite significant media attention provided to school-based acts of violence, these tragic incidents are relatively rare across school environments, leading to increasing challenges in identifying students who may pose a threat. Previous approaches to school discipline, including policies such as zero tolerance, resulted in significant racial disparities among students who received disciplinary consequences inconsistent with the severity of their behaviors or threats. Alternatively, a relatively recent approach that emerged following a series of school shootings in the 1990s was school threat assessment, which focuses on prevention rather than prediction. While it is important to determine students who may pose a …

From Austin To Santa Fe: Exploring The Prosecution Of Environmental Crimes Within Epa Region 6, Dr. Joshua Ozymy, Dr. Melissa Jarrell Ozymy
Natural Resources Journal
Criminal violations of environmental law are prosecuted by EPA and DOJ. Despite decades of such prosecutions, there has been relatively little analysis done towards understanding existing patterns in criminal prosecution of environmental crimes, especially on a regional basis. This article analyzes the 287 prosecutions which occurred in EPA Region 6 between 1983–2022, out of the 2,807 total environmental crimes prosecuted by all of EPA during that period. In the selected cases, defendants were cumulatively assessed with over $908 million in monetary penalties, 225 years of incarceration, and 1,032 years of probation. At 43 percent of the selected prosecutions, water pollution …

Reading Black As Orange: Supreme Court Of India On Section 173(4) Of Crpc, Nanditta Batra
Popular Media
Can the Supreme Court of India get the bare text of a provision wrong? To err is human, but when the judges of the top court in our country go wrong with something as basic as the words of a statute, it definitely cannot be overlooked as a mere error. It is one thing to interpret the provisions of a law and another to conjure up something in place of the black letters of law. No constitutional lens empowers a judge to read black as orange.

Black Lives, White Witnesses: An Argument For A Presentist Approach To Teaching Aphra Behn's Oroonoko, Sharon Smith
Black Lives, White Witnesses: An Argument For A Presentist Approach To Teaching Aphra Behn's Oroonoko, Sharon Smith
ABO: Interactive Journal for Women in the Arts, 1640–1830
This essay outlines a presentist approach to teaching Aphra Behn’s Oroonoko (1688), in which a white woman witnesses a Black man’s brutal execution at the hands of enslavers. This approach explores the capacity of Behn’s novel—a colonialist narrative scholars frequently identify as troubling or frustrating—to generate discussions about “white witnessing,” particularly white people’s consumption of images of Black people in peril. This includes recent videos of Black people killed by police or white citizen vigilantes. Many Black individuals identify these videos as traumatizing, frequently noting how they have failed to spur structural reform. Of central concern in the classroom discussion …

Brief Of Exonerees As Amici Curiae In Support Of Appellant, Derrick Hamilton
Brief Of Exonerees As Amici Curiae In Support Of Appellant, Derrick Hamilton
Perlmutter Center Briefs
Amici includes a group of wrongfully convicted individuals who spent years ( for most, decades) in prison for crimes they did not commit. They submit this brief in support of Damien Echols' appeal to the Supreme Court of Arkansas out of concern that, left uncorrected, the decision below would undermine the fundamental right to prove one's innocence and as such suffer the consequences left. Additionally, exonerees suffer beyond anyone's imagination and this Court should not ignore the voices of those who have been similarly situated to that of Damien Echols.
Amici understands all too well the importance of such safeguards. …
Missed And Prior Diagnoses In Children Later Diagnosed With Autism, Maire Diemer
Missed And Prior Diagnoses In Children Later Diagnosed With Autism, Maire Diemer
Dissertations
Awareness of autism is rising, yet social determinants of health continue to impact rates, ages of diagnosis, and diagnostic load. Different psychiatric labels carry stigmas; unequal rates of diagnoses may indicate biases in the healthcare system. This study investigates six prior diagnoses (ADHD, disorders of conduct, adjustment, anxiety, mood, and intellectual disability) assigned to children who are later diagnosed with autism. The study investigates how race, sex, and geographic factors were associated with age of diagnosis and diagnostic load. This study utilized a sample of 13,850 children aged 2-10 who were diagnosed with autism on Missouri Medicaid between 2015 and …

“Prison Tiktok”: Incarcerated Life Shared On Social Media, Kayla Reid, Nicole Niebuhr
Qualitative Criminology (QC)
Different areas of the criminal justice system interact with social media, but not much is known about how those incarcerated may be using it. A thematic analysis of “Prison TikTok” videos was conducted in order to gain a better understanding of what those incarcerated are sharing. The most represented themes in the sample are performance, food, prison views, and pains of imprisonment. Performance and food demonstrate creativity within the sample, and highlight how those incarcerated may be looking for creative outlets. Prison and pains of imprisonment include the realities of life incarcerated, and contain messaging that those incarcerated may be …
Blowing In The Wind: Cannabis Legalization, Insiders, And Methodological Insights From British Columbia, Jon Heidt, Johannes Wheeldon
Blowing In The Wind: Cannabis Legalization, Insiders, And Methodological Insights From British Columbia, Jon Heidt, Johannes Wheeldon
Qualitative Criminology (QC)
Legalizing cannabis in Canada has proven momentous in some ways and insufficient in others. This paper presents findings from a re-analysis of two studies on cannabis legalization conducted in British Columbia (B.C.) before and after legalization. Prioritizing public health over access appears to prolong stigmatization, complicate policing, and undermine efforts to disrupt illicit cannabis markets. We outline three contributions to the nascent post- prohibition cannabis research agenda. First, we demonstrate the potential for secondary data analysis (SDA) and model an approach to address recent concerns about this practice. Second, we show the value of insiders when assessing cannabis policy by …

“I’M Not Unemployed, I’M Unemployable”: Challenges Finding And Sustaining Work For People Requires To Register As Sex Offenders, Jennifer L. Wooldridge, Danielle J. S. Bailey
Qualitative Criminology (QC)
Many individuals convicted of a sexual offense (ICSOs) experience various collateral consequences due to registration requirements, including income loss, unemployment, harassment, social isolation, homelessness, and more. Finding employment post-conviction is a difficult endeavor for many reentering citizens with criminal records, but for ICSOs, the difficulty increases due to their label as sex offenders. When these individuals are unsuccessful in obtaining steady, living-wage employment, it can result in mental health impacts such as depression, hopelessness, and other reactions. This paper seeks to analyze participants’ emotional and mental health reactions to their direct experiences with employment struggles due to registration. What feelings …

Stroking Reflexivity Into Practice: The Pros And Cons Of Resorting To Gatekeepers To Conduct Qualitative Criminological Research, Gabriela Mesquita Borges, Ana Guerreirro, Leonardo Conde
Qualitative Criminology (QC)
Accessing research settings and participants can be deeply challenging for scientific research, especially when gatekeepers are involved. Gatekeepers are known to affect research through, among other reasons, their position inside institutions, their knowledge of the research topic, and their power over prospective participants. This article explores the methodological and ethical challenges that may arise from resorting to gatekeepers to access participants in qualitative criminological research. Using reflexive notes from the fieldwork of two doctoral research projects in criminology, this article emphasizes the central role gatekeepers can assume in qualitative research regarding gaining access to participants for a study and conducting …

Dying In Prison: End-Of-Life Care Services In A State Correctional Facility, Brook Cooley Webb, Mollee K. Steely Smith, Tusty Ten Bensel
Qualitative Criminology (QC)
The aging inmate population in American prisons has noticeably increased, contributing to a more significant number of offenders who will die in prison, thus forcing correctional facilities to aid in caring for prisoners at the end of life. Two common responses have emerged to deliver adequate healthcare to inmates, including hospice programs and End-of-Life (EOL) care services. This study aimed to explore the nature of EOL care in a state prison by interviewing correctional administrators, correctional officers, and relevant medical personnel (N=17). The current study provided insight into the inclusion criteria for inmates who utilized EOL care in the prison …

A Historic Review Of Community Policing & The Implementation Issues We Have Faced, Emily Bell
University Honors Theses
Community Policing has existed around the world for decades, despite becoming increasingly popular in the later 1990s and early 2000s in the United States. There have been multiple ways that the United States has tried to implement community policing, which this paper will review. Starting in the 1960s when the 12th street race riots caused Lyndon B. Johnson to publish government reports calling for an overhaul of policing and an increased focus on community relations, and looking all the way to 2014, when President Barack Obama created the Task Force on 21st Century Policing, which also put out a report …

Reparation For The Irreparable: Is Punishing International Crimes A Universalist Hoax?, Kholoud Hafez Hassan
Reparation For The Irreparable: Is Punishing International Crimes A Universalist Hoax?, Kholoud Hafez Hassan
Theses and Dissertations
This thesis challenges the conventional discourse on international punishment that emphasizes the development of a single, unified system of international criminal justice. Instead, it advocates for a pluralistic approach that recognizes the fragmented nature of international punishment, which involves various actors, including permanent courts, special tribunals, internationalized tribunals, and domestic courts exercising universal jurisdiction. The sui generis nature of international crimes demands a comprehensive approach to punishment that considers multiple perspectives and norms of diverse actors involved. Rejecting the notion of universalism in determining punishment rationales and promoting accounts of sentencing consistency, the author asserts that a global framework can …

This Isn't A Reality Show: How Social Media Livestreams Of High-Profile Criminal Trials May Violate One's Right To A Fair Trial, Ryan Fenn
St. John's Law Review
(Excerpt)
Since the invention of television in 1927, the American legal system faced drastic changes. In 1935, the first trial was broadcast to the public in the case of Bruno Hauptmann. During the trial, “[e]laborate telegraph equipment” was installed in the courtroom, with “sound and motion picture equipment . . . plainly visible in the [courtroom] balcony.” From 1935 on, broadcasting technology has been utilized in the courtroom to convey the inner workings of certain courts to the public, which has stimulated debate over whether the use of this technology is conducive to a fair trial under the Sixth and …

A Meditation On Afrosurrealism, Black Gender, And The Non-Human, Logan K. Shanks
Crossings: Swarthmore Undergraduate Feminist Research Journal
Quotidian Black life is characterized by our ability to alchemize violence into generative life-sustaining properties of matter. In this paper, I will measure Black matter based on anything produced and engaged by Black collectives. While Black existence is not tied to white violence, descendants of enslaved Black people enter our worlds of worlds greeted by a white captor. It is not until we consciously recognize that we are in his dream that we can work to escape the white captor’s circadian rhythms. Through this paper, I will tease out the contradictions of our Black living-unliving. I will employ an anti-methodological …

Ohio is a county-administered children services (formerly known as child welfare) system. Like many other states, Ohio is experiencing a shortage of child protective services (CPS) workers. County leaders report that this is due to high rates of turnover compounded by rising wages and competition from outside employers. Traditional recruitment techniques and programs, including traditional partnerships with universities with social work programs, are not adequate to meet the current level of need for new children services workers. Although social work majors come to children service agencies with a training set that allows faster onboarding, social work majors make up less …

African Americans experience high rates of obesity and food insecurity in part due to structural racism, or overlapping discriminatory systems and practices in housing, education, employment, health care and other settings. Nutrition education and nutrition-focused policy, systems and environmental changes may be able to address structural racism in the food environment. This scoping review aimed to summarise the available literature regarding nutrition interventions for African Americans that address structural racism in the food environment and compare them with the 'Getting to Equity in Obesity Prevention' framework of suggested interventions. An electronic literature search was conducted with the assistance of a …

Disparities In Violent Fatal Injury Among Racial And Ethnic Minorities, 2009–2019: A Portfolio Analysis Of United States—National Institutes Of Health, Maria-Isabel Roldós, Tilda Farhat, Marcia M. Gómez
Publications and Research
The excess mortality burden due to violent fatal injuries is an urgent public health issue for adolescents and young adults, especially those from racial and ethnic minority populations. We examined the research portfolio of the United States National Institutes of Health (NIH) related to violent fatal injuries between 2009 and 2019 to focus on adolescents and young adults from NIH-designated populations experiencing health disparities and to identify trends and research gaps. We analyzed funded projects by populations covered, geographic location of the study population, type of research (etiology, intervention, methodology), type of determinants, and publications generated. In 10 years, NIH …
