European Court Of Human Rights' Ruling In Georgia V. Russia (Ii) And Its Application To The Current Crisis In Ukraine, Edward N. Cain Jan 2023

European Court Of Human Rights' Ruling In Georgia V. Russia (Ii) And Its Application To The Current Crisis In Ukraine, Edward N. Cain

Loyola University Chicago International Law Review

Georgia v Russia (II) represents an important decision in the European Court of Human Rights case law. The Court sets out an important interpretation of Article 1 of the European Convention on Human Rights regarding the jurisdiction of signatory parties during times of invasion and war. The Court articulated that during active hostilities, there is no positive or negative obligation on the invading country to uphold or defend the human rights of the civilians of the invaded country. This is because they do not have effective control over the local population due to the dynamic nature of war. This precedent …

Midwest Governors’ Rhetoric During The Covid-19 Pandemic, Diego Sanchez Jan 2023

Midwest Governors’ Rhetoric During The Covid-19 Pandemic, Diego Sanchez

Lawrence University Honors Projects

There has been an explosion of research measuring governments' COVID-19 response both in the U.S. and globally. The response from the U.S. federal government to the COVID-19 pandemic was not consistent. Therefore, state governors had a variety of responses. Publicly available cell phone movement data was used to explore governors' impact on citizens' adherence to stay-at-home orders. This data was used to assess the impact of governors' press conferences, controlling for COVID-19 case count, partisanship, median income, and other factors. There were 13 Midwest states observed over 13 months from February 1, 2020, to February 26, 2021. The results of …

Women & Whistleblowing, Mary Saade Jan 2023

Women & Whistleblowing, Mary Saade

UC Law SF Journal on Gender and Justice

As more women in the United States take on leadership positions in the public and private sector, we have seen an influx of women whistleblowers. This Note examines whistleblower laws through a gender lens and offers insight to reveal why women blow the whistle, how women approach whistleblowing situations, and the effect current whistleblower laws have on women in the workforce.

This Note is divided into five parts. Part I includes an introduction and discusses competing definitions of whistleblower. Part II explores society’s differing perception of men and women whistleblowers and what may motivate women to report wrongdoings. Part III …

Rethinking The Federal Emergency Powers Regime, David Landau Jan 2023

Rethinking The Federal Emergency Powers Regime, David Landau

Scholarly Publications

Emergency has assumed central importance in the United States legal system. In 2019, President Trump declared an emergency at the southern border after Congress declined to fund his wall; critics responded with legal challenges and proposed reforms to the statute he invoked, the National Emergencies Act (NEA). Emergency powers have also played a key role during the COVID-19 pandemic. This Article conducts a comprehensive survey of emergency powers in the United States. It shows that the NEA is only one among many grants of authority presidents can call upon in a crisis, alongside other emergency schemes, specially delegated statutory power, …

Judicial Resistance To New York's 2020 Criminal Legal Reforms, Angelo Petrigh Jan 2023

Judicial Resistance To New York's 2020 Criminal Legal Reforms, Angelo Petrigh

Journal of Criminal Law and Criminology

This Article seeks to examine judicial opposition to New York’s 2020 criminal justice reforms in the context of existing scholarship on judicial organizational culture to understand why judicial obstruction occurs and how it can be addressed. New York’s 2020 criminal legal reforms sought to reduce pretrial detention and to provide greater access to discovery for the defense by curtailing judicial discretion to set bail and judicial power to excuse prosecutorial discovery delays. But judges opposed the law both surreptitiously and openly through defiant opinions, administrative adjustments, and routine court actions that undercut the reforms’ intended effects.

Scholars such as Malcolm …

A Mathematical Model Of Juvenile Delinquency In The New York State, Oluwasegun Micheal Ibrahim Jan 2023

A Mathematical Model Of Juvenile Delinquency In The New York State, Oluwasegun Micheal Ibrahim

Articles

This report presents a mathematical model of juvenile delinquency in the New York State. In particular, we develop a juvenile delinquency system of non-linear differential equations using the mathematical epidemiology framework. In constructing this model, we assume that juvenile delinquency can be studied as a socially infectious disease. The stability of the juvenile delinquency-free equilibrium of the model is examined using the standard non-linear dynamical systems theory technique. We carried out a data fitting based on real-life data from the New York State Criminal Justice Services. The research result reveals that the formulated model conforms with the available data and …

Black Liberty In Emergency, Norrinda Brown Jan 2023

Black Liberty In Emergency, Norrinda Brown

Faculty Scholarship

COVID-19 pandemic orders were weaponized by state and local governments in Black neighborhoods, often through violent acts of the police. This revealed an intersection of three centuries-old patterns— criminalizing Black movement, quarantining racial minorities in public health crises, and segregation. The geographic borders of the most restrictive pandemic order enforcement were nearly identical to the borders of highly segregated, historically Black neighborhoods.

The right to free movement is fundamental and, as a rule, cannot be impeded by the state. But the jurisprudence around state power in public health emergencies, deriving from the 1905 case Jacobson v. Massachusetts, has practically resulted …

Exploring Risk Factors Associated With Post-Traumatic Stress Disorder Symptomatology In Police, Lori Camacho Jan 2023

Exploring Risk Factors Associated With Post-Traumatic Stress Disorder Symptomatology In Police, Lori Camacho

Electronic Theses and Dissertations, 2020-2023

Mental health outcomes, especially post-traumatic stress disorder (PTSD), in police have become more of a concern for law enforcement administrators, peers, family and friends. Using culture as a theoretical framework, the current cross-sectional, convergent mixed methods study explored the relationship between personal cumulative exposure to different types of critical incidents and likelihood of reporting PTSD symptoms in a sample of officers (n=71) from one municipal police department. This study also examined how personal cumulative exposure to different types of critical incidents and likelihood of reporting symptoms of PTSD may be moderated by the degree of perception of social support from …

Ai Risk Assessment Tools Amid The War On Drugs: Productive Or Counterproductive?, Matin Pedram Jan 2023

Ai Risk Assessment Tools Amid The War On Drugs: Productive Or Counterproductive?, Matin Pedram

Mitchell Hamline Law Journal of Public Policy and Practice

The War on Drugs refers to a situation in which all the processes of production, distribution, and consumption of all illegal drugs are prohibited. This ambitious goal has imposed considerable costs on societies. The war has weaponized harsher punishments such as life imprisonment, execution, and long-term incarceration against drug offenders. Nonviolent offenders, those who possessed illegal drugs, have been easy targets for governments to show that the war is still ongoing. Although some countries became pioneers in changing the laws to end this costly war, Iran and the United States have made their stance on the drug issue clear, and …

Domestic Violence, Precarious Immigration Status, And The Complex Interplay Of Family Law And Immigration Law, Janet Mosher Jan 2023

Domestic Violence, Precarious Immigration Status, And The Complex Interplay Of Family Law And Immigration Law, Janet Mosher

Canadian Journal of Family Law

Survivors of domestic violence must frequently navigate multiple legal processes, as well as the various administrative systems that provide crucial supports and resources. For women with precarious immigration status, navigation is made all the more challenging not only because immigration and/or refugee law processes are added to the array of legal domains to be navigated, but because their access to supports and resources is both restrictive and in flux, shifting along with the changes in their immigration status.

Drawing from interviews with experienced lawyers and case law searches, I explore many of the intersections between family law and immigration law …

The Significance Of R. V. Albashir In The Evolution Of Constitutional Remedies, Anne M. Turley, Zoe Oxaal Jan 2023

The Significance Of R. V. Albashir In The Evolution Of Constitutional Remedies, Anne M. Turley, Zoe Oxaal

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper examines the impact of the Supreme Court of Canada’s decision in R. v. Albashir on constitutional remedies under section 52(1) of the Constitution Act, 1982 and section 24(1) of the Canadian Charter of Rights and Freedoms. Albashir marks a step in the evolution of constitutional remedies by adding to the list of factors that can justify a court declaring a law invalid on a prospective-only basis. It recognizes a new exception to the presumption of retroactivity that applies when a court declares a law to be invalid. Where a court suspends its declaration of invalidity, once the suspension …
