Purdue Pharma: Appalachia's Worst Nightmare, Malina C. Gaworski
Purdue Pharma: Appalachia's Worst Nightmare, Malina C. Gaworski
Honors Theses
This thesis describes the legal implications of Purdue Pharma’s vital role that implicated them in the opioid crisis after their release of the renowned drug, OxyContin. Purdue Pharma released the infamous drug in 1995 and the world of drugs and addiction has never been the same. Thousands of oxycontin-related deaths, pharmacies and medical professionals found liable, and countless lawsuits against the powerful company. This research expands on these lawsuits, the implications of these against Purdue Pharma, and the improvements made in the pharmaceutical company to prevent a disaster such as the opioid crisis from repeating itself.

Contactless Heart Rate Detection Using Mm-Wave Radar Systems Advancements, Amr Hussein, Mustafa M. Abd Elnaby, Ahmed M. Elkhawaga, Nessim M. Mahmoud
Journal of Engineering Research
In recent years, there has been a significant surge in the development of non-contact methods for detecting heart and breathing rates. Various Millimeter-wave (MM-wave) radar systems, operating at different frequency bands like 10 GHz, 24 GHz, 77 GHz, and 122 GHz, have been effectively deployed for this purpose. This paper explores the vital application of contactless systems in the medical field, particularly during disasters and epidemics. These systems are crucial for detecting the heart and breathing rates of individuals trapped under debris, in military operations, long-term vital sign monitoring in hospitals, and aiding the elderly in public spaces. Consequently, our …
Imprisoned By Algorithms: Risk Assessment Instruments And Predictive Sentencing In The Criminal Legal System, Thomas Johnson
Imprisoned By Algorithms: Risk Assessment Instruments And Predictive Sentencing In The Criminal Legal System, Thomas Johnson
Master's Theses (2009 -)
Tools for predicting an individual’s risk of recidivism are implemented throughout the criminal legal system, from informing decisions about release pretrial to identifying appropriate treatment plans for successful reentry. Data-driven risk assessment is increasingly being incorporated during sentencing proceedings across the United States. There is significant variation across jurisdictions in how these tools are constructed and what they aim to predict. The use of algorithmic risk assessment at sentencing is hotly contested due to concerns over the opacity of algorithms developed by private corporations, the potential for perpetuating disparities present in the criminal legal system, and violations of the constitutional …

The Third Generation Partnership Project (3GPP) has specified Cellular Vehicle-to-Everything (C-V2X) radio access technology in Releases 15–17, with an emphasis on facilitating direct communication between vehicles through the interface, sidelink PC5. This interface provides end-to-end network slicing functionality together with a stable cloud-native core network. The performance of direct vehicle-to-vehicle (V2V) communications has been improved by using the sidelink interface, which allows for a network infrastructure bypass. Sidelink transmissions make use of orthogonal resources that are either centrally allocated (Mode 1, Release 14) or chosen by the vehicles themselves (Mode 2, Release 14). With growing interest in connected and autonomous …
Sacred Topographies: The Rhetorical Construction Of Grandfather Mountain As A Sacred Place, Abby Marie Arnold-Patti
Sacred Topographies: The Rhetorical Construction Of Grandfather Mountain As A Sacred Place, Abby Marie Arnold-Patti
Electronic Theses and Dissertations Archive
This study interrogates the ways wilderness spaces become understood as sacred places through rhetoric, using Grandfather Mountain in Western North Carolina as a case study. Using close reading, rhetorical field methods, and social media content analysis, this dissertation examines the rhetorical interpretation, ritualization, contestation, and commodification of wilderness as it comes to be understood and interacted with as sacred. This study offers three significant and interrelated interventions. First, it interrogates how rhetoric works to designate a sacred place. While certain places are understood to be sacred because of their spiritual, historical, or social significance or their natural ecological uniqueness, what …
Harmful Precautions, Ronen Perry
Harmful Precautions, Ronen Perry
Notre Dame Law Review
According to the conventional definition of reasonableness, commonly known as the Hand formula, a person acts unreasonably (hence negligently) toward another if they fail to take precautions whose cost for the actor is lower than the expected loss for the other that these precautions can prevent.1 While law-and-economics theorists have advocated and courts have often embraced adjustments to both sides of this algebraic formulation,2 the idea that the expected loss must be compared with the cost of precautions for the potential injurer has remained mostly uncontested.3 This Article unveils an overlooked yet fundamental flaw in the orthodox understanding and application …

School-based law enforcement (SBLE) have become increasingly common in U.S. schools over recent decades despite the controversy surrounding their presence and lack of consensus around their associated benefits and harms. Drawing on the history and evidence base regarding SBLE, we advocate for an end to SBLE programs. Grounding our argument in principles of Community Psychology and positive youth development, we outline how the presence and actions of SBLE negatively affect individual students as well as school systems, with particularly harmful outcomes for students with minoritized and marginalized identities. Research on SBLE and school crime does not provide consistent evidence of …

Clemency: A Tool For Extreme And Discriminatory Sentences, Benjamin N. Cardozo School Of Law
Cardozo News 2023
This article appeared in the 2023 edition of Cardozo Life magazine.
For Joaquin Winfield, April 7, 2023, will forever be a day to remember. That is when he was granted clemency by New York Gov. Kathy Hochul after serving 26 years in prison for possession of 4.6 ounces of crack. The disparity in sentences given to people from different races for similar crimes has been widely written about in recent years. Winfield was sentenced under the now-repealed Rockefeller Drug Laws of the 1970s and 1980s. He was sentenced to 37.5 years to life, one of the longest prison sentences in …

The Contributions Of Mental Health Issues, Traumatic Brain Injury, And Adverse Childhood Experiences To Recidivism Among Rural Jail Incarcerees, Lauren N. Miley
The Contributions Of Mental Health Issues, Traumatic Brain Injury, And Adverse Childhood Experiences To Recidivism Among Rural Jail Incarcerees, Lauren N. Miley
USF Tampa Graduate Theses and Dissertations
Recidivism should be a major concern, particularly for American jails. The Unites States incarcerates 2.3 million people, a number exceeding rates in any other country. Approximately 90% of those individuals will reenter society at some point, and roughly half of those people will ultimately return to jail. This revolving door costs U.S. taxpayers upwards of $39 billion per year, and undermines public safety. Therefore, breaking this cycle of incarceration and recidivism is of utmost concern, and the focus of this dissertation. Mental health problems, traumatic brain injury (TBI), and adverse childhood experiences (ACEs) are three potential risk factors for recidivism …

This qualitative research study will use semi-structured interviews to explore the motivations of athletic trainers using social media for professional collaboration. The socio-psychological tradition is used to frame the study. Communities of practice, uses and gratification theory, and the Wisdom of the Crowd model are used as the guiding theoretical perspectives as they provide a framework for understanding how and why athletic trainers use social media. This qualitative study sought to show the impact of closed Facebook Group participation on athletic trainers. How athletic trainers understand patient privacy laws when participating in closed Facebook groups for athletic trainers will also …

Evaluating The Responsiveness Of Urban Security In The University Area, Varshini Renikunta
USF Tampa Graduate Theses and Dissertations
Perceptions of safety within one's neighborhood can significantly impact overall health. While certain neighborhood features like broken sidewalks, crime rates, and visible disorder can influence these perceptions, the exact interplay of these factors remains unclear, especially among individuals with disabilities who might perceive themselves at greater risk. Individuals typically opt for routes and spaces they deem safe in the built environment, such as well-lit pathways, areas next to lively storefronts instead of closed facades, or routes that steer clear of potentially unsafe building entrances. How individuals navigate and interact with their surroundings is intrinsically tied to their cognitive perceptions shaped …

Body Mass Index Misclassify Obesity In Firefighters, Samuel R. Vilmeau, Peter Beitia, Andreas Stamatis, Zacharias Papadakis
International Journal of Exercise Science: Conference Proceedings
Among firefighters the issue of obesity has gained significant attention due to its correlation with adverse health consequences. The National Fire Protection Association 1582 has endorsed the utilization of the body mass index (BMI) to assess obesity. However, long-standing concerns have emerged regarding BMI's reliability in accurately representing body composition (BC), especially in distinguishing between lean and fat mass. Firefighters' work is physically demanding, which often leads to increased muscle mass, BMI use may misclassify them as obese. This can result in false positives where firefighters are categorized as obese based on BMI even when their BC aligns with non-obese …

Coming Out Of Covid: Resuscitating Live Onboarding, Patricia Shafer, Claire Hackelberg
Nursing Research & Professional Development Conference
Background: Effective onboarding and orientation processes are critical for successful new hire engagement and retention. The COVID-19 pandemic caused disruption in the established in-person onboarding process leading to inconsistency and fragmentation. Evidence suggests that structured and supported on-the-job training is the most effective onboarding strategy (Frogeli et al., 2023). A program make-over was needed.
Purpose: To redesign the onboarding and orientation process for new nurses with effective and efficient process to address issues and increase satisfaction.
Method: Nursing Professional Development (NPD) Staff collaborated with the hospital and unit managers to gather input and redesign the on-boarding process for new hires. …

More Than Numbers – Let’S Talk About Mixed Methods Research, Deborah Gentile
Nursing Research & Professional Development Conference
Introduction: There are multiple approaches to conducting research. Quantitative and qualitative research inform nursing practice, but quantitative research tends to be emphasized. At AAH, most nursing research studies (in excess of 90%) are quantitative in nature even when the research question focuses on the meaning of a phenomenon or experience of a research subject. Meaning and experiences are best elicited using qualitative methods. Using one method to answer a research question is sometimes not enough.
Purpose: This presentation will address the use of mixed methods – involving quantitative and qualitative data – to add value to a study and …
