Virginia Tax Re-Structuring: 100 Years Ago, 50 Years Ago, And Now, Vivian E. Watts Jan 2023

Virginia Tax Re-Structuring: 100 Years Ago, 50 Years Ago, And Now, Vivian E. Watts

Richmond Public Interest Law Review

Virginia’s state and local financing structure is under pressure. Aged schools have fallen into disrepair in localities without a tax base to back capital improvement bonds. Virginia’s commitment in the wake of Brown v. Board of Education to fund equal public education opportunity for all has eroded. As the dominate source of local government funding, the real estate tax adds to housing costs, consuming the largest share of household budgets. This article discusses current and historic Virginia debates on tax equity, economic sustainability, program ramifications, and non-resident cost-sharing. It raises questions about the widening income gap and changes in business …

Structural Integrity Analysis Of The Rig Mast Following Repair Of Two Diagonal Braces In The Upper Mast Section, Rendhatya Padmodwiputra, Johny Wahyuadi Soedarsono, Mirza Mahendra, Bambang Eka Satria, Chandra Arif, Eka Juni Suarthana Jan 2023

Structural Integrity Analysis Of The Rig Mast Following Repair Of Two Diagonal Braces In The Upper Mast Section, Rendhatya Padmodwiputra, Johny Wahyuadi Soedarsono, Mirza Mahendra, Bambang Eka Satria, Chandra Arif, Eka Juni Suarthana

Journal of Materials Exploration and Findings

During a move to the new drilling location, two braces of the upper mast section on a 550 HP oil and gas rig was damaged. When damage is discovered, the rig operating company should conduct a risk analysis related to the damage using the standard used to determine rejection criteria and follow-up repairs. The strength of the rig mast is calculated using Finite Element Analysis (FEA) with initial conditions (before damage occurs) where all braces are installed and extreme conditions where neither brace is repaired. The calculation results are then used to assess the risk of reducing the rig mast …

The Excessive Fines Clause: Assessing Proportionality Of Fines Through Civil Asset Forfeiture By Multi-Factor Tests In The Wake Of Timbs V. Indiana, Lauren V. Parrottino Jan 2023

The Excessive Fines Clause: Assessing Proportionality Of Fines Through Civil Asset Forfeiture By Multi-Factor Tests In The Wake Of Timbs V. Indiana, Lauren V. Parrottino

Liberty University Law Review

This article analyzes the approaches to assessing the proportionality of fines imposed by civil asset forfeiture. In many cases, fines imposed by civil asset forfeiture consist of property. Without clear Supreme Court guidance on the matter of evaluating just what makes a fine “excessive,” I turned to the proportionality jurisprudence from the Eighth Amendment’s Cruel and Unusual Punishments Clause. While many circuits have proposed their own tests for excessive fines imposed through forfeiture, I propose an objective multi-factor test that will measure a fine’s proportionality to avoid excessiveness.

Iraqi Journal for Computer Science and Mathematics

The Internet of Things (IoT) hastransformed our interaction with the world by connecting devices, sensors, and systems to the Internet, enabling real-timemonitoring, control, and automation in various applications such as smart cities, healthcare, transportation, homes, and grids. However, challenges related to latency, privacy, and bandwidth have arisen due to the massive influx of data generated by IoT devices and the limitations of traditional cloud-based architectures. Moreover, network management, interoperability, security, and scalability issues have emerged due to the rapid growth and heterogeneous nature of IoT devices. To overcome such problems, researchers proposed a new architecture called Software Defined Networking for Edge …

A Reframed Consistent Ethic Of Life On Nuclear Energy: Exploring The Moral Implications Of The Revival Of The Bataan Nuclear Power Plant, Archie R. Magarao Jan 2023

A Reframed Consistent Ethic Of Life On Nuclear Energy: Exploring The Moral Implications Of The Revival Of The Bataan Nuclear Power Plant, Archie R. Magarao

Landas

This paper critically examines the moral implications of reviving the Bataan Nuclear Power Plant (BNPP) through the lens of the Reframed Consistent Ethic of Life (RCEL). While the Philippine government highlights its potential economic benefits, the study raises serious concerns about nuclear waste and its risks to human and nonhuman life. It evaluates both the advantages and dangers of nuclear energy, emphasizing threats to ecological integrity and long-term safety. The paper also questions the adequacy of existing plans for nuclear waste disposal, particularly in light of geopolitical and security challenges. In response, it proposes key moral perspectives: rethinking God’s presence …

Pharmacy Faculty Articles and Research

Domestic wastewater, when collected and evaluated appropriately, can provide valuable health-related information for a community. As a relatively unbiased and non-invasive approach, wastewater surveillance may complement current practices towards mitigating risks and protecting population health. Spurred by the COVID-19 pandemic, wastewater programs are now widely implemented to monitor viral infection trends in sewersheds and inform public health decision-making. This review summarizes recent developments in wastewater-based epidemiology for detecting and monitoring communicable infectious diseases, dissemination of antimicrobial resistance, and illicit drug consumption. Wastewater surveillance, a quickly advancing Frontier in environmental science, is becoming a new tool to enhance public health, improve …

Emergency Call Improvements In Areas With Marginal Wireless Coverage, Anonymous Jan 2023

Emergency Call Improvements In Areas With Marginal Wireless Coverage, Anonymous

Defensive Publications Series

In an emergency call, it is critical to provide accurate location and identity from the user equipment (UE) to the emergency service. However, the identity of the user equipment (UE) is known to the emergency service only when the UE is registered with the network. UE registration can be unreliable or unsuccessful in regions of marginal wireless coverage. This disclosure describes techniques to enable a UE, e.g., a smartphone or other mobile device, to attempt registration on a public land-mobile network (PLMN) for emergency calls in areas with marginal wireless coverage. If previous registration failure is traced to poor wireless …

Innocent Until Proven Posted: Regulating Online Mugshot Publication With Intellectual Property Law, Amanda Cheek Jan 2023

Innocent Until Proven Posted: Regulating Online Mugshot Publication With Intellectual Property Law, Amanda Cheek

Journal of Intellectual Property Law

Whether convicted of a crime or booked into jail for a misunderstanding, many individuals rightfully seek to shed the criminal label from their reputations and start anew. However, photo evidence of the individual’s association with the criminal justice system by way of a published mugshot photograph is often only a click away for someone, such as a potential employer or new neighbor. Mugshots, originally created to aid in the detection of criminals, now serve primarily as a device of public shaming by law enforcement agencies who publish mugshots on their website and groups of private citizens who run social media …

God, Guns, And Hair Salons: Public Perceptions Of Rights And Liberties During The Covid-19 Pandemic, Jessica R. Graham, Kyle J. Morgan

West Virginia Law Review

In response to the COVID-19 pandemic, elected officials across the United States took efforts to slow the spread of the virus. Some of these efforts raised constitutional questions about the ability of the government to curtail rights during a crisis. This project makes use of an original dataset—letters to the editor submitted to 33 of the nation’s largest newspapers during the early months of the pandemic—to analyze public attitudes about these restrictions. Like much of the previous work regarding attitudes towards rights and liberties during a crisis, we find that these concerns are not front of mind to the public. …

Democratizing Abolition, Brandon Hasbrouck Jan 2023

Democratizing Abolition, Brandon Hasbrouck

Scholarly Articles

When abolitionists discuss remedies for past and present injustices, they are frequently met with apparently pragmatic objections to the viability of such bold remedies in U.S. legislatures and courts held captive by reactionary forces. Previous movements have seen their lesser reforms dashed by the white supremacist capitalist order that retains its grip on power in America. While such objectors contend that abolitionists should not ask for so much justice, abolitionists should in fact demand significantly more.

Remedying our country’s history of subordination will not be complete without establishing abolition democracy. While our classical conception of a liberal republic asks us …

Youth In A Mental Health Crisis, William Simmons Jan 2023

Youth In A Mental Health Crisis, William Simmons

Integrated Studies

Recent research has shown that many of today’s youth are experiencing a mental health crisis that they are not prepared to handle on their own. A large portion of youth have a mental, emotional, or behavioral issue and may not even realize it or are not able to seek help. This problem is further exacerbated by continual budget cuts made to school spending and a justice system that prioritizes punishment over rehabilitation. This research paper will give a brief history of the juvenile justice system and what advances have been the most influential. It will also examine the flaws of …

Raising The Cyber Guard: Analyzing The Cost And Use Of The National Guard In Local Municipal And State Cyber Defense, Hunter Lacroix Jan 2023

Raising The Cyber Guard: Analyzing The Cost And Use Of The National Guard In Local Municipal And State Cyber Defense, Hunter Lacroix

Theses and Dissertations

Cybersecurity is a national priority for the Homeland Security enterprise. Yet, despite a prioritization at the federal level, municipal and state governments have struggled to incorporate the National Guard in cyber incident response. Cyber incidents strain municipalities and states, which have spent significant resources to mitigate cyber threats. The glaring gap in the National Guard’s role in municipal and state cyber incident response warrants two key questions as to why the National Guard isn’t more readily used. “Is it cost prohibitive to use National Guard assets when compared to private entities?” Or “is there an underlying sociological disconnect regarding the …
