Latino/Latin American Studies Reports
The COVID-19 crisis highlighted the increasing vulnerability of individuals, households, and communities. It has almost certainly been even more devastating for those who rely on community networks and organizations for aid but are less able to access aid networks in conditions of reduced mobility. This is the case for “mobile vulnerable populations,” among which include persons experiencing homelessness, victims of human trafficking, immigrants, refugees, and Latinos/as. This report summarizes our research with local Omaha service providers about what they need to serve mobile vulnerable populations in the community, how the pandemic has affected their ability to do so, and whether there …

Energy is an essential household need to sustain health and wellbeing. Connecticut has one of the highest energy costs in the nation and leaves a majority of residents experiencing energy insecurity, where households are not able to meet their energy needs. Energy efficiency retrofits have been introduced as an effective solution to sustain thermal comfort indoors. Despite increased funding and resources for energy efficiency, federal and state programs continue to go widely unused by tenants for several reasons from health and safety barriers, tenant-landlord power imbalances, and administrative challenges to name a few. This thesis aims to describe Connecticut’s energy …

An Intersectional Examination Of U.S. Civil Justice Problems, Kathryne M. Young, Katie R. Billings
Utah Law Review
Millions of Americans face civil justice problems each year, and most of these problems never make it to court, let alone to a legal expert. Although research has established that race and class are associated with a person’s chance of experiencing a civil justice problem, detailed intersectional examinations of everyday people’s justice experiences are largely absent. A more in-depth empirical understanding of the access to justice crisis can equip lawyers, policymakers, and other designers of justice interventions to create higher-impact, more efficient, and bettertargeted programs to meet the justice needs of everyday people.

Capstone Projects and Master's Theses
Santa Cruz County’s Shared Safety Workgroup, a collaborative chapter of United Way Santa Cruz, is working to better meet the needs of survivors and victims of crime. Due to the complexity of their trauma and the systems they navigate many survivors of crime are experiencing re-victimization. UWSCC attempted to create a comprehensive system mapping process for Santa Cruz County’s survivor-serving system with the assistance of community agencies. The expected outcome of the system mapping project is to create the first-ever system mapping tech platform that uniquely autogenerates services for survivors of crime while eliminating specific barriers based on their individual …

The Role Undocumented Student Resource Centers Play In Supporting Undocumented Students In Higher Education, Cynthia Boyzo
Electronic Theses, Projects, and Dissertations
Undocumented Students face many challenges in their daily lives. Accessing higher education is a challenge alone. Many undocumented students get discouraged to attend higher education due to financial constraints. The students that do attend institutions for higher education encounter different challenges. According to Murillo (2017), 65,000 undocumented students graduate from high school each year nationwide; however, only half (49%) attain a degree or enroll in college. Many institutions have developed Undocumented Student Resource Centers to provide a safe and welcoming environment for undocumented students. The purpose of this study explored how Undocumented Student Resource Centers support undocumented students throughout their …

Electronic Theses, Projects, and Dissertations
The purpose of this study is to address the challenges and barriers that LGBTQ+ individuals face when accessing mental health care services. This research is significant because though LGBTQ+ community faces many challenges such as discrimination and trauma, which greatly affect their mental health, yet LGBTQ+ specific mental health care is not widely available. This unavailability has resulted in only 12.6% of mental health care institutions having LGBTQ+ specific mental health care services. In addition, the small percentage of LGBTQ+ programs that are available in mental health institutions are not available in every city or region, which has resulted in …

A Framework For Identifying Malware Threat Distribution On The Dark Web, Shelby Caldwell
Graduate Theses and Dissertations (2019 - present)
The Dark Web is an ever-growing phenomenon that has not been deeply explored. It is no secret that in recent years, malware has become a powerful threat to technology users. The Dark Web is known for supporting anonymity and secure connections for private interactions. Over the years, it has become a rich environment for displaying trends, details, and indicators of emerging malware threats. Through the application of data science and open-source intelligence techniques, trends in malware distribution can be studied. In this research, we create a framework for helping identify malware threat distribution patterns. We examine this type of Dark …

The Role Of Organizational Support In The Relationship Between Safety Climate And Organizational Outcomes, Lee Chambers
Electronic Theses, Projects, and Dissertations
Organizations employing individuals in high-risk or safety-sensitive occupations (e.g., construction workers, commercial drivers, pilots, and oil rig workers) face the challenge of ensuring their employees’ safety and well-being amidst various hazards and dangerous situations. To address this, cultivating a positive safety climate has been identified as a crucial factor in reducing workplace accidents or injuries. However, despite its importance, the link between safety climate and non-safety outcomes remains underexplored in the literature. In response, this study proposed a model based on social exchange theory, which highlights the crucial role of organizational support in explaining the relationship between safety climate and …

Class Actions’ Ethical “Kiss”: The Class Action Lawyer’S Client Is The Class, Eli Wald
Class Actions’ Ethical “Kiss”: The Class Action Lawyer’S Client Is The Class, Eli Wald
UC Law Journal
The legal ethics of class actions is a mess, with many lingering, unresolved questions and conflicting answers. The culprit is a fundamental lack of agreement regarding the identity of the client, without which it is impossible to consistently resolve concerns about conflicts of interest and determine the scope of lawyers’ duties of competence and communication to the class, class representative, and class members. This Essay offers a simple solution to this disagreement: the class lawyer represents the class as an entity, not the class representatives and members, who are constituents of the class client. While conceptually simple, treating the class …

Complex Litigation Funding: Ethical Problem Or Ethical Solution?, W. Bradley Wendel, Joshua P. Davis
UC Law Journal
Commentators have worried that third-party funding, particularly in complex litigation, may give rise to ethical concerns. In this Essay, we explore an alternative possibility: third-party funding may solve ethical problems rather than cause them.
We explain why third-party funding can comply with the letter and spirit of the relevant ethical rules and why whether it causes or cures ethical problems depends on the setting. We note that if third-party funding agreements are properly structured—protecting, for example, lawyers’ independent judgment—they should not pose ethical problems. On the contrary, in some contexts third-party litigation funding may ameliorate tensions between clients and counsel. …

Ohio Forensic Nurse Examiners: Readiness To Care For Victims Of Sexual Assault With Disability, Deanna Nicole Smith
Doctor of Nursing Practice Scholarly Projects
Forensic nurse examiners (FNEs) care for crime victims in acute care settings. These nurses are specifically trained in trauma-informed care and evidence collection in cases of sexual assault, domestic violence, abuse, and human trafficking (RAINN, 2022). The scholarly project focuses on the care of victims of sexual assault living with disability, as this population is three times more likely to be victimized than any other population (NSVRC, 2022). The project literature review reveals a lack of data on preparation standards for FNEs on caring for victims with disability and providing accommodations during forensic examination. Currently, it is unknown if FNEs …

New Community Sponsorships For Humanitarian Immigrants: Guidance On Washington’S Practice Of Law And Immigration Services Fraud Prevention Rules, Megan J. Ballard, Zaida C. Rivera
Seattle University Law Review Online
Every state, including Washington, has enacted laws to protect the public from the harm caused when an unqualified person provides legal services. Each state defines the practice of law and generally limits that practice to members of the state bar association. In Washington, a complex collage of case law, statutes, and a Supreme Court rule attempt to define the practice of law, identify when the practice of law by a nonlawyer is unauthorized, and determine when public policy considerations allow such nonlawyer practice.
Protecting immigrants from unauthorized practice of immigration law is a particular concern. People who claim to be …

Behind The Scenes Of Controversial International Commercial Arbitration: Case Study Of Heirs To The Sultanate Of Sulu V. Malaysia, Tze Chin Ong, James Ding Tse Wen
Indonesian Journal of International Law
Recently, an ad hoc arbitration final award of US$14.92 billion (approximately RM62.59 billion) in favour of the heirs of the 19th-century sultanate, the late Sultan of Sulu, Sultan Jamalul Kiram II against Malaysia (the “Award”) that was handed down by a sole arbitrator had created much discussion in the international public and private law arena. Following the issuance of the n Award, Malaysia challenged the Award in the Paris Court of Appeal and successfully stayed the Award’s enforcement in France on July 12. During the same time, on July 11, two Luxembourg-registered subsidiaries of the Malaysian …

Franklin Loving v. Robert Morton
Appeal from the United States District Court for the Southern District of New York, No. 3:20-cv-11135
From the Summary of Argument
The Second Circuit should re-examine its precedent to allow for monetary damages for individual-capacity suits under the Religious Land Use and Institutionalized Persons Act (RLUIPA) for three reasons. First, RLUIPA’s text follows the same approach as 42 U.S.C. § 1983 and should be interpreted to afford the same types of broad remedies. Before Employment Division of Oregon v. Smith, 494 U.S. 872 (1990), reduced the availability of free exercise claims, free …

Direct-To-Consumer Advertising Of Prescription Drugs: Constitutionally Protected Speech Or Misinformation?, Matthew Griffin
William & Mary Law Review Online
This Note will argue that the United States can and should regulate direct-to-consumer (DTC) prescription drug advertisements on television more strictly—preferably by proscribing them altogether. In Part I, this Note will discuss the issues of soaring drug prices, disappointing health care outcomes, a glut of misleading drug advertisements affecting the doctor-patient relationship and personal health, and the problem with the current approach to prescription drug advertising. Part I will also discuss the misleading nature of DTC prescription drug advertisements and some examples of the harm they have caused. Additionally, Part I will propose a solution that focuses on limiting the …
