Innovation Funding And The Valley Of Death, Lital Helman
Innovation Funding And The Valley Of Death, Lital Helman
SMU Law Review
Innovation is a public good. As with other public goods, it is expected to be underproduced if only private incentives are present. Therefore, the law strives to encourage innovation via an array of stimulus mechanisms. The law offers three main mechanisms: intellectual property (IP), cash transfers—mainly prizes and grants—and tax incentives. Vast literature analyzes and compares these innovation stimuli in search of the optimal mix to boost innovation. Yet a key problem is largely overlooked: together, the existing stimuli do not cover the lion’s share of the innovation lifecycle. At the beginning of the innovation process, companies can win grants …

From Liberation To (Re)Criminalization: Dobbs V. Jackson Women’S Health Organization, Bodily Autonomy, And The Expansion Of State Rights, Robin S. Maril
SMU Law Review
For more than a generation, the U.S. Supreme Court recognized the constitutionally protected right to an abortion, and, in turn, the dignity-affirming power of reproductive autonomy and its role in designing one’s own destiny. The Court’s endorsement of the liberatory value of bodily autonomy in Roe v. Wade, as later affirmed in Planned Parenthood of Southeastern Pennsylvania v. Casey, rejected attempts to justify restrictive prohibitions on abortion as valid exercises of state police powers. However, the Court’s 2022 decision in Dobbs v. Jackson Women’s Health Organization threatens to fundamentally redefine the boundaries between the rights of individuals and those of …
Failures In The “Laboratories Of Democracy” And Democratic Due Process As Constitutional Guardrails, Matthew C. Clifford, F. Paul Bland Jr.
Failures In The “Laboratories Of Democracy” And Democratic Due Process As Constitutional Guardrails, Matthew C. Clifford, F. Paul Bland Jr.
SMU Law Review
In Dobbs v. Jackson Women’s Health Organization, the Supreme Court reversed decades of precedent supporting a substantive due process right to abortion under the Fourteenth Amendment, and purported to return the question of reproductive autonomy to the “democratic process” in the states. Justice Thomas, writing in concurrence, militated for reconsidering all of the Court’s substantive due process precedents. In today’s era of democratic backsliding, these are dangerous pronouncements with grave, if not existential, implications for democracy in the United States. The Dobbs majority hazardously asserted that state-level abortion legislation would, in fact, be the result of a democratic process. …

Hiring Discrimination In Denmark, Sweden, And Iceland: A Comparative Study Of Ukrainian And Afghan Job Applicants, Annika Brown
Hiring Discrimination In Denmark, Sweden, And Iceland: A Comparative Study Of Ukrainian And Afghan Job Applicants, Annika Brown
Economics Honors Papers
This paper investigates the labor market discrimination faced by job applicants from Afghanistan and Ukraine, using a correspondence test. Specifically, we examine the impact of nationality, gender, skill, and industry on positive responses from potential employers in Denmark, Iceland, and Sweden using a linear probability model. We used popular names in Afghanistan and Ukraine to create resumes that implied particular nationalities and included previous job experience in Kabul and Kyiv. Although the sample size of positive responses in Sweden and Iceland was too small to draw conclusions, employers in Denmark responded to 28 percent of the applications. For a Ukrainian, …
The Effect Of Federal And State-Level Policy On Undocumented Childhood Arrivals, Kim Kaczmarowski
The Effect Of Federal And State-Level Policy On Undocumented Childhood Arrivals, Kim Kaczmarowski
Walden Dissertations and Doctoral Studies
Deferred Action for Childhood Arrivals (DACA) provides a 2-year reprieve from deportation and a work permit for eligible undocumented childhood arrivals. It does not provide a pathway to citizenship or confer rights or protections enjoyed by those with permanent legal status leaving recipients in a constant state of legal limbo. State-level policy can mitigate or exacerbate obstacles faced by this population. The purpose of this generic qualitative study was to explore how federal and state-level policy in a conservative location shaped experiences of membership or exclusion. Responses were examined using segmented assimilation theory to identify layered contexts of reception. The …
Intersectionality Of Black Women Managers' Experiences With Gendered Racism In Corporate Finance, Venessa Marie Perry
Intersectionality Of Black Women Managers' Experiences With Gendered Racism In Corporate Finance, Venessa Marie Perry
Walden Dissertations and Doctoral Studies
Experiences of Black women with gendered racism remain a challenge in corporate America. Limited studies explore how Black women experience gendered racism due to the intersectionality of their dual identities. Black women experience chronic stress, burnout, and racial trauma. Disparities among Black women in management positions have gained traction and increased awareness; however, they remain underrepresented in corporate America. This qualitative study involved understanding Black women managers’ experiences with gendered racism in corporate finance. The generic qualitative study used intersectionality theory to illuminate the challenges of the intersecting identities of being a Black woman in corporate finance. Thirteen participants were …
Perception Of Effective Leadership Concerning Nurse Satisfaction And Intent To Leave, Tina Marie Rose
Perception Of Effective Leadership Concerning Nurse Satisfaction And Intent To Leave, Tina Marie Rose
Walden Dissertations and Doctoral Studies
Nurses are an essential part of patient care, and improving retention is important to quality outcomes and the cost of care. An integral aspect of nurse retention is job satisfaction, which may relate to communication provided by organizational leadership. The purpose of this quantitative study was to determine if there was a relationship between perceived effective leadership, nurse job satisfaction, and nurse turnover intent. This potential relationship between leadership communication and nurse turnover was studied with the competing values framework as the theoretical structure. The two research questions addressed the independent variables of perceived effective leadership in a hospital setting …

How To Build A World: Stereoscopes, Tourism, And Land In Zion National Park, Emma Duggleby
How To Build A World: Stereoscopes, Tourism, And Land In Zion National Park, Emma Duggleby
Scripps Senior Theses
This thesis fundamentally questions how representations of the environment and land impact how we relate to and live in it. By examining a set of 1925 stereoscope images of Zion National Park, it considers how use-based perceptions of place – structured by the entertainment of tourism and mass media – become part of the mundane practices of consumption. By revealing how these capitalist-colonial relationships to the land have been built through time, an analysis of these stereoscope slides reveals that these stories are anything but natural in hopes of making room for other stories to be built instead. The second …
Grain-Washing: The Issue With Corn Ethanol As A Sustainable Aviation Fuel, Emily J. Rinn
Grain-Washing: The Issue With Corn Ethanol As A Sustainable Aviation Fuel, Emily J. Rinn
Scripps Senior Theses
Decarbonizing the aviation sector remains one of the most prevalent obstacles in reducing the United States’ significant contribution to global greenhouse gas emissions. Launched in 2021, the Sustainable Aviation Fuel (SAF) Grand Challenge aims to supply enough fuel to meet 100% of demand by 2050 through reducing its production costs and enhancing its sustainable practices. Corn ethanol feedstock has been proposed to make up as much as half of all SAF production in the 2030 benchmark. This thesis explores the assemblage of corn ethanol – from its true environmental impacts, role in the future SAF market, to research claiming corn …
Wine, Culture, And Economics: The Barolo Model For Small Historical Wine Regions, Ravenna June Lee
Wine, Culture, And Economics: The Barolo Model For Small Historical Wine Regions, Ravenna June Lee
Scripps Senior Theses
This thesis investigates the resurgence of the Barolo wine industry as a paradigm for small historical wine regions seeking to revitalize and assert their independence in the face of corporate domination. Employing a multidisciplinary approach, the study blends economic analysis with cultural preservation, focusing on the unique circumstances of the Barolo region.
The Italian section of the thesis delves into the preservation of wine culture, emphasizing the role of tradition in maintaining the passion for wine among future generations amidst the threats of globalization. This section contributes to the broader discourse on regional identity, economic sustainability, and the intricate interplay …
Climate Cap And Trade And Pollution Hot Spots: An Economics Perspective, Jeff Todd
Climate Cap And Trade And Pollution Hot Spots: An Economics Perspective, Jeff Todd
Georgia State University Law Review
Although cap and trade is overwhelmingly preferred by economists for reducing greenhouse gases and spurring the adoption of renewables and other zero-carbon alternatives, some scholars and advocates worry that it allows firms to concentrate operations in poor and minority neighborhoods, thus leading to hot spots of harmful co-pollutants. Commentators differ on the danger of hot spots and the necessity of adjusting cap-and-trade programs to avoid them, however. This Article therefore surveys ex post economic studies of cap-and-trade programs to show that they do not lead to hot spots but may actually cool them—perhaps even better than command-and-control regulation. Accordingly, cap …

Synthesizing Energy Transitions, Nadia Ahmad, Uma Outka, Danielle Stokes, Hannah Wiseman
Synthesizing Energy Transitions, Nadia Ahmad, Uma Outka, Danielle Stokes, Hannah Wiseman
Georgia State University Law Review
This Article assesses the growing and cross-disciplinary literature on energy transitions to explore how it can guide law and policy reforms for the energy sector. The modern conception of energy transition centers primarily on clean energy—a shift away from fossil energy dependence. It also, however, incorporates equity as a core principle, as an increasing emphasis on energy justice and just transition seeks to create guiding norms for the energy sector’s current state of change. The concept of energy transition is critical for describing and giving meaning to a fundamental societal shift at the local, regional, national, and global scales, aligned …

The United States stands at an important crossroads. Polarization and paralysis are the political norm. Social divisions are deep and seemingly intractable. Concerted action is disappointingly rare. Social and political pressures continue to build like tectonic plates waiting to release. What will come next? This Article begins with a description of the current situation before turning to a consideration of five possible paths forward. First, stasis. There may be more of the same with limited systemic shocks releasing small amounts of pressure without a fundamental change of circumstances. Second, rupture. Building pressure may tear the current political and social system …

Introduction: Venezuelan Migrations, Journeys, And Trajectories Across The Americas, Esteban Devis-Amaya Ed., Mauricio Palma-Gutiérrez Ed.
Journal of Latino/Latin American Studies (JOLLAS)
The continuous large-scale process of human mobility from Venezuela can be attributed to recent years’ political and economic instability; the related, and unprecedented, humanitarian crisis; and the widespread suppression of civil liberties by an autocratic regime that remains in power (Freier et al., 2022; Vera et al., 2021; Freier and Doña-Reveco, 2022). It has been more than a decade since Anitza Freitez (2011: 11) argued that leaving the country, whether temporarily or permanently, had already become commonplace for Venezuelans to cope with the “structural problems affecting the daily survival”. As a result, as Venezuelan groups and individuals became more visible …
Foreign Constellations, Steven Archer
Foreign Constellations, Steven Archer
Electronic Theses and Dissertations, 2020-2023
Foreign Constellations is a magical realist collection that centers queer people of color in states of displacement. Facing disconnect from their own tribes along axes of faith, cultural tradition, sexuality, race, geography, and more, the Black and Hispanic characters in these eight stories chafe against the capacity of intersectionality to stratify rather than unite. They are, however, all Floridians, challenging the constraints of national perception with the breadth of their lived experiences. Set across Florida and beyond, each piece sees its protagonists venture into unfamiliar surroundings, or else return to old homes they no longer know how to navigate. A …

Three Essays On Rural Education: Descriptive Studies Focused On Federal Rural Definitions And Policy Changes, Kyung Ha Oh
Theses and Dissertations--Public Policy and Administration
Rural education issues in K-12 public schools are understudied despite a large rural student population in the U.S. This dissertation studies how different federal definitions of rural change how rural school districts and their diverse communities are portrayed, in comparison to their non-rural counterparts. This study also explores the recent federal rural policy changes on rural district revenue and student academic outcomes.
This dissertation consists of three descriptive essays. The first chapter shows how we choose to define ‘rural’ changes what differences are accentuated between rural and non-rural districts. Definitions of ‘rural’ is closely related to who gains access to …
The Fallibility Of The Brandenburg Test Through The Lens Of The Capitol Insurrection, Lauren M. Hausman
The Fallibility Of The Brandenburg Test Through The Lens Of The Capitol Insurrection, Lauren M. Hausman
Western New England Law Review
This Article explores the insurrection that occurred at our Capitol in relation to the Brandenburg test. The paper seeks to discuss whether free speech has gone too far, whether Brandenburg needs reform, and how we could effectuate such changes. While the Article certainly has political undertones, sincere efforts were made to present the facts in a more neutral fashion. Despite the political nature of the Article, I wholeheartedly believe that discussing the insurrection is critical to not only our nation’s history, but to the law.

Examining Colonial Impact On Beothuk Technological Traditions On The Island Of Newfoundland, Amanda G. Samuels
Examining Colonial Impact On Beothuk Technological Traditions On The Island Of Newfoundland, Amanda G. Samuels
Legacy Theses & Dissertations (2009 - 2024)
Indigenous technological production and use of tools is often influenced by several cultural factors including, functionality, environment, and cosmological and ideological beliefs. Projectile points are no exception, and they are often imbued with rich, symbolic meaning. While projectile points across North America have been extensively studied using various methods, there are some Indigenous groups and environments that are often excluded from academic, archaeological research, such as the Beothuk of Newfoundland. Since the Beothuk have seldom been the focus of archaeological research, their lithic and iron technology has not yet been analyzed thoroughly. I have conducted a systematic comparative analysis of …

A Comparison Of Teacher Evaluation Systems In New York State And Finland - Are There Alternatives To Appr?, Lindsay Tresansky
Legacy Theses & Dissertations (2009 - 2024)
The Annual Professional Performance Review (APPR) system in New York State (NYS) has been called into question by educators since its adoption nearly 10 years ago, yet it remains the mandated evaluation system in NYS schools today. Much of the concern has been over changes such as assigning teachers final evaluation scores, as well as for the added emphasis of students’ state assessment results on teachers’ individual final evaluation scores. In fact, the US Secretary of Education continues to promote the importance of administering high-stakes standardized tests, in spite of educator feedback expressing concerns on the impacts of the COVID-19 …

Encajar From The Margins: Drop-Out And Undocumented Latinx Youth Negotiating Deservingness And Spaces Of Belonging, Eric J. Macias
Legacy Theses & Dissertations (2009 - 2024)
Encajar from the Margins is a timely and important ethnographic project that contributes to existing literature on issues related to immigrant youth’s navigation of “illegality,” deservingness, and belonging. It examines the layers of challenges faced by undocumented youth who drop-out of high school. More specifically, this research centers the counter-narratives of undocumented youth that challenge many stigmatizing labels they have socially acquired. This dissertation focuses on an understudied population of young people who do not qualify for Deferred Action for Childhood Arrivals (DACA) or any other immigration protections after they migrated to the United States. This study provides important insight …
Analysis Of The Introduction Of Green Laboratory Certification Program At The University At Albany, State University Of New York To Increase Sustainability In Laboratories, Samantha Long
Legacy Theses & Dissertations (2009 - 2024)
Universities around the world are making changes to become more sustainable including lowering energy and water consumption, reducing waste production, and looking at procurement methods. At the University at Albany, State University of New York, there is an ongoing effort to increase sustainability and climate resiliency to align with state and international goals. One of the key areas needing improvement are scientific laboratories because they have a substantially larger energy consumption than other buildings. An analysis of current practices on campus was conducted and improvements suggested from research of similar programs. This included expanding and testing a campus specific “Green …
Evaluating Spatial Relationships Between Environmental Factors And Contextual Sociodemographic Burden And Associations With Respiratory Morbidity Among Young Children: An Indicator-Based Approach, Neil Anthony Muscatiello
Evaluating Spatial Relationships Between Environmental Factors And Contextual Sociodemographic Burden And Associations With Respiratory Morbidity Among Young Children: An Indicator-Based Approach, Neil Anthony Muscatiello
Legacy Theses & Dissertations (2009 - 2024)
The body of public health literature related to air pollution epidemiology is extensive. Similarly, the body of literature related to social epidemiology has also expanded greatly in recent years. While studies in these sub-disciplines of epidemiology sometimes seek to control for variables more commonly studied in one or the other, fewer studies report on their combined effects. Studies which do attempt to summarize how the combined air pollution burden and contextual sociodemographic burden differentially effect health outcomes beyond their individual effects could be beneficial in understanding links between the environment and certain health outcomes such as childhood asthma. The proposed …
