The Impact Of Marginalization On Relations With Law Enforcement And The Criminal Justice System, Angelo Kevin Brown
The Impact Of Marginalization On Relations With Law Enforcement And The Criminal Justice System, Angelo Kevin Brown
Faculty Publications
This chapter provides an overview of how critical race theory (CRT) has provided an important context for the racial disparities in the criminal justice system. CRT has promoted teaching the history of the criminal justice system in the United States of America (USA) and abroad from a racial perceptive. CRT scholars emphasize race because of how race and racism have shaped and impacted our society and institutions. CRT has been used to understand issues from police violence, sentencing disparities, school-to-prison pipeline, prison abolitionism, and much more. The CRT framework is especially important when it comes to understanding the disparities and …
Safety Of Domestic Ferries: A Scoping Study Of Seven High-Risk Countries, Anish Hebbar, Serdar Yildiz, Nadhir Kahlouche, Jens-Uwe Schröder-Hinrichs
Safety Of Domestic Ferries: A Scoping Study Of Seven High-Risk Countries, Anish Hebbar, Serdar Yildiz, Nadhir Kahlouche, Jens-Uwe Schröder-Hinrichs
Reports
Ferry accidents are fairly common globally, causing countless deaths and injuries. Whereas ferry transportation is an integral part of the domestic transport infrastructure in many countries, particularly archipelagic countries such as Indonesia and the Philippines, river deltaic countries like Bangladesh, countries with extensive riverine systems such as the Democratic Republic of the Congo, Nigeria and Senegal, or even a combination of great lakes, rivers and archipelago such as Tanzania, these countries are experiencing a high number of ferry accidents and fatalities over the past two decades and, therefore, considered high-risk countries in the ferry transport sector. International community continuously seeks …
Coercive Rideshare Practices: At The Intersection Of Antitrust And Consumer Protection Law In The Gig Economy, Christopher L. Peterson, Marshall Steinbaum
Coercive Rideshare Practices: At The Intersection Of Antitrust And Consumer Protection Law In The Gig Economy, Christopher L. Peterson, Marshall Steinbaum
Utah Law Faculty Scholarship
This Essay considers antitrust and consumer protection liability for coercive practices vis-à-vis drivers that are prevalent in the rideshare industry. Resale price maintenance, nonlinear pay practices, withholding data, and conditioning data access on maintaining a minimum acceptance rate all curtail platform competition, sustaining a high-price, tacitly collusive equilibrium among the few incumbents. Moreover, concealing relevant trip data from drivers is both deceptive and unfair when the platforms are in full possession of the relevant facts. In the absence of these coercive practices, customers too would be better off due to platform competition, which would lower average prices by sharpening competition …

The Prospect And Perils Of Climate Preemption For Public Health, Sarah Fox
The Prospect And Perils Of Climate Preemption For Public Health, Sarah Fox
College of Law Faculty Publications
Climate change is disrupting many communities in the United States and around the world. Climate events like heat waves, hurricanes, drought, fire, and flooding will become much more frequent, and with them will come the need for robust health care responses. Given the widespread and boundary-crossing nature of the problem, an ideal response would possibly originate at the federal or state level. As illustrated by the COVID-19 pandemic, however, there is little guarantee that such a response will be forthcoming. Recent foreclosures of federal options for handling climate change make such a response even less likely. Instead, it seems likely …
The Primacy Of Openness In Ecological Complexity Theory, Colby Clark
The Primacy Of Openness In Ecological Complexity Theory, Colby Clark
Theses and Dissertations--Philosophy
Five principles are at the foundation of complex systems theory: emergence, openness, contingency, historicity, and indeterminacy. Of those five, the principle of emergence is easily the most prevalent. Simply put, emergence refers to the idea that some wholes cannot be properly accounted for by appealing to individual explanations of the parts that compose it. In ecological complexity theory, the principle of emergence is strongly associated with the self-organizing feedbacks that often identify the structural framework of ecosystems.
Within the last half century, the intense focus on the principle of emergence has engendered the development of many conceptual distinctions that have …
Disparate Access To Medical Coverage Associated With Type 2 Diabetes Care In Low-Income And Rural Communities In Georgia, Crystal Alexis Symone Edwards
Disparate Access To Medical Coverage Associated With Type 2 Diabetes Care In Low-Income And Rural Communities In Georgia, Crystal Alexis Symone Edwards
Walden Dissertations and Doctoral Studies
Disparate access to diabetes care in rural and low-income communities among older adults has been an ongoing issue among Americans. Type 2 diabetes in low-income and rural communities has continuously burdened many residents due to age, costs of care, income, geographic location, and education levels. Researchers have demonstrated that providing resources and tools to rural and low-income communities would assist in decreasing type 2 diabetes and increase education and awareness. The purpose of this quantitative cross-sectional study using secondary data was to examine the relationship between health insurance status and lack of access to health care resources and delay of …
Practice Size And Geographical Location And Annual Merit-Based Incentive Payment System Scores In Dermatology, Issam H. Harmouch
Practice Size And Geographical Location And Annual Merit-Based Incentive Payment System Scores In Dermatology, Issam H. Harmouch
Walden Dissertations and Doctoral Studies
Despite the transition to value-based care in the healthcare industry using the Merit-Based Incentive Payment Systems (MIPS), small and rural physician practices still score in the poor category annually. These poor performances negatively impact funding for staffing and service availability; further, little research has focused on the factors behind these poor performance scores. The purpose of this study was to examine the relationship between practice size and organization geographical location on annual MIPS scores among dermatologists in the South-Central United States. The Donabedian model was used as the theoretical framework for this study that focused on the three qualities of …
Sociodemographic Predictors Of Veterans’ Health-Related Quality Of Life, Tamala Jones Choice
Sociodemographic Predictors Of Veterans’ Health-Related Quality Of Life, Tamala Jones Choice
Walden Dissertations and Doctoral Studies
Health-related quality of life (HRQoL) is a theoretical concept that intertwines physical, mental, emotional, and social functioning, with a focus on the impact that health status has on quality of life. Although sociodemographic factors are associated with lower HRQoL, how these factors influence HRQoL in military veterans is less understood. The study’s purpose was to examine the relationships between sociodemographic characteristics (gender, military pay grade, military branch, and geographic location) and perceived HRQoL measured by the SF-8 survey among veterans living in a metropolitan community in the Mid-Atlantic region of the United States. A cross-sectional recruitment study design yielded 90 …
The Relationship Between Chlamydia, Gonorrhea, Syphilis And Race, Gender, And Age, Johnny James Mcgrew
The Relationship Between Chlamydia, Gonorrhea, Syphilis And Race, Gender, And Age, Johnny James Mcgrew
Walden Dissertations and Doctoral Studies
The purpose of this quantitative correlational design using secondary data from Colorado Department of Public Health and Environment was to examine the relationship between different types of sexually transmitted infections (STIs), specifically, chlamydia, gonorrhea, and syphilis, and race, gender, and age in the United States. This study is significant because it could assist medical personnel to focus on more personally-based STI treatments. This study could also lead to a call for more research regarding sexual health programs across the nation, individuals’ willingness to share personal information regarding STIs, and how sexual health programs could increase testing for STIs. The study …
Pancreatic Cancer: Quantitative Study Investigating The Regional Risk Factors In North Carolina, Holly Marie Myers
Pancreatic Cancer: Quantitative Study Investigating The Regional Risk Factors In North Carolina, Holly Marie Myers
Walden Dissertations and Doctoral Studies
Pancreatic cancer is the fourth-leading cause of cancer-related deaths in the United States, killing more than 90% of individuals diagnosed within 5 years. Due to the lack of signs and symptoms, 82% of all pancreatic cancer cases are diagnosed in terminal stages. As such, the most powerful method to reducing the morbidity and mortality of pancreatic cancer is to further investigate the risk factors. According to the theoretical framework of the ecosocial theory, long-term exposure to exposures to unfavorable socioecological and environmental factors serve as a “web of causation” for adverse health outcomes. Using data from the North Carolina Department …
Sharing Strategies Between Higher Education Administrators And Their Information Technology Leaders, Larita Brewster
Sharing Strategies Between Higher Education Administrators And Their Information Technology Leaders, Larita Brewster
Walden Dissertations and Doctoral Studies
Some senior administrators in higher education institutions lack strategies to share leadership decision-making with their information technology (IT) leaders in the quest to sustain and improve organizational performance, which is often of concern to leverage technology and improve organizational performance. Grounded in the Bolman and Deal four-frame model of leadership, the purpose of this qualitative, multiple-case study was to explore strategies used at four higher education institutions by four IT leaders and four senior administrators, to improve organizational performance in Alabama. The participants were four higher education senior administrators and four IT leaders in Alabaman higher educational institutions. Data were …

Volume 10: Muslim Cultures Of The Indian Ocean : Diversity And Pluralism, Past And Present, Stephane Pradines, Farouk Topan
Exploring Muslim Contexts
Scholars are increasingly recognising the centrality of the Indian Ocean in the study of Muslim cultures.
This volume explores the expanding and changing roles of these Muslim communities across the Indian Ocean World from the seventh century to the mediaeval period to the present day. The book goes beyond the usual focus on geographical sub-regions to highlight different aspects of interconnectivity in relation to Islam. By analysing textual and material evidence, the fifteen papers in this volume examine identities and diasporas, manuscripts and literature, as well as vernacular and religious architecture. It explores the networks and movements of peoples, ideas …

Smallholder Views On Chinese Agricultural Investments In Mozambique And Tanzania In The Context Of Vggts, Rebecca Pointer, Emmanuel Sulle, Clemente Ntauazi
East Africa Institute
Based on a case study in each country, this study documents the views of Mozambican and Tanzanian smallholders regarding Chinese agricultural investments and the extent to which investors abide by their legitimate land tenure rights as defined by the Voluntary Guidelines for the Responsible Governance of Tenure of Land, Forests and Fisheries in the Context of National Food Security (VGGTs). The VGGTs offer guidelines to government on how to protect the land tenure of rural communities when land is being acquired for large-scale land investments. The study also assessed the impact of the COVID-19 pandemic on smallholders. Due to COVID-19, …

Across the country, violent tactics were employed to create and maintain all-white municipalities. The legacy of that violence endures today. An underexamined space in which that violence endures is within school districts. Many school district boundary lines encompass geographic areas that were created as whites-only municipalities through both physical violence and law. Yet principles that inform how school district boundary lines are drawn fail to account for the harms engendered by geographic spaces that are formerly whites-only municipalities. Legal doctrine and public policies also fail to capture the significance of the historical violence in considering the constitutionality and normative propriety …

This project involves the use of multi-source GIS data, suitability analysis, and spatial modeling techniques to identify the most suitable areas for improving renewable energy infrastructures, primarily focusing on wind energy, within a given region. Previous literature conducted on the subject matter shows research being done in isolated areas or states. The primary objective of this project is to develop a GIS model and scripting tool that has the capability to test any input region to find the most suitable area within the given region that would be ideal for implementing new wind power infrastructure. The success rate of the …

How Much Heirs’ Property Is There? Using Lightbox Data To Estimate Heirs’ Property Extent In The U.S., G. Rebecca Dobbs, Cassandra Johnson Gaither
Heirs' Property
The ramifications of a tenancy in common or heirs’ property ownership are extensive. This kind of tenuous ownership affects not only individual families but also the economic health of the typically minority and lower-wealth communities where these properties tend to cluster. Very little research has identified heirs’ property extent at a broad scale, however. We present results of our approach to identifying heirs’ parcels for every county and census tract in the U.S., using geospatial methodologies and aggregated parcel records acquired from LightBox. The method estimated 444,172 heirs’ parcels for the U.S., not including territories. The combined acreage is 9,247,452 …

Identifying Heirs’ Property: Extent And Value Across The South And Appalachia, Ryan Thomson, Conner Bailey
Heirs' Property
A database of property tax records was used to locate and quantify the extent of heirs' property across 11 states (Alabama, Florida, Georgia, Kentucky, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Virginia, and West Virginia). Based on previously published work, an index of four variables was then developed to estimate the likelihood that a given parcel was heirs’ property. The authors conservatively estimate that there are at least 496,994 parcels of heirs’ properties with a combined total area of 5.3 million acres and a market value of $41.9 billion in these states.

Referral Pathways And Service Connections Among Heirs’ Property Owners In South Carolina, Jennie L. Stephens, Jasmine Simington
Heirs' Property
Researchers, practitioners, and policymakers interested in alleviating heirs’ property ownership precarity have long sought to connect these owners to titling and land management resources, but there is limited scholarly evidence on successful interventions. Using administrative data from the Center for Heirs’ Property Preservation®(CHPP®), this article explores the demographic characteristics, types of direct legal services received, and referral pathways of landowners seeking legal assistance from CHPP® between 2017 and 2021. We find that applicants are primarily elderly, Black women, referred through four main pathways: (1) owners’ personal networks, (2) CHPP® outreach efforts, (3) CHPP® partner organizations—including public, private, and nonprofit agencies, …

Barriers To Sleep In Us Army Service Members: A Scoping Review, Sally Paul
Occupational Therapy Doctorate Capstone Projects
Background: Insufficient sleep contributes to human health and performance deficits with Active Duty US Army soldiers being at highest risk for poor sleep and subsequent sleep disorders. Research in this area continues to grow and has focused on pathology and intervention, often related to deployment, yet it is vital to understand the barriers to sufficient sleep in healthy soldiers (the majority) in the garrison context, where they will spend most of their time. Purpose: Explore the current state of literature regarding barriers to sufficient sleep in healthy US Army active duty service members in the garrison setting. Theoretical Framework. Biopsychosocial …
