Less Is More?: Accountability For White-Collar Offenses Through An Abolitionist Framework, Pedro Gerson Apr 2023

Less Is More?: Accountability For White-Collar Offenses Through An Abolitionist Framework, Pedro Gerson

Faculty Scholarship

White-collar crime is underenforced: not enough cases are brought, not many convictions are secured, and when they are, those who were convicted usually benefit from leniency not seen in other kinds of criminal wrongdoing. Calls for accountability center on strengthening the traditional tools of criminal law enforcement to reach actors that have so far eluded criminal liability. These responses, however, risk further entrenching the systems that have led the United States to mass incarceration and its many real and tangible harms. In this Article, I question whether an abolitionist framework is possible for white-collar crime. First, I argue that given …

Comparative Medicaid Policy Analysis Related To Maternal And Infant Birth Outcomes In South Carolina, Cassidy L. Lena Apr 2023

Comparative Medicaid Policy Analysis Related To Maternal And Infant Birth Outcomes In South Carolina, Cassidy L. Lena

Senior Theses

The United States despite being one of the most industrialized and wealthiest nations in the world, has the worst maternal and child health outcomes of any industrialized nation. The rates of maternal morbidity, mortality, and infant mortality have been increasing within the past decade, when many causes of death for this population are preventable. This study conducted a literature review on Medicaid policies and associated programs between three states (South Carolina, North Carolina, and California) in order to gain background information. Secondly, a comparative Medicaid policy analysis was completed using the Centers for Disease Control and Prevention [CDC] framework, which …

Around The Table: A Comparative Study On The Commensality Of American And Italian Culture And Its Implications On Wellbeing, Joy Bernal Apr 2023

Around The Table: A Comparative Study On The Commensality Of American And Italian Culture And Its Implications On Wellbeing, Joy Bernal

Senior Theses

Commensality (the act of eating together) has been shown to increase psychosocial wellbeing. As culture differs, so do the ways commensality occurs. This thesis uses established literature to compare the commensality between two countries, the United States and Italy, and conclude how those behaviors impact psychosocial wellbeing. After exploration and drawing connections, the hope is that this thesis encourages a call for change on the way we view eating and how we can gather more often to improve overall psychosocial wellbeing.

Imperialist Immigration Reform, Cori Alonso-Yoder Apr 2023

Imperialist Immigration Reform, Cori Alonso-Yoder

Fordham Law Review

For decades, one of the most challenging domestic policy matters has been immigration reform. Dogged by controversial notions of what makes for a “desirable” immigrant and debates about enforcement and amnesty, elected officials have largely given up on achieving comprehensive, bipartisan immigration solutions. The lack of federal action has led to an outdated and impractical legal framework, with state and local lawmakers unable to step into the breach. Well over 100 years ago, the U.S. Supreme Court firmly stated that regulation of the U.S. immigration system is within the sole constitutional authority of the federal government.

Yet there is one …

The Clinic As A Site Of Grounded Pedagogy, Madalyn K. Wasilczuk Apr 2023

The Clinic As A Site Of Grounded Pedagogy, Madalyn K. Wasilczuk

Faculty Publications

Legal education tends to focus on teaching students federal law from hefty casebooks, inculcating the ability to "think like lawyers." In a sea of Socratic lectures and hypotheticals, students often take refuge in clinics as an island of practical skills-building, client centeredness, and individual fulfillment. Yet even clinics sometimes fail to highlight for students how the place where they practice, with its particular political context and history, shapes their clients' lives and legal problems. This Article describes the law school clinic as a site of grounded pedagogy: a teaching method that centers the connection between local history and the present …

Localism, Pretext, And The Color Of School Dollars, Derek W. Black Apr 2023

Localism, Pretext, And The Color Of School Dollars, Derek W. Black

Minnesota Law Review Vols. 106:2 onward (2021-present)

Educational inequality is embedded in the structure of education itself. School districts, not individual schools, are the gatekeepers of educational opportunity. Racial isolation exists between school districts, not within them. Enormous funding gaps exist between neighboring school districts, sometimes in the same city, but not within them. These fault lines dictate everything from class size and teacher quality to suspension rates, achievement test scores, and graduation. To date, courts have rejected claims and remedies that would interfere with school district boundaries or local funding. The reluctance rests on the notion that localism is the historical foundation of public education. This …

On Electric Vehicles And Environmental Policies For Innovation, Shi-Ling Hsu Apr 2023

On Electric Vehicles And Environmental Policies For Innovation, Shi-Ling Hsu

UC Law Science and Technology Journal

Electric vehicles have been in existence for over a century. Impetus and progress towards commercialization have been uneven. For the most part, government policy on electric vehicle development has consisted of government funding and other support for research and development. The long, meandering path that has now resulted in the emergence of Tesla as an industry leader has been documented carefully in John Graham’s The Global Rise of the Modern Plug-in Electric Vehicle. Graham’s account is remarkably broad and thorough, leaving few stones unturned, and comprehensively detailing the history of electric vehicle policy in a number of countries, and often …

Tourism, Mapping, Retail And Recreational Trails: A Case Study Of Connectivity Between Trails And Adjacent Downtowns In Anniston, Alabama, Usa, Jennifer Green

Theses

This study examines the estimated increase in economic impact on a geography’s local economy by creating cross-marketing efforts between expanding an established outdoor recreation trail to a closely located city downtown commerce district. This research will analyze the resulting potential rise in sales/lodging tax revenues for that city by mapping the trail and downtown district, and cross-marketing the other to users of both or either venue. Potential increase in economic impact will be estimated utilizing IMPLAN methodology by assessing the economic impact on the local economy that a percentage range of increased spending resulting from this cross-marketing effort could generate.

The Psychogeographic Relationship With Memories, Popular Music, And Identity: A Case Study From 1995-2022 Of The Grateful Dead, Margaret Lane Walton

Theses

This paper will explore sonic geography and its impact on human and cultural geography through popular music, specifically the Grateful Dead, from 1995 to 2022. This research focuses on the eventization of the band and popular music post-Jerry Garcia’s death, whereas previous research has focused primarily on the band from 1965 to 1995. The infamous psychedelic rock and roll band was widely known for the created and imagined communities that it forged over their 30-year run. Recent research on soundscapes and music’s role in the study of geography precipitated the need for more attention to music geography. This paper explores …

Along Party Lines: Examining The Gubernatorial Party Difference In Covid-19 Mortality Rates In U.S. Counties, Aparna Lhila, Fares Alghanem

Anesthesiology Articles

Drawing upon the literatures on risk factors for COVID-19 and the roles of political party and political partisanship in COVID-19 policies and outcomes, this study quantifies the extent to which differences in Republican- and Democrat-governed counties' observable characteristics explain the Republican - Democrat gap in COVID-19 mortality rate in the United States. We analyze the county COVID-19 mortality rate between February 1 and December 31, 2020 and employ the Blinder-Oaxaca decomposition method. We estimate the extent to which differences in county characteristics - demographic, socioeconomic, employment, health status, healthcare access, area geography, and Republican vote share, explain the difference in …

Addition Of Mental Health To The Lady Health Worker Curriculum In Pakistan: Now Or Never, Fauziah Rabbani, Samina Akhtar, Javeria Nafis, Shahid Khan, Sameen Siddiqi, Zul Merali

Brain and Mind Institute

The technical advisory group of the World Health Organization (Geneva, Switzerland) has suggested person-centered and community-based mental health services in response to the long-term and far-reaching mental health impacts of the COVID-19 pandemic. Task shifting is a pragmatic approach to tackle the mental health treatment gap in low- and middle-income countries. Pakistan is dismally resourced to address the mental health challenges. Pakistan’s government has established a lady health worker’s program (LHW-P) which can be effectively utilized to provide some basic mental health services at community doorsteps. However, lady health workers’ current curriculum does not include mental health as a subject. …

Critical Workforce Skills For Bachelor-Level Geoscientists: An Analysis Of Geoscience Job Advertisements, G. W. Shafer, K. Viskupic, A. E. Egger

Geosciences Faculty Publications and Presentations

Understanding the skills bachelor-level geoscientists need to enter the workforce is critical to their success. The goal of this study was to identify the workforce skills that are most requested from a broad range of geoscience employers. We collected 3668 job advertisements for bachelor-level geoscientists and used a case-insensitive, code-matching function in Matlab to determine the skills geoscience employers seek. Written communication (67%), field skills (63%), planning (53%), and driving (51%) were most frequently requested. Field skills and data collection were frequently found together in the ads. Written communication skills were common regardless of occupation. Quantitative skills were requested less …

Rocky Intertidal Community Structure Along An Upwelling Gradient Between Playa Venao And Nueva Gorgona On Panama’S Pacific Coast, Claire Brady Apr 2023

Rocky Intertidal Community Structure Along An Upwelling Gradient Between Playa Venao And Nueva Gorgona On Panama’S Pacific Coast, Claire Brady

Independent Study Project (ISP) Collection

Ecological research on rocky intertidal ecosystems has increasingly focused on the regional oceanographic processes that shape community structure over functional group interactions. Intertidal communities’ dependence on onshore and offshore transport of intertidal species larvae, dissolved inorganic nutrients, and phytoplankton signal that upwelling and nearshore currents can have an influential role in determining the growth and composition of intertidal systems. The community structure of rocky intertidal areas was compared between two locations along an upwelling gradient in the Gulf of Panama: Nueva Gorgona, with intermittent seasonal upwelling, and Playa Venao, with fringe seasonal upwelling. The surface cover of algae, barnacles, and …

The Power Of Local: Nearby Innovators Dominate Patented Technology Development, Richard Gruner Apr 2023

The Power Of Local: Nearby Innovators Dominate Patented Technology Development, Richard Gruner

Northwestern Journal of Technology and Intellectual Property

Advances by nearby innovators – close enough to interact in person – play key roles in patented technology development. Patents frequently cite nearby innovations, identifying these local innovations as the background for further patented inventions. Such citations reveal narrow geographic areas with intensely active innovation communities advancing similar projects and technologies. Local innovators – working within a commutable distance of 40 miles or less of each other – accounted for 25 percent of all patent citations between 2010 and 2019 and about 21 percent of citations by disinterested patent examiners reviewing patent applications. These percentages of citations to local advances …

Community Participation And Perspectives Of Ambondrolava Mangrove Restoration Project, Nadine Shannon Apr 2023

Community Participation And Perspectives Of Ambondrolava Mangrove Restoration Project, Nadine Shannon

Independent Study Project (ISP) Collection

Madagascar’s mangrove forests are intertidal ecosystems that provide numerous valuable ecosystem services but are nonetheless under pressure from large amounts of deforestation. On the southwestern coast of Madagascar, the village of Ambondrolava practices community led management of the mangrove and its resources. This research project studied the evolution of the mangrove area using GIS data, and investigated, through interviews, the relationship between the local community of Ambondrolava and the organizations that manage the mangrove ecosystem. From 2000 to 2018, the zone of the mangrove has experienced a net loss in area every year, despite reforestation efforts. Most community members interviewed …

Ecological Living In Nepali Food Systems: A Synthesis Of Circular Nutrient And Knowledge Flows In The Kathmandu Valley, Kaitlyn Feely Apr 2023

Ecological Living In Nepali Food Systems: A Synthesis Of Circular Nutrient And Knowledge Flows In The Kathmandu Valley, Kaitlyn Feely

Independent Study Project (ISP) Collection

Researching food-systems in Nepal can feel like drinking from a fire hydrant. Sixty-six percent of the population is directly involved in agriculture and a diverse set of ecocultural understandings influence the practice across the country’s landscapes, ranging from the Himalayas to urban centers to southern plains. In the Kathmandu Valley and peripheral hills where I conducted my research, seemingly any spare land was under cultivation, enabled by fertile ground, optimal climate, and market potential. But despite the prevalence of farming in daily life throughout the country, Nepal’s food system is not domestically self-sufficient. A complex web of imports and exports …

Blockchain Coming To A Block Near You: How Fintech Is Changing Real Estate Investing, Joseph Bizub, Justin Peralta, David Reiss Apr 2023

Blockchain Coming To A Block Near You: How Fintech Is Changing Real Estate Investing, Joseph Bizub, Justin Peralta, David Reiss

Cornell Law Faculty Working Papers

Until recently, real estate with a small footprint – one-to-four-family homes as well as small retail, office, and industrial buildings – were generally within the purview of small investors who invested locally. Today, because of technological advances, these owner-occupants and investors face competition from an emerging class of decentralized finance (DeFi) investors. Fintech companies are presenting DeFi investors with new approaches to the challenges that real estate investing traditionally poses: illiquidity, high capital requirements, lack of diversification, and opaque markets. This article focuses on how fintech companies are meeting those challenges and suggests that while much of their vaunted innovation …

Is Corporate Law Nonpartisan?, Ofer Eldar, Gabriel Rauterberg Apr 2023

Is Corporate Law Nonpartisan?, Ofer Eldar, Gabriel Rauterberg

Faculty Scholarship

Only rarely does the United States Supreme Court hear a case with fundamental implications for corporate law. In Carney v. Adams, however, the Supreme Court had the opportunity to address whether the State of Delaware’s requirement of partisan balance for its judiciary violates the First Amendment. Although the Court disposed of the case on other grounds, Justice Sotomayor acknowledged that the issue “will likely be raised again.” The stakes are high because most large businesses are incorporated in Delaware and thus are governed by its corporate law. Former Delaware governors and chief justices lined up to defend the state’s …

Heritage Products, National Dishes And Consumer Identity, Monisha Das Dr,

AMTP Proceedings 2023

Food and agriculture is at the heart of the 17 Sustainable Development Goals, beginning with Sustainable Development Goal (SDG) 1: End poverty, and Sustainable Development goal (SDG) 2: End hunger. In this paper, the researcher explores data from FAO and WHO surveys conducted over ten years. The researcher applies various interdisciplinary approaches and references the theory of planned behavior to explain the resilience, especially of hedonic aspects of food diets in the context of the living heritage of national dishes. The research references Vavilov’s botanical centers of origin and dispersion to capture the biogeographic underpinnings of global cuisine. The findings …

The Human-computer Interaction (HCI) community has the opportunity to foster the integration of research practices across the Global South and North to begin overcoming colonial relationships. In this paper, we focus on the case of Latin America (LATAM), where initiatives to increase the representation of HCI practitioners lack a consolidated understanding of the practices they employ, the factors that influence them, and the challenges that practitioners face. To address this knowledge gap, we employ a mixed-methods approach, comprising a survey (66 respondents) and in-depth interviews (19 interviewees). Our analyses characterize a set of research perspectives on how HCI is practiced …

The Impact Of Gender On The Acceptance Of Surveillance Technology, Jody Messick Apr 2023

The Impact Of Gender On The Acceptance Of Surveillance Technology, Jody Messick

Sigma: Journal of Political and International Studies

A classic dilemma facing governments and citizens alike is the trade-off between privacy and security. This concept is found in the Constitution’s Fourth Amendment, which implies that citizens have a right to be protected against “unreasonable searches and seizures by the government” (FindLaw 2019). The technological revolution, and its implications for privacy, has complicated the nature of this right. Different types of data require different approaches to the privacy versus security tradeoff. A 2003 panel by Wright et. al asks how “sensor data,” data that is collected through technology that tracks a user’s online or real-world movements, should be approached, …

Patriotism And Democratic Education, Richard Dagger Apr 2023

Patriotism And Democratic Education, Richard Dagger

Political Science Faculty Publications

Whether patriotism has a valuable part to play in the educational system of a democratic society is now a highly contentious matter. This chapter argues that it does, principally because such a society is a kind of cooperative practice that requires its members to enact, enforce, and – in most cases – obey the laws that govern their self-governing polity. Democracies rely on rules, and especially the rule of law, to provide the reasonably clear expectations necessary to coordinate public activities and to overcome collective-action problems. By encouraging citizens to set aside personal advantage and play a cooperative part in …

The United States government holds public lands in trust for the whole of the American people. This article focuses on National Monuments under the Antiquities Act. It argues that the federal government should renew its approach to the management of these lands by incorporating principles of environmental justice and long- term environmental viability. The article begins by examining the historical and legal foundations of federal lands in the United States, with a focus on the Antiquities Act. It then reflects on recent litigation and political controversy surrounding Bears Ears National Monument and Grand Staircase–Escalante National Monument, to illustrate how the …

Contemporary Environmental Art: The Multidimensional Relationship Between Black Communities And The American Landscape, Sophia Perkins

Honors Capstones

Contemporary environmental art can be inspired by personal experience and reflections between the artist and their surroundings. Black women have a unique interaction with and relation to their environment. I would like to unpack the relationships between Black women and the environment by exploring a few different artists’ work, and by dissecting the effects race and gender have on one’s view of the natural world. I have studied the work of four artists: Torkwase Dyson, Allison Jane Hamilton, LaToya Ruby Frazier, and Calida Garcia Rawles. Environmentally, I have a specific interest in bodies of water / Black waterways because of …
