Indigenous Influence On The Rights Of Nature Movement, Vanessa Racehorse Oct 2023

Indigenous Influence On The Rights Of Nature Movement, Vanessa Racehorse

Faculty Scholarship

The growing recognition of the rights of nature is a blend of both modern conservation efforts and principles reflected in traditional Indigenous stewardship that should be an essential component of the discourse around environmental justice. This article provides an overview of the laws that invoke the rights of nature that Indigenous perspectives and practices regarding environmental preservation have influenced. This discussion pays particular attention to the White Earth Band of Ojibwe's "Rights of Manoomin" law and Manoomin v. Minnesota Department of Natural Resources (White Earth Band of Ojibwe Tribal Ct. 2021), the first rights of nature case filed in a …

Does Renewable Electricity Promote Indigenous Sovereignty? Reviewing Support, Barriers, And Recommendations For Solar And Wind Energy Development On Native Lands In The United States, Corrie Grosse, Brigid Mark Oct 2023

Does Renewable Electricity Promote Indigenous Sovereignty? Reviewing Support, Barriers, And Recommendations For Solar And Wind Energy Development On Native Lands In The United States, Corrie Grosse, Brigid Mark

Environmental Studies Faculty Publications

Native lands in what is called the United States have vast renewable energy resources. If focused on advancing sovereignty and self-determination, renewable energy development could alleviate harm from ongoing processes of settler colonialism and from the climate crisis, experienced by Native peoples first and worst. However, Native peoples benefit very little from existing renewable energy projects. To increase understanding on how renewable energy can better support Native sovereignty, this paper provides a systematic literature review of 74 articles published between 2003 and 2023 on Native peoples' involvement in wind and solar electricity in the United States. We find that existing …

The Satellite And The Territory: Essays On Remote Sensing And The Economics Of Sustainable Development, Matthew Gordon Oct 2023

The Satellite And The Territory: Essays On Remote Sensing And The Economics Of Sustainable Development, Matthew Gordon

Yale Graduate School of Arts and Sciences Dissertations

The increasing availability of satellite data is creating unprecedented opportunities to study sustainable development processes at both a global scale and fine temporal and spatial resolution. Economists and environmental researchers are using satellite data products to measure land-use change, economic growth, household vulnerability, air pollution, and more. When these data products are used in research or policy-making uncritically, however, the conclusions that follow can be inappropriate. This dissertation examines the potential opportunities and the shortcomings of three different uses of satellite data to inform sustainable development policy -- targeting policy, causal inference, and measurement. The first chapter studies the question …

Informing Design Of Sustainable Sorbents For Drinking Water Treatment: Faceted Nanohematite For Oxoanion Removal, Holly Elizabeth Rudel Oct 2023

Informing Design Of Sustainable Sorbents For Drinking Water Treatment: Faceted Nanohematite For Oxoanion Removal, Holly Elizabeth Rudel

Yale Graduate School of Arts and Sciences Dissertations

Provision of safe drinking water is of global importance, as evidenced by the United Nations Sustainable Development Goals, and yet significant inequities still exist in its access. Particularly, people that are geographically and/or economically limited bear the greatest burden. Within the United States, high costs of treatment for small communities or individual households pose significant barriers to the removal of contaminants below regulatory limits, let alone to health protective concentrations. Of particular concern are inorganic oxoanions (e.g., arsenic (As) and selenium (Se)), which pose serious risks to human and environmental health and are simultaneously challenging to remove because of their …

Third Coast Housing Solutions: The Case For Bringing Yimby Legal Activist Strategies To Chicago, Abigail Kuchnir Oct 2023

Third Coast Housing Solutions: The Case For Bringing Yimby Legal Activist Strategies To Chicago, Abigail Kuchnir

Northwestern Journal of Law & Social Policy

An insufficient supply of suitable housing stock is the root cause of issues like homelessness, overcrowding, and a cost burden on renters throughout the United States. A loose collective of activists and stakeholders comprise the YIMBY movement, an acronym for Yes In My Backyard. YIMBY advocates advance the perspective that additional housing stock is a necessary stratagem to improve housing availability and affordability, and they have used litigation as a tool towards developing new and diverse housing. This Comment examines the strategies currently used by legal activists in California, where impact litigation on this issue has been most prevalent. It …

One-Way Ticket To Mars: The Privatization Of The Space Industry And Its Environmental Impact On Earth And Beyond, Yuree Nam Oct 2023

One-Way Ticket To Mars: The Privatization Of The Space Industry And Its Environmental Impact On Earth And Beyond, Yuree Nam

Northwestern Journal of Law & Social Policy

In the 21st century, the space industry has changed from a government-focused practice to a rapidly growing private sector. Billionaires like Elon Musk and Jeff Bezos operate private companies for the advance of space travel and exploration. Other companies like Lunar Outpost, ispace, and Masten Space Systems were selected by NASA to collect lunar resources back in 2020. The concern is that current international space law is insufficient to regulate private actors who play a significant role in exacerbating environmental problems. Whether it be rocket emissions and environmental justice concerns on Earth, or commercial resource extraction in outer space, …

Assessing The Performance Of Agricultural Systems In The Inland And Coastal Regions Of Northern Portugal Using Indicators: Establishing The Foundation Towards Better Agricultural Practices, Genevieve Gehlken Oct 2023

Assessing The Performance Of Agricultural Systems In The Inland And Coastal Regions Of Northern Portugal Using Indicators: Establishing The Foundation Towards Better Agricultural Practices, Genevieve Gehlken

Independent Study Project (ISP) Collection

This study conducts a comprehensive evaluation of agricultural systems in the distinct coastal and inland regions of Northern Portugal. Employing key indicators, including soil erosion, nitrogen surplus, irrigation practices, Agricultural Gross Domestic Product (GDP), and crop yield, the analysis reveals statistically significant disparities and unique challenges in each region. The coastal areas, marked by higher agricultural GDP, exhibit distinct economic dependencies on agriculture, while the inland regions face challenges related to water scarcity, soil erosion, and rural isolation. The looming threat of climate change adds complexity to these dynamics, further highlighting the need for region-specific, sustainable agricultural practices. In the …

The Truth Behind Avocado Expansion In The Algarve: A Synthesis Of Public, Environmental Associations, And Government Perspectives And Response, Mandy Ausman Oct 2023

The Truth Behind Avocado Expansion In The Algarve: A Synthesis Of Public, Environmental Associations, And Government Perspectives And Response, Mandy Ausman

Independent Study Project (ISP) Collection

Avocado expansion has exponentially increased in the Algarve region of southern Portugal in recent years. The surge in expansion has provoked contention and discrepancy in the media regarding how and if avocado production can persist in the water-scarce region due to worsening drought conditions related to climate change coupled with the fruit’s significant water footprint. This paper aims to synthesize the arguments and response of the public, environmental associations, and government agencies to the expansion of avocado production in the water- scarce region of the Algarve, highlight the region’s current challenges of avocado expansion and water management regulation, and analyze …

Fauna As Fieldworkers: An Analysis On The Use Of Animals As A Form Of Organic Weed And Pest Management In Modern Viticulture, Mariana Del Carmen Campano Oct 2023

Fauna As Fieldworkers: An Analysis On The Use Of Animals As A Form Of Organic Weed And Pest Management In Modern Viticulture, Mariana Del Carmen Campano

Independent Study Project (ISP) Collection

Recent data on the current state of pesticide use in global agriculture suggests serious concerns over significant overuse and negative effects on both environmental and human health, and current trends only suggest continued increases in future global pesticide use. Without prompt, large-scale intervention, this global abuse of chemical pesticides spells significant threats of not only continued harm to global health and environmental quality, but also to the long term viability of agricultural lands and the growing threat of pesticide resistant insects and weeds. Various methods have been explored in the realm of integrated pest management (IPM), but a current lack …

Environmental (In)Justice: Evaluating The Factors That Led To The Jackson Water Crisis & Proposing A Solution For Environmental Justice In Mississippi, Emily Brennan Oct 2023

Environmental (In)Justice: Evaluating The Factors That Led To The Jackson Water Crisis & Proposing A Solution For Environmental Justice In Mississippi, Emily Brennan

MC Law Review

40,000. That is the number of residents that were left without potable water for nearly five weeks during Jackson, Mississippi’s February 2021 water crisis. An unusual cold front rolled through, freezing plant equipment, bursting water pipes, and causing many in Jackson to lose access to running water. This was not, however, the first time that Jackson residents had endured hardships with regard to their drinking water—it was just the first time that national attention turned to, and has seemed to remain on, Mississippi’s capital city. Those in Jackson are all too familiar with water pipes bursting, low water pressure, boil …

The Low-Hanging Fruit: Health, Rights, And The Commission, Bright Nkrumah Oct 2023

The Low-Hanging Fruit: Health, Rights, And The Commission, Bright Nkrumah

Washington and Lee Journal of Civil Rights and Social Justice

The year 2022 marked the 35th anniversary of the African Commission on Human and Peoples’ Rights. As it is a custom in many communities, when one reaches this milestone, it is an opportune time to introspect and reflect on the successes and challenges encountered in one’s journey. It is this template that the paper adopts to measure the prospects and setbacks of the African Commission in the advancement of the right to health. The Article argues that while the body remains the poster child of the continent’s human rights architecture, its inability to clearly articulate how states ought to advance …

Columbia Center on Sustainable Investment

During the Summit of the Americas in June 2022, U.S. President Joe Biden announced the launch of negotiations for an Americas Partnership for Economic Prosperity (APEP). The Biden administration hopes this initiative can rebuild relationships with countries in the region by increasing cooperation to address economic development and inequality, climate, and other challenges affecting the entire Western Hemisphere. To fulfill this vision and its associated goals, the participating countries must address the severe challenges posed by the investor-state dispute settlement (ISDS) regime and its escalating threats to the transition to a post-carbon society and the establishment of resilient public health …

The Legal Case For Equity In Local Climate Action Planning, Amy E. Turner Oct 2023

The Legal Case For Equity In Local Climate Action Planning, Amy E. Turner

Sabin Center for Climate Change Law

Over the last half decade, local climate action plans have regularly come to incorporate considerations of racial and socioeconomic equity, recognizing the ways in which low-income communities and communities of color experience earlier and worse consequences from global warming, and these communities are also at risk of being harmed by policies meant to address climate change. Until now, however, the discourse on equity in climate action planning has largely pertained to policy; it acknowledges the disproportionate harm that certain communities experience as a result of climate change and policies to address climate change, and suggests policy tools that can address …

Secondly, it identifies the right to environment as a unifying and holistic right that integrates these environmental concepts and encapsulates comprehensive environmental protection. Thirdly, it provides a comparison …

Preparing For The Flood: Virginia Local Governments' Stormwater Management Liability, James E. Davidson Oct 2023

Preparing For The Flood: Virginia Local Governments' Stormwater Management Liability, James E. Davidson

William & Mary Environmental Law and Policy Review

This Note explains that modern interpretations of Virginia Code § 15.2-970 have made Virginia municipalities immune to tort suits arising from the negligent maintenance of stormwater systems. Due to the Virginia Supreme Court’s holdings in Livingston v. Virginia Department of Transportation and other inverse condemnation suits, localities may be found liable when their stormwater management decisions cause property damage. However, following the Court’s holding in AGCS Marine Insurance Co. v. Arlington County, which prevented inverse condemnation claims arising from municipal negligence, residents are still unlikely to find legal redress for negligent stormwater management that results in property damage. Therefore, this …

Place-Based Environmental Education Towards Collective Environmental Literacy, Nicole Stubbs Oct 2023

Place-Based Environmental Education Towards Collective Environmental Literacy, Nicole Stubbs

School of Education and Leadership Student Capstone Projects

As environmental issues and environmental injustices persist, it is even more important for environmental educators to foster in individuals and groups the skills, knowledge, and natural appreciation needed to timely address these issues. Place-focused environmental education that seeks to address an individual’s sense of place can deepen an individual's connection with their local environment and community. A developed sense of place within a group can also pave the way for collective environmental literacy, the literacy held by a community and defined by the characteristics of collective action, collaboration, shared knowledge, and diverse perspectives. This capstone seeks to answer the question: …

Inequality Of Air Quality?: A Study Of Air Quality Within Housing Price Brackets In Gettysburg, Pa, Jess G. Schaefer, Alexis J. Jones, Arden H. Dowd

Student Publications

With the rise of cars and other motorized vehicles has come the rise of air pollution, which tends to have disproportionate environmental and health impacts on low-income and communities of color. This study analyzes car presence and air quality on a transect within Gettysburg, PA to determine if there is a relationship between air pollution and vehicle presence, and if there is a difference in air quality between higher price bracket housing compared to campus, commercial, and lower price bracket housing. To test our research questions, we identified nine sampling locations along a transect where we measured air pollutants, including …
