Rule 4 And Personal Jurisdiction, Scott Dodson Jan 2023

Rule 4 And Personal Jurisdiction, Scott Dodson

Faculty Scholarship

State-court personal jurisdiction is regulated intensely by the Fourteenth Amend- ment’s Due Process Clause, which the Court has famously used to tie state-court personal jurisdiction to state borders. Although the Fourteenth Amendment doesn’t apply to federal courts, the prevailing wisdom is that federal courts nevertheless are largely confined to the same personal-jurisdiction limits as state courts because of Rule 4(k), which provides that service “establishes personal jurisdiction” in federal court only upon specified conditions, including when the state courts would have personal jurisdiction. Some commentators have further argued that Rule 4(k) sets a limit on federal-court personal jurisdiction independent of …

The Dog That Didn’T Bark: Looking For Techno-Libertarian Ideology In A Decade Of Public Discourse About Big Tech Regulation, Jodi L. Short, Reuel E, Schiller, Susan Sibley, Noah Jones, Babak Hammatian, Lee Anna Bowman-Carpio Jan 2023

The Dog That Didn’T Bark: Looking For Techno-Libertarian Ideology In A Decade Of Public Discourse About Big Tech Regulation, Jodi L. Short, Reuel E, Schiller, Susan Sibley, Noah Jones, Babak Hammatian, Lee Anna Bowman-Carpio

Faculty Scholarship

The internet was built on the techno-libertarian ideology that “information wants to be free,” and that ideology has played a prominent role in academic and policy debates about regulating the internet and the big technology companies that dominate it.2 Techno-libertarian ideology has generated a constellation of claims about tech and regulation—from the suggestion that regulation will stifle innovation in the complex, dynamic tech sector, to the assertion that the large platform companies are literally not regulable. In this article, we explore how much traction such claims and ideologies have in the broader public discourse about big tech and regulation. We …

A Trip To The Border: Legal History And Apa Originalism, Reuel E. Schiller Jan 2023

A Trip To The Border: Legal History And Apa Originalism, Reuel E. Schiller

Faculty Scholarship

This article examines originalist interpretations of the Administrative Procedure Act (APA) from the perspective of a legal historian. After ex amining two pieces of originalist scholarship, it concludes that the histor ical record may not produce narratives of enough specificity or coherence to assist the originalist project. Nonetheless, it highlights three under-examined subjects of historical inquiry that have the most potential to aid APA originalists: the nature of administrative procedure during the first three decades of the twentieth century when the modem "appellate model" of judicial review emerged; the actual practice of ad ministrative law during the New Deal, both …

The Impact Of Whole Fruits High In Anthocyanins On Blood Lipids In Middle-Aged Women, Denise N. Leininger

Cal Poly Humboldt theses and projects

Cardiometabolic Diseases (CMDs) are the leading cause of morbidity and mortality among women. During the menopause transition, drops in estrogen play a favorable role in the excess accumulation of Intraabdominal Fat (IAF), altering blood lipid metabolism and inducing inflammatory responses in CMDs attributed to dyslipidemia. This systematic review and meta-analysis examined current research on the effects of whole fruits high in anthocyanins on blood lipid metabolism in women at risk for CMDs. This meta-analysis included 15 studies using the PRISMA 2020 guidelines. Overall, effect sizes were not significant when exploring blood lipid marker outcomes High-Density Lipoprotein (HDL), Low-Density Lipoprotein (LDL), …

Examining Educator Burnout And Classroom Outcomes As Correlates To Teaching Pyramid Implementation, April N. Frazer Jan 2023

Examining Educator Burnout And Classroom Outcomes As Correlates To Teaching Pyramid Implementation, April N. Frazer

Cal Poly Humboldt theses and projects

The Teaching Pyramid is a research-based socio-emotional framework created for implementation in early childhood education programs. It is designed to support children’s socio-emotional development and decrease persistent challenging behaviors. Challenging child behaviors have been linked to early educator stress. Job stressors in early childhood educators have been previously linked to educator burnout.

This study examined fidelity of implementation of the Teaching Pyramid framework as well as experience being trained and coached on the framework in 21 early childhood educators. It evaluated how these variables correlated with educator burnout, children’s socio-emotional development, and observed quality of care in nine Head Start …

Risk Of Position-Based Concussions Among Collegiate Men And Women Soccer Players, Devin Hauenstein Jan 2023

Risk Of Position-Based Concussions Among Collegiate Men And Women Soccer Players, Devin Hauenstein

Cal Poly Humboldt theses and projects

Limiting the incidence of concussions has become a foremost concern among collegiate athletes and coaches. This study aimed to determine if the soccer position played, and minutes played during a game predict the incident of concussion among college soccer players. If concussion risk can be predicted, it may lead to mitigating actions to minimize risks. Data from 208 male and female soccer players from the North Coast Concussion Program (NCCP) were assessed to predict the incidence of concussion based on total minutes played and position(s) played. A logistic regression analysis and predictive modeling technique were used to determine whether the …

This research used the BEST dataset gathered in 2017 by de Bruin and colleagues, which contains information gathered from 650 multilingual participants (435 female, Mage = 25.02) from the Basque Country at the Basque Center on Cognition, Brain and Language (BCBL). Multilingual individuals may have different levels of proficiency in each language they speak, and there are various factors that can influence proficiency. Such factors include the age at which they begin learning a language and how much exposure they have to the language. Proficiency can be assessed both subjectively (personal perception of proficiency) and objectively (observed and/or measured …

Extremism In America: Explaining Political Extremism Using Uncertainty-Identity Theory, Natasha A. La Vogue Jan 2023

Extremism In America: Explaining Political Extremism Using Uncertainty-Identity Theory, Natasha A. La Vogue

Cal Poly Humboldt theses and projects

Navigating a post-pandemic society, climate-change, political conflict and international wars have become part of most people’s daily existence. These crises are sources of societal and personal uncertainty. An effective method of uncertainty reduction comes from people’s entrenched group memberships (e.g. nation, political party). Unfortunately, groups with extreme norms and ideologies provide rigid structures that aid in uncertainty reduction. From white nationalists to anti-fascists, the political arena is tumultuous to the point of explosion. These eruptions can be violent, even deadly, and are becoming too familiar and recognizable. Extremism poses both international and domestic threats. There is no nation or society …

Writing Outside The Soviet Canon: Aleksandr Kozachinskii's "The Green Wagon" As Roman A Clef And Odesa Memoir, Cassio F. De Oliveira

World Languages and Literatures Faculty Publications and Presentations

This essay analyzes Aleksandr Kozachinskii’s 1938 Russian-language novella “The Green Wagon” as a roman à clef and exemplar of the Odesa Myth that has been unjustly neglected in literary scholarship. Reasons for the neglect of “The Green Wagon” include the historical context of its publication, between the Great Purges of 1936–1938 and the outbreak of World War II; Kozachinskii’s untimely death; and the conventional interpretation of the novella that reduces it to a fictionalized account of Kozachinskii’s friendship with Evgenii Petrov in Odesa during the early Soviet period. Against such a reductionist reading, and on the basis of recent archival-based …

BACKGROUND: The expanding population of older adults with obesity is a public health challenge, in part, because of the increased risk of fractures despite normal or high bone mineral density. Potential factors predisposing to fractures in this group include sarcopenia associated with obesity and impaired bone quality. We aimed to determine the contribution of sarcopenic obesity (SO) indices to bone strength as assessed by microfinite element analysis (μFEA) of high-resolution peripheral quantitative computed tomography (HR-pQCT).

METHODS: One-hundred eighty-nine older (age ≥ 65 years) adults with obesity (BMI ≥ 30 kg/m

RESULTS: Both ALM/W and HGS were positively correlated explaining 28% …

Weight Strategy In Older Adults With Obesity: Calorie Restriction Or Not?, Georgia Colleluori, Dennis T Villareal

Faculty, Staff and Students Publications

PURPOSE OF REVIEW: Along with the marked increase in the population of older adults with obesity is the need for effective strategies to treat aging- and obesity-related complications. This review highlights recent progress in obesity management in older adults.

RECENT FINDINGS: Although calorie restriction is needed to significantly reduce fat mass, an exercise protocol is crucial to ameliorate functional outcomes. The addition of a resistance exercise protocol improves the response of muscle protein synthesis to anabolic stimuli, preventing the calorie restriction-induced reduction in muscle and bone mass. The addition of an aerobic exercise protocol improves cardiorespiratory fitness and cognitive function. …

Faculty, Staff and Students Publications

AIMS/HYPOTHESIS: TCF7L2 variants are the strongest genetic risk factor for type 2 diabetes. In individuals with type 1 diabetes, these variants are associated with a higher C-peptide AUC, a lower glucose AUC during an OGTT, single autoantibody positivity near diagnosis, particularly in individuals older than 12 years of age, and a lower frequency of type 1 diabetes-associated HLA genotypes. Based on initial observations from clinical cohorts, we tested the hypothesis that type 2 diabetes-predisposing TCF7L2 genetic variants are associated with a higher percentage of residual insulin-containing cells (ICI%) in pancreases of donors with type 1 diabetes, by examining genomic data …

Introduction: In carefully selected patients with medically refractory epilepsy, disconnective hemispherotomy can result in significant seizure freedom; however, incomplete disconnection can result in ongoing seizures and poses a significant challenge. Completion hemispherotomy provides an opportunity to finish the disconnection. We describe the use of magnetic resonance-guided laser interstitial thermal ablation (MRgLITT) for completion hemispherotomy.

Methods: Patients treated with completion hemispherotomy using MRgLITT at our institution were identified. Procedural and seizure outcomes were evaluated retrospectively.

Results: Five patients (3 males) underwent six MRgLITT procedures (one child treated twice) for completion hemispherotomy at a median age of 6 years (range 1.8-12.9). Two …

Molecular analysis of public wastewater has great potential as a harbinger for community health and health threats. Long-used to monitor the presence of enteric viruses, in particular polio, recent successes of wastewater as a reliable lead indicator for trends in SARS-CoV-2 levels and hospital admissions has generated optimism and emerging evidence that similar science can be applied to other pathogens of pandemic potential (PPPs), especially respiratory viruses and their variants of concern (VOC). However, there are substantial challenges associated with implementation of this ideal, namely that multiple and distinct fields of inquiry must be bridged and coordinated. These include engineering, …

Transformations Between Rotational And Translational Invariants Formulated In Reciprocal Spaces, Philip R Baldwin

Faculty, Staff and Students Publications

Correlation functions play an important role in the theoretical underpinnings of many disparate areas of the physical sciences: in particular, scattering theory. More recently, they have become useful in the classification of objects in areas such as computer vision and our area of cryoEM. Our primary classification scheme in the cryoEM image processing system, EMAN2, is now based on third order invariants formulated in Fourier space. This allows a factor of 8 speed up in the two classification procedures inherent in our software pipeline, because it allows for classification without the need for computationally costly alignment procedures. In this work, …

The Neurobiology Of Duration Of Untreated Psychosis: A Comprehensive Review, Anthony W Zoghbi, Jeffrey A Lieberman, Ragy R Girgis

Faculty, Staff and Students Publications

Duration of untreated psychosis (DUP) is defined as the time from the onset of psychotic symptoms until the first treatment. Studies have shown that longer DUP is associated with poorer response rates to antipsychotic medications and impaired cognition, yet the neurobiologic correlates of DUP are poorly understood. Moreover, it has been hypothesized that untreated psychosis may be neurotoxic. Here, we conducted a comprehensive review of studies that have examined the neurobiology of DUP. Specifically, we included studies that evaluated DUP using a range of neurobiologic and imaging techniques and identified 83 articles that met inclusion and exclusion criteria. Overall, 27 …

INTRODUCTION: Surgical resection remains the first-line treatment for gliomas. Several fluorescent dyes are currently in use to augment intraoperative tumor visualization, but information on their comparative effectiveness is lacking. We performed systematic assessment of fluorescein sodium (FNa), 5-aminolevulinic acid (5-ALA)-induced protoporphyrin IX (PpIX), and indocyanine green (ICG) fluorescence in various glioma models using advanced fluorescence imaging techniques.

METHODS: Four glioma models were used: GL261 (high-grade model), GB3 (low-grade model), and an

RESULTS: Our systematic analysis showed that wide-field imaging of highly malignant gliomas is equally efficient with 5-ALA, FNa, and ICG, although FNa is associated with more false-positive staining of …

The Pathway To The Natural Gas Industry: Financial Development, Coal Consumption, And Carbon Dioxide Emissions In Pr China, Teng Tong, Jaime Ortiz, Haibo Wang

Faculty, Staff and Students Publications

This paper revisits the causal links between financial development, coal consumption, and CO2 emissions in P.R. China over the 1977–2017 period to validate the development of its natural gas industry. It uses a Bootstrap ARDL bound test with structural breaks to establish stationarity, short- and long-run dynamics, and causality of the series. The results show there are no long-run relationships among these three variables, but a Granger causality test does indicate the presence of both a two-way Granger causality between coal consumption and CO2 emissions, and a one-way Granger causality running from financial development to both coal consumption and CO2 …

HIV-1 infection of target cells can occur through either cell-free virions or cell-cell transmission in a virological synapse, with the latter mechanism of infection reported to be 100- to 1,000-fold more efficient. Neutralizing antibodies and entry inhibitors effectively block cell-free HIV-1, but with few exceptions, they display much less inhibitory activity against cell-mediated HIV-1 transmission. Previously, we showed that engineering HIV-1 target cells by genetically linking single-chain variable fragments (scFvs) of antibodies to glycosyl phosphatidylinositol (GPI) potently blocks infection by cell-free virions and cell-mediated infection by immature dendritic cell (iDC)-captured HIV-1. Expression of scFvs on CD4

The lysosomal protein TMEM106B was identified as a risk modifier of multiple dementias including frontotemporal dementia and Alzheimer’s disease. The gene comes in two major haplotypes, one associated with disease risk, and by comparison, the other with resilience. Only one coding polymorphism distinguishes the two alleles, a threonine-to-serine substitution at residue 185 (186 in mouse), that is inherited in disequilibrium with multiple non-coding variants. Transcriptional studies suggest synaptic, neuronal, and cognitive preservation in human subjects with the protective haplotype, while murine in vitro studies reveal dramatic effects of TMEM106B deletion on neuronal development. Despite this foundation, the field has not …

Targeting the Kv1.3 potassium channel has proven effective in reducing obesity and the severity of animal models of autoimmune disease. Stichodactyla toxin (ShK), isolated from the sea anemone Stichodactyla helianthus, is a potent blocker of Kv1.3. Several of its analogs are some of the most potent and selective blockers of this channel. However, like most biologics, ShK and its analogs require injections for their delivery, and repeated injections reduce patient compliance during the treatment of chronic diseases. We hypothesized that inducing the expression of an ShK analog by hepatocytes would remove the requirement for frequent injections and lead to a …

The single largest contributor to human mortality is cardiovascular disease, the top risk factor for which is hypertension (HTN). The last two decades have placed much emphasis on the identification of genetic factors contributing to HTN. As a result, over 1,500 genetic alleles have been associated with human HTN. Mapping studies using genetic models of HTN have yielded hundreds of blood pressure (BP) loci but their individual effects on BP are minor, which limits opportunities to target them in the clinic. The value of collecting genome-wide association data is evident in ongoing research, which is beginning to utilize these data …
