Biden V. Nebraska: The New State Standing And The (Old) Purposive Major Questions Doctrine, Jed Handelsman Shugerman Jan 2023

Biden V. Nebraska: The New State Standing And The (Old) Purposive Major Questions Doctrine, Jed Handelsman Shugerman

Faculty Scholarship

Chief Justice Roberts’s majority opinion in Biden v. Nebraska does not sufficiently explain how Missouri has standing under established Article III doctrine, nor how the Court approaches the major questions doctrine as a method of statutory interpretation. Clarification can come from other opinions, even other cases entirely, in which Justice’s counterarguments are suggestive of the real arguments underlying the decisions.

MOHELA may have faced a concrete injury from the student debt waiver, but there was no evidence that Missouri would – and the majority had no answer for how Missouri had standing without an injury. A debate over special state …

Judicial Resistance To New York's 2020 Criminal Legal Reforms, Angelo Petrigh Jan 2023

Judicial Resistance To New York's 2020 Criminal Legal Reforms, Angelo Petrigh

Faculty Scholarship

Scholars have examined judiciaries as organizations with their own culture and considered how this organizational culture can form a significant impediment to the implementation of reforms.22 There is a strong connection between judicial culture and a reform’s ability to accomplish its stated goals. Some go so far as to state that most reforms will fail because of the difficulty in altering judicial culture.23 These studies sometimes focus on legislators misunderstanding the actual effects of legislation when it was drafted, or on the failure to account for particularities in a law’s implementation by undervaluing the fragmentation, adversarial nature, and …

How Do Prosecutors "Send A Message"?, Steven Arrigg Koh Jan 2023

How Do Prosecutors "Send A Message"?, Steven Arrigg Koh

Faculty Scholarship

The recent indictments of former President Trump are stirring national debate about their effects on American society. Commentators speculate on the cases’ impact outside of the courtroom — on the 2024 election, on political polarization, and on the future of American democracy. Such cases originated in the prosecutor’s office, begging the question of if, when, and how prosecutors should consider the societal effects of the cases they bring.

Indeed, prosecutors often publicly claim that they “send a message” when they indict a defendant. What, exactly, does this mean? Often, their assumption is that such messaging goes in one direction: indictment …

In SFFA v. Harvard (SFFA), the Supreme Court further restricted a university’s right to consider the racial identity of individual applicants during admissions. The ruling has spawned considerable confusion regarding a university’s ongoing ability to pursue racial diversity, racial inclusion, and other equality-oriented goals—whether through “raceconscious” or “race-neutral” means. To assist institutions attempting to navigate the ruling, this article outlines a set of key legal rights and responsibilities that universities continue to possess following SFFA.

The Diffuse Executive, Anya Bernstein, Cristina Rodriguez Jan 2023

The Diffuse Executive, Anya Bernstein, Cristina Rodriguez

Faculty Scholarship

A unitary executive is an exacting ideal. It asks that all power in an administration be gathered in the person of the President, who should have full authority to determine the actions of officials and employees. Even if the President does not directly control every executive action (how could he?), when officials fail to implement presidential preferences, the unitary theory dictates that the President must have the power to remove them. The model posits a tightly organized hierarchy—every rung implementing the substantive decisions of the rung above, with orders flowing from the top: a command-and-control structure for government action. And, …

Predictors Of Psychological Well-Being And Relationship Satisfaction Among Bisexual Individuals, Sam Kahl Jan 2023

Predictors Of Psychological Well-Being And Relationship Satisfaction Among Bisexual Individuals, Sam Kahl

All-Inclusive List of Electronic Theses and Dissertations

Despite representing the largest subgroup of the LGBTQ+ community, bisexual individuals have long faced marginalization and erasure in psychological research on LGBTQ+ issues, which has often lumped bisexual individuals together with lesbians and gay men or excluded them altogether. Such practices fail to acknowledge the unique discriminatory experiences bisexual individuals face at the hands of heterosexual people as well as lesbians and gay men, and how these minority stressors contribute to distinctly poorer mental health and relationship outcomes for bisexual individuals. Although bisexuality research is still in its early stages and many gaps in the literature remain, a few recent …

Self-Authorship And Professional Identity Formation In Professional-Level Athletic Training Students, Matthew J. Rivera

All-Inclusive List of Electronic Theses and Dissertations

The development of a professional identity is a crucial component of health professions education programs and aids in interprofessional collaboration, communication, efficiency, and patient outcomes. Yet, limited research on the development of the individual as a component of professional identity development exists. The use of curricular strategies rooted in the self-authorship theory can close this gap in the development of a professional identity. Self-authorship is a developmental continuum whereby individuals move from following external formulas to building an internal foundation where they make meaning and integrate beliefs into how they think and act. This study aimed to investigate the self-authorship …

Cardiovascular Disease (CVD) is the leading cause of death globally and creates a large economic burden on society, through cost of treatment and missed workdays (Center for Disease Control and Prevention [CDC], 2022). The body of research examining factors contributing to the development and exacerbation of CVD primarily focused on identifying biological factors until the development of George Engels biopsychosocial model in the 1970s (Engel, 1977). Researchers then turned to identifying psychosocial factors contributing to CVD, particularly in the context of identifying modifiable psychosocial factors. Trait self-control and nonattachment are two psychosocial constructs that have been associated with positive outcomes …

Emoting In Context: Lived Narratives Of Filipino Health-Care Frontliners During The Early Days Of The Covid-19 Pandemic, John Martin Bernard Gappy

Sociology & Anthropology Department Faculty Publications

The current SARS-CoV-2 pandemic has placed the entire world in a liminal position whereby our well-rehearsed and predictive practices have been deeply shaken. Within this context of liminality, studies point to potential distress among healthcare workers who are taking care of COVID-19 patients. Most studies focus on emotional distress of frontline healthcare workers as fixed entities. The current approach perceives emotion as a type of connection with social worlds. This article focuses on contextual acts of emoting and is organized around personal, situational, and cultural features of nine frontline medical doctors affiliated with ten hospitals in Metro-Manila who were taking …

Explaining Organisational Business Process Adoption Mechanisms - A Critical Realist Perspective On Social Reflexivity And Process Affordances, Andreas Brönnimann Jan 2023

Explaining Organisational Business Process Adoption Mechanisms - A Critical Realist Perspective On Social Reflexivity And Process Affordances, Andreas Brönnimann

Theses: Doctorates and Masters

The implementation of new business processes can be problematic for organisations. Employees tend towards reluctant behaviour when confronted with organisational change that requires adoption of new workflows and work tasks. The crucial importance of people affected by change has been highlighted in past research. While the adoption of new processes is beneficial to the organisation, deviations from or rejections of new processes can lead to increased risks, missed process goals, increased waste leading to lost revenue, and other unforeseeable outcomes.

However, the adoption of proposed processes by individuals only is less desirable, because the collective nature of processes requires choreographed …

W-Sitting Position In Children And Its Musculoskeletal Implication, B.V. Murlimanju, Jayashree K, Suchetha S. Rao

Manipal Journal of Medical Sciences

W-sitting is a sitting position observed in a few children, where the child sits over the floor with his or her bent knees and legs positioned to the sides, making a ‘W’ shape. This sitting posture, if practiced very often can lead to the forward pelvic tilt and medial rotation of the hip. Children who suffered from cerebral palsy can present with abnormal sitting postures, including the W-sitting. Adaptive sitting and physiotherapy can be advised to improve the sitting posture and overall motor function in these children. However, a few studies suggested that there is no significant association between this …

Deconstructing Motherhood And Fatherhood: An Exploration Of Same-Sex Parents’ Experiences And Construction Of Their Parenting Roles, Jenine M. Giles

Theses: Doctorates and Masters

Dominant discourses regarding motherhood and fatherhood are entrenched in Australian culture and are often implied during public discussions of families with same-sex parents. Using a post structuralist approach, this project aimed to identify how parents in same-sex relationships experience and construct their parenting roles through combinations of dominant and alternative discourses of families, motherhood, and fatherhood. Following ethics approval, participants were recruited primarily through communication with Australian LGBTQIA+ community organisations and publications. Twenty-nine respondents each participated in one one-on-one semi-structured interview, which was audio- and video-recorded with their consent. The participants were eighteen years of age or older, in a …

Quantifying And Managing The Impact Of Electric Vehicles On Power Distribution Assets, Pravakar Pradhan Jan 2023

Quantifying And Managing The Impact Of Electric Vehicles On Power Distribution Assets, Pravakar Pradhan

Theses: Doctorates and Masters

Concern over the transportation sector’s greenhouse gas (GHG) emissions, which make up around 23% of all energy-related CO2 emissions, has grown in recent years. The widespread use of electric vehicles will be the primary strategy for tackling this issue. About 30% of the world’s passenger vehicle fleet is anticipated to be electrified by the year 2040. Moreover, the existing power distribution assets are already operating near their nominal capacities, and most of them have been in service for more than 25 years. Replacement of these assets will be very costly and disruptive to the power distribution network. Ergo, the main …

An Investigation Of Change In Drone Practices In Broadacre Farming Environments, Hrishikesh S. Neetye Jan 2023

An Investigation Of Change In Drone Practices In Broadacre Farming Environments, Hrishikesh S. Neetye

Theses: Doctorates and Masters

The application of drones in broadacre farming is influenced by novel and emergent factors. Drone technology is subject to legal, financial, social, and technical constraints that affect the Agri-tech sector. This research showed that emerging improvements to drone technology influence the analysis of precision data resulting in disparate and asymmetrically flawed Ag-tech outputs. The novelty of this thesis is that it examines the changes in drone technology through the lens of entropic decay. It considers the planning and controlling of an organisation’s resources to minimise harmful effects through systems change. The rapid advances in drone technology have outpaced the systematic …

The Cartographies Of Place: Approaches To Audio-Visual Composition Incorporating Aspects Of Place, Wing S. Tsang Jan 2023

The Cartographies Of Place: Approaches To Audio-Visual Composition Incorporating Aspects Of Place, Wing S. Tsang

Theses: Doctorates and Masters

Incorporating aural and visual elements of a place in a composition serves as a powerful way of exploring the intersection of time, history and geography associated with a location. The combination of these elements acts as an invitation for deeper engagement by offering multiple perspectives of place. One way of exploring these intersections is through incorporating aspects of place—in the form of field recordings, field footage and cartographical information—into audio and audio-visual work, where spatial and physical information can be situated as a way of representing an individual’s surroundings and subjective realities of place. This practice-led exegesis aims to explore …

Potential Contribution Of Immature Myeloid Cd11c+Dendritic Cells-Derived Osteoclast Precursor To Inflammation-Induced Bone Loss In The Traf6-Null Chimeras In-Vivo, Andy Yen-Tung Teng, Yen Chun G. Liu Jan 2023

Potential Contribution Of Immature Myeloid Cd11c+Dendritic Cells-Derived Osteoclast Precursor To Inflammation-Induced Bone Loss In The Traf6-Null Chimeras In-Vivo, Andy Yen-Tung Teng, Yen Chun G. Liu

Journal of Dental Sciences

Abstract Dendritic cells (DC) are potent antigen-presenting-cells widely distributed at the osteo-immune and/or mucosal–mesenchyme interface, consequentially implicating in certain bone-sparing disorders; i.e., via signaling Receptor-activator-of-nuclear-factor-kappa-B-ligand/RANKL-Receptor-activator-of-nuclear-factor-kB/RANK-Osteoprotegerin/OPG-TRAF6 transducer-complex etc. , evidently associated with arthritis, osteoporosis and periodontitis. We have reported that the immature myeloid CD11c+-DC subsets can act as osteoclast precursor (OCp; mDDOCp), thereby developing into osteoclasts (OCs) via an alternative pathway for osteoclastogenesis. Importantly, cytokine TGF-β remains critical to prime CD11c+-mDDOCp-cells deficient of TRAF6-&-related immune/osteotropic signaling, featuring distinctive TGF-β-&-IL-17-invoked effectors in the environmental milieu sufficient to driving bona-fide osteoclastogenesis in-vitro . Herein, we sought to explore the potential contribution of immature-mDDOCp/OCp …
