Factors Influencing Educational Equity In Online Instruction For Students During Covid-19, Sudha Krishnan
Faculty Research, Scholarly, and Creative Activity
This qualitative study examined special education teachers’ perceptions of student success in online instruction during the pandemic school closures to isolate the key determinants in the differential student outcomes reported by the teachers. Data were collected from 16 teachers using semi-structured interviews and analyzed using thematic coding. The six themes that emerged from the data were that the key determinants of student outcomes were variables related to teacher, school administrator, district, student, parent, and pedagogy. The study showed that underlying deficit thinking in school professionals, lack of planned support for those parents and students needing the most support, and limited …

Just Go To The Office! An Intersectional Exploration Of The Role Of Race And Gender In Discipline Referral Reasons, Kamilah B. Legette, Yoli Anyon
Faculty Research, Scholarly, and Creative Activity
Educators’ differential selection of Black and Latine students for office discipline referrals is a significant driver of inequity in exclusionary outcomes. Using demographic data and discipline records for all students in one large urban school district, we use descriptive statistics and multilevel regression models to consider whether referral reasons are racialized and if these patterns intersect with gender. Our analyses indicate that educators are consistently more likely to refer Black students than White students to the office for several subjective reasons, including habitual disruption, that are purportedly race-neutral but privilege Whiteness. They are less likely to make referrals for Black …

Alzheimer’S Disease (Ad) Knowledge In Korean Americans: Identifying Knowledge Gaps And Misconceptions And Examining Predictors Of Ad Knowledge, Sang E. Lee, Michin Hong, Banghwa L. Casado
Faculty Research, Scholarly, and Creative Activity
Objectives: This study examined Alzheimer’s disease (AD) knowledge and its predictors among Korean Americans (KAs). Design: Convenience sampling was used to recruit KAs in the Greater Washington metropolitan area. A total of 268 KAs participated in the study and completed a cross-sectional survey in 2014. Using the Alzheimer’s Disease Knowledge Scale (ADKS), overall and domain knowledge was assessed. Multiple regression analyses were conducted for overall and domain knowledge with predictors including exposure to AD, social engagement, sources and frequency of health-related information, stigmatic beliefs (pity, antipathy, and social distance), English proficiency, and education. Results: KAs reported a 59% accuracy in …

Perioperative Outcomes Of Patients With Bleeding Disorders Undergoing Major Surgery At An Academic Hemophilia Treatment Center, Ruben Rhoades, Zachary French, Amy Yang, Karen Walsh, Douglass A. Drelich, Steven E. Mckenzie
Department of Medicine Faculty Papers
Persons with bleeding disorders (PwBD) are at high risk for bleeding with invasive procedures. However, the risk of bleeding in PwBD undergoing major surgery and outcomes of patients managed perioperatively at a hemophilia treatment center (HTC) are not well described. We performed a retrospective review of surgical outcomes among PwBD undergoing major surgery between January 1st, 2017 and December 31st, 2019 at the Cardeza Foundation Hemophilia and Thrombosis Center in Philadelphia, PA. The primary outcome was postoperative bleeding, assessed according to the ISTH-SSC's 2010 definition. Secondary outcomes included use of unplanned postoperative hemostatic therapy, LOS, and 30-day readmission rate. Results …
To Whom Are Directors’ Duties Owed? Evidence From Canadian M&A Transactions, Camden Hutchison
To Whom Are Directors’ Duties Owed? Evidence From Canadian M&A Transactions, Camden Hutchison
All Faculty Publications
One of the most contentious issues in corporate law is the proper scope of fiduciary duties. Many scholars have argued that fiduciary duties are owed exclusively to shareholders, while others have advocated a broader conception of directors’ fiduciary obligations, potentially encompassing a wide variety of stakeholder and community interests. This debate has both normative and positive dimensions: Not only are there theoretical disagreements as to whom directors’ duties should be owed, there are also more basic disagreements as to what the law actually requires, including the extent to which business norms supplement (or undermine) legal rules. In Canada, at least, …

Algorithms And Their Affordances: How Crowdworkers Manage Algorithmic Scores In Online Labour Markets, Francesca Bellesia, Elisa Mattarelli, Fabiola Bertolotti
Faculty Research, Scholarly, and Creative Activity
On online labour platforms, algorithmic scores are used as indicators of freelancers' work quality and future performance. Recent studies underscore that, to achieve good scores and secure their presence on platforms, freelancers respond to algorithmic control in different ways. However, we argue, to fully understand how freelancers deal with algorithmic scores, we first need to investigate how they interpret scores and, more specifically, what scores can do for them, i.e., perceived algorithmic affordances and constraints. Our interviews and other qualitative data collected with knowledge intensive gig workers on a major platform allow us to explain how the perceived affordances of …
Schelling's Clara: Romantic Psychotherapy, Michael Vater
Schelling's Clara: Romantic Psychotherapy, Michael Vater
Philosophy Faculty Research and Publications
Schelling’s unfinished novella/dialog from the early years of his turn to philosophy of spirit presents arguments for personal immortality, but in a narrative form. Characters that represent nature and mind try to rescue the usually equanimous Clara from psychological crisis occasioned by her husband’s death and consequent intellectual perplexities about personal survival. Their arguments illustrate Schelling’s reformulated Spinozistic metaphysics: expressivism. On this theory, a Wesenheit or creative essence manifests in both physical and psychic dimensions but is itself nothing other than the connection between the two. Clara, doctor, and pastor symbolize these three functions while their personae fashion arguments that …

Enhancing Reciprocity, Equity And Quality Of Ethics Review For Multisite Research During Public Health Crises: The Experience Of The Covid-19 Clinical Research Coalition Ethics Working Group, Vasiliki Rahimzadeh, Jennyfer Ambe, Jantina De Vries

In this paper we report findings from a commissioned report to the COVID-19 Clinical Research Coalition on approaches to streamline multinational REC review/approval during public health emergencies. As currently envisioned in the literature, a system of REC mutual recognition is theoretically possible based on shared procedural REC standards, but raises numerous concerns about perceived inequities and mistrust.

What Mcculloch V. Maryland Got Wrong: The Original Meaning Of "Necessary" Is Not "Useful", "Convenient", Or "Rational", Steven Gow Calabresi, Elise Kostial, Gary S. Lawson

McCulloch v. Maryland, echoing Alexander Hamilton nearly thirty years earlier, claimed of the word “necessary” in the Necessary and Proper Clause: “If reference be had to its use, in the common affairs of the world, or in approved authors, we find that it frequently imports that one thing is convenient, or useful . . . to another.” Modern case law has translated that understanding into a rational-basis test that treats the issue of necessity as all but nonjusticiable; The Supreme Court has never found a congressional law unconstitutional on the ground that it was not “necessary . . . …
The Ghosts Of Chevron Present And Future, Gary S. Lawson
The Ghosts Of Chevron Present And Future, Gary S. Lawson
Faculty Scholarship
In the October 2021 term, the Supreme Court decided six cases involving federal agency interpretations of statutes, at least five of which seemingly implicated the Chevron doctrine and several of which explicitly turned on applications of Chevron in the lower courts. But while the Chevron doctrine has dominated federal administrative law for nearly four decades, not a single majority opinion during the term even cited Chevron. Three of those cases formalized the so-called “major questions” doctrine, which functions essentially as an anti-Chevron doctrine by requiring clear congressional statements of authority to justify agency action on matters of great legal and …

A Scientific Approach To Tech Accountability, David Choffnes, Woodrow Hartzog, Scott Jordan, Athina Markopoulou, Zubair Shafiq

The Federal Trade Commission can only do so much to hold tech companies accountable. Enforcement agencies and the people they protect need help. One problem is that the inner workings of large organizations and complex algorithmically driven systems remain obscure and opaque while their privacy representations are voluminous and vague. In this Essay, we propose a scientific approach to tech accountability, where academic researchers can play a larger role in privacy policy. This approach involves surfacing a company’s privacy representations and statements, as well as measuring the actual behavior of their systems with respect to algorithms, user interfaces, and data …
Prosecution And Polarization, Steven Arrigg Koh
Prosecution And Polarization, Steven Arrigg Koh
Faculty Scholarship
Domestically and internationally, two prominent contemporary discourses arise in law and society. First, we live in a time of tremendous uncertainty about the nature and function of criminal justice. In the United States, we chronicle mass incarceration, while the international community weighs war crimes prosecutions in Ukraine. Second, we live in a time of polarization, both at home and abroad. Cultural and political division is elevated domestically, while the international community debates fragmentation in a multipolar world.
This symposium contribution to the Fordham Urban Law Journal’s “Future of Prosecution” symposium asks: what does it mean to prosecute in a time …

This Article covers a potential response to a Massachusetts state law which has been interpreted to require health care providers and birthing hospitals to report to state authorities any infant born to a person taking medication of opioid use disorder. While the statute mandates reports where a professional has "reasonable cause to believe that a child is suffering physical or emotional injury" as a result of substance dependence at birth, the Article highlights that many institutions report all infants born to persons with substance abuse disorders, regardless of risk of harm, for fear of penalty for failure to report. As …

Designing Implementation Strategies To Improve Identification, Cascade Testing, And Management Of Families With Familial Hypercholesterolemia: An Intervention Mapping Approach, Laney K Jones, Ross C Brownson, Anne C Goldberg, Et Al.
2020-Current year OA Pubs
INTRODUCTION: Familial hypercholesterolemia (FH) is a common inherited cholesterol disorder that, without early intervention, leads to premature cardiovascular disease. Multilevel strategies that target all components of FH care including identification, cascade testing, and management are needed to address gaps that exist in FH care. We utilized intervention mapping, a systematic implementation science approach, to identify and match strategies to existing barriers and develop programs to improve FH care.
METHODS: Data were collected utilizing two methods: a scoping review of published literature, related to any component of FH care, and a parallel mixed method study using interviews and surveys. The scientific …
Humanizing Corporate Governance, Caleb N. Griffin
Humanizing Corporate Governance, Caleb N. Griffin
Faculty Publications
American corporate governance evolved in a different era, for a type of investor who is no longer typical today. Roughly half of Americans own investment funds, but legal and structural impediments prevent these “human investors” from fully participating in corporate democracy.
One response—“so what?”—is based on the assumption that investors are rationally apathetic. Most investors have so little at stake, the argument goes, that it is economically irrational for them to vote in corporate elections. What this argument misses is that investors’ rational apathy is not fixed. Instead, it is a function of the costs and benefits of voting. If …
Contracting As A Class, Caleb N. Griffin
Contracting As A Class, Caleb N. Griffin

Contract law is stuck in a loop of path dependency and stale precedent. Its metaphors, like “the meeting of the minds,” are today laughably implausible. Its values, like “consent,” have been stripped of any real meaning. No one reads or understands the overwhelming majority of contracts to which they agree. And no one should. Reading them is meaningless, because it simply does not matter what they say. Individuals must agree to them— indeed, are effectively forced to agree to them—if they wish to participate in the modern world.
Modern digital contracting is not a collaborative process. Today, most “contracting” involves …
Pitfalls Of Progressive Prosecution, Carissa Byrne Hessick
Pitfalls Of Progressive Prosecution, Carissa Byrne Hessick
Faculty Publications
This Essay examines the political vulnerabilities facing the progressive prosecution movement, arguing that two core features of its public brand—emphasizing a fundamental break from traditional prosecution and pledging to “do less” by shrinking the criminal justice footprint—have inadvertently exposed reform‑oriented prosecutors to intensified backlash. Drawing on recent examples, the Essay shows how framing progressive prosecution as radically different obscures the long-standing prosecutorial tools these offices still rely on, enabling critics to portray routine exercises of discretion as unprecedented or dangerous. It further explains how decarceral commitments make progressive prosecutors easy targets when crime or disorder rises, both because voters may …
