The Public Voice Of The Defender,, Russell M. Gold, Kay L. Levine

For decades, police and prosecutors have controlled the public narrative about criminal law. The news landscape features salacious stories of violent crimes while ignoring the more mundane but far more prevalent minor cases that clog the court dockets. Defenders, faced with overwhelming caseloads and fear that speaking out may harm their clients, have largely ceded the opportunity to offer a counternarrative based on what they see every day. Defenders tell each other about the overuse of pretrial detention, intensive pressure to plead guilty, overzealous prosecutors, cycles of violence, and rampant constitutional violations-all of which inflict severe harm on defendants and …
The Credibility Effect: Defamation Law And Audiences, Yonathan A. Arbel
The Credibility Effect: Defamation Law And Audiences, Yonathan A. Arbel
Articles
What should be the legal response to false statements? In the context of defamation law, courts try to set a standard that balances the interests of speakers and their potential targets. This article empirically demonstrates an unappreciated effect of such decisions on third parties: a credibility effect. Using a series of lab experiments, I find that defamation law makes individuals more trusting of reports from various media. This credibility effect is desirable when the report is true but can lead to unintended consequences in the case of misinformation. In particular, the credibility effect is shown to cast a stigma on …

Superficial Peroneal Nerve Entrapment In Female Collegiate Tennis Athlete: A Disablement Model Case Study, Sarah Branning, Neeru Jayanthi, Zachary K. Winkelmann
Clinical Practice in Athletic Training
A 19-year-old female, NCAA Division I collegiate tennis player presented with a burning and aching sensation halfway up the lateral portion of her right calf following an extensive period spent in a squatting position. This discomfort began distal to the fibular head, then ran along her lateral calf, reached into her ankle, and wrapped behind the lateral malleolus. Initially, the patient only noticed this discomfort during long durations of physical activity. However, she began to report symptoms with activities of daily living (ADLs) and following workouts. The patient first received a working diagnosis of a stress reaction along the mid …

Strategies To Improve Healthcare Communication With Non-Native English Speakers: An Evidence To Practice Review, Skylar B. Hudgens-Wallace, Kaitlyn M. Pierce, Madison P. Whitesell, Nancy A. Uriegas, Zachary K. Winkelmann
Clinical Practice in Athletic Training
As the number of non-native English speakers in the United States rises, the degree to which some patients understand their healthcare communication is decreasing. It is essential to recognize the areas of limited health literacy to ensure proper patient communication and education are achieved. The guiding systematic review aimed to examine different communication interventions and the reported patient experiences from those interactions. The main forms of healthcare communication interventions used in the study included in-person, telephone, and video call interpreters. Patients have been shown to respond best to in-person interpreters, but using interpreters via telephone or video call was also …

Clinical Practice in Athletic Training
Athletic trainers are responsible for the patient care of student-athletes but also can be responsible for the education and mentorship of athletic training (AT) students through the role of preceptor. ATSs require extensive first-hand clinical experiences to prepare them for autonomous practice but must first feel comfortable with the skills they have learned to apply them in clinical practice. The unique clinical experience these ATSs experienced was the combined experience of a graduate assistant athletic trainer preceptor who also assisted as a teaching assistant in the classroom. This allowed the preceptor to help the ATSs expand on the information provided …

University Football Player With Hoffa’S Fat Pad Syndrome: A Disablement Model Case Study, Kaitlyn Jones, Kristy Dao, Zachary K. Winkelmann
Clinical Practice in Athletic Training
A 23-year-old university football player presented with acute onset anterior knee pain with no distinct mechanism of injury. The pain began soon after the start of fall football camp and prevented the patient from participating in team activities, including weights and practices. Along with pain, the patient experienced edema, decreased knee flexion range of motion, and an antalgic gait. The findings of the evaluation of this patient were consistent with Hoffa’s fat pad syndrome, an inflammatory and impingement condition of the infrapatellar fat pad that is often a rare diagnosis of exclusion. Conservative treatment was used for this patient, which …

Rhabdomyolysis And Hypothyroidism In A Collegiate Hammer Thrower: A Disablement Model Case Study, S. Andrew Cage, Robert Michael Galbraith, Rebecca Peebles, Payton Williams, Brandon Warner
Clinical Practice in Athletic Training
The purpose of this disablement model case report was to detail the case of a patient suffering from rhabdomyolysis and hypothyroidism. Despite swelling, cramping, and loss of range of motion at the wrists, hands, and fingers, the patient did not seek physician evaluation until their athletic trainer encouraged them. While hypothyroidism is a relatively common condition, there has been little literature published that associate hypothyroidism with rhabdomyolysis. In this case, the patient reported to the athletic training staff reporting swelling, cramping, and loss of range of motion at the wrists, hands, and fingers. After evaluation by the team physician and …

Figure-8-Reconstruction Of Posterior Sternoclavicular Joint Dislocation 18 Days Post Initial Injury, M Suri, S Bunemann
Clinical Practice in Athletic Training
Introduction: Traumatic sternoclavicular joint injuries account for less than 3% of all traumatic joint injuries1. Although rare, posterior dislocation of the sternoclavicular joint has the potential to be life-threatening due to the proximity of vital structures posterior to the manubrium. This injury typically requires a high-energy force applied through the joint2. SC dislocations become increasingly difficult to reduce after 24 hours, so timely diagnosis and treatment are important. Glass et al. found mediastinal compression occurred 30% of the time with posterior dislocations. If left untreated, prolonged pressure on the superior mediastinum can cause erosion of the great vessels, tracheoesophageal fistula, …

Unmasking Microaggressions On The Homefront: Exploring Faculty And Staff Perceptions After Attending An Online Workshop On Microaggressions In Higher Education, Andrea N. Crenshaw, Natasha N. Ramsay-Jordan, Allyson Deskins
Georgia Educational Researcher
Microaggressions are brief and everyday slights, insults, indignities, and denigrating messages sent to people of color and/or marginalized groups (women, LGBTQ+, etc.) by well-intentioned [people] who are unaware of the hidden messages being communicated (Sue et al., 2007). Microaggressions are connected to broader conceptualizations of the impact of implicit bias and systems of inequity. Specifically, in K-12 and higher education, microaggressions impact the physical, social, and emotional well-being of those who experience them. Growing research posits the need for more discussions in education about racism, sexism, and other bias prevalent in the field of education (Bergerson, 2003). As such, some …

Ranking systems have proven to improve the quality of education and help build the reputation of academic institutions. Each of the current academic ranking systems is based on different methodologies, criteria, and standards of measurement. Academic and employer reputations are subjective indicators of some rankings determined through surveying that is neither transparent nor traceable. The current academic ranking systems fall short of providing transparency and traceability features for both subjective and objective indicators that are used to calculate the ranking. Also, the ranking systems are managed and controlled in a centralized manner by specific entities. This raises concerns about fairness …

The ‘Homework Gap’ And Academic Achievement In High School Science: An Ecological Perspective For Policymakers And Practitioners, Tianca Crocker, David Kleitsch
National Youth Advocacy & Resilience Journal
Information and communication technologies (ICTs) are increasingly required within K-12 educational settings, yet the impact of youth’s access to and use of digital resources outside of the classroom on academic achievement is only beginning to be explored in the literature. This study used data from the Fragile Families & Child Wellbeing Study to assess the relationship between grades in high school science and digital equity across the learner’s ecological environment. Digital inequities experienced by school-aged youth are referred to as the homework gap. The COVID-19 pandemic placed new urgency on resolving the homework gap as millions of students shifted to …

A “Post” Pandemic(S) Village Check-In: Pulse Checks And Recommendations For A Hard Re-Set In Education, Jarvais J. Jackson, Alesia Mickle Moldavan, Anne Valauri
National Youth Advocacy & Resilience Journal
Utilizing the lens of the “pandemic as portal” (Roy, 2020; Souto-Manning, 2021) and the need for a “hard re-set” (Ladson-Billings, 2021) of our current education system, this literature synthesis engages with head, health, and home to consider what a new normal could look like as we take a “village check-in” of each area. For head, we consider the systemic barriers to equitable academic achievement that have long been in place for Black and Brown students. When considering health, we look at the impact of the pandemic on teacher well-being and how this may impact their ability to teach effectively and …

National Youth Advocacy & Resilience Journal
Abstract
COVID-19 has permeated news since December 2019 and has impacted all areas of life. Despite widespread coverage of COVID-related risks, there is limited understanding of adolescent resilience in Global South contexts (e.g., Africa) and against the backdrop of COVID-19. We, therefore, conducted a qualitative secondary analysis of 79 documents (i.e., drawings and written explanations) generated by school-attending adolescents in grades eight to ten in Zamdela, South Africa, during 2020 lockdown. Using a multisystemic resilience approach, we explored what these documents revealed as resilience enabling for adolescents in a township context during COVID-19. The thematic findings highlight the importance of …
Spatial Robustness: Double-Design And The Democratization Of Space, An Exploration Of Designing For Multiple Uses, Michael Cassidy
Spatial Robustness: Double-Design And The Democratization Of Space, An Exploration Of Designing For Multiple Uses, Michael Cassidy
School of Art, Design and Architecture Theses
Spatial Robustness: Double-design And The Democratization Of Space, An Exploration Of Designing For Multiple Uses by Michael Warren Arkinstall Cassidy Differing attitudes to the expected life and value of architecture characterize the sustainability debate, yet space itself is rarely mentioned. The buildings for which architecture is responsible comprise both space and materials. While it is taken for granted that some existing buildings can be reused productively, this cultural phenomenon has not influenced the design of the new stock. While content to revere old buildings, the qualities that make them valued have not influenced design principles for new projects. Should new …

The Baroque Photograph: Palermo, Street Photography, and the Fold. By Martin Cole. Abstract This practice-led research project comprises a body of photographs taken in the historic centre of Palermo, the capital city of the island of Sicily, together with a contextual essay. Taken over five years using handheld cameras, the images comprise an extended picture essay, the main output of which is a book. That book’s visual narrative is driven by what is identified as the baroque nature of the Palermo environment. As cultural artefact and living city, Palermo incorporates the three tropes of baroque culture identified by the cultural …
Reframing Museum Epistemology For The Information Age: A Discursive Design Approach To Revealing Complexity, Coral Manton
Reframing Museum Epistemology For The Information Age: A Discursive Design Approach To Revealing Complexity, Coral Manton
School of Art, Design and Architecture Theses
This practice-based research inquiry examines the impact of an epistemic shift, brought about by the dawning of the information age and advances in networked communication technologies, on physical knowledge institutions - focusing on museums. The research charts adapting knowledge schemas used in museum knowledge organisation and discusses the potential for a new knowledge schema, the network, to establish a new epistemology for museums that reflects contemporary hyperlinked and networked knowledge. The research investigates the potential for networked and shared virtual reality spaces to reveal new ‘knowledge monuments’ reflecting the epistemic values of the network society and the space of flows. …
Shanshuihua: ‘Mountain-Water-Painting’ For An Ecological Age, Lei Liu
Shanshuihua: ‘Mountain-Water-Painting’ For An Ecological Age, Lei Liu
School of Art, Design and Architecture Theses
This practice-led research project appraises the tradition of shanshuihua, or ‘mountain-water painting’, within broader traditions of Chinese ink painting, or shuimohua, and, through links with ancient Chinese philosophies, considers its continuing relevance to contemporary painting, and modern ecological themes, both in China and beyond. The research initially assesses historical connections between ink painting and the fundamental philosophies of Chinese history and culture, namely Confucianism, Taoism and Buddhism, and maps certain connections to the development of shanshuihua. Through a series of interviews with contemporary Chinese artists, the project investigates whether the influence of these philosophic traditions have a continuing significance to …

Assessing The Efficacy Of A Novel Galactooligosaccharide To Promote Fish Health And Robustness, Lucy May Sykes
School of Biological and Marine Sciences Theses
Aquaculture has been steadily increasing global production; however, there remains a progressively greater demand for sustainable sources of protein, whilst the prevalence of disease represents a major constraint to industry growth. Feed additives are gaining traction as useful tools to help combat disease and promote health, and previous research has documented benefits to the mucosal surfaces and microbial communities within a range of teleost species. Three experimental in vivo feeding trials were undertaken using a range of in-depth analyses, such as growth performance, haematology, immunology, intestinal histology, intestinal gene expression and intestinal bacterial 16S rRNA sequence libraries. Studies were conducted …
Octopus Optics: A Cross-Disciplinary Investigation Of Human Visual Bias In Narrative With Corresponding Writing Experiments Using Animal Focalisation, Stephanie Jane Cussans Moran
Octopus Optics: A Cross-Disciplinary Investigation Of Human Visual Bias In Narrative With Corresponding Writing Experiments Using Animal Focalisation, Stephanie Jane Cussans Moran
School of Art, Design and Architecture Theses
What is it like to be a human? If an octopus wrote an anthropology based on human depictions of octopuses then how might that reconfigure this existential question? This thesis addresses the posthuman problem of visual bias in animal storytelling practices by experimentally adopting the perspective of another highly visual animal - the octopus - through fiction. It seeks to question, find the edges, and feel the limitations of human representations of other animals and asks what doing so might say about our own naturalcultural perceptions and interpretations. In attending particularly to opticality in Anglophone storytelling, the thesis investigates ways …
The Postnatural Animal In Contemporary Art, Paul Finnegan
The Postnatural Animal In Contemporary Art, Paul Finnegan
School of Art, Design and Architecture Theses
The thesis uses art practice as a research method to propose novel characterisations of animal life. These characterisations aim to challenge an organicist image of non-human animals. The thesis considers animal bodies and behaviours as subject to aesthetic judgments that are underpinned by deeper ontological and epistemological commitments as to relations between nature and society, in which to be categorised as the former entails a series of privations in relation to the latter – the absence of freedom, subjectivity and creativity. Scholarly research on the history of the perception and conception of animal life within modernity, and subsequent challenges made …

A Practice-Led Inquiry Into Collaboration With Landscape Within The Expanded Field Of Photography, Laurie Reynolds
School of Art, Design and Architecture Theses
It is the intent, by working within the expanded field of photography, sculpture, video archiving and writing practice, to create a new theoretical model of landscape’s agency as co-author and collaborator. The inquiry is approached through a Deleuzian sense of crystallization; a process of forming concepts through a series of encounters with post-industrial landscapes. Through practice, these encounters are an attempt to understand the nature of collaborating with a non-human agency; explored not through historical, material, or evolutionary origins, but rather, through the conditions that afford the emergence of a collaborative practice. These encounters are transcribed and presented through the …
