Millions of individuals in the United States maintain both personal and business accounts on social media platforms, a handful of which dominate the market for online content. However, if one of these platforms removes an account without cause, the affected user has little recourse because most platforms’ Terms of Service contain clauses allowing them to terminate user accounts for any reason. Nevertheless, as the power imbalance between platforms and users grows, scholars and judges are starting to believe that there is a need for greater regulation of these platforms. Recent years have seen exponential growth in the use of voice shoppers – artificial intelligence–based algorithms installed on digital voice assistants, such as Alexa and Google Assistant, that buy products based on verbal requests received from consumers. This game-changing switch to semi-automated shopping is shaking up markets by reshaping consumer–supplier relationships, as well as the business models of suppliers and search services. Voice shoppers benefit consumers by offering speedier and more sophisticated transactions while reducing search and transaction costs. Title VII recognizes both individual and group disparate treatment claims, which allege intentional discrimination. But Title VII recognizes only group claims for disparate impact. Conspicuously absent are claims for individual impact. The reason for the absence of an individual-disparate-impact claim is a problem of proof. To establish a Title VII claim, a plaintiff must prove that he or she lost a job opportunity was “because of” membership in a protected class. The urgent need to cool the atmosphere and slow the effects of climate change is evident all around us. However, half of Congress and large swaths of the American public are still not on board, and the highest Court in the land just knee-capped the EPA’s power to regulate effectively. This note looks at the implementation and amendment of the Clean Air Act and subsequent deviation from the Act’s bipartisan roots to its current highly political polarizing status. Over the last four years, the US Supreme Court has granted certiorari in four immigration bond review cases. The sheer number of cases the Court has recently considered underscores the significance of this area of immigration law. Each case centers on whether the Immigration and Nationality Act or the Constitution mandates a bond review hearing after prolonged detention. Yet these cases leave unresolved the issue of whether initial bond hearings themselves meet the due process threshold required of civil confinement proceedings. The Cost Of Cutting Corners: Jurisdictional Implications Flowing From Removal Proceedings Commenced By A Defective Notice To Appear, Juliana M. Lopez

A Notice to Appear (NTA) in removal proceedings is a written notice served on noncitizens that, among other things, alerts them that they must appear in immigration court for a hearing. In 2018, contrary to statute and common sense, the Department of Homeland Security (DHS) admitted to issuing almost all NTAs without the accurate date, time, and place of the initial proceeding. In response, the Supreme Court, in Pereira v. Sessions, clarified that an NTA without the date and place of the hearing is statutorily defective and cannot be used to bar noncitizens from cancellation of removal. However, DHS circumvented …

In 2011’s Goodyear Dunlop Tires Operations, S.A. v. Brown, the United States Supreme Court redefined the contours of corporate personal jurisdiction, radically curtailing the “doing business” jurisdiction that previously predominated. Since then, corporations are only subject to general jurisdiction where they are “fairly regarded as at home,” a domicile test effectively limited to two locations: (1) the state in which the corporation is incorporated and (2) the state in which the corporation has its “principal place of business.” However, the Supreme Court has never explicitly defined the term “principal place of business” for personal jurisdiction purposes. Limited research exists that effectively describes what format of ads (photos, videos, graphics, or GIFs), receive the most link clicks, the most adds-to-cart, and the most conversions. There is even less research available that describes the extent to which the visual structure of advertisements, such as chosen colors, imagery, text, and duration impacts ad performance. This study sets out to address and help close this research gap by creating and testing multiple advertisements on Facebook and Instagram.

Introduction: Stillbirth fetal loss (SFL) is a significant cause of infant death in the US, with 23,000 reported in 2017. Negative psychological and emotional repercussions of SFL, for parents and nurses, may be mitigated by nurses’ preparedness to provide bereavement support (BS). Several studies exploring BS for miscarriage-related fetal loss were found. However, studies exploring SFL BS and nurses’ preparedness for providing SFL BS are sparse. The purpose of this study was to assess nurses’ confidence and knowledge for providing BS to families experiencing stillbirth fetal loss.

When Disney released The Mandalorian, it quickly became the top show on its highly popular streaming platform. As with all media wielding this level of exposure, it is important to closely examine its content for depictions of peoples including females. In accordance with Sandra Bem's gender schema theory, the implicit messaging in this series can influence the formation of people's mental shortcuts about what it means to be female. Is Teaching Experience A Predictor For School Psychologists' Confidence And Competence In Behavior Intervention Plans?, Misty Dawn Lainé Coplan

The Individuals with Disabilities Education Improvement Act (IDEIA) introduced Behavior Intervention Plans (BIPs) into United States law in 1990, and the reauthorization of IDEIA occurred in 2004. Even though BIPs have been codified into law, school personnel struggle to meet BIP mandates due to poor implementation fidelity. Barriers for BIP implementation are varied, but there is little research regarding whether practitioner competence and confidence through teaching experience is a factor. School psychologists (N = 122) from eight states completed a self-evaluation survey using the tailored design method. Floating Sargassum is thought to be a sink of blue carbon in that it removes carbon dioxide (CO2) from the atmosphere and sequesters organic carbon by sinking into the deep ocean or being buried in sediments. However, Sargassum that washes into intertidal ecosystems will eventually decompose, releasing greenhouse gases to the surrounding air, groundwater, and surface coastal seawater. In recent years, Sargassum strandings have increased in the Atlantic Ocean, making our understanding of the fate of beached Sargassum critical for determining how much carbon is sequestered by the seaweed. Traditional mortise and tenon timber frames have been used in modern construction for a substantial period of time with acceptable performance against weather phenomena and other hazards. However, performance criteria for this style of timber framing are not well defined in current codes and standards. To determine performance criteria for free-standing timber frames with knee-braces, three tasks were undertaken: (1) Two timber frame specimens were tested under cyclic loads to determine hysteretic behavior, damage states, and to explore rehabilitation of a damaged member using self-tapping screws. For our thesis project, we partnered with Dr. Michelle Suarez, the co-director of the Resiliency Center at Western Michigan University. When we first met with her, she informed us about the high rates of expulsion for Kalamazoo preschool students with various regulation challenges relating to sensory processing disorders, regulation, autism, and trauma. In fact, according to the U.S. Department of Health and Human Services, preschool students are expelled at three times the rate of children in K-12 (2022). Additionally, according to the Equal Justice Society, 250 preschool children get suspended or expelled each day nationwide (2021). The article continues to …

Although language-family specific traits which do not find direct counterparts outside a given language family are usually ignored in quantitative phylogenetic studies, scholars have made ample use of them in qualitative investigations, revealing their potential for identifying language relationships. An example of such a family specific trait are body-part expressions in Pano languages, which are often lexicalized forms, composed of bound roots (also called body-part prefixes in the literature) and non-productive derivative morphemes (called here body-part formatives). We use various statistical methods to demonstrate that whereas body-part roots are generally conservative, body-part formatives exhibit diverse chronologies and are often the …
