This article seeks to reveal that Islam, at its core, does not condemn non- heterosexual sexual intimacy. On the contrary, it accepts it as part of a divine plan. In its true sense of peace and justice, Islam accepts a person’s sexual orientation as an intrinsic part of their biological and psychological makeup. He shows that the prohibition of same-sex marriages in Islam does not come from the Koran but from the legal construction of marriage and that sexual relations are both gendered and hierarchical. Conexión Queer: Revista Latinoamericana y Caribeña de Teologías Queer

This article explores the issues concerning the intersection of spirituality, sacramentality, proximity, and health safety in light of extreme circumstances such as the current COVID-19 pandemic. We begin by tracing the origins of the sacrament of the Eucharist, including the Eucharistic agency in the lives of the community. The second part of the analysis discusses the nature of community and how it relates to breaking bread and sharing wine. The last part of the article centers on community practice within the context of queering ecclesiology and rites through two examples, one in Latin America and the other in Asia.

Commercial pilot numbers have been on a decline since 2009, while in parallel, pilot demands continue to rise. In order to close the gap, airlines and companies need a steady stream of pilots-in-training who have successfully graduated. This paper studies the efficiency of applying an engineered cementitious composite (ECC) layer to the tensile surface of (RC) beams that were previously strengthened using externally bonded (EB) carbon fiber-reinforced polymer (CFRP) laminates. One control and ten strengthened RC beams were produced and tested utilizing a four-point loading regime. For strengthened beams, two beams were kept strengthened using only CFRP, and additional ECC layers were added to the rest of the strengthened beams. The CFRP width and overlap length and position were among the test factors. Experimental results revealed that strengthening RC beams with CFRP laminates enhanced both the stiffness …

Investigating Student Development Of Intercultural Communicationcompetence Through Collaborative Online International Learning, Yizhe Huang

Journal of Comparative & International Higher Education

This dissertation is a qualitative case study detailing the intercultural communication competence (ICC) development of seven Chinese foreign language learners who participated in Collaborative Online International Learning (COIL) activities at a regional U.S. university with a group of native Chinese speakers. Multiple qualitative data sources - including semi-structured interviews, observations, questionnaires, and reflection journals - were collected over two years. Drawing on sociocultural and transformative learning theories, this study disclosed four findings that practitioners and researchers can build upon to promote language development and intercultural learning in foreign language coursework through virtual exchange.

Mitochondria are the powerhouse of a cell, whose disruption due to mitochondrial pore opening can cause cell death, leading to necrosis and many other diseases. The peptidyl-prolyl cis–trans isomerase cyclophilin D (CypD) is a key player in the regulation of the mitochondrial pore. The activity of CypD can be modulated by the post-translational modification (PTM). However, the detailed mechanism of this functional modulation is not well understood. Here, we investigate the catalytic mechanism of unmodified and modified CypD by calculating the reaction free energy profiles and characterizing the function-related conformational dynamics using molecular dynamics simulations and associated analyses. It is long established that the Eighth Amendment’s prohibition against imposing cruel and unusual punishments requires prisons to adequately address their inmates’ medical needs. Inmates identifying with the LGBTQ+ community are not exempt from this constitutional mandate. Trans inmates with gender dysphoria require specific treatment, including, but not limited to, gender confirmation surgery. While courts acknowledge that prisons owe a duty to provide some transition-related care, the extent of that duty remains contested. With no guidance from Congress or the Supreme Court, the constitutionality of prisons’ denial of gender confirmation surgery is in the hands of the circuit courts, which …

The #MeToo movement has brought the voices of victims of sexual assault into the public’s eye and, in turn, into the legal system. As its name suggests, the movement’s strength lies in numbers—it is, after all, hard to ignore the collective voices of a group of considerable size and visibility. This Article argues that another group of victims—namely, victims who have mental disabilities— also are desperately in need of their own movement to raise public awareness and bring about reform. Moore v. Regents of the University of California represents the seminal case regarding the protection of genetic material. In this case, the California Supreme Court held that patients do not retain property rights in their excised genetic material; instead, informed consent laws serve as genetic material’s only protection. Many states have accepted the Moore court’s decision not to extend property rights to genetic material, and most states choose to protect genetic material through informed consent alone. Moore and informed consent do not adequately protect genetic material, creating unjust results in which “donors” of genetic material have little to no recourse …

Navigating Beyond The Lodestar: Borrowing The Federal Sentencing Guidelines To Provide Fee-Shifting Predictability, Matthew Ahn

The lodestar has been the dominant calculation method for fee-shifting awards for nearly 40 years. But the lodestar has numerous persistent issues: it leads to extra litigation and judicial effort, it results in highly variable fee awards, and it incentivizes plaintiffs’ attorneys to bill extravagantly and reject settlement. This Article argues that these issues with the lodestar, along with many others, result from a mismatch between the lodestar and the purpose of the underlying fee-shifting statutes, which is to encourage attorneys to bring suits that would not normally be economically viable. When Apple announced it would combat the growth of child sexual abuse material (CSAM) on its platform by scanning all its users’ devices without their consent, many of its loyal customers felt betrayed. With tech companies such as Google and Facebook arranging their business models around selling their customers’ personal information, Apple customers saw the company’s focus on privacy as a refreshing alternative. The National Firearms Act of 1934 (NFA) is the strictest federal gun control law currently in effect. It criminalizes the mere possession and transfer of specifically enumerated categories of firearms deemed to be especially dangerous and unusual, such as machine guns and silencers. Commensurate with this viewpoint, the NFA imposes on violators harsh felony penalties, from lengthy prison sentences to six-figure fines. However, the NFA permits lawful civilian ownership of these firearms under a taxation and registration scheme administered by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The Magic Of Fintech? Insights For A Regulatory Agenda From Analyzing Student Loan Complaints Filed With The Cfpb, Matthew Adam Bruckner, Christopher J. Ryan

This Article looks at consumer complaints about student loan lenders and servicers from the Consumer Financial Protection Bureau’s (CFPB’s) consumer complaint database. Using a novel dataset drawn from 30,678 complaints filed against 212 student loan companies, we analyze consumers’ subjective views about whether traditional or fintech student loan lenders and servicers provide a better customer experience. Overall, we find that consumers initiate far fewer complaints against fintech lenders than traditional lenders. But we find that fintech lenders are 28 times more likely than traditional lenders to receive complaints for making confusing or misleading advertisements. Our data also show that complaints …

Skin-to-skin contact (SSC) is the practice in which a newborn is dried and placed immediately on mother’s chest. Both the mother and the baby gains benefits from this as it aids in breastfeeding and helps baby adjust to temperature outside the mother’s womb. However, not many midwives in hospitals carry out this crucial practice. Staff shortage, lack of awareness and time constraints were identified as the main determinants because SSC was not implemented. Although the Vietnamese government has launched numerous initiatives to develop employability for students, half of its university graduates are unable to find jobs in their area of specialization. In order to address this issue, the Vietnamese higher education sector has introduced international career-oriented programs (ICOPs) to position the quality of Vietnamese graduates on par with international standards. This research focuses on three ICOPs to explore the interaction between teacher and student agency in enhancing graduate employability. This article explores Iranian international students’ (IISs) experiences of human dignity (HD) within Canadian universities, compared to Iranian ones. Drawing on in-depth interviews with 24 current and former IISs (10 women and 10 men in Montreal and two women and two men who had left Canada), I created a conceptual HD framework to analyze the data. Three themes emerged as key to IISs’ experiences of HD in the context of postsecondary education: 1) the relationship between students and university faculty/staff, 2) gender equality and freedom, and 3) having a minority or marginalized identity. In this emerging scholar summary, the author joins together scholarship on religion and culture and advocates for socially just education for religious understanding that is linked to global citizenship and diversity education. A comparative case study methodology that incorporates a survey and elite interviews is used to explore the manner and degree to which global liberal arts colleges and universities are engaging with religious diversity. Three axes are applied to analyze the ways education for religious understanding may function across place, space, and time within global education policy networks.

This study compares Canadian and Iranian international students’ conceptions of critical thinking during their graduate studies in Canada. Critical thinking is an essential skill in Canadian higher education. It enables students to make reasoned judgments from their observations and experimentation. This narrative inquiry using open-ended interviews describes the narratives of eight students from different master’s programs at a university in western Canada to examine their experiences and notions of critical thinking. The preliminary findings reveal that while all Canadian participants had knowledgeable perspectives about critical thinking, Iranian participants required more knowledge to build their critical thinking conceptualizations. Eosinophilic chronic rhinosinusitis (ECRS) is a refractory airway disease accompanied by eosinophilic inflammation, the mechanisms of which are unknown. We recently found that CCL4/MIP-1β-a specific ligand for CCR5 receptors-was implicated in eosinophil recruitment into the inflammatory site and was substantially released from activated eosinophils. Moreover, it was found in nasal polyps from patients with ECRS, primarily in epithelial cells. Ribosomal protein S6 kinase 1 (S6K1), a key downstream effector of the mammalian target of rapamycin (mTOR), regulates diverse functions, such as cell proliferation, cell growth, and protein synthesis. Because S6K1 was previously known to be localized in the cytoplasm, its function has been mainly studied in the cytoplasm. However, the nuclear localization and function of S6K1 have recently been elucidated and other nuclear functions are expected to exist but remain elusive.
