Big Data Visualization Through The Lens Of Peirce’S Visual Sign Theory, Alon Friedman, Martin Thellefsen
Big Data Visualization Through The Lens Of Peirce’S Visual Sign Theory, Alon Friedman, Martin Thellefsen
School of Information Faculty Publications
Data from social media platforms, such as Twitter and Facebook, are generated by people who produce, spread, share, or exchange multimedia content. Such content may include text, images, sounds, or videos. To derive insight into the behavior of social media users, researchers often use open-source technologies to visualize data and generate models for data analytics. One of the most popular open-source applications for managing and analyzing social media data is the open-source R programming language. Friedman and Feichtinger (2017) created an R package termed ‘Peirce’s sign theory R package’ to analyze data using Peirce’s principles of discovery. Though Peirce semiotics …

The Entity Attorney-Client Privilege Meets The Twenty-First Century: Rethinking Functional Equivalent Analysis In The Time Of A Nonemployee Workforce., Grace M. Giesel
Faculty and Staff Scholarship
Courts have struggled with whether an entity’s attorney-client privilege can protect communications between the entity’s lawyer and a nonemployee who has information the entity’s lawyer needs to best advise the entity. The nonemployee might be a former employee. But increasingly in recent times, the nonemployee is an individual who was never an entity employee. Corporations and other entities have incorporated nonemployees in their economic enterprises in all sorts of roles—roles employees may have held in the past. Many courts have accepted that the privilege can apply to communications involving former employees.
When faced with nonemployees who are not former employees, …
On (Not) Seeing The Chicken: Perdue, Animal Welfare, And The Failure Of Transparency, Calvin Coker, Rachel A. Coker
On (Not) Seeing The Chicken: Perdue, Animal Welfare, And The Failure Of Transparency, Calvin Coker, Rachel A. Coker
Faculty and Staff Scholarship
In this essay, we analyze Perdue’s animal welfare campaign from 2016 to 2020 to isolate how demands for transparency are mediated and subverted by Perdue’s public facing rhetoric. Though Perdue’s annual releases and commitments to change nominally constitute a victory for animal welfare advocates, the company’s campaign enacts transparency as a sort of publicity for the company that belies marginal gains for the lives of chickens and may ultimately result in increased meat consumption. In providing trackable metrics, offering paternalistic justifications for their treatments of chickens, and through strategic omissions of language and visuals, Perdue satisfies demands for transparency without …

In 1629, Thomas and John Buck, Cambridge University Press printers, published three texts—the Book of Common Prayer, the Bible and the Whole Book of Psalmes (known as the “Metrical Psalter”)—that were often bound together in one volume [UL], 1 one copy of which is now on permanent loan to the Archives & Special Collections of Ekstrom Library, University of Louisville. We do not know with any certainty when UL was bound, but because the KJV second edition was published in 1638, with many scholarly corrections based on the original languages, we can assume that the three texts were bound together …

The title of Rachael Scarborough King’s edited collection of essays, After Print, refers at once to Peter Stallybrass’s insight that printing is a provocation of manuscript, as well as to what the study of manuscripts looks like when we move away from stadial and supersessionist print culture paradigms of authorship and publication and instead embrace archival methods and interpretive approaches that center on concepts of media interrelation in early modern manuscript cultures, such as Margaret Ezell’s concept of social authorship. The essays in King’s collection, including an epilogue by Ezell herself, bear the fruits of such intermedial and transmedial approaches, bringing …

Implementation Of A Software Defined Flisr Solution On An Active Distribution Grid, Darren Leniston, David Ryan, Clem Power, Paul Hayes, Steven Davy
Research Outputs: 2025-Present
Background: The resiliency of the distribution grid is of increasing concern to the distribution system operator (DSO) due to factors such as climate change and the resulting faults caused by inclement weather conditions, leading to service disruption to consumers. Loss of service negatively affects key performance indicators (KPI) of the DSO, such as customer minutes lost (CML) and customer interruptions (CI), leading to financial penalties imposed by the regulator. Methods: In this paper we propose a software-driven Fault Location, Isolation and Service Restoration (FLISR) solution, leveraging modern software and communication technologies married with the DSO's existing infrastructure, to aid fault …

The Role Of Investor-State Tribunals In Determining The Scope And Content Of The Fair And Equitable Treatment Standard – Legitimate Expectations And Proportionality, Simon Bianchi
LL.M. Essays & Theses
In recent years, the legitimacy of the investor-State dispute settlement (“ISDS”) has been called into question and several initiatives, such as the UNCITRAL Working Group III, are currently looking at various ways to enhance such legitimacy and ensure the sustainability of ISDS. In this respect, certain scholars like Professors Sornarajah and van Harten claim that the interpretative process undertaken by investor-State tribunals has contributed to this legitimacy crisis among others because the application of vague standards, such as fair and equitable treatment (“FET”), involves applying subjective notions of what adjudicators perceive as desirable developments of investment law. By contrast, other …

Cooperation Without Convergence: Border Carbon Adjustment And Heterogeneity Of Climate Actions, Lucas Moreira Jiminez
LL.M. Essays & Theses
Border Carbon Adjustment measures (“BCAs”) were originally conceived to help solve a problem that arises when countries ask firms to internalize the costs of environmental depredation in an open economy. Environmental regulation raises costs to domestic producers who feel and are — both are relevant — disadvantaged vis-à-vis their foreign competitors subject to lower regulatory costs, in ways that impact economic competitiveness but also the effectiveness of the regulation itself, to the extent it is directed at a ‘global commons’ problem such as reducing greenhouse gas (“GHG”) emissions in an attempt to mitigate climate change. However, BCAs create issues of …
Conflicting Fundamental Rights Under The Indian Constitution: Analyzing The Supreme Court’S Doctrinal Gap, Nikhil Pratap
Conflicting Fundamental Rights Under The Indian Constitution: Analyzing The Supreme Court’S Doctrinal Gap, Nikhil Pratap
LL.M. Essays & Theses
The Constitution of India recognizes a wide variety of fundamental rights: civil and political, socio-economic, and group rights. A conflict between these rights is a common occurrence. The Supreme Court of India’s method of resolving conflicts has been ad-hoc, nebulous, and vague. The Court rarely locates the conflict at a granular level and, on the rare occasion that it does, the decision lacks comprehensive reasoning. This paper attempts to demonstrate the doctrinal, structural, and reasoning gap in the Court’s jurisprudence. The paper does so by analyzing a subset of cases where the Court has adjudicated on conflicts between the right …

The Role Of Arbitral Tribunals In Determining The Scope Of The Fair And Equitable Treatment Standard, Thomas Ferguson Whip
LL.M. Essays & Theses
Whether or not investor-State dispute settlement (“ISDS”) faces a “legitimacy crisis,” there is a “growing consensus” that it requires reform. The development of the fair and equitable treatment standard (“FET standard”) by arbitral tribunals been a salient factor in fomenting this consensus and is the subject of several reform proposals. A number of scholars, including Professors Sornarajah and Gus van Harten, claim the interpretative process undertaken by tribunals in relation to the FET standard has contributed to ISDS’ legitimacy crisis because it involves applying subjective notions of what adjudicators perceive to be desirable developments of the law. On the other …

During the COVID-19 pandemic, wastewater-based epidemiology has emerged as a promising approach for monitoring SARS-CoV-2 prevalence on a community-level. Despite much being known about the utility of making these measurements in large wastewater treatment plants, little is known about the correlation with finer geographic resolution, such as those obtained through sewershed sub-area catchments. This study aims to identify community wastewater surveillance characteristics between sewershed areas that affect the strength of the association of SARS-CoV-2 RNA detection in a metropolitan area. For this, wastewater from 17 sewershed areas were sampled in Louisville/Jefferson County, Kentucky (USA), from August 2020 to April 2021 …

In 2008, as the world dreaded economic meltdown, one or more anonymous individuals titled "Nakomoto" posted a scientific white paper on the Internet. "Bitcoin" was thus born. That name - uttered but once in the white paper- would go on to define a movement, a market, and a mountain.
By late 2010, approximately 100 bitcoin had been mined; two years later, that number approached 10 million, and a second crypto had emerged. By 2018, bitcoin traded at over $18,000 per coin; a year later, that market value had plummeted to less than $5,000. Concurrently, tales of digital asset fortunes lost …

This article considers two legal cases and the stories that developed around them. Both the cases and their stories involved issues of significance to the larger society - death and bias. Each concern has occasioned confusion and debate in its own right. When these issues are combined, confusion and debate are intensified. This Article examines the complicated interplay between bias and decisions about death and dying in the U.S. health care system. Further, it reviews intersecting claims about the importance, respectively, of autonomy and community in resolving disputes about the topics of death and dying.

In response to the global spread of the COVID-19 pandemic in the spring and summer of 2020, thousands of grassroots, participatory, and often social movement-connected community efforts to help feed and care for one another through the crisis were launched, many of which identified their projects as 'mutual aid'. This article tells the story of how the Hofstra Law School Community Economic Development ("CED") Clinic has provided legal support and information to hundreds of these COVID-19 mutual aid groups. The article briefly reviews Professor Dean Spade's 2020 book Mutual Aid: Building Solidarity During This Crisis (and the Next), contrasting it …

Despite the ever-growing number of exonerations in the U.S.— and the corresponding surge in scholarly interest in wrongful convictions in recent years—research on the carceral experiences of wrongfully-convicted persons remains strikingly limited. In this essay, we draw on in-depth interviews with 15 exonerated men to explore the moral dimensions of the experience of wrongful imprisonment. We argue that imprisonment entails what we refer to as “coerced moral degradation,” whereby innocent men’s self-preservation efforts in prison require them to feign being—and at times actually become— morally worse people. We argue that these findings speak to the fundamental question of what the …

Lawyers know how to tell a good story and are expected, encouraged, and even ethically required to use that skill on behalf of their clients. More and more, lawyers and legal academics are now using their clients' stories to advance goals that go far beyond achieving a client's objectives: exposing inequities with regard to access to justice; educating the public about the functioning and limitations of the legal system; raising the quality of lawyering; and improving our system of legal education. Unfortunately, the increase in the use of case histories to achieve such laudable goals has not been paired with …

B-site ordered 4d1 and 5d1 double perovskites have a number of potential exotic ground states including multipolar order, quantum spin liquids and valence bond glass states. These arise from the complex interactions of spin-orbital entangled Jeff = 3/2 pseudospins on the geometrically frustrated fcc lattice. The 4d1 Mo5+ perovskite Ba2YMoO6 has been suggested to have a valence bond glass ground state. Here we report on the low temperature properties of powder samples of isostructural Ba2LuMoO6: the only other known cubic 4d1 perovskite with one magnetic cation. Our …

The concern of 5G C-band frequency interference with global aviation operations was founded on the criticality of a single-point failure with the radio altimeter operations. The research in this report intends to highlight the severe impact of 5G C-band implementation on the air transportation industry. It focuses on one airport in the United States, Seattle-Tacoma International Airport (SEA), one of the busiest airports in the country, flying both domestically and internationally. The results show that Boeing aircraft are affected more than Airbus for 5G interference. Further, the findings show that the United States should align its 5G implementation with other …

This chapter examines Soviet military planning and preparedness on the eve of Germany’s June 1941 invasion of the Soviet Union. Drawing on archival evidence and post-Soviet scholarship, it reassesses explanations for the Red Army’s catastrophic initial defeats. It argues that the General Staff’s unrealistic offensive plans and force posture conflicted with Stalin’s political strategy of deterrence and war avoidance. This mismatch, rooted partly in the Soviet military’s organizational preference for offensive operations and flawed assumptions about mobilization and the initial period of war, increased Soviet vulnerability to surprise attack. The chapter considers the development of Soviet war plans in 1940–1941, …
