Journal of Dental Sciences
Background/purpose Human dental pulp stem cells (hDPSCs) are an emerging source of mesenchymal stem cells (MSCs) for bone tissue regeneration and engineering. In bone regeneration using transplanted MSCs, the extracellular environment or co-injected drugs can affect their success or failure. In this study, we investigated the effects and signaling mechanisms of lidocaine on osteogenic differentiation of hDPSCs after inducing inflammatory conditions with lipopolysaccharide (LPS) and tumor necrosis factor-alpha (TNF-α). Materials and methods To investigate the effect of lidocaine on the osteogenic differentiation of LPS/TNF-α-treated hDPSCs, alkaline phosphatase (ALP) and Alizarin red S (ARS) staining were conducted. The expression of osteogenesis-related …

Influence Of Different Kinematics On Stationary And Dynamic Torsional Behavior Of Jizai Nickel-Titanium Rotary Instruments: An In Vitro Study, Arata Ebihara, Myint Thu, Moe Kyaw, Satoshi Omori, Keiichiro Maki, Shunsuke Kimura, Hayate Unno, Takashi Okiji
Journal of Dental Sciences
Background/purpose Using conventional approach to examine stationary torque of nickel-titanium rotary instruments contradicts the clinical condition, and its validity for motions involving clockwise and counterclockwise rotations is questionable. This study aimed to examine the effect of different kinematics on the torsional behavior using a JIZAI instrument (#25/.04) under stationary/dynamic test conditions using clinical torque limit settings. Materials and methods In the stationary test, the 5-mm tip of JIZAI was fixed in a cylinder-shaped vise and rotated in continuous rotation (CR) with auto-torque-reverse, optimum-torque-reverse (OTR), or reciprocation (REC) until fracture (n = 10, each). In the dynamic test, straight and severe …

A Double Blinded Trial To Compare The Patient Satisfaction And Crown Accuracy Of Two Different Intraoral Scanners For The Fabrication Of Monolithic Lithium Disilicate Single Crowns, Chih-Wen Cheng, Chun-Hsiu Yang, Chia-Hui Chien, Sung-Ying Ye
Journal of Dental Sciences
Abstract Background/Purpose The digital impression is a promising technique in prosthodontic treatment. However, the influencing factors of patient comfort is lacking, and the evidence of crown quality is mostly based on in vitro studies. The purpose of this double-blinded clinical trial was to compare the patient satisfaction and crown accuracy of two different intraoral scanners (IOSs) for the fabrication of all-ceramic single crowns (SCs). Materials and methods Participants in need of posterior tooth-supported SCs were enrolled. Each patient received quadrant scan by both the Metal Industries Research and Development Centre (MIRDC) IOS and Carestream CS3500 in a random sequence. After …

The Framers argued judicial independence was necessary to the success of the American democratic experiment. Independence required judges possess and act with integrity. One aspect of judicial integrity was impartiality. Impartial judging was believed crucial to public confidence that the decisions issued by American courts followed the rule of law. Public confidence in judicial decision making promoted faith and belief in an independent judiciary. The greater the belief in the independent judiciary, the greater the chance of continued success of the republic.
During the nineteenth century, state constitutions, courts, and legislatures slowly expanded the instances in which a judge was …

The federal courts' current approach to character evidence is widely recognized as problematic. Although Rule 404(b)(1) categorically prohibits the use of character evidence, Rule 404(b)(2) presents a list of examples of permitted purposes that has tempted courts to view the admission of other-acts evidence as proper so long as the evidence is merely relevant to a non-character purpose. Additionally, courts have misconstrued the inclusive structure of Rule 404(b) as creating a presumption
in favor of admissibility. Recent efforts to correct this mistakenly permissive view include decisions by several of the federal circuit courts of appeals recognizing that Rule 404(b) requires …

Most people think of property as a thing: a chunk of land or a piece of personal property. Most lawyers, hopefully, have a more sophisticated view and think of property as a set of rights that exists with respect to a thing and governs how one interacts with that thing vis-a-vis other people. But even that nuance is not refined enough for an oil and gas lawyer. Such a practitioner does, of course, view ownership as a set of rights, but the thing at hand is not just a piece of real property or the part of the land that …
The Third Amendment In 2020, Michael L. Smith
The Third Amendment In 2020, Michael L. Smith
Faculty Articles
Compared with other Amendments in the Bill of Rights, the Third Amendment does not get much attention. Its prohibition on the quartering of soldiers in houses during peacetime, along with its prohibition on similar quartering during times of war absent legal prescription, is rarely the subject of litigation or scholarship. Indeed, most people—and likely most attorneys—probably cannot tell you what the Third Amendment covers if put on the spot. This Article aims to fix this by giving the Third Amendment the respect that one of the Constitution's original amendments deserves. This Article surveys and analyzes caselaw, scholarship, and popular media …
Reconstruction Of The Reasonable Person Standard Under Chinese Patent Law, Weihong Yao, Robert H. Hu
Reconstruction Of The Reasonable Person Standard Under Chinese Patent Law, Weihong Yao, Robert H. Hu
Faculty Articles
The standard of a Reasonable Person is the common basis for determining the duty of care of a patent infringer. Under the Chinese patent law, the standards for Reasonable Manufacturer and Reasonable Importer are among the highest standards in the world; such high Chinese standards impose an excessive duty of care for Chinese manufacturing enterprises, importers, and distributors, which hinder the development of those enterprises. We should reconstruct the Chinese patent law's Reasonable Person standard based on the characteristics of the patent system and the status quo of China's economic production. A Reasonable Manufacturer should be defined as an ordinary …

Respecting The Identity And Dignity Of All Indigenous Americans, Bill Piatt

The United States government attempted to eliminate Native Americans through outright physical extermination and later by the eradication of Indian identity through a boarding school system and other "paper genocide" mechanisms. One of those mechanisms is the recognition of some Natives but not the majority, including those who ancestors were enslaved. The assistance provided to recognized tribes by the government is inadequate to compensate for the historical and continuing suffering these people endure. And yet the problem is compounded for those unrecognized Natives whose ancestors were enslaved and whose tribal identity was erased. They are subjected to a double-barreled discrimination. …

Using Bruen To Overturn New York Times V. Sullivan, Michael L. Smith, Alexander S. Hiland

New York Times Co. v. Sullivan is a foundational, well regarded First Amendment case, Justice Clarence Thomas has repeatedly called on the Court to revisit it. Sullivan, Thomas claims, is policy masquerading as constitutional law, and it makes almost no effort to ground itself in the original meaning of the First and Fourteenth Amendments. Thomas argues that at the time of the founding, libelous statements were routinely subject to criminal prosecution including libel of public figures and public officials.
This Essay connects Justice Thomas's calls to revisit Sullivan to his recent opinion for the Court in New York State Rifle …
Countermajoritarian Criminal Law, Michael L. Smith
Countermajoritarian Criminal Law, Michael L. Smith
Faculty Articles
Criminal law pervades American society, subjecting millions to criminal enforcement, prosecution, and punishment every year. All too often, culpability is a minimal or nonexistent aspect of this phenomenon. Criminal law prohibits a wide range of common behaviors and practices, especially when one considers the various federal, state, and municipal levels of law restricting people's actions. Recent scholarship has criticized not only the scope and impact of these laws but has also critiqued these laws out to the extent that they fail to live up to supermajoritarian ideals that underlie criminal justice.
This Article adds to and amplifies this criticism by …

From the moment social media companies like Facebook were created, they have been largely immune to suits for the actions they take with respect to user content. This is thanks to Section 230 of the Communications Decency Act, 47 U.S.C. § 230, which offers broad immunity to sites for content posted by users. But seemingly the only thing a deeply divided legislature can agree on is that Section 230 must be amended, and soon. Once that immunity is altered, either by Congress or the courts, these companies may be liable for the decisions and actions of their algorithmic recommendation systems, …

Using exceptional point dynamics in time and space modulated lattices we propose a new mechanism for generation of asymmetric robust higher harmonics. Specifically we design a metallic-silicon system with a complex optical potential spatiotemporally modulated along the length of the waveguide for this robust higher harmonic generation. In our system the dynamical equations associated with modal field amplitudes are described by a Jordan form Hamiltonian. This ultimately will allow for a unidirectional higher frequency generation which always has a maximum value for a specific length of the waveguide irrespective of the geometrical imperfections in the design of the waveguide. Furthermore, …

The Entity Attorney-Client Privilege Meets The Twenty-First Century: Rethinking Functional Equivalent Analysis In The Time Of A Nonemployee Workforce., Grace M. Giesel
Faculty and Staff Scholarship
Courts have struggled with whether an entity’s attorney-client privilege can protect communications between the entity’s lawyer and a nonemployee who has information the entity’s lawyer needs to best advise the entity. The nonemployee might be a former employee. But increasingly in recent times, the nonemployee is an individual who was never an entity employee. Corporations and other entities have incorporated nonemployees in their economic enterprises in all sorts of roles—roles employees may have held in the past. Many courts have accepted that the privilege can apply to communications involving former employees.
When faced with nonemployees who are not former employees, …

It is well established that the federal judiciary has been an overwhelmingly White and male institution since its creation and continues to be so today. Even as presidents of both parties have looked to diversify their judicial nominees, this has tended to result in the appointment of White women and men of color rather than women of color. Using data on the confirmed federal district and circuit court judges from presidents Clinton through Trump, we assess how the backgrounds of women of color nominated to the federal judiciary compare with those of other appointees. The results indicate that, compared to …

In this essay, we analyze Perdue’s animal welfare campaign from 2016 to 2020 to isolate how demands for transparency are mediated and subverted by Perdue’s public facing rhetoric. Though Perdue’s annual releases and commitments to change nominally constitute a victory for animal welfare advocates, the company’s campaign enacts transparency as a sort of publicity for the company that belies marginal gains for the lives of chickens and may ultimately result in increased meat consumption. In providing trackable metrics, offering paternalistic justifications for their treatments of chickens, and through strategic omissions of language and visuals, Perdue satisfies demands for transparency without …

In 1629, Thomas and John Buck, Cambridge University Press printers, published three texts—the Book of Common Prayer, the Bible and the Whole Book of Psalmes (known as the “Metrical Psalter”)—that were often bound together in one volume [UL], 1 one copy of which is now on permanent loan to the Archives & Special Collections of Ekstrom Library, University of Louisville. We do not know with any certainty when UL was bound, but because the KJV second edition was published in 1638, with many scholarly corrections based on the original languages, we can assume that the three texts were bound together …

Ultracool dwarf stars and brown dwarfs provide a unique probe of large-scale Galactic structure and evolution; however, until recently spectroscopic samples of sufficient size, depth, and fidelity have been unavailable. Here, we present the identification of 164 M7-T9 ultracool dwarfs in 0.6 deg2 of deep, low-resolution, near-infrared spectroscopic data obtained with the Hubble Space Telescope (HST) Wide Field Camera 3 (WFC3) instrument as part of the WFC3 Infrared Spectroscopic Parallel Survey and the 3D-HST survey. We describe the methodology by which we isolate ultracool dwarf candidates from over 200,000 spectra, and show that selection by machine-learning classification is superior to …

Writing Centers, Enclaves, And Creating Spaces Of Change Within Universities, Bronwyn T. Williams

Writing center scholarship often high-lights the ways in which their distinctive, less directive, nongraded, and individualized instruction can make them distinctive social and pedagogical spaces. There is a simultaneous argument, however, that writing centers are often institutionally vulnerable and may be unable to engage in or promote such differences within the larger college or university. Yet, despite their size and possible vulnerability, the daily practices and institutional positioning of writing centers can help change conversations and work toward a different vision, political approach, and institutional presence. Drawing on Victor Friedman’s concept of “enclaves of different practice” and Brian Massumi’s theories …
