We raise some questions about the timeliness and timelessness of certain themes in Robert Cover’s masterwork, Justice Accused, originally published in 1975. Our concern is how the issues Cover raised when exploring the ways antislavery justices decided fugitive slave cases in the antebellum United States, played out in the United States first when Cover was writing nearly fifty years ago, and then play out in the United States today. The moral-formal dilemma faced by the justices that Cover studied when adjudicating cases arising from the Fugitive Slave Acts of 1793 and 1850 was whether judicial decision-makers should interpret the …

This Essay argues that trusts and estates (“T&E”) should prioritize intergenerational economic mobility—the ability of children to move beyond the economic station of their parents—above all other goals. The field’s traditional emphasis on testamentary freedom fosters the stickiness of inequality. For wealthy settlors, dynasty trusts sequester assets from the nation’s system of taxation and stream of commerce. For low-income decedents, intestacy splinters property rights and inhibits their transfer, especially to nontraditional heirs.

Holistically, this Essay argues that T&E should promote mean regression of the wealth distribution curve over time. This can be accomplished by loosening spending in ultrawealthy households and …

On August 15, 2021, the Taliban took control of Kabul, ending their weeks-long takeover of Afghanistan. Distraught by the quick offensive, United States forces and their allies quickly secured the Kabul airport and were forced to accelerate their planned withdrawal from the country in a makeshift manner. Afghan civilians, particularly those who had supported the efforts of U.S. forces, desperately attempted to get out of the country. The chaotic and disorganized withdrawal was not well received, both in the United States and internationally.

During the Cold War, the United States and Soviet Russia focused on spreading their distinctive ideologies across the globe, and in doing so, came in direct competition with one another. In this study, I employ content analysis of two major U.S. and Soviet education reports and reforms from 1983 to 1991, namely A Nation at Risk and Fundamental Directions of General and Vocational School Reform, to explore and illustrate how the two states wielded their youth as weapons in a battle for ideological supremacy. My findings add nuance to the conversation surrounding education as a method of state control.

Much has been written about the Kremlin’s embrace of the Russian Orthodox Church—Moscow Patriarchate (ROC) as a lever of soft power for advancing Russia’s foreign policy. Based on the substance of the constitutional amendments ratified in July 2020, this chapter reasons that the church-state partnership is poised to grow stronger and more entrenched in the coming years.

After briefly highlighting the energizing effect several key constitutional amendments are likely to have on existing Kremlin foreign policy objectives, this chapter offers an assessment of the ROC’s central role in disseminating and advocating these newly minted constitutional norms across its international platforms …

Organophosphate (OP) chemicals include commonly used pesticides and chemical warfare agents, and mechanistically they are potent inhibitors of the cholinesterase (ChE) enzyme. Epidemiological studies report long-term neuropsychiatric issues, including depression and cognitive impairments in OP-exposed individuals. Chlorpyrifos (CPF) is one of the most widely used pesticides worldwide. Multiple laboratory studies have reported on either the long-term behavioral effect of an acute high-dose CPF (30-250 mg/kg) or studied sub-chronic behavioral effects, particularly the motor and cognitive effects of repeated low-dose CPF. This article argues that the embodied characterization of Grendel’s mother offers us an alternative heroic model for women, from the titular hero, Beowulf, around whose heroic life and legacy the Old English poem is structured and more usually celebrated. In doing so, it addresses the problematic legacy of the heroic, masculinist poem and its pedagogical role as a canonical text for English literature and national identity which also informs our cultural attitudes to gender-based violence. This article argues that Congress can exercise its constitutional war powers to enact a law restricting the President from using nuclear weapons first. The article contends that using a nuclear weapon is qualitatively different from conventional warfare and that the first use of nuclear weapons marks a decision to enter into war. Therefore, nuclear first use is not a battlefield decision within the President’s commander in chief power but rather a choice to enter the United States into a new type of conflict that could pose a direct, immediate, and existential threat to the U.S. homeland. The purpose of this research is to determine how combining radical egalitarianism and nationalism to create radical democracy can lead to the destruction of society. Politics are for the purpose of protecting the common good, but individual liberties are sometimes necessary for the preservation of the common good based on the continual flux of social contexts. However, too much individualism can lead to the rise of tyrannical collectivism. This thesis examines the manners and methods employed in the battles of Old Testament passages and what they reveal about the spiritual formation of God’s people in times of combat. Paralleled with this examination, this thesis analyzes certain female figures who have played a significant role in Old Testament narratives of combat and violence. Through this study, the analysis of female figures reveal how their character and/ or actions impacted the precipitation of warfare, participation in military victory, and finally establishing their own testimonies that challenge the implications and integrity of the Biblical master narratives.

In an earlier paper, I concluded that Lehi and Nephi were highly trained Josephite scribes and were associated with an official Jerusalem scribal school that preserved ancient Manassite traditions. There they acquired advanced writing skills and classical Hebrew and Egyptian, which would become the scriptural languages of the Nephite peoples. These they maintained in the new promised land and passed on from generation to generation through the entire thousand-year Nephite dispensation, even though the Nephite language itself would naturally evolve. This honors thesis argues that football is a location of leisure which reinforces and (re)creates a comforting white male supremacist American empire through its use of imaginary frontiers, distortion of Native imagery and culture, and its development of mythic cowboy-heroes— which serve as escapes from ubiquitous national anxieties. I use textual and visual analysis of primary sources from the 1890s, 1920s, and 1970s to describe how football developed as a comforting space of leisure for white people in the face of national crises of masculinity, rights movements, and disillusionment with America’s empire.

Hagiography, or Saints’ Lives or Miracles, often record significant details about the period in which the saint under discussion lived or the period in which the hagiography originated. These documents are useful in attempting to understand the Seventh Century Crisis Period, the period when the Eastern Roman Empire transitioned into the Byzantine Empire. Most traumatic brain injuries (TBIs) during military deployment or training are clinically “mild” and frequently caused by non-impact blast exposures. Experimental models were developed to reproduce the biological consequences of high-intensity blasts causing moderate to severe brain injuries. However, the pathophysiological mechanisms of low-intensity blast (LIB)-induced neurological deficits have been understudied. This review provides perspectives on primary blast-induced mild TBI models and discusses translational aspects of LIB exposures as defined by standardized physical parameters including overpressure, impulse, and shock wave velocity. Our mouse LIB-exposure model, which reproduces deployment-related scenarios of open-field blast (OFB), caused neurobehavioral changes, including reduced exploratory activities, …

In the past few years, a revised cyber strategy, a spate of new cyber authorities, and revamped presidential directives have significantly expanded the cyber capabilities of the U.S. military. This expansion has coincided with a weakening and dispersion of traditional congressional oversight mechanisms, creating a separation of powers mismatch. This mismatch, and the necessarily stealthy features that characterize cyberoperations, inhibit Congress’s ability to gain a comprehensive understanding of the use and deployment of these cyber powers, while obscuring the use of such powers from the public as well.
