Does U.S. Federal Employment Law Now Cover Caste Discrimination Based On Untouchability?: If All Else Fails, There Is The Possible Application Of Bostock V. Clayton County, Kevin Brown, Lalit Khandare, Annapurna Waughray, Kenneth Dau-Schmidt, Theodore M. Shaw

Faculty Publications

This article discusses the issue of whether a victim of caste discrimination based on untouchability can assert a claim of intentional employment discrimination under Title VII or Section 1981. This article contends that there are legitimate arguments that this form of discrimination is a form of religious discrimination under Title VII. The question of whether caste discrimination is a form of race or national origin discrimination under Title VII or Section 1981 depends upon how the courts apply these definitions to caste discrimination based on untouchability. There are legitimate arguments that this form of discrimination is recognized within the concept …

Automated Video Interviewing As The New Phrenology, Ifeoma Ajunwa Jan 2022

Automated Video Interviewing As The New Phrenology, Ifeoma Ajunwa

Faculty Publications

This Article deploys the new business practice of automated video interviewing as a case study to illuminate the limitations of traditional employment antidiscrimination laws. Employment antidiscrimination laws are inadequate to address the unlawful discrimination attributable to emerging workplace technologies which gatekeep employment opportunities. The Article maintains that the practice of automated video interviewing is based on shaky or unproven social scientific principles that disproportionately impact racial minorities. In this way, the practice of automated video interviewing is analogous to the pseudoscience of phrenology, which enabled societal and economic exclusion through the legitimization of eugenicist and racist attitudes. After parsing the …

Public Investment In Climate Resiliency: Lessons From The Law And Economics Of Natural Disasters, Donald T. Hornstein Jan 2022

Public Investment In Climate Resiliency: Lessons From The Law And Economics Of Natural Disasters, Donald T. Hornstein

Faculty Publications

This Article takes issue with an important claim in the public choice and climate disaster literature: that American political markets will not allow appropriate investments in disaster preparedness and prevention, even when those investments are cost-benefit bargains. The claim is significant because the costs of climate disasters in the twenty-first century are estimated to be in the trillions of dollars due to the presence of legacy greenhouse gases in the atmosphere. Thus, even assuming a sustained, successful global campaign to limit future greenhouse gases, the ingredients for decades of droughts, wildfires, storms, and floods are already locked into the atmosphere. …

Precautionary Ratemaking, Jonas J. Monast Jan 2022

Precautionary Ratemaking, Jonas J. Monast

Faculty Publications

For more than one hundred years, states have relied on ratemaking to ensure that electric utilities deliver affordable and reliable power to their customers. This process helped keep costs down, but it also produced an electricity system that is a cause of, and vulnerable to, some of the most pressing challenges now facing society: climate change, catastrophic wildfires, extreme storms, and air and water pollution.

This Article argues that risk regulation is an alternate legal foundation for interpreting bedrock principles of ratemaking, such as prudency, reasonableness, least cost, and the public interest. The traditional economic regulator view of ratemaking evaluates …

Influence Of Annealing And Compaction On Enhancing The Temperature And Strain Sensitivities Of Multi-Walled Carbon Nanotube (Mwcnt) Films, Rufaydah Hassan

Theses and Dissertations

Carbon nanotubes (CNTs) possess superior thermal, electrical, and mechanical properties. When CNTs undergo particular fabrication procedures, they transform from a nanoscale form into macroscopic thin sheets referred to as buckypapers (BPs). The main idea behind using BP is to facilitate the handling of CNTs without losing their exceptional properties. Additionally, BPs showed potential for being the used material in strain and temperature applications thanks to their thermal stability, flexibility, high sensitivity, and the ability to conform to any complex structure.

In the current study, the multi-walled carbon nanotube (MWCNT) thin films were prepared using the vacuum filtration technique. Following the …

Hemocytes Are Essential For Drosophila Melanogaster Post-Embryonic Development, Independent Of Control Of The Microbiota, Holly N. Stephenson, Robert Streeck, Florian Grüblinger, Christian Goosmann, Alf Herzig

Peninsula Medical School

ABSTRACT Proven roles for hemocytes (blood cells) have expanded beyond the control of infections in Drosophila. Despite this, the crucial role of hemocytes in post-embryonic development has long thought to be limited to control of microorganisms during metamorphosis. This has previously been shown by rescue of adult development in hemocyte-ablation models under germ-free conditions. Here, we show that hemocytes have an essential role in post-embryonic development beyond their ability to control the microbiota. Using a newly generated strong hemocyte-specific driver line for the GAL4/UAS system, we show that specific ablation of hemocytes is early pupal lethal, even under axenic conditions. …

The Genetic Diversity And Distribution Of Two Endangered Pit Vipers (Bothriechis Marchi And Cerrophidion Wilsoni) Within Cusuco National Park, Honduras, Debbie Starbuck

School of Biological and Marine Sciences Theses

The current extinction rate is being increasingly recognised as an escalating issue, with observations still indicating that humans are the leading cause of a sixth mass extinction. Cloud forests in particular are home to a variety of threatened species, however, many of these forests are highly fragmented resulting in many species and populations existing in isolation. These forests have become centres of endemism for many species, leading to a high representation within global biodiversity hotspots and “irreplaceable” protected areas. This study primarily investigates the genetic diversity and distribution of two recently re-classified, sympatric pit vipers (Bothriechis marchi and Cerrophidion wilsoni) …

Synergistic Effects Of A Domestic (Thiacloprid Based) Neonicotinoid Pesticide And Nitrogen, Phosphorus And Potassium Fertiliser On Common Earthworms (Lumbricus Terrestris)., Tristan Holmes

School of Biological and Marine Sciences Theses

Neonicotinoids are designed to target insect pests, but their extensive use and long persistence in soils mean that non-target soil organisms such as earthworms are likely to be chronically exposed to them. The common use of neonicotinoids in agricultural systems makes them highly likely to come into contact with other agro-chemicals that may give rise to synergistic effects. Chronic exposure of common earthworm (Lumbricus terrestris) to neonicotinoids in single or combined use with inorganic NPK fertiliser may pose problems that are not accounted for in most biological risk assessments under laboratory conditions. To assess the impacts of such chronic exposure …
