The Agrarian Road To Peace: Henry Morgenthau's Post-War Planning For Germany, Logan W. Ray
The Agrarian Road To Peace: Henry Morgenthau's Post-War Planning For Germany, Logan W. Ray
Armstrong Undergraduate Journal of History
In September 1944, allied leaders Franklin D. Roosevelt and Winston S. Churchill met at Quebec to discuss the post-war planning of Germany. Treasury Secretary Henry Morgenthau accompanied Roosevelt to this conference and put forward his agrarian plan for Germany which would bear his name, the Morgenthau Plan. His plan called for the industrial reorganization of Germany and transition it to a farming community, thus making the country incapable of war. Though his plan was accepted at the Quebec Conference, its fierce opposition from the War Department and its leak to the press pressured Roosevelt to abandon the plan.

Metasoftware: Building Blocks For Legal Technology, Houman Shadab
Articles & Chapters
This Article develops a novel concept in information technology called metasoftware. It then applies the concept of metasoftware to developing legal technology.
Metasoftware enables users to create the software of their choosing and stands in sharp contrast to traditional, functional software that is intended for a particular purpose or a defined range of tasks. Functional software is the default type of software that is currently produced and includes word processing, email, social networking, enterprise resource management, online marketplaces, and video game software. Metasoftware, by contrast, is not functional. Metasoftware presents the user with a blank slate upon which to build …
Synchronizing Copyright And Technology: A New Paradigm For Sync Rights, Michael Goodyear
Synchronizing Copyright And Technology: A New Paradigm For Sync Rights, Michael Goodyear
Articles & Chapters
Embedded in a copyright owner’s musical work or sound recording is the synchronization, or sync right. One of the least discussed aspects of music copyright, considerations about sync have come to the fore as the world has increasingly moved from the real world to the virtual. The COVID-19 pandemic has spurred thousands of activities and events to go online. With many of these involving music, the shift to the virtual world has raised new questions about the extent of sync rights.
Traditionally, sync rights were meant to require licenses for the use of music in timed-relation to a film or …
Genetic Dissection And Improvement Of Fusarium Head Blight Resistance In Durum Wheat, Runhao Wang
Genetic Dissection And Improvement Of Fusarium Head Blight Resistance In Durum Wheat, Runhao Wang
Plant Sciences
Fusarium Head Blight (FHB) is a destructive and complex fungal disease in wheat. Durum wheat, an economically important crop for pasta production, is under the severe impact of FHB. While numerous favorable QTL/genes have been identified in common wheat, there are fewer resistance resources found in durum wheat. An interspecific cross between FHB resistant hard red spring wheat (HRSW) and durum wheat cultivar ‘Riveland’ has been conducted for the introgression of resistance resources to durum wheat. Given the complex quantitative trait of FHB resistance in wheat, a recurrent selection population was constructed by crossing durum wheat cultivars and durum breeding …

The Democratic (Il)Legitimacy Of Assembly-Line Litigation, Jessica Steinberg, Colleen Shanahan, Anna Carpenter, Alyx Mark
The Democratic (Il)Legitimacy Of Assembly-Line Litigation, Jessica Steinberg, Colleen Shanahan, Anna Carpenter, Alyx Mark
Faculty Articles
In response to Daniel Wilf-Townsend’s Assembly-Line Plaintiffs we take a panoramic picture of state civil courts, and debt cases in particular, and name specific features of the courts that must be taken into account in crafting reform prescriptions. In doing so, we question both the democratic legitimacy of debt collection courts and the adequacy of incremental reform that targets the structure of litigation. Part I contributes two critical components to Wilf-Townsend’s rich description of consumer debt cases: pervasive intersectional inequality among pro se defendants and a record of fraud among top filers. We add a sharper focus on the racial, …
In Celebration Of Dissents (And Lengthy Textbooks): How Digital Became Different For The Fourth Amendment And Why It Is Time For A Real Warrant Default, Stephen E. Henderson
In Celebration Of Dissents (And Lengthy Textbooks): How Digital Became Different For The Fourth Amendment And Why It Is Time For A Real Warrant Default, Stephen E. Henderson
Faculty Articles
The last decade has brought tremendous change to the Fourth Amendment, finally resulting in a ‘digital is different’ norm. We stand at an inflection point between a monolithic, analog past and a murky future of yet-unarticulated constitutional digital policing rules. It is a good time, then, to reflect upon how we came to be here and where we ought to go. This Essay first looks back to a monumental, majestic dissent: that of Justice Louis Brandeis in the 1928 decision of Olmstead v. United States. Every American, and especially every law student, ought to know that opinion, and judges …
Beyond The Narrow Harvard Model Of Legal Education: Restoring Legal Education According To The Proposals Of Valentin Tomberg, Brian Mccall
Beyond The Narrow Harvard Model Of Legal Education: Restoring Legal Education According To The Proposals Of Valentin Tomberg, Brian Mccall
Faculty Articles
Professor Mark Jones has argued that legal education needs to be “reliberalized” by returning to a state in which “all law students receive a basic minimum exposure to the general subject areas of legal history, jurisprudence, and comparative law, as well as to the general subject areas of international/trans-national/global legal studies . . . .” Jones’s call to restore the cultural dimensions has recently received an additional source of strength. The recent publication of an English translation of Dr. Valentin Tomberg’s doctoral dissertation for the first time, under the title The Art of the Good: The Regeneration of Fallen Jurisprudence, …
Health Risk Perceptions Regarding Electronic Nicotine Delivery Systems (Ends) Among Individuals With Respiratory Illnes, Sarah Ann Sebban
Health Risk Perceptions Regarding Electronic Nicotine Delivery Systems (Ends) Among Individuals With Respiratory Illnes, Sarah Ann Sebban
Theses and Dissertations
Electronic nicotine delivery systems (ENDS), also known as electronic cigarettes, are portable battery-powered devices used to smoke or “vape” a flavored solution which usually contains nicotine. Many national organizations (CDC, AMA, AAFP, ALA, AHA) have recognized the alarmingly increased rates of ENDS use in the United States, especially among certain populations. Those most likely to engage in ENDS use are youth and young adults, and adults who already smoke combustible cigarettes. Many people perceive ENDS use as a healthier alternative to smoking regular cigarettes and thus, are more willing to initiate ENDS use. However, research has indicated that ENDS use …

The Perspectives Of Augmentative And Alternative Communication Experts On The Clinical Integration Of Non-Invasive Brain-Computer Interfaces, Kevin Pitt, Miechelle L. Mckelvey, Kristy Weissling
Department of Special Education and Communication Disorders: Faculty Publications
As brain-computer interface for augmentative and alternative communication access (BCI-AAC) development continues to consider avenues for translation into the clinical setting, the perspectives of clinician experts in AAC should be considered. Therefore, 11 USA-based speech-language pathologists who are experts in AAC completed a semistructured interview along with Likert scale measures to assess their perspectives on BCI-AAC. The interviews and scales explored the potential impact of BCI-AAC, along with barriers and solutions to BCI-AAC implementation. Speech-language pathologists estimated that 1.5% to 50% of their caseload may benefit from BCI-AAC across various settings. Further, identified barriers and solutions included (a) BCI-AAC implementation …

Dynamic Causal Modeling Of Neural Responses To An Orofacial Pneumotactile Velocity Array, Yingying Wang, Rebecca Custead, Hyuntaek Oh, Steven M. Barlow
Department of Special Education and Communication Disorders: Faculty Publications
The effective connectivity of neuronal networks during orofacial pneumotactile stimulation with different velocities is still unknown. The present study aims to characterize the effectivity connectivity elicited by three different saltatory velocities (5, 25, and 65 cm/s) over the lower face using dynamic causal modeling on functional magnetic resonance imaging data of twenty neurotypical adults. Our results revealed the contralateral SI and SII as the most likely sources of the driving inputs within the sensorimotor network for the pneumotactile stimuli, suggesting parallel processing of the orofacial pneumotactile stimuli. The 25 cm/s pneumotactile stimuli modulated forward interhemispheric connection from the contralateral SII …

The stereocilia rootlet is a key structure in vertebrate hair cells, anchoring stereocilia firmly into the cell’s cuticular plate and protecting them from overstimulation. Using superresolution microscopy, we show that the ankyrin-repeat protein ANKRD24 concentrates at the stereocilia insertion point, forming a ring at the junction between the lower and upper rootlets. Annular ANKRD24 continues into the lower rootlet, where it surrounds and binds TRIOBP-5, which itself bundles rootlet F-actin. TRIOBP-5 is mislocalized in Ankrd24KO/KO hair cells, and ANKRD24 no longer localizes with rootlets in mice lacking TRIOBP-5; exogenous DsRed–TRIOBP-5 restores endogenous ANKRD24 to rootlets in these mice. Ankrd24 …

Atomically flat (111) interfaces between insulating perovskite oxides provide a landscape for new electronic phenomena. For example, the graphene-like coordination between interfacial metallic ion layer pairs can lead to topologically protected states [Xiao et al., Nat. Commun. 2, 596 (2011) and A. Rüegg and G. A. Fiete, Phys. Rev. B 84, 201103 (2011)]. The metallic ion/metal oxide bilayers that comprise the unit cell of the perovskite (111) heterostructures require the interface to be polar, generating an intrinsic polar discontinuity [Chakhalian et al., Nat. Mater. 11, 92 (2012)]. Here, we investigate epitaxial heterostructures of (111)-oriented LaAlO3/SrTiO3 (LAO/STO). We …

Pilot-Scale Spinning And Sucrose-Tetra-Aldehydes-Crosslinking Of Feather-Derived Protein Fibers With Improved Mechanical Properties And Water Resistance, Bingnan Mu, Faqrul Hassan, Qianmei Wu, Yiqi Yang
Department of Textiles, Merchandising and Fashion Design: Faculty Publications
Pliable and water-resistant protein fibers from feathers were developed via continuous one-step spinning and crosslinking using sucrose-tetra-aldehydes. Though flexible protein fibers from feathers were developed, poor wet stability and low tenacity still limit the large and high-end applications of feather-derived fibers. Despite that saccharide aldehydes are considered as an efficient and sustainable crosslinker, substantial concerns such as generation of formaldehyde, high consumption of modifiers, loss of mechanical properties, yellowing, and decline in dyeability of fibers, exist after crosslinking. In this work, we controlled structures of crosslinkers and incorporated disaccharide-tetra-aldehydes into a continuous wet-spinning line. No formaldehyde was generated in the …

We determine the anisotropic dielectric functions of rhombohedral α-Ga2O3 by far-infrared and infrared generalized spectroscopic ellipsometry and derive all transverse optical and longitudinal optical phonon mode frequencies and broadening parameters. We also determine the high-frequency and static dielectric constants. We perform density functional theory computations and determine the phonon dispersion for all branches in the Brillouin zone, and we derive all phonon mode parameters at the Brillouin zone center including Raman-active, infrared-active, and silent modes. Excellent agreement is obtained between our experimental and computation results as well as among all previously reported partial information from experiment …

The quest for realizing and manipulating ever smaller man-made movable structures and dynamical machines has spurred tremendous endeavors, led to important discoveries, and inspired researchers to venture to new grounds. Scientific feats and technological milestones of miniaturization of mechanical structures have been widely accomplished by advances in machining and sculpturing ever shrinking features out of bulk materials such as silicon. With the flourishing multidisciplinary field of low-dimensional nanomaterials, including one-dimensional (1D) nanowires/nanotubes, and two-dimensional (2D) atomic layers such as graphene/phosphorene, growing interests and sustained efforts have been devoted to creating mechanical devices toward the ultimate limit of miniaturization— genuinely down …

Introduction: Minimal change disease (MCD) and membranous nephropathy (MN) are glomerular diseases (glomerulonephritis [GN]) that present with the nephrotic syndrome. Although circulating PLA2R antibodies have been validated as a biomarker for MN, the diagnosis of MCD and PLA2R-negative MN still relies on the results of kidney biopsy or empirical corticosteroids in children. We aimed to identify serum protein biomarker signatures associated with MCD and MN pathogenesis using aptamer-based proteomics.
Methods: Quantitative SOMAscan proteomics was applied to the serum of adult patients with MCD (n = 15) and MN(n = 37) and healthy controls (n = …

Revision Total Hip Femoral Stem Micromotion And Statistical Shape Modeling Of The Knee, William Fugit
Electronic Theses and Dissertations
The first purpose of this thesis was to compare the amount of micromotion seen in the femoral stem in a revision total hip arthroplasty between simple loading conditions and loading conditions derived from activities of daily living, through the use of experimental and computational methods. The amount of micromotion at the bone-implant interface was larger for activities of daily living, with ranges of 200μm more than the largest simple loading conditions. The second purpose of this thesis was to compare measurements of accuracy in a statistical shape model between individual bone and joint-level models, specifically for the knee. Using computational …

Design Of Human Inspired Feet For Mithra, A High-Performance Humanoid Robot, Spencer Lyle Brewster
Electronic Theses and Dissertations
This thesis explores the foot design for the new humanoid robot Mithra, with the goal to improve impact mitigation, natural gait throughout the gait cycle and balance. Using human gait parameters, a stiff aluminum foot was designed to emulate human center of pressure rollover trajectories. In addition, a 2D dynamic Finite Element Analysis (FEA) of the gait cycle was created in Abaqus to rapidly prototype foot designs. Data from the FE model provided impact forces, parameters for distal foot power evaluation and maximum lean angles. From this model a flexible nylon foot was optimized for the given design objectives. The …

An Investigation Into The Plate Fixation For Periprosthetic Femoral Fractures, Xiang Chen
Electronic Theses and Dissertations
Periprosthetic femoral fractures are the third most reason for reoperation after the total hip arthroplasty with an incident rate of approximately 6%. The Vancouver type B periprosthetic femoral fractures account for over 70% of all cases, while the sub-type B1 fracture (when the total hip stem is stable) has remained a clinical challenge due to incidences of severe complications after the standard plate-screw fixation. To seek biomechanically sound fixations for the Vancouver type B1 fracture, this dissertation developed a combined modeling and testing framework to investigate the efficacy of fixation for a Vancouver type B1 fracture using different construct lengths …

Contact Simulation For Evaluating Patient Specific Surgical Guide Stability, Vincent Nierste
Electronic Theses and Dissertations
This study proposes a novel computational method to quantify guide stability for Patient Specific Instrumentation (PSI) guides. A finite element contact model was used to analyze the final position of PSI guides on a femur across a range of loading parameters representing forces applied by a surgeon during operative use. Separate segmentation methods were used for the guide and bone geometry to represent differences between segmentation and actual patient geometry. The region of loading parameters over which the guide exhibited a consistent final position was measured and reported as Guide Stability Score. The model was verified using cadaver specimens for …

Due to the COVID-19 pandemic, many United States brick-and-mortar schools in Spring 2020 rapidly transitioned to emergency remote learning. School leaders grappled with how grades ought to fit within the many unknowns of K-12 remote education. In some cases, schools modified their grading scales to give students greater flexibility to pass courses, and in other situations, schools offered incomplete grades in lieu of failures. During this time, state departments of education (DOEs) provided a variety of guidance documents to their school districts. The purpose of this study was to explore the components of state DOE grading guidance during the Spring …

A shift is needed in information and digital literacy instruction and assessment led by elementary and secondary school librarians with an emphasis on the evaluation of information sources. The need is in response to widespread societal sharing of mis- and disinformation related to political news including the politicizing of scientific understandings of a disease and the ensuing distrust of the messages of public health officials during the COVID-19 global pandemic. In this article, I create an instructional framework for information evaluation that is grounded in data derived from a qualitative content analysis of published research, standards, and theoretical perspectives and …

Every country has to make hard choices about the distribution of entitlements. But employers control the entitlements that individual Americans enjoy to a far greater extent than those in other rich democracies. In this Essay, I argue that, in the absence of the political consensus necessary to deliver state solutions to political questions, employers here are assigned an exaggerated role in employees’ lives. Government incentives for and directives to employers have become a strategy of political deflection. The effect has been to raise the stakes of employment well beyond the scope of those terms and conditions that relate to attracting …

In the last 15 years, crustacean fisheries have experienced billions of dollars in economic losses, primarily due to viral diseases caused by such pathogens as white spot syndrome virus (WSSV) in the Pacific white shrimp Litopenaeus vannamei and Asian tiger shrimp Penaeus monodon. To date, no effective measures are available to prevent or control disease outbreaks in these animals, despite their economic importance. Recently, double-stranded RNA-based vaccines have been shown to provide specific and robust protection against WSSV infection in cultured shrimp. However, the limited stability of double-stranded RNA is the most significant hurdle for the field application of these …

Providing an exact answer to open-ended numeric questions can be a burdensome task for respondents. Researchers often assume that adding an invitation to estimate (e.g., “Your best estimate is fine”) to these questions reduces cognitive burden, and in turn, reduces rates of undesirable response behaviors like item nonresponse, nonsubstantive answers, and answers that must be processed into a final response (e.g., qualified answers like “about 12” and ranges). Yet there is little research investigating this claim. Additionally, explicitly inviting estimation may lead respondents to round their answers, which may affect survey estimates. In this study, we investigate the effect of …
