Correlates Of Early Adversity In Children And Adolescents: Examining The Interrelatedness Of Aggression, Post-Traumatic Stress, And Suicidal Behaviors, Elizabeth Mcrae Jan 2022

Correlates Of Early Adversity In Children And Adolescents: Examining The Interrelatedness Of Aggression, Post-Traumatic Stress, And Suicidal Behaviors, Elizabeth Mcrae

All ETDs from UAB

The negative outcomes associated with adverse childhood experiences, especially child maltreatment ACEs (CM-ACEs), often emerge concomitantly with these experiences and have cascading negative effects across the lifespan. For example, childhood aggression, post-traumatic stress, and suicidal behaviors have all been identified as negative sequelae of CM-ACEs. They have been associated with each other, as well, and share several common underlying mechanisms. Thus, it might be that these outcomes collectively exacerbate the risk of experiencing negative effects of CM-ACEs, yet most existing research has examined these risk factors independently. Moreover, these outcomes often emerge early in development, yet most related research has been …

Willard Hurst's Unpublished Manuscript On Law, Technology, And Regulation, Bj Ard, William J. Novak

Other Publications

It is with a great deal of excitement ( and with thanks to so many contributing colleagues and collaborators over the years ) that we are able to present to the public for the first time a newly published work by one of the great originators of modem legal history and law and society scholarship-James Willard Hurst. Hurst published his last two books, Law and Markets in United States History and Dealing with Statutes, in 1982. And, fittingly, he published his last substantive article--.-a very short comment on "The Use of Case Histories"-in the Wisconsin Law Review in 1992. In …

White Paper: Effective Communication With Deaf, Hard Of Hearing, Blind, And Low Vision Incarcerated People, Tessa Bialek, Margo Schlanger

Other Publications

Tens of thousands of people incarcerated in jails and prisons throughout the United States have one or more communication disabilities, a term that describes persons who are deaf, hard of hearing, blind, low vision, deaf-blind, speech disabled, or otherwise disabled in ways that affect communication. Incarceration is not easy for anyone, but the isolation and inflexibility of incarceration can be especially challenging, dangerous, and further disabling, for persons with disabilities. Correctional entities must confront these challenges; persons with communication disabilities are overrepresented in jails and prisons and the population continues to grow. Federal antidiscrimination law obligates jails and prisons to …

Mich. Ruling Widens Sentencing Protections For Young Adults, Kimberly A. Thomas

Other Publications

On July 28, the Michigan Supreme Court held that the mandatory imposition of a life-without-parole sentence on an 18-year-old violated the state constitution.

This decision expands the protections provided for young defendants by the U.S. Supreme Court in Miller v. Alabama and builds on a nascent trend that provides additional constitutional and statutory protections for young people over 17 years old who are charged with serious offenses.

The Hidden Harms Of Privacy Penalties, Mary D. Fan Jan 2022

The Hidden Harms Of Privacy Penalties, Mary D. Fan

Articles

How to frame privacy penalties to protect our personal information is an important question as demands for legislation and proposals proliferate. The predominant assumption in calls for a comprehensive consumer privacy regime is that regulation and penalties arm the consumer David against Goliath businesses. Missing in the focus on powerful companies is attention to the potential harms of expanding privacy penalties for small-fry individuals and entities, especially from disfavored or marginalized groups. This article is the first to illuminate the regressive risks of privacy penalties, showing how broad privacy penalties can become tools for harassment of small businesses and individuals …

“When You Come Together And Do Everything, It’Ll Be Better For Everybody”: Exploring Gender Relations Among Two Southeastern Native American Tribes, Jenn M. Lilly, Catherine E. Mckinley, Hannah Knipp, Jessica L. Liddell Jan 2022

“When You Come Together And Do Everything, It’Ll Be Better For Everybody”: Exploring Gender Relations Among Two Southeastern Native American Tribes, Jenn M. Lilly, Catherine E. Mckinley, Hannah Knipp, Jessica L. Liddell

Social Service Faculty Publications

Prior to the imposition of patriarchal colonial norms, Native American (NA) gender relations were characterized as complementary and egalitarian; however, little research has explored gender relations within NA communities today. This study used a community-based critical ethnography to explore contemporary NA gender relations with a purposive sample of 208 individuals from the “Coastal Tribe” and 228 participants from the “Inland Tribe.” After participant observation, interviews, and focus groups were conducted, a collaborative approach to reconstructive analysis was used to identify themes in the data. Within these communities, gender relations tended to reflect egalitarian and cooperative but gendered norms, and participants …

‘A Learning Experience’: Disciplinary And Parenting Practices Among Native American Families, Catherine Mckinley, Hannah Knipp, Jenn M. Lilly

Social Service Faculty Publications

Research indicates that effective disciplinary practices, such as offering praise and teaching acceptable versus non-acceptable behaviour, can act as protective factors against the social and behavioural health disparities experienced by Native Americans (NA). The purpose of this critical ethnographic study (n = 436 qualitative elder, adult, youth and professional participants) was to use the Framework of Historical Oppression, Resilience, and Transcendence (FHORT) to qualitatively examine participants' reported experiences of disciplinary practices. Thematic analysis of qualitative results indicated several approaches to disciplining children, which included the following themes: (a) Establishing Structure and Boundaries; (b) Taking Away Privileges and Rewarding Good Behavior; …

“It’S In The Family Circle”: Communication Promoting Indigenous Family Resilience, Catherine E. Mckinley, Jenn M. Lilly Jan 2022

“It’S In The Family Circle”: Communication Promoting Indigenous Family Resilience, Catherine E. Mckinley, Jenn M. Lilly

Social Service Faculty Publications

Objective: We use the Framework of Historical Oppression, Resilience, and Transcendence (FHORT) to investigate the framework’s core concept of family resilience and related protective and promotive factors that contribute to greater resilience, namely communication.

Background: Scant research has examined communication in Indigenous families; yet general research suggests that family communication is a prominent aspect of family resilience.

Methods: In this exploratory sequential mixed-methods study with data from 563 Indigenous participants (n = 436 qualitative and n = 127 quantitative survey), thematic reconstructive analysis was used to qualitatively understand participants’ experiences of family communication and quantitatively examine protective …

‘Marriage Is Going To Fix It’: Indigenous Women’S Experiences With Early Childbearing, Early Marriage And Intimate Partner Violence, Catherine E. Mckinley, Jenn M. Lilly Jan 2022

‘Marriage Is Going To Fix It’: Indigenous Women’S Experiences With Early Childbearing, Early Marriage And Intimate Partner Violence, Catherine E. Mckinley, Jenn M. Lilly

Social Service Faculty Publications

Intimate partner violence (IPV), early childbearing (ECB) and early marriage (EM) are interconnected to the historical oppression of patriarchal colonialism imposed upon Indigenous peoples throughout the world by colonising nations, such as the UK. The artefacts of colonial oppression persist in both colonising nations and those that have been colonised through social norms of patriarchal oppression perpetuated upon women with far-reaching consequences. Indigenous women of the US experience higher rates of IPV, ECB and EM than any other ethnic group—which pose risks to women’s physical, psychological, socioeconomic and educational status. The purpose of this study is to explore Indigenous women’s …

Addressing Human-Centered Artificial Intelligence: Fair Data Generation And Classification And Analyzing Algorithmic Curation In Social Media, Amirarsalan Rajabi Jan 2022

Addressing Human-Centered Artificial Intelligence: Fair Data Generation And Classification And Analyzing Algorithmic Curation In Social Media, Amirarsalan Rajabi

Electronic Theses and Dissertations, 2020-2023

With the growing impact of artificial intelligence, the topic of fairness in AI has received increasing attention. Artificial intelligence is observed to have caused unanticipated negative consequences. In this dissertation, we address two critical aspects regarding human-centered artificial intelligence (HCAI), a new paradigm for developing artificial intelligence that is ethical, fair, and helps to improve the human condition. In the first part of this dissertation, we investigate the effect that AI curation of contents by social media platforms has on an online discussions, by studying a polarized discussion in the Twitter network. We then develop a network communication model that …

A Bonded Case Study Of Missouri Secondary Criminal Justice Program Curricula, James Barnes, James Oren Barnes Jan 2022

A Bonded Case Study Of Missouri Secondary Criminal Justice Program Curricula, James Barnes, James Oren Barnes

Murray State Theses and Dissertations

This exploratory case study measured the Missouri Secondary Criminal Justice Program instructors' perception on the impact of Missouri technical standards, the Industry Recognized Credential/Technical Skills Assessment (IRC/TSA), Career and Technical Student Organizations (CTSOs), individual cumulative career experience, and advisory boards on their curricula. As a local autonomy state, Missouri has no statutorily mandated curricula to guide instructors. Six secondary criminal justice instructors agreed to be interviewed on their perspectives regarding the factors that impact curricula. The research found that instructor experience had the most substantial impact on curricula. The instructors used the technical standards as a scope and sequence for …

In Celebration Of Dissents (And Lengthy Textbooks): How Digital Became Different For The Fourth Amendment And Why It Is Time For A Real Warrant Default, Stephen E. Henderson Jan 2022

In Celebration Of Dissents (And Lengthy Textbooks): How Digital Became Different For The Fourth Amendment And Why It Is Time For A Real Warrant Default, Stephen E. Henderson

Faculty Articles

The last decade has brought tremendous change to the Fourth Amendment, finally resulting in a ‘digital is different’ norm. We stand at an inflection point between a monolithic, analog past and a murky future of yet-unarticulated constitutional digital policing rules. It is a good time, then, to reflect upon how we came to be here and where we ought to go. This Essay first looks back to a monumental, majestic dissent: that of Justice Louis Brandeis in the 1928 decision of Olmstead v. United States. Every American, and especially every law student, ought to know that opinion, and judges …

The Jury Veto, Stephen E. Henderson Jan 2022

The Jury Veto, Stephen E. Henderson

Faculty Articles

While the American civic religion is to be distrustful of government, feelings of discontent regarding our systems of criminal investigation and adjudication feel historic. And while those systems are capable of great carnage en route, the endgame is, ultimately, criminal punishment. Yet before punishment can be imposed, every prosecution—and therefore every defendant—is meant to encounter a potential “circuit breaker”: the jury. I propose that we re-inject this democratic voice into our criminal adjudications, but through an entirely novel structure: the defendant (and perhaps the prosecutor) would have the choice of invoking a jury empowered to ‘veto’ any judicial sentence. By …

The Corruption Of The Pardon Power, Albert Alschuler Jan 2022

The Corruption Of The Pardon Power, Albert Alschuler

Public Law and Legal Theory Working Papers

This Article shows how the pardon power has been corrupted over the past forty years. It begins with a brief history of federal clemency. Throughout this history, presidents gave weight to the views of prosecutors and judges and afforded politicians considerable influence. Nevertheless, until well into the twentieth century, presidents liberally granted clemency to both prisoners and ex-offenders who, after completing their sentences, sought to erase their convictions.

In the early 1930s, as parole became a common means of releasing prisoners, the use of clemency to release prisoners declined. The abolition of parole in the 1980s, however, brought no revival …

Hannibal Lecter And A Friend Walk Into A Bar: The Role Of Psychopathy In Peer Drinking Behaviors, Matthew Kramer Jan 2022

Hannibal Lecter And A Friend Walk Into A Bar: The Role Of Psychopathy In Peer Drinking Behaviors, Matthew Kramer

Electronic Theses and Dissertations, 2020-2023

OVERVIEW: College student drinking remains a concern on campuses, with many interventions for college students not showing the desired effect in lowering alcohol use and problems. Thus, examining possible underlying factors, such as psychopathy, is important. Psychopathy includes elements of callousness, manipulativeness, charm, and impulsivity. Additionally, psychopathy has been associated with increased alcohol use and problems. Despite the overwhelming evidence of psychopathy's role in alcohol pathology writ large, and that psychopathy is considered to include predatory interpersonal skills and antisocial behaviors, there is little research examining the role of psychopathy in peer influence related to alcohol use and protective strategies. …

Homicide Patterns In Urban Places:A Geospatial Analysis Of Homicide In Baltimore, M.D., Kayla Toohy

Electronic Theses and Dissertations, 2020-2023

Extant criminological research examining research questions oriented on understanding the spatial distribution of violent crime instances, such as homicide, have often employed the theoretical foundations of both social disorganization theory and routine activities theory. Though there is much research using these theories independently and in conjunction with one another, few studies have integrated the theories in analyses of homicide at multiple levels of aggregation. The current study is conducted to analyze homicide incidents in Baltimore, Maryland from 2014 through 2018. The analysis conducted considers both social disorganization and routine activities theory variables to test the explanatory power of each theory …

Inclusive Writing, Kairos, And Technical Communication: Defining Our Modern Age., Ramara Reisch

Electronic Theses and Dissertations, 2020-2023

A reoccurring topic in the TPC (technical/ professional communication) field has been the exclusion and marginalization of some audience members, especially those who are African American/ Black, Asian, Hispanic or Latino, LGBTQIA, and those with physical or mental disabilities. Throughout this thesis, I make connections between what has happened in the past and how it has contributed to the kairos of the TPC social justice turn. I explore the term "kairos" which is the timing and space in which something occurs and, depending on someone's delivery, they can create a persuasive and opportunist moment. The subject of including audiences into …
