Women, Peace, And Security: A Human Rights Agenda?, Christine M. Chinkin Jan 2022

Women, Peace, And Security: A Human Rights Agenda?, Christine M. Chinkin

Book Chapters

The Women, Peace and Security (WPS) agenda emanates from the ground-breaking Security Council Resolution 1325 (2000) which centres upon bringing women’s experiences of armed conflict into decision and policymaking in the exercise of the Council’s primary responsibility for the maintenance of international peace and security. The chapter asks whether, despite its location within the Security Council, WPS can be understood as an international human rights agenda as envisaged by women activists who lobbied for the adoption of Resolution 1325. It traces the antecedents of WPS through women’s peace and human rights activism throughout the twentieth century. It examines the texts …

The Developing Global Crisis And Survival Of Human Civilizations, Michael M. Andregg Ph.D. Jan 2022

The Developing Global Crisis And Survival Of Human Civilizations, Michael M. Andregg Ph.D.

Comparative Civilizations Review

For over thirty years, we have used a phrase “the Developing Global Crisis” to identify a cluster of recurring causal factors of chaos that are especially difficult to deal with. These are: population pressure (not simply growth), corruptions of governance (hard to study in democracies much less in police-states), authoritarian political systems, and militant religions. The West has failed to control these recurring causes of chaos, often by imperial patterns of behavior instead of more enlightened governance. Civilizational scholars in Japan might be able to find better solutions to these problems for Asia and the world if they try hard. …

Drug Policy And Our Self-Inflicted Harm, Deborah Ahrens Jan 2022

Drug Policy And Our Self-Inflicted Harm, Deborah Ahrens

Journal of Interdisciplinary Perspectives and Scholarship

The failure of American politics to appropriately address the harms of substance use and substance use disorders reflects “a bitter cost of the white majority’s willingness to accept the suffering of others" (McGhee p. 47) and the ways in which that willingness also harms white people is an additional cost we bear.

Patents On Psychedelics: The Next Legal Battlefront Of Drug Development, Mason Marks, I. Glenn Cohen Jan 2022

Patents On Psychedelics: The Next Legal Battlefront Of Drug Development, Mason Marks, I. Glenn Cohen

Scholarly Publications

In the past two decades, pioneering research has rekindled interest in the therapeutic use of psychedelic substances such as psilocybin, ibogaine, and dimethyltryptamine (DMT). Indigenous communities have used them for centuries, and researchers studied them in the i9gos and '6cs. However, most psychedelics were banned in the '7os, when President Nixon launched the U.S. war on drugs. Fifty years later, rising rates of mental illness, substance use, and suicide are prompting researchers to revisit psychedelics, and some have gained permission to study them in limited quantities. Clinical trials are producing promising results, creating enthusiasm for commercializing and patenting psychedelics. This …

Police Ignorance And (Un)Reasonable Fourth Amendment Exclusion, Nadia Banteka Jan 2022

Police Ignorance And (Un)Reasonable Fourth Amendment Exclusion, Nadia Banteka

Scholarly Publications

The Fourth Amendment exclusion doctrine is as baffling as it is ubiquitous. Although courts rely on it every day to decide Fourth Amendment violations as well as defendants' motions to suppress evidence obtained through these violations, virtually every aspect of the doctrine is a subject of fundamental disagreement and confusion. When defendants file motions to suppress unlawfully obtained evidence, the government often argues that even if a violation of the Fourth Amendment has transpired, the remedy of evidence suppression is barred because the police acted in "good faith," meaning the officer reasonably, albeit mistakenly, believed the search or seizure was …

Indicators Of Deception: Science Or Non-Science, Kristina Vasquez Jan 2022

Indicators Of Deception: Science Or Non-Science, Kristina Vasquez

Undergraduate Honors Theses

Deception detection is used by many law enforcement professionals who work in interviews and interrogations. The ability to detect deception or having knowledge on the signs of deception is very important in not only law enforcement, but in other careers and everyday life. The question remains: is deception detection a science or not a science? There are three areas where someone can learn how to detect deception and those are verbal communication, non-verbal communication, and paralanguage. The use of verbal communication looks at what the person is saying with their words. The use of non-verbal communication looks at what someone …

Expected growth of the job market for cyber security professionals in both the US and the UK remains strong for the foreseeable future. While there are many roles to be found in cyber security, that vary from penetration tester to chief information security officer (CISO). One job of particular interest is security architect. The rise in Zero Trust Architecture (ZTA) implementations, especially in the cloud environment, promises an increase in the demand for these security professionals. A Formative Evaluation Of Washington Prison Animal Programs, Kim Satterfield Jan 2022

A Formative Evaluation Of Washington Prison Animal Programs, Kim Satterfield

Master of Arts in Criminal Justice Theses

With the ever-growing prison population in the United States, it is imperative to continue to examine programs that may foster reductions in recidivism rates. In the minimal observatory studies that have been conducted on animal programs in prison, it has been concluded that these programs have a positive effect on the inmates, prison environment, the animals, and the community. Implementations of these programs are in place nationwide, but thorough research and evaluation of methods and outcomes of these programs remain scarce. The purpose of this thesis is to gather data through interviews about the personal and community impacts of such …

Forecasting The How And Why Of Corporate Crime’S Demise, Miriam H. Baer Jan 2022

Forecasting The How And Why Of Corporate Crime’S Demise, Miriam H. Baer

Faculty Scholarship

The law of corporate criminal liability has long elicited deep criticism from many quarters. Respondeat superior, the judge-created attribution rule that affixes criminal blame to corporations, enables the government to exercise too much power while securing too little accountability. It is hardly surprising, then, that the Journal of Corporation Law has published a symposium volume called, “Imagining a World Without Corporate Criminal Law,” of which this article is part.

My contribution predicts that corporate crime’s demise will arise, not from a direct attack, but rather from a series of indirect punches. Respondeat superior premises the corporation’s liability on that of …

Dmca § 1201: Effective Or Outdated?, Yazzolino, Sydney Jan 2022

Dmca § 1201: Effective Or Outdated?, Yazzolino, Sydney

Santa Clara Law Review

Creators have gone digital and so have copyrights. To combat rampant piracy, creators flock to digital rights management systems (DRM), which control user access to copyrighted material through technology. However, DRM can be bypassed, and file-sharing networks make it easy to distribute and download illegal copies. In response, Congress enacted the Digital Millennium Copyright Act (DMCA), which makes it illegal to circumvent digital rights management technologies. This Note will analyze the effectiveness of the DMCA in the light of DRM technology in 2022. Both copyright holders and users of the copyrighted works have legitimate concerns over how digital copyrights are …

Setting The Stage For Representation: Women Candidates And Moderators' Impact On The Prevalence Of Women's Issues In Presidential Primary Debates, Hannah Groetsch Jan 2022

Setting The Stage For Representation: Women Candidates And Moderators' Impact On The Prevalence Of Women's Issues In Presidential Primary Debates, Hannah Groetsch

Senior Independent Study Theses

This Independent Study explores how women’s increased presence in presidential primary debates impacts the extent to which women’s issues are discussed in the debates. Prior research on political representation and critical mass theory indicates that women politicians can turn their identity as women (descriptive representation) into action that benefits their women constituents (substantive representation) by adding women’s voices and lived experiences into the political conversation. I capitalize on the 2020 election being the first where multiple women presidential candidates ran against each other, allowing me to see whether the increase in the number of women participating in the Democratic primary …

Madison 2.0—Applying The Constitution’S Taxing And Spending Clause To Revitalize American Federalism, Mohamed Akram Faizer

Seattle University Law Review

This article introduces the proposal entitled Madison 2.0 which calls for an enlightened federal government to enact legislation—using its broad ability to tax and spend for the general welfare—to revitalize, as opposed to undermine, American federalism. Part I discusses American Federalism today and the need for an updated approach. Part II explores the government's dysfunctional response to the Covid-19 pandemic. Part III proposes how to revitalize American federalism through the Spending Clause. Part IV discusses how to claw back funds in situations of state recalcitrance and replacing funds with a basic income. Lastly, this article concludes by explaining why the …

Seattle University Law Review

Part I of this report provides the core work of the subcommittee and is intended to function as a stand-alone document, expressed in youth- friendly language, that sets forth: (1) the youth-articulated goals for systemic change to the juvenile legal system; (2) a narrative of how the system currently works and the harms caused; and (3) the change needed to bring about the youth-articulated goals for systemic change. This document is intended to be a youth-centered blueprint for change—a tool for community advocates, a framework for policy makers, and a call-in to the many institutional actors to center the leadership …

Wrongful Imprisonment And Coerced Moral Degradation, G. Alex Sinha, Janani Umamaheswar Jan 2022

Wrongful Imprisonment And Coerced Moral Degradation, G. Alex Sinha, Janani Umamaheswar

Hofstra Law Faculty Scholarship

Despite the ever-growing number of exonerations in the U.S.— and the corresponding surge in scholarly interest in wrongful convictions in recent years—research on the carceral experiences of wrongfully-convicted persons remains strikingly limited. In this essay, we draw on in-depth interviews with 15 exonerated men to explore the moral dimensions of the experience of wrongful imprisonment. We argue that imprisonment entails what we refer to as “coerced moral degradation,” whereby innocent men’s self-preservation efforts in prison require them to feign being—and at times actually become— morally worse people. We argue that these findings speak to the fundamental question of what the …

The Elephant In The Room In Clinical Scholarship: Ethical Guardrails And Case Histories, Theo Liebmann, Stefan H. Krieger Jan 2022

The Elephant In The Room In Clinical Scholarship: Ethical Guardrails And Case Histories, Theo Liebmann, Stefan H. Krieger

Hofstra Law Faculty Scholarship

Lawyers know how to tell a good story and are expected, encouraged, and even ethically required to use that skill on behalf of their clients. More and more, lawyers and legal academics are now using their clients' stories to advance goals that go far beyond achieving a client's objectives: exposing inequities with regard to access to justice; educating the public about the functioning and limitations of the legal system; raising the quality of lawyering; and improving our system of legal education. Unfortunately, the increase in the use of case histories to achieve such laudable goals has not been paired with …
