Justice Delayed: The Complex System Of Delays In Criminal Court, Kat Albrecht, Maria Hawilo, Meredith Martin Rountree, Thomas Geraghty
Justice Delayed: The Complex System Of Delays In Criminal Court, Kat Albrecht, Maria Hawilo, Meredith Martin Rountree, Thomas Geraghty
Loyola University Chicago Law Journal
While federal and state constitutions and statutes guarantee criminal defendants a speedy trial, in practice these rights are exceedingly difficult to enforce. Felony criminal cases can be tied up in court for years. Defendants and victims return to court repeatedly, but progress in resolving their cases is slow.
This Article uses unique data from Cook County, Illinois, to illuminate a complicated and path-dependent system of delay in the Criminal Division of the Circuit Court of Cook County. Our analysis demonstrates that delay is not only pervasive, but also central to how this criminal court system functions.
The Article first reviews …
American Kaleidoscope: An Intersectional Approach To The Cultural Defense, Lillian Mobley
American Kaleidoscope: An Intersectional Approach To The Cultural Defense, Lillian Mobley
Loyola University Chicago Law Journal
The cultural defense is a controversial legal strategy that allows criminal defendants to offer evidence of their native culture to mitigate culpability. While courts usually decline to formally consider these defenses, cultural influences are increasingly present in the courtroom, demanding recognition in the midst of a Eurocentric legal system. The cultural defense can be an important tool for achieving justice in minority and immigrant communities. In practice, however, the defense can slip dangerously off-course, reinforcing white American norms and reductive stereotypes. Ultimately, an “official” defense allowing cultural evidence at trial may cause more harm than good. Instead, this Comment advocates …
Illinois Courts Struggle With Implicit Bias And Justice Stevens’S Legacy: Why Illinois Should Revisit His Dissenting Opinion In Purkett V. Elem, Ted A. Donner
Loyola University Chicago Law Journal
Contemporary racial justice movements and increased interest in implicit bias are shining a spotlight on the role of peremptory challenges in jury selection and how best to combat prejudice in this essential step of the criminal justice system. States such as Arizona and Washington have undertaken reforms designed to shift a dynamic that, under Batson, has prioritized obvious and intentional discrimination and ignored the more subtle but perhaps equally insidious effects of implicit bias. Focusing first on the history of peremptory challenges in Illinois, this article next looks to how the current state of the law can be reconciled with …

Nurturing Cultural Humility And Responsiveness Through Restorative Pedagogy In Graduate Education, Annmary S. Abdou, Kris T. De Pedro, Arantxa De Anda, Ivette Merced, Karen Mao
Education Faculty Articles and Research
In an increasingly diverse world that is characterized by significant social and educational inequities, the development of educators and leaders who embody cultural humility and culturally responsive practices is necessary and transformational. Moving beyond individual and deficit-centered models of student support systems towards ecological and relational paradigms of education are critical to the goals of equity and justice. In order to make progress on these goals, training programs must prioritize and embed the values of cultural humility and culturally responsive practice as foundational constructs for future educators. This multi-authored reflective paper describes the use of Restorative Pedagogy, an approach grounded …

Dna Exonerations And Stakeholder Responses: A Case Of Cognitive Dissonance, Anne Richardson Oakes, Julian Killingley
Dna Exonerations And Stakeholder Responses: A Case Of Cognitive Dissonance, Anne Richardson Oakes, Julian Killingley
Tennessee Law Review
The availability of DNA testing developed in the 1980s transformed the ability of prosecutors to secure convictions while providing Innocence Projects with the tools to overturn them. However, DNA exonerations which establish conclusively that a person convicted of a crime is in fact innocent, can represent a major threat to the value systems and therefore the self-belief of stakeholders who acted in good faith and in the genuine but mistaken belief that the exoneree was guilty. This Article reports on the findings of an investigation into stakeholder responses to DNA exonerations between 1990-1999 when DNA evidence was new and more …
Workplace Harasser Liability: Assailing Moral Hazards And Rehabilitating The Individualist Approach, Ryan H. Nelson
Workplace Harasser Liability: Assailing Moral Hazards And Rehabilitating The Individualist Approach, Ryan H. Nelson
Tennessee Law Review
The focus of recent workplace harassment scholarship has been on irreproachable workplaces. Without detracting from that literature, this Article seeks to rehabilitate the individualist approach as a worthy supplement to institutional liability. It explicates, contextualizes, and outlines solutions to the moral hazards that would shelter workplace harassers from the risks of individual harasser liability if such liability ever comes to pass, thereby reclaiming the deterrent potential of the individualist approach. This Article begins by exploring how, without additional law reform, individual harasser liability would fail to optimally deter workplace harassment in two regards. First, it presents and analyzes original empirical …
Assessing The Relationship Between White Privilege, White Fragility, And Masculine Gender Identity And Stressors In The Workplace, Anna Edelman
Electronic Theses and Dissertations
The current study examined how White privilege information avoidance and White fragility are related to aspects of traditional masculinity. Informed by Critical Race Theory and Critical Whiteness Studies, this study examined the link between traditional masculine norms, masculine gender identity stress, and White privilege reactions. A sample of White, working men were recruited both through snowball sampling and Amazon’s Mechanical Turk. Participants were first assessed on a variety of masculinity variables and then were randomly assigned to view one of two video vignettes. After viewing this video, their affective responses, White privilege information avoidance, and White fragility were assessed through …
Understanding And Supporting Asian American Youth’S Mental Health Within Cultural And Family Contexts, In Young Park
Understanding And Supporting Asian American Youth’S Mental Health Within Cultural And Family Contexts, In Young Park
Electronic Theses and Dissertations
Mental health problems are a major health issue among East Asian American (EAA) youth. Although previous research has explored the risk and protective factors associated with mental health problems of EAA youth, many studies have employed Eurocentric perspectives, thereby excluding their unique cultural backgrounds, beliefs, and values. To better understand mental health needs and support these youth, further research that identifies different factors associated with mental health problems in their cultural context and assesses evidence-supported and culturally responsive interventions is needed.
This three-manuscript dissertation is presented in three papers. The first manuscript presents an integrative conceptual framework that uses two …

Socioeconomic Factors And Mass Shootings, 1982-2016, Taylor Petkovich
Electronic Theses and Dissertations
This paper is an examination and investigation of the relationship between socioeconomic factors and mass shootings. The objective of this paper was to see if economic policy making could be an effective tool for reducing the level of mass gun violence that America has been experiencing. This paper highlights the known relationship between violent crime and economics and tries to bridge that connection to mass shootings specifically through literature review and econometric testing. The ultimate takeaway from this paper’s results and analysis is the need for a universal definition and governing body for data on mass shootings in order to …
Trans And Genderqueer Military Service Member-Veterans: An Acculturation Phenomenology Of Civilian Reintegration, Joseph A. Galluzzo
Trans And Genderqueer Military Service Member-Veterans: An Acculturation Phenomenology Of Civilian Reintegration, Joseph A. Galluzzo
Electronic Theses and Dissertations
As United States military policy continues to evolve and affirm the accession and retention of trans and genderqueer (TGQ) service members, more TGQ people will join and ultimately separate from military service. Reintegration is a term that represents the experience of beginning to separate from the military and transitioning into civilian life, and those who encounter it are referred to as military service member-veterans (MSMVs). Though empirical knowledge of reintegration for MSMVs overall continues to improve, cultural relevance has only recently been considered, and no research has investigated the reintegration experiences of TGQ MSMVs specifically. The primary purpose of this …
The Intersection Of Traumatic Brain Injury And Homelessness, Stephanie A. Chassman
The Intersection Of Traumatic Brain Injury And Homelessness, Stephanie A. Chassman
Electronic Theses and Dissertations
The rates of TBI are significantly higher among individuals experiencing homelessness compared to the general population. Up to half of individuals experiencing homelessness may have a TBI. Accurate prevalence rates of TBI among individuals experiencing homelessness are difficult to obtain due to different methods of sampling participants and differing definitions of TBI; therefore, estimates may be underrepresented. Despite past research that has examined the relationship between TBI and homelessness, there are specific gaps in knowledge such as correlates and risk factors of TBI among individuals experiencing homelessness. This three-manuscript dissertation attempts to address these gaps in knowledge.
The first manuscript …
Restorative Justice & A Dean Of Students: An Auto-Criticism Of The Role Of Care In School Discipline In A Poverty Impacted Public High School, Alicia D. Vasquez
Restorative Justice & A Dean Of Students: An Auto-Criticism Of The Role Of Care In School Discipline In A Poverty Impacted Public High School, Alicia D. Vasquez
Electronic Theses and Dissertations
This qualitative study is an auto-criticism, an approach that allows researchers to study themselves. This emergent methodology is derived from educational criticism and connoisseurship, which fits under the broader category of arts-based research. School discipline is a programmatic component of any secondary school’s educational framework and directly effects student engagement and academic achievement. An analysis of the dean role in relation to school discipline is central to this study. The main research question is what are the lived experiences of a dean who incorporates restorative justice practices in a poverty impacted public high school?

A Study Of The Implementation Process Of Interventions To Address Racial Disproportionalities In Student Discipline, Katie Stennes
All Electronic Theses and Dissertations
Beginning in the fall of 2017, forty-one districts and charter schools entered into three-year legal agreements with the Minnesota Department of Human Rights to reduce the racial disproportionality in their district or school’s exclusionary discipline practices, specifically the overrepresentation of students of color in suspensions and expulsions. This case study examines the experience of one district over the three years of the agreement. Interviews and document analysis from the planning committee reveal a focus on data analysis, Restorative Practices, teacher mindset and practices, and systemic changes. Interviews and focus groups with students and staff who were not on the planning …

Cedaw And Transformative Judicial Obligations: The Vulnerable Migrant Domestic Worker And Root Causes Of Abuse, Cheah W. L.
Cedaw And Transformative Judicial Obligations: The Vulnerable Migrant Domestic Worker And Root Causes Of Abuse, Cheah W. L.
Michigan Journal of International Law
CEDAW’s transformative provisions, which require states to address root causes of injustice and discrimination, can be made more effective not only through legislation and policy, as commonly argued, but through the judiciary. This article highlights the need to develop the content and implementation of transformative judicial obligations under CEDAW through a comparative study of judicial decisions on the abuse of female MDWs in three key MDW destinations that are party to CEDAW—Hong Kong, Singapore, and Malaysia. By engaging with scholarship on CEDAW’s positive obligations, transformative equality, and theories of adjudication, this article argues that criminal law courts should not only …
