Three Common-Sense Measures To Limit The School-To-Prison Pipeline In Maryland, John Marinelli
Three Common-Sense Measures To Limit The School-To-Prison Pipeline In Maryland, John Marinelli
BYU Education & Law Journal
In 2016, a Salisbury, Maryland eighth grader left class without permission and ran through the halls of his middle school. As punishment for his adolescent defiance, the boy was not sent home or suspended but rather pepper-sprayed, handcuffed, and criminally prosecuted.
This episode exhibits the harsh realities of a school-to-prison pipeline that annually funnels thousands of Maryland students into the criminal justice system as a consequence of in-school misbehavior. Criminal interaction of this sort negatively affects children in numerous well-documented, often disastrous ways. To improve these circumstances in Maryland, three contributing factors stand out as ripe for change: the state’s …
Conceptual Complexity And Terrorist Rhetoric: Examining Conceptual Complexity’S Role In Political Violence, Westley S. Hunter
Conceptual Complexity And Terrorist Rhetoric: Examining Conceptual Complexity’S Role In Political Violence, Westley S. Hunter
Honors Undergraduate Theses
It is well-documented that leaders' conceptual complexity can affect their decision-making, but what about its broader effects on political violence? While Hermann & Sakiev (2011) and Conway & Conway (2011) have examined terrorists' conceptual complexity before attacks, this study generates a more extensive analysis by examining weapon types and target types. This research explored the connection between a terrorist leader's level of conceptual complexity and the violent attacks their organizations commit, arguing that complexity lowers before an attack and after the 9/11 terrorist attacks. It employed a content analysis of Osama bin Laden's rhetoric from 1999 to 2003 to discern …

It Is Not By Blood But By Love: Impact Of Mentoring On Black Men Attending A Statewide Public Community College System, Julius W. Edwards
It Is Not By Blood But By Love: Impact Of Mentoring On Black Men Attending A Statewide Public Community College System, Julius W. Edwards
All-Inclusive List of Electronic Theses and Dissertations
This qualitative, narrative multi-case inquiry study aimed to explore how a network of mentors influenced Black men attending Indianas statewide community college system. The study drew 17 participants from 11 of the community colleges 19 campuses interviewed through Zoom during the fall 2021 semester. The literal assumption was that students would benefit from a structured mentoring program. The idea was that community colleges should identify ways to create targeted programs to address Black male students. Through investigation of the research, participants favored informal and formal mentoring networks. The emerging themes were that participants considered community members and campus personnel who …

Facially neutral doctrines create racially disparate outcomes. Increasingly, legal academia and mainstream commentators recognize that this is by design. The rise of this colorblind racism in Supreme Court jurisprudence parallels the rise of the War on Drugs as a political response to the Civil Rights Movement. But, to date, no member of the Supreme Court has acknowledged the reality of this majestic inequality of the law. Instead, the Court itself has been complicit in upholding facially neutral doctrines when confronted with the racial disparities they create. …

Racially Collusive Boycotts: African American Purchasing Power In The Wigs And Hair Extensions Market, Felix B. Chang, Janelle Thompson, Anisha Rakhra
Faculty Articles and Other Publications
This Essay analyzes expressive boycotts in the market for wigs and hair extensions, where consumers are primarily African Americans and producers are almost uniformly Korean Americans. This type of ethnically segmented and misaligned (“ESM”) market raises unique doctrinal and theoretical questions. Under antitrust caselaw, the treatment of a campaign to divert business from Korean American–owned to African American–owned hair stores is uncertain because of the campaign’s mixed social and economic motives. Delving into the theoretical implications of this ESM market can help steer the doctrine appropriately. Along the way, such an exercise illuminates the nuances of racial solidarity and market …

The Inequity Of Third-Party Bail Practices, Judge Patrick Carroll
The Inequity Of Third-Party Bail Practices, Judge Patrick Carroll
Loyola University Chicago Law Journal
For many criminal defendants, a common source of bail funds is their own family or friends. Such individuals typically assist in the expectation that if the defendant complies with court orders and satisfies all court appearances, their money will be returned to them. In revenue-motivated court systems, however, bail funds--even when owned by a third party--are often applied to the defendant's fines and court costs, resulting in the effective forfeiture of the friend or relative's money. This Article reviews the processes of third-party bonds, the risk that a third-party bond will be incorrectly identified as the defendant's asset, and the …

The Relationship Between Methadone Familiarity And Methadone Opinions Among Community Corrections Staff, Luis Israel Culcas
The Relationship Between Methadone Familiarity And Methadone Opinions Among Community Corrections Staff, Luis Israel Culcas
Honors Undergraduate Theses
The United States is in the midst of an opioid crisis. Fortunately, effective treatments for opioid use disorder exist (OUD); however, they are underutilized. Medications for opioid use disorder (MOUDs) decrease death by 50 %. These MOUDs are particularly relevant in the criminal justice population given that this population has a higher OUD disease burden but is less likely than the general population to receive this life-saving treatment. Research has identified negative attitudes toward MOUDs among corrections staff as a barrier to utilizing MOUDs. This thesis examines the relationships between community correction staff familiarity with methadone, one type of MOUD, …
Psychological Reactance And Sensation Seeking As Risk Factors For Perpetration Of Sexual Violence, Elana Gabriel
Psychological Reactance And Sensation Seeking As Risk Factors For Perpetration Of Sexual Violence, Elana Gabriel
Honors Undergraduate Theses
Sexual violence is a major public health issue within the United States, particularly that with perpetrators who are men and victims who are women. Understanding risk factors for sexual violence perpetration is necessary to decrease the overall severity of sexual violence. In past research, psychological reactance has been shown to be associated with sexual violence perpetration, yet there is limited research on this association. Additionally, previous research has found that other traits may enhance the predictive properties of psychological reactance and that sensation seeking can predict sexual violence risk factors and sexual violence perpetration. Yet there is little to no …

Reclaiming Safety: Participatory Research, Community Perspectives, And Possibilities For Transformation, Janet Moore
Faculty Articles and Other Publications
This paper offers the first known interdisciplinary, community-based participatory research study to focus directly on two questions that have drawn increased attention in the wake of global protests over racialized police violence: 1) What is the definition of safety? and 2) How can safety be made equally accessible to all? The study is part of a larger project that was co-designed by community members and academic researchers. The project aimed to strengthen local justice reform efforts by adding new data literacy skills to existing community-organizing capacity among Black residents of the Cincinnati, Ohio metropolitan area. Community-led roundtable discussions offered community …
What Law Schools Must Change To Train Transactional Lawyers, Stephanie Mcmahon
What Law Schools Must Change To Train Transactional Lawyers, Stephanie Mcmahon
Faculty Articles and Other Publications
Not all lawyers litigate, but you would not know that from the first-year curriculum at most law schools. Despite 50% of lawyers working in transactional practices, schools do not incorporate its legal doctrines or skills in the foundational first year. That the Progressives pushed through antitrust laws and the New Dealers founded the modern administrative state reframed how people use the law, particularly in transactional practices, and should be given equal weight as the appellate-based common law in any legal introduction. Nevertheless, the law school model created by Christopher Columbus Langdell in the 1870s remains dominant. As this review of …
