For Whom The Bell Tolls: Bell V. Itawamba Targets Rap Music And Students' Free Speech Rights, Kevin Scot Johns

In the Fifth Circuit Court of Appeals case Bell v. Itawamba, student free speech rights, a vigilantly protected constitutional freedom, came to clash with rap music, an art form viciously misunderstood by much of America. The distaste for rap ultimately won out—the court crafted a new, more restrictive student free speech doctrine to render the rap lyrics in question, which were produced and published off the school’s campus, regulable by the school board. This ruling is legally noteworthy because it dramatically augments school boards’ authority to regulate student expression, even when such expression does not take place at school. …

Epistemic Classism In Elite College Mathematics Education, Silas Olsen

I observed a single introductory calculus class at an elite college, conducted three rounds of interviews throughout the semester with ten students, interviewed the professor, and took limited field notes during class time. In line with Bernstein’s (1964) work on social class and language, I found that there were codes of mathematical language that differed by social class, with more upper-class students fluent in elaborated mathematical code. More working-class students had to learn this language throughout the semester, as they were surprised at how abstract the class was. This thesis argues that patisserie and the French relationship with dessert are a part of national identity. The historical context of patisserie runs parallel to the growth and power of the French colonial empire. Patisserie feels removed from the empire, and yet the two show how gastronomy, luxury, and exploitative power in the form of empire are components of French history and identity. Marx’s theory on commodity fetishism serves as the backbone for this argument. The Galveston-Des Moines Plan for commission government, seen as an important municipal reform during the Progressive Era meant to address corruption and inefficiency in many cities, was pitched by business elites and spread like wildfire in the 1910s. Is there a spatial component to the spread of the adoption of the commission form of government? What are the municipal fiscal outcomes of adoption? The past two decades have witnessed a critical re-analysis of the many African American urban “ghetto revolts” of the 1960s and 1970s. This paper analyzes one of the one hundred fifty-seven violent incidents of the “Long Hot Summer” of 1967, the Buffalo Uprising (June 26 – July 1, 1967). Building from recent research which indicates this incident had deeply political overtones, this work demonstrates the student-driven nature of the five-day rebellion, and the internal collaboration participants engaged in during their violent and non-violent activities. เอกัตศึกษานี้มุ่งศึกษาสภาพบังคับของมาตรา 74 แห่งประมวลกฎหมายอาญา ซึ่งบัญญัติยกเว้นโทษแก่เด็กอายุกว่า 12 ปี แต่ยังไม่เกิน 15 ปี ทั้งที่เด็กในช่วงอายุดังกล่าวพ้นเกณฑ์อายุขั้นต่ำที่จะมีความรับผิดทางอาญาได้แล้ว มาตรการที่ศาลอาจกำหนดใช้กับเด็กในช่วงอายุนี้ได้มีเพียงวิธีการสำหรับเด็กสามประการหลัก ได้แก่ การว่ากล่าวตักเตือน การวางข้อกำหนดให้ระวังมิให้ก่อเหตุร้าย หรือการส่งตัวไปฝึกและอบรม แต่เมื่อพิจารณาการดำเนินกระบวนการยุติธรรมทางอาญาสำหรับเด็กและเยาวชนตามพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว พ.ศ. 2553 แล้ว เด็กที่กระทำความผิดไม่ร้ายแรงและมีลักษณะเหมาะแก่การแก้ไขฟื้นฟูย่อมถูกกลั่นกรองออกไปด้วยมาตรการเบี่ยงเบนคดีทำให้ไม่ต้องถูกพิพากษา คงเหลือเพียงเด็กที่กระทำความผิดร้ายแรงหรือมีลักษณะยากต่อการแก้ไขฟื้นฟูประการอื่นที่จะต้องตกอยู่ภายใต้สภาพบังคับตามมาตรา 74 ซึ่งนำไปสู่ปัญหาสำคัญว่าลำพังการยกเว้นโทษโดยให้ใช้วิธีการสำหรับเด็กไม่น่าจะเพียงพอคุ้มครองป้องกันสังคมได้อีกต่อไป จากการศึกษาแนวคิดทฤษฎีทางวิทยาศาสตร์และจิตวิทยาพัฒนาการ พบว่าเด็กอายุกว่า 12 ปี ซึ่งอยู่ในวัยแรกรุ่นแล้ว อาจกระทำความผิดโดยมีความรู้ผิดชอบไม่แตกต่างจากผู้ใหญ่ได้ มาตรฐานระหว่างประเทศ เช่น อนุสัญญาว่าด้วยสิทธิเด็กและกฎแห่งกรุงปักกิ่ง ก็ยอมรับการลงโทษเด็กในกรณีความผิดร้ายแรงเมื่อความจำเป็นในการปกป้องความสงบปลอดภัยของสังคมมีน้ำหนักมากกว่า นอกจากนี้ กฎหมายต่างประเทศที่ได้ศึกษา ซึ่งประกอบด้วยประเทศแคนาดา ฝรั่งเศส และเวียดนาม ต่างก็นำโทษทางอาญามาใช้กับเด็กที่พ้นเกณฑ์อายุขั้นต่ำที่จะมีความรับผิดทางอาญาทั้งสิ้น ด้วยเหตุนี้ จึงเสนอให้มีการแก้ไขเพิ่มเติมประมวลกฎหมายอาญา มาตรา 74 โดยกำหนดบทยกเว้นให้ศาลอาจใช้ดุลพินิจลงโทษเด็กได้ในกรณีความผิดร้ายแรง กรณีที่มิใช่ความผิดร้ายแรงหรือเด็กยังไม่มีความรู้ผิดชอบมากนักจึงจะนำวิธีการสำหรับเด็กมาใช้บังคับ นอกจากนี้ ผู้เขียนยังได้เสนอแนวทางการปรับปรุงวิธีการสำหรับเด็กให้มีความเข้มงวดมากขึ้นไว้ด้วย

การแสวงหาความช่วยเหลือทางจิตวิทยา หมายถึง พฤติกรรมที่บุคคลมีการแสวงหาความช่วยเหลือจากผู้อื่นโดยผ่านการพูดคุยสื่อสารเพื่อให้ได้รับความช่วยเหลือในลักษณะต่าง ๆ การแสวงหาความช่วยเหลือทางจิตวิทยานี้ได้รับอิทธิพลจากทั้งปัจจัยภายในตนเองเช่นมุมมองและเจตคติที่บุคคลมีต่อการแสวงหาความช่วยเหลือทางจิตวิทยา และปัจจัยภายนอกเช่นมุมมองจากบุคคลใกล้ชิดหรือสังคม อย่างไรก็ตาม ยังมีงานวิจัยไม่มากนักที่ศึกษาถึงความสัมพันธ์ระหว่างตราบาปเกี่ยวกับความเจ็บป่วยทางจิตใจ ความเมตตากรุณาต่อตนเอง และเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยา ผู้วิจัยจึงมีความสนใจที่จะศึกษา ความสัมพันธ์ระหว่างตราบาปเกี่ยวกับความเจ็บป่วยทางจิตใจ ความเมตตากรุณาต่อตนเอง ในการร่วมกันทำนายเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยา ในกลุ่มนิสิตนักศึกษาระดับปริญญาตรี โดยในการศึกษาครั้งนี้ผู้วิจัยทำการเก็บข้อมูลจากนิสิตนักศึกษาระดับปริญญาตรีจำนวน 221 คน มีอายุเฉลี่ย 20.29 ปี (SD = 1.59) ผลการวิจัยพบว่า 1) ตราบาปจากสังคมมีสหสัมพันธ์ทางลบต่อเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยา 2) ตราบาปจากบุคคลใกล้ชิดมีสหสัมพันธ์ทางลบต่อเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยา 3) ตราบาปจากตนเองมีสหสัมพันธ์ทางบวกต่อเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยา 4) ความเมตตากรุณาต่อตนเองมีสหสัมพันธ์ทางบวกต่อเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยา และ 5) ตราบาปจากสังคม ตราบาปจากบุคคลใกล้ชิด ตราบาปจากตนเอง และความเมตตากรุณาต่อตนเอง สามารถร่วมกันทำนายระดับเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยาได้อย่างมีนัยสำคัญทางสถิติที่ adjusted R2 = .449 ผลการวิจัยดังกล่าวสอดคล้องกับสมมติฐานที่ตั้งไว้ องค์ความรู้ที่ได้รับสามารถนำไปประกอบการออกแบบ วางแผนกระบวนการเพื่อส่งเสริมเจตคติต่อการแสวงหาความช่วยเหลือทางจิตวิทยาในกลุ่มนิสิตนักศึกษาต่อไป

งานวิจัยนี้เป็นการศึกษาวิจัยเชิงปริมาณ โดยมีวัตถุประสงค์ของงานวิจัยคือ 1) เพื่อศึกษาความสัมพันธ์ระหว่างความสัมพันธ์ระหว่างผู้นำและสมาชิกต่อความไว้วางใจ 2) เพื่อศึกษาความสัมพันธ์ระหว่างการเล่นพรรคเล่นพวกของหัวหน้างานต่อความไว้วางใจ และ 3) เพื่อศึกษาอิทธิพลกำกับการเล่นพรรคเล่นพวกของหัวหน้างานต่อความสัมพันธ์ระหว่างผู้นำและสมาชิกกับความไว้วางใจ กลุ่มตัวอย่างที่ใช้ในการศึกษาครั้งนี้เป็นพนักงานที่มีหัวหน้างาน ที่มีอายุงานไม่ต่ำกว่า 6 เดือน ปฏิบัติงานกับหัวหน้างานไม่ต่ำกว่า 6 เดือน ซึ่งปฏิบัติงานอยู่ในบริษัทเอกชนในประเทศไทย โดยไม่ได้มีการระบุอุตสาหกรรมที่เฉพาะเจาะจง จำนวนทั้งสิ้น 200 คน โดยสามารถสรุปผลการวิจัย พบว่า การรับรู้การแลกเปลี่ยนความสัมพันธ์ระหว่างผู้นำและสมาชิกมีความสัมพันธ์ทางบวกต่อความไว้วางใจด้านความรู้ความเข้าใจที่ขนาด (β = .57, p < .01) และทางด้านอารมณ์ (β = .76, p < .01) การรับรู้การเล่นพรรคเล่นของหัวหน้างานมีความสัมพันธ์ทางบวกต่อความไว้วางใจด้านความรู้ความเข้าใจที่อิทธิพลขนาดเล็ก (β = .27, p < .01) ในขณะที่การรับรู้การเล่นพรรคเล่นของหัวหน้างานไม่มีความสัมพันธ์ต่อความไว้วางใจด้านอารมณ์ อีกทั้งการรับรู้การเล่นพรรคเล่นพวกของหัวหน้างานไม่ได้เป็นตัวแปรกำกับต่อความสัมพันธ์ระหว่างการแลกเปลี่ยนความสัมพันธ์ระหว่างผู้นำและสมาชิกกับความไว้วางใจด้านความรู้ความเข้าใจและทางด้านอารมณ์ ดังนั้น การแลกเปลี่ยนความสัมพันธ์ระหว่างผู้นำและสมาชิกควรตระหนักในเรื่องของคุณภาพการแลกเปลี่ยนความสัมพันธ์ให้อยู่ในลักษณะของการเปิดกว้าง สนับสนุนให้สมาชิกใช้ประโยชน์จากคุณภาพของการแลกเปลี่ยนอย่างเกิดประโยชน์และนำไปสู่ความไว้วางใจที่มีต่อหัวหน้างาน

The Bronze Drum is a living specimen of Southeast Asian culture and a testimony to the development of Southeast Asian societies for more than 2,000 years. The Bronze Drum has been inherited dynamically hitherto, and the Thai state ceremonies still adopt it. Racism, institutional racism, racial bias, discrimination, and microaggressions have existed in our country since its inception. One way to work to overcome these is by growing allyship and having allies who are willing to speak up and stand beside marginalized groups. This research study addressed what allyship means, the byproducts of racist structures that allies have encountered, ally burnout, and ways to overcome burnout. The purpose of this quantitative study was to examine the influence labor union affiliation has on psychological well-being and depression. Poverty and income-inequality are large challenges within contemporary American society. Labor unions have historically mitigated income-inequality, promoted solidarity, and decent working conditions. There is growing research on their role as a social determinant of health and mental health. As the number of available cybersecurity jobs continues to grow, colleges strive to offer to their cybersecurity students an environment which will make them sufficiently prepared to enter the workforce after graduation. This paper explores the academic and professional needs of STEM-students in various higher education institutions across Virginia and how cybersecurity programs can cater to these needs. It also seeks to propose an evidence-based approach for improving the existing cybersecurity programs so that they can become more inclusive and student-ready. การศึกษาเรื่อง ผู้ก่อการร้ายหญิง : ปัญหาและแนวทางการแก้ไข เป็นการวิจัยเชิงคุณภาพ มีวัตถุประสงค์เพื่อศึกษามูลเหตุ จูงใจ บทบาท และกระบวนการในการที่ผู้หญิงเข้าไปมีส่วนร่วมในการก่อการร้าย ตลอดจนแสวงหาแนวทางในการป้องกันและแก้ไขปัญหา ผลจากการวิจัยพบว่า มูลเหตุจูงใจในการก่อการร้ายของผู้หญิงสามารถแบ่งเป็นสองส่วนหลัก ได้แก่ ส่วนที่เป็นปัจจัยดึงดูด อันเป็นปัจจัยจากฝั่งกลุ่มก่อการร้าย ได้แก่ กระบวนการชักชวนและจัดหาที่มีประสิทธิภาพ ประกอบกับความมีบารมีและความดึงดูดของผู้นำกลุ่มก่อการร้ายและส่วนที่เป็นปัจจัยผลักดัน อันเป็นปัจจัยที่มาจากแรงกระตุ้นของฝั่งผู้หญิงเอง ได้แก่ อารมณ์ส่วนตัว ศาสนา และการเมือง จนนำไปสู่การเข้าสู่กระบวนการโดยสมัครใจเพื่อไปมีส่วนร่วมในการก่อการร้าย โดยในต่างประเทศผู้หญิงมีทั้งบทบาทหลักในการก่อเหตุ และบทบาทสนับสนุน อาทิ การทำหน้าที่เป็นแม่ ภรรยา และจัดหาสมาชิก เป็นต้น ซึ่งมักถูกชักจูงผ่านช่องทางออนไลน์เป็นหลัก ขณะที่บางส่วนที่ไม่สมัครใจก็จะตกเป็นเหยื่อเพื่อแสวงประโยชน์ของกลุ่มก่อการร้าย ในส่วนของประเทศไทยนั้น การก่อการร้ายถูกชี้นำไปในพื้นที่จังหวัดชายแดนภาคใต้ ซึ่งผู้หญิงจะมีบทบาทในการสนับสนุนกลุ่มก่อความไม่สงบ อาทิ การทำหน้าที่ปฐมพยาบาล และการหารายได้ เป็นต้น โดยถูกชักจูงจากคนในครอบครัวและคนใกล้ตัว ประกอบกับการซึมซับข้อมูลและเรื่องเล่าต่าง ๆ ผ่านประสบการณ์จากการอาศัยอยู่ในพื้นที่เป็นเวลานาน และเนื่องจากผู้หญิงเข้าไปมีส่วนร่วมในการก่อการร้ายในบทบาทต่าง ๆ อันเป็นฟันเฟืองหนึ่งที่ขับเคลื่อนให้เกิดการก่อการร้ายในหลายพื้นที่ทั่วโลก ประชาคมระหว่างประเทศรวมทั้งประเทศไทยจึงได้มีการกำหนดนโยบายที่เกี่ยวข้องในการต่อต้านการก่อการร้ายทั้งในภาพรวมและในมิติของผู้หญิงในการก่อการร้ายเป็นการเฉพาะ อย่างไรก็ดี ยังพบว่าหลายประเทศทั่วโลกยังคงเผชิญกับภัยคุกคามจากการก่อการร้ายจวบจนปัจจุบัน เช่นเดียวกับประเทศไทยที่ปัญหาการก่อความไม่สงบในจังหวัดชายแดนภาคใต้ยังคงดำเนินต่อเนื่องเรื่อยมาหลายทศวรรษ ผู้วิจัยจึงได้เสนอแนะให้มีการปรับปรุงนโยบาย การเพิ่มมาตรการป้องกันในระดับปฏิบัติ ตลอดจนการนำทฤษฎีทางอาชญาวิทยาและแนวทางการป้องกันจากต่างประเทศที่ได้ศึกษาไว้ มาเป็นกรอบในการจัดทำแนวทางในการป้องกันและแก้ไขทั้งในระดับนโยบายและระดับปฏิบัติการที่สอดคล้องกับบริบทของไทย

การศึกษาเรื่องนี้มีวัตถุประสงค์เพื่อศึกษากระบวนการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต ศึกษาความสัมพันธ์ของการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต และศึกษาทัศนคติของประชาชนเกี่ยวกับการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต เป็นการวิจัยแบบผสมผสาน (Mixed method) การวิจัยเชิงปริมาณ เครื่องมือที่ใช้ในการวิจัยคือ แบบสอบถาม โดยวิธีการเก็บข้อมูลกับกลุ่มตัวอย่าง จำนวน 400 คน ในจังหวัดเชียงราย เชียงใหม่ กรุงเทพมหานคร สมุทรสาคร ตราด และสุราษฎร์ธานี และการวิจัยเชิงคุณภาพด้วยการวิจัยเชิงเอกสาร 10 ปีย้อนหลัง พ.ศ. 2556 - 2566 และใช้เทคนิคการสัมภาษณ์แบบเจาะลึก ผู้ให้ข้อมูลสำคัญ จำนวน 15 คน ในหน่วยงานที่เกี่ยวข้องกับคาร์บอนเครดิต นักวิชาการและผู้เชี่ยวชาญ องค์กรไม่แสวงหากำไร ผลการศึกษาพบว่า การซื้อขายคาร์บอนเครดิตสามารถบรรเทาปัญหาภาวะโลกร้อน ก่อให้เกิดโครงการเพื่อสิ่งแวดล้อม และนำไปสู่การลงทุนรูปแบบใหม่ที่เป็นมิตรต่อสิ่งแวดล้อม ทั้งนี้การซื้อขายคาร์บอนเครดิตไม่ได้เป็นอาชญากรรมในตัวเอง หากแต่มีการใช้เป็นเครื่องมือกระทำความผิดและนำไปสู่การฟอกเขียว การฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต ประกอบด้วย 6 องค์ประกอบ 1) ผู้กระทำ 2) กิจกรรมการฟอกเขียว 3) ฟอกเขียวด้วยกลไกคาร์บอน 4) เป้าหมาย 5) ผลกระทบ 6) กระทำด้วยเจตนา โดยผู้กระทำการฟอกเขียว ประกอบด้วย 1) บุคคลธรรมดา มีลักษณะอาชญากรคอปกขาว 2) นิติบุคคล มีลักษณะอาชญากรรมที่กระทำโดยบริษัทหรือธุรกิจองค์กร 3) รัฐ ที่เกี่ยวข้องกับอุบัติเหตุจากความประมาทจากการประกาศนโยบายของรัฐ หรือการดำเนินการผิดพลาดที่นำไปสู่การทุจริตคอร์รัปชัน การฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิตสามารถเกิดใน 3 รูปแบบ ได้แก่ การใช้ช่องโหว่ของกระบวนการซื้อขายคาร์บอนเครดิต การพึ่งพาการชดเชยมากเกินไป และการใช้กลไกการทำธุรกรรมของกลไกคาร์บอน ความสัมพันธ์ของการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต จำแนกเป็น 2 ลักษณะคือ การซื้อขายคาร์บอนเครดิตช่วยบรรเทาปัญหาภาวะโลกร้อน และการซื้อขายคาร์บอนเครดิตนำไปสู่ปัญหาสังคม 2 ลักษณะ ได้แก่ เป็นเครื่องมือการฟอกเขียว และ ก่อให้เกิดอาชญากรรมรูปแบบใหม่ในลักษณะห่วงโซ่อาชญากรรม ได้แก่ การฉ้อโกงประชาชน อาชญากรรมสิ่งแวดล้อม อาชญากรรมคอปกขาว อาชญากรรมทางเศรษฐกิจ อาชญากรรมไซเบอร์ การฉ้อโกงภาษี และการฟอกเงิน จากการศึกษาทัศนคติของประชาชนเกี่ยวกับการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิตปรากฎว่า มีความสัมพันธ์กับการบรรเทาปัญหาภาวะโลกร้อน โครงการเพื่อสิ่งแวดล้อม และการลงทุนที่เป็นมิตรต่อสิ่งแวดล้อมในระดับน้อย มีความสัมพันธ์กับไม่ช่วยลดการปล่อยก๊าซเรือนกระจก …

Objective To examine how living arrangement as a social contextual factor can affect Chinese elders’ cognitive function.

Setting and participants Our sample consists of 2486 Chinese elders from two waves (2014 and 2018) of the Chinese Longitudinal Healthy Longevity Survey (CLHLS) that was administered in 22 of China’s 31 provinces using a multi-stage, disproportionate, purposive random sampling method. The CLHLS aims to better understand the determinants of healthy longevity in China and collects extensive data on a large population of fragile elders aged 80–112 in China.

The concept of the “family farm” holds powerful sway within the American narrative, embodying both nostalgia for an imagined past and anxiety for a future perceived to be under threat. Since the founding of the United States, this cultural ideal has been invoked in support of a rosy vision of agrarian democracy while obscuring the ways in which the U.S. Department of Agriculture’s codified definition of “family farm” has unfairly aggregated advantages for the benefit of a particular kind of family (nuclear) and farmer (white, male, straight). The creative writing workshop has been the subject of sustained critique for its tendency to reproduce dominant cultural norms, especially in spaces where admissions to the workshop do not reflect local ethnic and cultural diversity. Homeless encampments constitute one of the most serious right-to-housing issues in Canada today. During the COVID-19 pandemic, the number of shelter spaces decreased, indoor congregate settings became increasingly unsafe, and individuals lost their livelihoods. This has led to a rise in homeless encampments across the country. The lack of comprehensive data on this urgent crisis is distressing. Even so, we know that many individuals had little choice but to turn to living in tents or informal shelters to survive the confluence of historic crises in health, housing, climate change, colonial violence, and unemployment.
