Homography Of Inventorship: Dabus And Valuing Inventors, Jordana Goodman

Faculty Scholarship

On July 28, 2021, the Device for the Autonomous Bootstrapping of Unified Sentience ("DAB US") became the first computer to be recognized as a patent inventor. Due to the advocacy of DAB US's inventor, Dr. Stephen Thaler, the world's definition of "inventor" has finally fractured - dividing patent regimes between recognition of machine inventorship and lack thereof This division has sparked many scholarly conversations about inventorship contribution, but none have discussed the implications of a homographic inventorship.

This Article addresses the implications of international homographic inventorship - where countries have different notions and rules concerning patent inventorship - and the …

Abortion Experts, Aziza Ahmed

Faculty Scholarship

The COVID-19 pandemic, and the overturning of Roe v. Wade,1 has intensified the fight for access to medication abortion. 2 As state governors put emergency orders into place limiting health care provisions to essential services, some also limited access to abortion, designating it a nonessential service. 3 In the face of these challenges, women's health advocates, in keeping with prior advocacy, have called for greater access to medication abortion.4 The increased reliance on telemedicine during the COVID-19 pandemic provides new possibilities for the provision of abortion medication that do not rely on a patient engaging in-person at a …

Spirituality And Community: A Quantitative Analysis On Spirituality As A Pathway To Psychological Sense Of Community Among First Year Minoritized Students, Jason B. Stephens

All-Inclusive List of Electronic Theses and Dissertations

Throughout much of American history, spirituality has played an important role in the lives of students of color. This has led to students of color tending to have higher levels of spiritual identity compared to their White peers. Additionally, we have seen increased access to higher education for previously underrepresented student populations. Researchers demonstrated that students with a strong spiritual identity tend to perform better academically, persist to graduation, have more intentional mentoring, and connect better with peers, all of which are common factors of student success. Yet, students of color continue to lag behind their White peers in these …

Research outputs 2014 to 2021

Australian law schools are becoming increasingly diverse. Yet, there is very little quantitative or qualitative data on diversity in law schools and even less research examining how students’ diverse backgrounds and social identities–including their sexual orientation and gender identity–affect their law student experience. This article begins to fill this gap in the literature by reporting the findings from a study examining the law school experiences of LGBTQI+ students at all law schools within a single Australian state. The study reveals that much of the law school experience is similar for both LGBTQI+ and non-LGBTQI+ students, and that LGBTQI+ law students …

‘Own Your Narrative’: Teenagers As Producers And Consumers Of Porn In Netflix’S Sex Education, Debra Dudek, Giselle Woodley, Lelia Green

Research outputs 2014 to 2021

Netflix’s Sex Education both represents sex education and educates viewers about sex. From the opening scene of the first episode, viewers are positioned to see this series as one that is not afraid to represent explicitly the details of a range of sexual experiences. The series’ frank depiction of sexual relationships between characters, and its exploration of characters’ hopes, fears, and choices regarding ways to express their sexual desire is, arguably, ground-breaking. This paper focuses upon the ways in which the series represents young people as producers and consumers of pornographic/erotic narratives, harnessing the communication options within their social settings …

Research outputs 2014 to 2021

Shift workers employed at a remote mining operation may experience sleep loss, impaired alertness, and consequently negative health and safety outcomes. This study determined the sleep behaviors and prevalence of risk for sleep disorders among shift workers; and quantified alertness for a roster cycle. Sleep duration was significantly less following; night shift by 77 ± 7 min and day shift by 30 ± 7 min. The wake after sleep onset was less by 23 ± 3 min for night shifts and 22 ± 3 min for day shifts (p < 0.05 for all). The prevalence of risk for sleep apnea was 31%, insomnia was 8%, and shiftwork disorder was 44%. Average alertness for all working hours was 75%. Shiftwork in remote mining operations is a significant factor that leads to sleep loss and reduced alertness, which is exacerbated by the high prevalence of risk for sleep disorders.

Schools, Separating Parents And Family Violence: A Case Study Of The Coercion Of Organisational Networks, Sue Saltmarsh, Kay Ayre, Eseta Tualaulelei

Research outputs 2014 to 2021

This paper considers how complex family circumstances such as parental separation, custody disputes and family violence intersect with the organisational cultures and everyday practices of schools. In particular, we are concerned with the ways that coercive control–a strategy used predominantly by men to dominate, control and oppress women in the context of intimate partner relationships–can be deployed to manipulate and coerce the organisational networks of schools into furthering abusive agendas. Informed by cultural theory and research from sociology of education, legal studies, criminology and family violence, we show how what we term the ‘coercion of organisational networks’ (CON) both relies …

Voicing Derbarl Yerrigan As A Feminist Anti-Colonial Methodology, Vanessa Wintoneak, Mindy Blaise

Research outputs 2014 to 2021

The paper voices Derbarl Yerrigan, a significant river in Western Australia, through three imperfect, non-innocent, and necessary river-child stories. These stories highlight the emergence of a feminist anti-colonial methodology that is attentive to settler response-abilities to Derbarl Yerrigan through situated, relational, active, and generative research methods. Voicing Derbarl Yerrigan influences the methodological practices used as part of an ongoing river-child walking inquiry that is concerned with generating climate change pedagogies in response to the global climate crises and calls for new ways of thinking and producing knowledge. In particular, the authors found that voicing as a methodology includes listening and …

How To Phrase Critical Realist Interview Questions In Applied Social Science Research, Andreas Brönnimann

Research outputs 2014 to 2021

The tenets of critical and social realism are well supported in the literature. However, researchers following a realist paradigm have concerns about the lack of methodical guidance for qualitative interviewing, despite their affirmation about the importance of in-depth interviews. A conducted review of empirical realist literature provides evidence of an absence of guidance and commonality regarding interview planning practices. To overcome this absence, this paper composes a guiding framework to assist researchers to phrase more appropriate interview questions in realist research. The steps are founded on critical and social realist concepts while guided by methodological realist principles. Its contribution aims …

Using qualitative methodology, data were collected via course observations (n = 27), informal interviews with tutors (n = 10), and a tutor questionnaire (n = 18). Findings suggest that although tutors’ theoretical interpretations of inclusion were largely consistent …

It Takes A Village: Tribalism As A Premise To Understand Societal Responsibility And Impact Of Mass Violence, Paige D. Schultz Jan 2022

It Takes A Village: Tribalism As A Premise To Understand Societal Responsibility And Impact Of Mass Violence, Paige D. Schultz

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

What is a mass shooter? This is difficult to answer as there is no single definition. The definition of a mass shooter depends on contextual factors including victim count, setting, and motivation (Gramlich, 2019). The Federal Bureau of Investigation (FBI) defines active shooters as “one or more individuals actively engaged in killing or attempting to kill people in a populated area” (Federal Bureau of Investigation, 2021, page 1). While other definitions are used to identify a mass shooter, given the breadth of study in this area by the FBI, this paper will use the FBI definition.

The human papillomavirus (HPV) is responsible for most cervical cancer cases worldwide. This gynecological carcinoma causes many deaths, even though it can be treated by removing malignant tissues at a preliminary stage. In many developing countries, patients do not undertake medical examinations due to the lack of awareness, hospital resources and high testing costs. Hence, it is vital to design a computer aided diagnostic method which can screen cervical cancer patients. In this research, we predict the probability risk of contracting this deadly disease using a custom stacked ensemble machine learning approach. The technique combines the results of several machine …

“Cancel Culture” And Criminal Justice, Steven Arrigg Koh Jan 2022

“Cancel Culture” And Criminal Justice, Steven Arrigg Koh

Faculty Scholarship

This Article explores the relationship between two normative systems in modern society: “cancel culture” and criminal justice. It argues that cancel culture—a ubiquitous phenomenon in contemporary life—may rectify deficiencies of over- and under-enforcement in the U.S. criminal justice system. However, the downsides of cancel culture’s structure—imprecise factfinding, potentially disproportionate sanctions leading to collateral consequences, a “thin” conception of the wrongdoer as beyond rehabilitation, and a broader cultural anxiety that “chills” certain human conduct—reflect problematic U.S. punitive impulses that characterize our era of mass incarceration. This Article thus argues that social media reform proposals obscure a deeper necessity: transcendence of blame …

Investigating Design, Mark Mckenna, Jessica Silbey Jan 2022

Investigating Design, Mark Mckenna, Jessica Silbey

Faculty Scholarship

Design is ascendant. Steve Jobs’s legendary obsession with design was widely regarded as Apple’s comparative advantage, and that lesson has not been lost on its competitors. Design thinking is a growth industry, in business and at universities, and design professionals continue to take on increasingly significant roles within firms. The increasing economic significance of design has been reflected in an explosion of design patent applications and increasing amount of design litigation.

Duty And Diversity, Chris Brummer, Leo E. Strine, Jr. Jan 2022

Duty And Diversity, Chris Brummer, Leo E. Strine, Jr.

Vanderbilt Law Review

In the wake of the brutal deaths of George Floyd and Breonna Taylor, lawmakers and corporate boards from Wall Street to the West Coast have introduced a slew of reforms aimed at increasing Diversity, Equity, and Inclusion (“DEI”) in corporations. Yet the reforms face difficulties ranging from possible constitutional challenges to critical limitations in their scale, scope, and degree of legal obligation and practical effects.

In this Article, we provide an old answer to the new questions facing DEI policy and offer the first close examination of how corporate law duties impel and facilitate corporate attention to diversity. Specifically, we …

Housewives To Heroines: Continuing Education For Women At The University Of Kentucky, 1964-1988, Allison L. Elliott

Theses and Dissertations--Educational Policy Studies and Evaluation

Beginning in the early 1960s, the movement for the continuing education for women (CEW) brought together a seemingly unlikely alliance of American activists, educators, philanthropists, and government agencies. Fueled by philanthropic funds, accelerated by the quest for “womanpower” to bolster national defense, and aligned with regional workforce needs as well as the personal goals of individual women, CEW programs pioneered new models of academic advising and student support that continue to influence higher education practitioners today. By studying the experiences of both administrators and students involved with CEW at the University of Kentucky, this study sheds light on how one …

The Language Of Power: An Investigation Of How The Macropolitics Of Education Policy Affects The Micropolitics Of Schooling English Learners, Catherine E. Vannatter

Theses and Dissertations--Education Sciences

The population of English Learners (ELs) continues to increase across the United States, and these students persistently perform below their native English-speaking peers in measures of academic achievement. Federal government leaders passed the Every Student Succeeds Act (ESSA) in 2015, which modified how state and local educational agencies identify, instruct, assess, and reclassify ELs and revised what funding EL programming could receive. In this multiphase study, I investigated how the macropolitics of federal and state policy became enacted in the micropolitics of a mid-sized school district in Kentucky. Through an initial phase of document review followed by a mixed methods …

Authorship & Agency: Exploring Coaching As A Tool For Student Success, Allison Rebecca Lake Jan 2022

Authorship & Agency: Exploring Coaching As A Tool For Student Success, Allison Rebecca Lake

Theses and Dissertations--Educational Policy Studies and Evaluation

Coaching has emerged as a new, innovative practice within higher education. However, we have only begun to understand the true impact of coaching for college students. Research from individual coaching programs has shown that students who participate in coaching sessions are more likely to be retained, have higher GPAs, and engage in self-regulated learning. However, little research has been done to explore coaching from the student perspective. We do not yet understand how students utilize coaching as a tool to optimize their student experience. The goal of this project was to explore how coaching impacts the student experience and to …
