The Kenai Rule In Four Acts: Bear Baiting, Firearms, And Hunting: Comment & Analysis Of Alaska V. Bernhardt, Jon C. Nachtigal, Mike Stocz
Alaska Law Review
The Kenai Rule, enacted by the U.S. Fish and Wildlife Service in 2016, prohibits (a) the hunting of brown bears with bait in the Kenai National Wildlife Refuge, (b) most hunting in the Skilak Wildlife Recreation Area, and (c) the discharge of firearms along the Kenai and Russian Rivers. The Kenai Rule was challenged by the State of Alaska and Safari Club International in Alaska v. Bernhardt. This Comment provides an overview of the case as it was heard in the District Court of Alaska. This discussion includes arguments and counterarguments surrounding the application of four legislative acts: the …

Delegation At The Founding: A Response To Critics, Julian Davis Mortenson, Nicholas Bagley
Articles
This essay responds to the wide range of commentary on Delegation at the Founding, published previously in the Columbia Law Review. The critics’ arguments deserve thoughtful consideration and a careful response. We’re happy to supply both. As a matter of eighteenth-century legal and political theory, “rulemaking” could not be neatly described as either legislative or executive based on analysis of its scope, subject, or substantive effect. To the contrary: Depending on the relationships you chose to emphasize, a given act could properly be classified as both legislative (from the perspective of the immediate actor) and also executive (from the perspective …
Closing The Door On Permanent Incorrigibility: Juvenile Life Without Parole After Jones V. Mississippi, Juliet Liu
Closing The Door On Permanent Incorrigibility: Juvenile Life Without Parole After Jones V. Mississippi, Juliet Liu
Fordham Law Review
In April 2021, the U.S. Supreme Court decided Jones v. Mississippi, its latest opinion in a line of cases addressing when, if ever, a child should be sentenced to life in prison with no hope of parole or release. Although Jones purported to resolve division among lower courts over the findings that a sentencing court must make about a child defendant’s character and prospects for reform and rehabilitation, the decision will likely lead to further disagreement among courts.
This Note argues that although the Supreme Court’s jurisprudence has protected children from harsh sentences, it has also opened a Pandora’s …
Performance Comparison Of Weak And Strong Learners In Detecting Gps Spoofing Attacks On Unmanned Aerial Vehicles (Uavs), Aydan Gasimova
Performance Comparison Of Weak And Strong Learners In Detecting Gps Spoofing Attacks On Unmanned Aerial Vehicles (Uavs), Aydan Gasimova
Theses and Dissertations
Unmanned Aerial Vehicle systems (UAVs) are widely used in civil and military applications. These systems rely on trustworthy connections with various nodes in their network to conduct their safe operations and return-to-home. These entities consist of other aircrafts, ground control facilities, air traffic control facilities, and satellite navigation systems. Global positioning systems (GPS) play a significant role in UAV's communication with different nodes, navigation, and positioning tasks. However, due to the unencrypted nature of the GPS signals, these vehicles are prone to several cyberattacks, including GPS meaconing, GPS spoofing, and jamming. Therefore, this thesis aims at conducting a detailed comparison …

Development Of An Excel Model To Evaluate The Stability Of Slopes, Bradley Davis
All Graduate Plan B and other Reports, Spring 1920 to Spring 2023
This objective of this study is to determine a method or tool for taking given slope stability parameters and quickly and effectively determining the factor of safety against sliding of fully softened slopes. This study evaluates the effects of soil and geometric parameters of common slopes, and models these properties in a hypothetical model. The methodology is based on a parametric analysis using the Spencer’s Method of Slices limit equilibrium analysis used in the computer program Slide2. A parametric analysis is performed to determine which soil and/or geometric properties have a high influence on slope stability. The parametric analysis is …
Security Analysis And Implementation Of Dnp3 Multilayer Protocol For Secure And Safe Communication In Scada Systems, Isaac Monroy
Security Analysis And Implementation Of Dnp3 Multilayer Protocol For Secure And Safe Communication In Scada Systems, Isaac Monroy
Open Access Theses & Dissertations
When SCADA systems were first introduced into society, a lot of manpower was required for monitoring and controlling devices within critical infrastructures. With the increasing demand for services and growing systems, a need arose to automate the monitoring and controlling tasks. This led to introduction of networks into SCADA systems to enhance monitoring and control capabilities, that can scale with system size and requirements. But this introduction of network layer along with its advantages, also introduced a new threat surface which exposed multiple vulnerabilities within the system that can exploited to launch attacks, that led to the integration of security …
Predictive Utility Of The El Paso Pretrial Risk Assessment Instrument - Revised (Eppra-R), Chelsea Sierra Queen
Predictive Utility Of The El Paso Pretrial Risk Assessment Instrument - Revised (Eppra-R), Chelsea Sierra Queen
Open Access Theses & Dissertations
Pretrial risk assessments are used to divert defendants from pretrial detention by estimating risk of pretrial specific outcomes (i.e., failure to appear, rearrest). Ongoing validation of this tool is recommended to assess accuracy and ensure that there is no bias against specific subgroups (e.g., gender, race/ethnicity, or age) of defendants. The present study evaluates the utility of a locally developed instrument in El Paso County - a predominantly Latinx county. Area Under the Curve (AUC) Receiving Operator Condition (ROC) analyses indicate statistically â??fairâ?? predictive utility for the tool. Binary logistic regression models suggest no evidence of bias. This study will …

Low-Income Housing Tax Credit And The Role Of Public Participation, Juan Antonio Sorto
Low-Income Housing Tax Credit And The Role Of Public Participation, Juan Antonio Sorto
Dissertations (2016-Present)
This dissertation analyzes the role of public participation and the implementation of Low-Income Housing Tax Credit (LIHTC) funded developments in higher socio-economic communities. Using archival research, participant observation, and in-depth interviews, the dissertation examines the placement of North Court Villas, Frisco, Texas and 2640 Fountain View, Houston, Texas. The literature shows that the placement of LIHTC-funded developments continues to be distributed in low-income communities. Housing policies have not been able to resolve these imbalances, which has resulted in multiple court interventions. However, court rulings have not sufficiently addressed the aspects of public participation of these developments. Research shows that these …

Best Practices In Disaster Public Communications: Evacuation Alerting And Social Media, Frannie Edwards, Kaikai Liu, Amanda Lee Hughes, Jerry Zeyo Gao, Dan Goodrich, Alan Barner, Robert Herrera
Mineta Transportation Institute
This research project examines the current state of the practice for disaster public communication, the distrust of government, the training available to public information officers, and the literature available to guide the design of effective public outreach messaging, especially for rapid on-set events. Growing distrust in government had led to lack of public confidence in public agency messaging during emergencies, yet public agency public information officers are using multiple pathways, including both traditional and social media resources, to try to reach impacted communities effectively. The introduction explains the development of wildfire events in the West and their context. A literature …
Simulating Emergency Evacuation Response In An Auditorium Space, Anna Lee
Simulating Emergency Evacuation Response In An Auditorium Space, Anna Lee
Industrial Engineering Undergraduate Honors Theses
The successful execution of emergency evacuations is very important for the protection of the public. Some emergency events, such as fires, can occur with very little warning and turn into a dangerous situation in less than a minute. With high population densities, universities have increased risk involved with evacuations. One specific area that presents high risk is auditorium spaces such as lecture halls with high densities combined with added barriers such as tables and chairs. The ability to assess a building’s emergency preparedness is necessary for keeping the public safe. Simulation is a way to conduct a theoretical event and …

Forks Over Knives: Predictive Inconsistency In Criminal Justice Algorithmic Risk Assessment Tools, Travis Greene, Galit Shmueli, Jan Fell, Ching-Fu Lin, Han-Wei Liu
Research Collection Yong Pung How School Of Law
Big data and algorithmic risk prediction tools promise to improve criminal justice systems by reducing human biases and inconsistencies in decision-making. Yet different, equally justifiable choices when developing, testing and deploying these socio-technical tools can lead to disparate predicted risk scores for the same individual. Synthesising diverse perspectives from machine learning, statistics, sociology, criminology, law, philosophy and economics, we conceptualise this phenomenon as predictive inconsistency. We describe sources of predictive inconsistency at different stages of algorithmic risk assessment tool development and deployment and consider how future technological developments may amplify predictive inconsistency. We argue, however, that in a diverse and …

Limiting Limited Liability: Requiring More Than Mere Subsequence Under Federal Rule Of Evidence 407, Cynara Hermes Mcquillan
Limiting Limited Liability: Requiring More Than Mere Subsequence Under Federal Rule Of Evidence 407, Cynara Hermes Mcquillan
Scholarly Works
Rule 407 of the Federal Rules of Evidence, the “Subsequent Remedial Measures” Rule, is troubling. This exclusionary rule of evidence prohibits using subsequent remedial measures to demonstrate negligence, culpable conduct, or product defect. But, other than in the title of the rule, the phrase “subsequent remedial measures” does not appear anywhere in the rule’s text and the rule itself does not expressly define what measures fall within its purview. This omission creates space for different judicial interpretations of the rule’s language and ultimately disparate judicial outcomes. Although the Federal Rules of Evidence lend themselves to fact-specific inquiries that can lead …

The Unfulfilled Promise Of Environmental Constitutionalism, Amber Polk
The Unfulfilled Promise Of Environmental Constitutionalism, Amber Polk
Articles
The political push for the adoption of state-level "green amendments" in the United States has gained significant traction in just the last couple of years. Green amendments add an environmental right to a state's constitution. Five such amendments were made in the 1970s in Pennsylvania, Montana, Hawaii, Massachusetts, and Illinois. This Article looks in depth at the case law that has developed the contours of these constitutional environmental rights in the wake of the political revival of environmental constitutionalism in the United States. I distill two lessons from this jurisprudence. First, constitutional environmental rights are interpreted by the courts as …

Wait, Is That Legal?: A Defense Of The Rights Of The Mentally Ill In The United States Prison System, Sophie Owen
Wait, Is That Legal?: A Defense Of The Rights Of The Mentally Ill In The United States Prison System, Sophie Owen
Honors Theses
The ever-evolving question of what the legal requirements are regarding providing mental health care in prisons has been debated for decades. This thesis presents a meta-analysis that examines the Eighth Amendment Cruel and Unusual Punishment Clause in regards to the mentally ill in the Criminal Justice System and applies it to present day prison systems in the United States. This research creates a clear picture of the inadequate care that is provided and the systemic issues that allow this level of mistreatment and lack of care to prevail. It examines the requirements for mental health care as set by the …
